WHEREAS, by application dated October 10, 2002, Charles Dolquist (hereinafter "Owner") requested a rezone from Multi - Family Residential (R -3) to Central Business District Support (CBDS) and amendment of the Official Yakima Urban Area Zoning Map, all regarding a parcel located at 820 North 20th Avenue (formerly Yakima County Assessor's Parcel No 181314 -42446 and merged on December 12, 2002, with Parcel No 181314 -42006 to form new Parcel No 181314- 42453) (hereinafter "Subject Property "), and WHEREAS, on December 12, 2002, the Hearing Examiner for the City of Yakima conducted an open - record public hearing regarding the requested rezone and after considering the record issued Hearing Examiner's Recommendation No IUO2 -2 -18, dated December 24, 2002, and WHEREAS, the Hearing Examiner recommended that the Subject Property should be rezoned from Multi- Family Residential (R -3) to Central Business District Support (CBDS) subject to certain conditions, and WHEREAS, at a closed- record public hearing on January 21, 2003, the City Council considered the requested rezone, including the documents and other evidence which comprise the record developed before the Hearing Examiner, the Hearing Examiner's Recommendation, and the statements of interested persons, and WHEREAS, after considering the Hearing Examiner's Recommendation, the contents of the file, and the statements of interested persons, the City Council finds with respect to the requested rezone, and subject to the conditions provided herein, that: a. The requested rezone is consistent with and complies with. • The requirements and considerations set forth in Chapter 15.23 Yakima Municipal Code, • The goals and policies of the Yakima Urban Area Comprehensive Plan, • The intent of the Yakima Urban Area Zoning Ordinance, • Compatibility with neighboring land uses, and • Other applicable land use controls. WHEREAS, it is in the best interests of the City to enact the following to approve the requested rezone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Subject to the specific terms of this ordinance, the Yakima City Council adopts the findings, conclusions and recommendations of the Hearing Examiner's Recommendation No IUO2 -2 -18, dated December 24, 2002, and incorporates that Hearing Examiner's Recommendation by reference as part of this Ordinance. Subject to the specific terms of this ordinance, the conditions stated on page 6 of the Hearing Examiner's Recommendation shall govern the rezone granted by this ordinance. Section 2. Regarding the Subject Property, Yakima County Assessor's Parcel No 181314 - 42453, the legal description of which is. The Subject Property is suitable to be classified Central Business District Support (CBDS), b Circumstances have changed since the existing Multi- Family Residential (R -3) zoning was established which now make the requested rezone appropriate; and c. The requested rezone is consistent with and complies with. • The requirements and considerations set forth in Chapter 15.23 Yakima Municipal Code, • The goals and policies of the Yakima Urban Area Comprehensive Plan, • The intent of the Yakima Urban Area Zoning Ordinance, • Compatibility with neighboring land uses, and • Other applicable land use controls. Section 3 The Official Yakima Urban Area Zoning Map and all other zoning and land use maps shall be amended or modified, subject to conditions stated below, to rezone the Subject Property from Multi- Family Residential (R -3) to Central Business District Support (CBDS) Section 4. The rezone granted by this ordinance is expressly conditioned on the Owner's satisfaction of the following conditions stated on page 6 of the Hearing Examiner's Recommendation. a. An additional five (5) feet of right -of -way along the frontage of 20th Avenue must be deeded by the Owner to the City as part of this rezone. b No provisions of Title 15 YMC or other development regulations are waived as a result of this zoning map amendment. The Owner will be required to obtain all applicable authorizations for subsequent activities on the subject parcel. The Hearing Examiner conducted a site visit on December 11, 2002. An open record hearing was conducted on December 12, 2002. SUMMARY OF RECOMMENDATION The requested change m zoning for the subject properties should be approved, subject to conditions regarding adequacy of the frontage right of way and compliance with all applicable development regulations. From the site visit, a review of the staff report and other exhibits, information received at the hearing, and a review of Urban Area Zoning Ordinance and the Yakima Urban Area Comprehensive Plan as it pertains to the subject application, the Hearing Examiner makes the following FINDINGS 1. Applicant: Charles Dolquist, Yakima Plastics, 2002 Fruitvale Boulevard, Yakima, WA 98902. 2. Application. Zoning map amendment to change the subject property from R -3 to CBDS 3. Location and Parcel Number. The lot is located at 820 North 20 Avenue in Yakima. The new parcel number for the whole property is 181314 -42453 4. Proposed Use: No specific use is being applied for in association with the rezone application. However, the itutial development plan calls for the construction of a 45'x50' metal storage building. 