HomeMy WebLinkAbout2003-072 Michael Taylor Rezone ORDINANCE NO. 2003-72 AN ORDINANCE concerning land use and zoning; rezoning the parcel located at the northwest corner of the intersection of Douglas Drive and North 42nd Avenue from Single- Family Residential (R -1) to Professional Business (B -1), and amending the Official Yakima Urban Area Zoning Map to reflect said rezone. WHEREAS, by application dated July, 2003, Dr Michael Taylor (hereinafter "Owner ") requested a rezone from Smgle- Family Residential (R -1) to Professional Business (B -1) and amendment of the Official Yakima Urban Area Zoning Map, all regarding a parcel located at the northwest corner of the intersection of Douglas Drive and North 42nd Avenue (Yakima County Assessor's Parcel No 181322- 21454) (hereinafter "Subject Property "), and WHEREAS, on September 12, 2003, the Hearing Examiner for the City of Yakima conducted an open- record public hearing regarding the requested rezone and after considering the record and the Hearing Examiner's Recommendation No IUO3 -2 -1, dated September 25, 2003, and WHEREAS, the Hearing Examiner recommended that the Subject Property should be rezoned from Single- Family Residential (R -1) to Professional Business (B- 1) subject to certain conditions, and WHEREAS, at a closed- record public hearmg on November 4, 2003, the City Council considered the requested rezone, including the documents and other evidence which comprise the record developed before the Hearing Examiner, the Hearing Examiner's Recommendation, and the statements of interested persons, and WHEREAS, after considering the Hearing Examiner's Recommendation, the contents of the file, and the statements of interested persons, the City Council finds with respect to the requested rezone, and subject to the conditions provided herein, that: Page 1 a. The requirements for public notice of the rezone application and public hearing were satisfied, and b The Subject Property is suitable to be classified Professional Business (B- 1), c. The requested rezone is consistent with the Future Land Use Map as approved by the City of Yakima on October 22, 2002, and d. The requested rezone is consistent with and complies with the Yakima Urban Area Zoning Ordinance, and e. The requested rezone is consistent with and complies with the requirements and considerations set forth in Chapter 15.23 Yakima Municipal Code, and f The requested rezone is consistent with and complies with the goals and policies of the Yakima Urban Area Comprehensive Plan, and g That the requested rezone does not present any substantial incompatibility with neighboring land uses so long as actual uses comply with the design, development and review requirements in the Yakima Municipal Code, and h. That public facilities are adequate at the site to support the proposed professional business uses of the property, subject to compatibility and environmental impacts analysis of specific proposed uses, and i. That the requested rezone is in the public interest and is an appropriate action for implementing comprehensive plan amendments, subject to conditions. WHEREAS, it is in the best interests of the City to enact the following to approve the requested rezone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1. Subject to the specific terms of this ordinance, the Yakima City Council adopts the findings, conclusions and recommendations of the Hearing Page 2 Examiner's Recommendation No IUO3 -2 -1, dated September 25, 2003, and incorporates the Hearing Examiner's Recommendation by reference as part of this Ordinance Subject to the specific terms of this ordinance, the conditions stated on page 6 of the Hearing Examiner's Recommendation shall govern the rezone granted by this ordinance. Section 2. Regarding the Subject Property, Yakima County Assessor's Parcel No 181322 - 21454, (Lot B of City of Yakima Short Plat No 96 -133), a more complete description of which is attached to this ordinance as Exhibit A, which is incorporated by reference in this ordinance, and subject to conditions stated below, the City Council finds formally that, for the uses described by the Applicant: a. The requirements for public notice of the rezone application and public hearing were satisfied, and b The Subject Property is suitable to be classified Professional Business (B- 1), c. The requested rezone is consistent with the Future Land Use Map as approved by the City of Yakima on October 22, 2002, and d. The requested rezone is consistent with and complies with the Yakima Urban Area Zoning Ordinance, and e The requested rezone is consistent with and complies with the requirements and considerations set forth in Chapter 15.23 Yakima Municipal Code, and f The requested rezone is consistent with and complies with the goals and policies of the Yakima Urban Area Comprehensive Plan, and g. Section 3 The Official Yakima Urban Area Zoning Map and all other zoning and land use maps shall be amended or modified, subject to conditions stated below, to rezone the Subject Property from Single- Family Residential (R -1) to Professional Business (B -1) Section 4 The rezone granted by this ordinance is expressly conditioned on the Owner's satisfaction of the following conditions stated on page 6 of the Hearing Examiner's Recommendation. a. Permits and certificates of zoning review must be obtained from the City of Yakima for all specific projects proposed for the rezoned property, and such projects shall comply with applicable development standards, including requirements for dedication of easements. b Unless otherwise exempted, any specific project proposal for the rezoned property shall be subject to environmental review in accordance with the State Environmental Policy Act. c. For any development on the property, all stormwater shall be retained and managed on site unless the applicant enters an agreement with an authorized stormwater management utility to manage stormwater offsite. d. All project permits required by the Yakima Regional Clean Air Authority shall be obtained. Page 4 Section 5 If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The city planning staff provided a staff report on the application to the Hearing Examiner on September 8, 2003. The staff report recommended approval of the rezone subject to certain conditions. The staff report also addressed proposed development of the subject property and related development conditions, but no application for any class of land use review is contained in the staff report or in the submitted exhibits. An open record hearing was conducted on September 11, 2003 at Yakima City Hall. The Hearing Examiner conducted a site visit on the same day. One written public comment letter was received, which expressed support for the rezone, but requested that the applicant be required to manage his stormwater on site. No members of the public attended the open record hearing. The applicant stated no objections to the staff - recommended conditions at the hearing. SUMMARY OF RECOMMENDATION. The Hearing Examiner recommends approval of this application subject to conditions. From the view of the site, the matters contained in the application, agency comments, and a review of both the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance, the Hearing Examiner makes the following FINDINGS 1. APPLICANT. Michael Taylor 506 N. 40 Ave. Yakima, WA 98908 2. LOCATION. NW corner of the intersection of Douglas Drive & N. 42n Ave. INDEX DOC. HEARING EXAMINER RECOMMENDATION - 1 // # A /1- 3. PARCEL NO. 181322 -21454 4, APPLICATION, Project specific rezone from R-1, Single - Family Residential to B -1, Professional Business. 5, PROPERTY DESCRIPTION. The property is essentially flat and vacant. Access is available from both North 42nd Avenue and Douglas Drive, which intersect at the southwest comer of the property. Short Plat No. 3148216, which created the subject parcel, also shows an access easement that the parcel abuts on its northeast boundary. Utilities are available to the property, but it is not currently served. 6. CURRENT ZONING AND LAND USE. The subject property consists of one parcel, currently zoned R-1, Single - Family Residential. Adjacent properties have the following characteristics: Location Zoning Existing Land Use North R-1 Senior Residential Facility East B -1 Professional Businesses South R-1 Church West R-1 Orchard 7 STATE ENVIRONMENTAL POLICY ACT. On August 13, 2003 the City of Yakima issued a Declaration of Non - significance for environmental checklist #16 -03. The checklist was submitted along with the Rezone Application. The 15 -day appeal period for this DNS ended on August 28, 2003. No appeals were filed. S. PUBLIC NOTICE, Notice for the hearing was provided in accordance with the UAZO requirements in the following manner: Mailing of notice July 18, 2003 Posting of property August 19, 2003 Legal Ad published August 21, 2003 No comments were received during the comment period. 9. ANALYSIS. HEARING EXAMINER RECOMMENDATION - 2 Y J I a. Rezone review criteria. YMC 15.23.030.E provides the following criteria to be considered in making a recommendation on a zoning map amendment, which are respectively analyzed below: (i) The suitability of the property in question for uses permitted under the proposed zoning; (ii) The extent to which the proposed amendments are in compliance with and/or deviate from the goals and policies as adopted in the Yakima urban area comprehensive plan and the intent of the Urban Area Zoning Ordinance; (iii) The compatibility of the proposed zone change and associated uses with neighboring land uses; (iv) The recommendation from interested agencies and departments; (v) The adequacy of public facilities, such as roads, sewer, water and other required public services; (vi) The public need for the proposed change; and (vii) The testimony at the public hearing. b. Suitability of the property for professional office space use. The property presents no physical characteristics that suggest any unsuitability for professional office space development. c. Compliance with the YUACP and UAZO intent. This rezone is in compliance with the Comprehensive Plan's Future Land Use Map because of a Comprehensive Plan amendment changing the designation to Professional Office approved by the City Council on October 6, 2002. This designation fully supports the requested B -1, Professional Business rezone. The Professional Office zone is intended to provide a buffer between more intense uses and residential uses. Given the proximity of other professional office uses, high- density residential use and transitional agricultural use, there is no evidence of inconsistency of the proposed zoning with the intent of the B- 1 use district. See UAZO15.03.030.5. d. Compatibility