5. Zoning and Land Use: The site is currently zoned R -3, Multi- Family ResidentiaL The site currently is occupied with a duplex and a manufactured home. Notices: Notice for the hearing was provided in accordance with the Urban Area Zonmg Ordinance requirements in the following manner • Application and SEPA notices mailed to adjacent owners November 6, 2002. • Notice posted on property November 18, 2002. • Legal Ad published in the Yakima Herald November 21, 2002. 6. Environmental Review. A Washington State Environmental Policy Act Determination of Nonsigmficance was issued on November 27, 2002. No comments were received and no appeals were filed. 7 Analysis: a. Rezone review criteria. YMC 15.23 030.E provides the following criteria to be considered in making a recommendation on a zoning map amendment, which are respectively analyzed below• • The suitability of the property in question for uses permitted under the proposed zoning; HEARING EXAMINER RECOMMENDATION -2 I III II 11111 11 I 7 Page 58 12 06107/ 8 55R CITY OF YAKIMA - CODES DI dR0 !43 AA YAltiMM rm 111 • The extent to which the proposed amendment is m compliance.with and/or deviates fromthe goals and policies as adopted in the Yakima urban area comprehensive plan and the intent of Title 15 YMC, • The compatibility of the proposed zone change and associated uses with neighboring land uses, • The recommendation from interested agencies and departments, • The adequacy of public facilities, such as roads, sewer, water and other required public services, • The public need for the proposed change; and, • The testimony at the public hearing. b. Suitability of the property for central business district support use. The property is flat and does not present physical 'valuations to use for CBDS purposes. The property is located on North 20 Avenue which is not a major arterial, but the property abuts to property with frontage on Fruitvale Boulevard. Taken together with the adjacent property, the subject property is generally suitable for CBDS uses. c. Compliance with and/or deviation from the YUACP and the intent of zoning ordinance. The 1997 Yakima Urban Area Comprehensive Plan, Future Land Use Map designates this area as being suitable for Arterial Commercial development in this area along Fruitvale Boulevard. In 2002, the applicant requested a change to the future land use map covering the subject property during the annual Comprehensive Plan amendment process from High Density Residential to Arterial Commercial. The Regional Planning Commission, Joint Board, and the Joint City Council and County Commissioner's approved the amendment to Arterial Commercial on August 20, 2002. The implementing ordinance was adopted the following month. The assignment of the subject property to a zoning district that is consistent with the Arterial Commercial future land use designation will support the policy decision rendered by the Joint Board/Council. The rezone would allow expansion of existing businesses on immediatel) adjacent properties, consistent with clustering policy "The purpose of the CBD support district is to accommodate wholesale and retail activities with some high- density residential development. This district is primarily located near the central business district and along the major arterials leading to the central business district." YMC 15 03 030 11 The proposed zoning would serve the purposes for which the district is intended, based on in its proximity to Fruttvale Boulevard and existing commercial establishments. d. Compatibility of associated uses with netghborini land uses. Properties to the north and east are already zoned for CBDS use and present no compatibility issues. The properties to the south and west are residential. There is no evidence that the rezone would unreasonably interfere with the enjoyment of the neighboring residential properties. The character of the neighborhood is already quite diverse, and no adverse comments have been offered by neighbors. e. Adequacy of public facilities and consideration of agency and department recommendations.. This property is currently served by all necessary public utilities. This site fronts on 20 Avenue - -a local access street. In accordance with Title 12 YMC (Development Standards), this street is classified as a local access street, necessitating 50 feet of right of way, 25 feet on each side of centerline. The existing right of way is 20 feet on each side of centerline. The city engineering department therefore recommends that the approval of the rezone be conditioned upon conveyance of an additional 5 feet of right of way from the centerline. £ Public need_ There is not a public need that demands the requested rezone. Nevertheless, the proposed rezone is consistent with the Future Land Use Map amendment approved by the City and County joint legislative bodies. There is a public interest in implementing zoning regulations consistent with comprehensive plans or amendments to plans in accordance with the state Growth Management Act, Chapter 36 70A RCW h. Public comment. No public comment was offered on the rezone application. HEARING EXAMINER RECOMMENDATION - F re 6 :2 8 9 1 9 78 7 1 10 5 5A CITY OF YAKIMA - CODES DI ORD $43 93 Yakima Co, WA From the foregoing findings, the Hearing Examiner makes the following CONCLUSIONS 1 The Hearing Examiner has jurisdiction to conduct an open record hearing on and review the application to change the zoning of the subject property from R -3 to CBDS and to make a recommendation on the proposed rezone to the Yakima City Council. 