of uses allowed in the B -1 zone with neighboring land uses. A very limited number of uses allowed in the B -1 zone after Class (1) review would require a Class (3) review in the R-1 zone, and an even lesser number of uses are HEARING EXAMINER RECOMMENDATION - 3 !NM `''` permissible in the B -1 zone but excluded from the R-1 zone. For the most part, allowable uses in the B -1 zone are allowable in the R-1, subject to conditions that assure compatibility. The uses on some of the neighboring R-1 properties (a church and a senior residential facility) are themselves conditional uses in the R-1. There is no evidence of any kind that allowable professional office zone uses would be incompatible with the current agricultural use to the west. At the time a specific project is applied for, the compatibility of the proposed use with neighboring uses will be evaluated. e. Agency recommendations. The applicant has not applied for any land use review other than for the rezone. It appears from Design Review Team comments that team members had before them a specific project proposal. Generally, therefore, agency recommendations are not directed at the rezone per se. Such project - specific recommendations should be addressed in the context of an application for development. f Adequacy of public facilities, such as roads, sewer, water and other required public services. Utilities necessary for uses permitted in the B -1 zone are available to the property. Access is available from Douglas Drive and North 42n Avenue. No evidence has been presented that indicates that local streets will be overwhelmed by traffic associated with B -1 types of development. The development of a specific project will be subject to compliance with infrastructure development standards and substantive environmental protection policies at the time of application. g. The public need for the proposed change. There is not a public need that demands the requested rezone. Nevertheless, the proposed rezone is consistent with the Future Land Use Map amendment. There is a public need to implement zoning regulations consistent with comprehensive plans or amendments to plans in accordance with the state Growth Management Act, Chapter 36.70A RCW. Though a change in circumstances is usually necessary to support a rezone, when the rezone is intended to implement a comprehensive plan provision, it need not be based on changed circumstances. Even so, as the staff report points out: Several land use changes have occurred within this general area since the subject property was zoned [R-1] in 1991. Significant amongst these changes are the development of professional buildings to the east and the assisted living homes built to the North. These l a.N3 )i HEARING EXAMINER RECOMMENDATION - 4 changes support the requested rezone from moderate density residential to professional business development. h. Public Testimony. No public testimony was offered at hearing. This suggests a local acceptance of the appropriateness of the B -1 zoning designation for the subject property. From the foregoing findings, the Hearing Examiner makes the following CONCLUSIONS 1. The Hearing Examiner has jurisdiction to conduct an open record hearing on the application to change the zoning of the property identified in the findings from R-1 to B -1 and to make a recommendation to the City Council accordingly. The Hearing Examiner does not have jurisdiction to develop a record or make a recommendation regarding a proposed development for which no application has been made, such as for the development of a specific land use on the rezoned property as set out in the site plan included in the hearing exhibits. 2. The requirements for public notice of the applications and the hearing were satisfied. 3. The subject property is suitable for uses permitted under the proposed zoning. 4. The proposed amendment is consistent with the amendments to the Future Land Use Map approved by the city on October 22, 2002. 5. The proposed amendment complies with the intent of the zoning ordinance. 6. The proposed amendment does not present any substantial incompatibility with neighboring land uses so long as actual uses comply with the design, development and review requirements in the Yakima Municipal Code. 7. Public facilities are adequate at the site to support the proposed professional business uses of the property, subject to compatibility and environmental impacts analysis of specific proposed uses. The Goals, Objectives and Policies of the 1997 Comprehensive Plan include: Policy C2.2: Office development should be encouraged to locate within city limits. Objective S1: Encourage the location of public and semi -public facilities in appropriate locations throughout the urban area. Objective S2: Require public and semi -public uses to be developed in a manner, which does not detract from surrounding uses. URBAN AREA ZONING ORDINANCE. The zoning ordinance under Table 4 -1 permits professional offices to locate within the B -1 zoning district following Class (1), (2) or (3) review as required in Table 4 -1. REZONE CRITERIA. Public Need /Change in Circumstance Several land use changes have occurred within this general area since the subject property was zoned R -2 in 1991. Significant amongst these changes are the development of professional buildings to the east and the assisted living homes built to