2. The requirements for public notice of the application and the hearing were satisfied. 3 The subject property is suitable for the uses permitted under the proposed zoning so long as the uses comply with applicable design and development standards set out in the Yakima Municipal Code and other applicable development regulations. 4 The proposed amendment complies on balance with the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan. 5 The proposed amendment is consistent with the amendments to the Future Land Use Map adopted by the Joint Board and Council on August 20, 2002. 6 The proposed amendment complies with the intent of the zonmg ordinance. 7 The proposed amendment does not present any substantial incompatibility with neighboring land uses so long as actual uses comply with the design, development and review requirements in the Yakima Municipal Code, 8 Public facilities are adequate at the site for CBDS uses so long as a an additional width of right of way is deeded to the city to assure North 20 Avenue complies with development standards. 9 The rezone is an appropriate action for mtplementmg comprehensive plan amendments and is therefore in the public interest. This site fronts on 20 Avenue - -a local access street. In accordance with Title 12 YMC (Development Standards), this street is classified as a local access street, necessitating 50 feet of nght of way, 25 feet on each side of centerline. The existing nght of way is 20 feet on each side of centerline. The city engmeenng department therefore recommends that the approval of the rezone be conditioned upon conveyance of an additional 5 feet of nght of way from the centerline. f. Public need. The Chart indicates that the Arterial Commercial designation is compatible with the CBDS zoning district. • Objective G1.1: Encourage the physical development of the Yakima Urban Area in a manner that enhances its image as the cultural and business center. (1997 Plan) • Policy C8.2: Encourage major commercial, industrial, and multi - family developments to locate within city limits. This district is primarily located near the central business district and along the major arterials leading to the central business district. Like the CBD district, a variety of land uses are permitted. However, the intensity of development is intended to be less than in the CBD district. Site Design and Improvement Standards The Yakima Urban Area Zoning Ordinance at Section 15.05.010, establishes basic development requirements as minimum criteria which must be met to assure land use compatibility and promote the public health, safety and general welfare. The following is an overview of the proposal's compliance with the aforementioned development standards: Setbacks - Structure setbacks are required by the UAZO (Table 5 -1). The City's Code Administration Division will review any new structure during plan review which will review the structural setbacks of any new building. Parking: Chapter 15.06 (Table 6 -1) of the Zoning Ordinance sets forth parking requirements for various land uses. The parking requirements for industrial manufactures are one parking space per employee, per shift. Any new expansion will be required to follow the zoning ordinance minimum requirements for the required off - street parking needs of this manufacturing facility. This will be accomplished during building plan review conducted by the City's Code Administration Division. Site - screening: The Yakima Urban Area Zoning Ordinance at 15.07 establishes site screening standards to provide a visual buffer between uses of different intensity, streets and structures, reduce erosion and storm water runoff, protect property values and eliminate potential land use conflicts by mitigating adverse impacts from dust, odor, litter, noise, glare, lights, signs, building or parking areas. After review of Table 7 -1 of the UAZO, it has been determined that site screening standard "C will apply along the south and west property lines. Standard "C" requires a six -foot high, view obscuring fence, made of wood, masonry block or slatted chain link. Public facilities: The site is currently served with public water and sanitary sewer. The extension of sanitary sewer and domestic water mains will not be necessary to serve this site. State Environmental Policy Act A Determination of Nonsignificance (DNS) was issued by the City of Yakima on November 27, 2002. This determination was based on SEPA guidelines (WAC 197 -11 -355). Testimony at the hearing should be considered in determining whether this proposal is compatible with the surrounding land uses. 3. The proposed rezone is consistent with the future land use map designation as Arterial Commercial. 4. All agencies and city departments indicate that public services are available to the site and this rezone would not create any difficulties for infrastructure. 5. All public notice requirements of YMC Chapters 15 and 16 have been completed.