the North. These changes support the requested rezone from moderate density residential to professional business development. ZONING ORDINANCE DEVELOPMENT STANDARDS. The zoning ordinance sets forth specific standards for lot size, maximum lot coverage, minimum building setbacks, parking, building height, sight screening, etc. This proposal meets all applicable zoning ordinance standards for development. Parking. The proposed new buildings are 6,300 and 13,860 square feet for a total of 20,160 square feet. Because the proposed development will be divided into smaller offices which could potentially house various uses the multiuse parking designation under Table 6 -1 has been used to calculate the parking standard. The parking standard for multiuse developments is one space for every 300 square feet of gross floor area. Based upon this standard the total number of parking spaces required is 67 and the applicant has provided a total of 94 parking spaces. Site screening. Based upon existing land uses site screening is not required along the north, south and east property lines. However, on the west boundary farming operations (orchards) are a permitted Class (1) use within the SR, Suburban Residential district — the lowest intensity use district in which farming is a Class (1) use — and site screening standard "A," 3 Michael Taylor Vacant land at the corner of DOC. This is partially because there is a perceived need for a future access road coming south from Englewood Avenue and connecting with N 42 Avenue. Preserving the possibility of an interconnecting north/south roadway outweighs a dubious need for a landscape strip between an existing orchard and this development. Consequently, staff recommends against the requirement for site screening. Setbacks. All proposed building setbacks comply with zoning ordinance standards. Signs. No signs are indicated on the site plan. Future signage will be in compliance with the requirements of Tables 8 -1, 8 -2 and 8 -3 of the UAZO. Lot coverage. The site plan indicates lot coverage at 76% and 80% is permitted in the B - zoning district. DEVELOPMENT SERVICES TEAM (DST) REVIEW. The DST meeting for this proposal was held on July 30, 2003 at which time the following comments were submitted. 1. City Engineer A thirty -foot access easement is required to be created along the west property line running the length of the subject lot. This access easement shall be improved to City street standards and connect to 42n Avenue as a private drive. Curb, gutter, sidewalk and a commercial driveway approach apron are to be installed on the east side of the proposed private drive. All the above improvements are to cease at the northern edge of the commercial driveway approach located along the west property line, indicated on the applicant's site plan. There does exist sanitary sewer available to serve this site. Each structure must be served be a separate side sewer from a public main. There will be associated connection fees due at the time of sewer connection. Building Codes 1. Access to a public hydrant is critical in this development. Regarding the proposed development of two medical buildings and approximately 93 parking spaces, I would recommend a street connection of North 42 Street and either Englewood Ave. or Douglas Drive. This would provide emergency vehicles an alternate access to the parking lot and office buildings. Yakima Regional Clean Air Authority ( YRCAA) 1. The proponent shall file with, and gain approval from YRCAA, a site dust control plan to address site preparation, construction and landscaping phases. The Proponent is also encouraged to file a Construction Dust Control Plan for projects now and in the future. No other comments were received TRAFFIC CONCURRENCY. The Traffic Concurrency review for this project was completed on August 4, 2003. Based upon the information provided by the applicants this development will not adversely impact the arterial streets, reserve capacity exists and this development did not diminish the Level of Service for any arterial street below an acceptable level. STATE ENVIRONMENTAL POLICY ACT. On August 13, 2003 the City of Yakima issued a Declaration of Non - significance for environmental checklist #16 -03. The 20 -day comment period, which preceded the issuance of this DNS, ended August 7, 2003 with one comments received. The 15 -day appeal period for this DNS ended on August 28, 2003. The Department of Ecology had the following comment: "If this property has ever been in agricultural use, there is a possibility the soil contains residual concentrations of pesticides. Ecology recommends that the soils be sampled and analyzed for led and arsenic and for organochlorine pesticides." The above comments were forwarded to the applicant to inform them of the possibility of contamination. After consultation with the Department of Ecology it was determined paving, building and landscaping will "cap the property" and are considered to be an acceptable means of mitigating soil contamination. PUBLIC NOTICE. This rezone is in compliance with the Comprehensive Plan's Future Land Use Map because of an approved Comprehensive Plan amendment changing the designation to Professional Office. This designation gives full support to the requested B -1, Professional Business rezone. Also all required infrastructure necessary to support this requested development is, or soon will be, available. And finally there have been numerous significant changes within this general area that trend towards Professional Business development. CONCLUSIONS. 1. The hearing examiner has jurisdiction to issue a recommendation on this application to the City Council. 2. This rezone is compatible with the future land use map 111 -3 and land use compatibility Figure 111 -3 of the Comprehensive Plan. 3. The proposed use does not conflict with the goals and objectives of The Yakima Urban Area Comprehensive Plan. 4. During project review it has been determined that this request is in compliance with YMC 16.06.020(B) for making a Determination of Consistency as follows: a. The density of the development is not a factor with this application. b. Professional offices are a Class (1) permitted use in the B -1 zoning district. c. Adequate public facilities are available to serve this site. d. The proposal is consistent with development standards of the zoning ordinance. 5. Public Notice for this hearing was provided in accordance with zoning ordinance requirements. 6. SEPA review resulted in the issuance of a DNS on August 13, 2003. The appeal period for this determination ended, August 28, 2003. 7. I recommend that this drive be improved as a private driveway There is existing sanitary sewer available to serve this proposal. Each structure must be served by a separate side sewer from a public main. There will be associated connection fees due at the time of sewer connection. There are existing water mains looped through this site with fire hydrants. The property is vacant with no development except services that come the border of the property and it is currently a piece of vacant land providing no useful purpose. I have owned the property ten years and during this time have not had a single person express any interest in utilizing the property for high or low- density housing. A few years ago, a serious inquiry was made by a Portland, Oregon company specializing in Alzheimer units. That development never took place. The rest of the Fieldstone property, which was purchased by me ten years ago, has been usefully developed with good results. Alterra Assisted Living Facility occupies Lot A, which is nearly 2.5 acres. REMAX realty is currently operating at the corner of 40` and Englewood in the original Plath home. A one -acre parcel was sold to Family Medicine where several doctors provide healthcare services to Westside Yakima residents. In the two buildings, which we constructed on 40th, there are currently three doctors, a lawyer, an optical shop and a hair salon successfully operating and serving patients and clients. There is also a medically related business operated by Providence Hospital in the small building on Englewood and there are several allergy doctors operating Northwest Allergy in that small building on 40 All in all it is a very positive location for professional services, patients and clients. Our parking continues to he adequate through the years and I believe our safety record has been excellent. With the development of most of the approximate 27 acres northeast of Fieldstone by James L. Smith and Myron Abrams there are also in that area many attractive buildings with various kinds of professional services including even a fast food restaurant. As those lots have finally filled up I am lead to believe that there might be some interest in DOC. INDEX # r_ ( I t this 2.1 -acre parcel, which is Lot B because of the decreasing amount of property available on the Westside. There has been created at the corner of 40` and Englewood an island of commercial and professional services that has reduced the need for the 60 or .more thousands of people living west of 40 to travel all the way to the center of Yakima to obtain services. This has been good for us that work here but we also think that it has been good for the people who live on the Westside of Yakima and with continued annexation that the city is active in the area of services on the Westside seem important. While I have no specific proposals or offers from any purchasers, I believe that the land use reclassification from RI to BJ is needed for me to have any chance to see this property utilized in a positive or successful way. The public needs served would be that the vacant property might be developed and therefore placed on the tax rolls providing an additional location for s,ervices to people living on the Westside of Yakima and would generate jobs primarily,in the service sector. I believe that if the property is rezoned that I would have a chance of selling four one half acre parcels for development. I have been contacted this past year by an accountant, who wanted a one half acre parcel but my property was not zoned properly in his mind and was also not subdivided suitable for development. I have continued to feel that more medical services might be well located on this site since medical, professional services don't really require a lot of traffic visibility like that which retail establishments seem to desire. The planning which was done a number of years ago with regards to Fieldstone included a safety .lane driveway running north and south on the west border of the Fieldstone property so that fire, police and other vehicles could travel between Englewood and Richey Road and so that depending on how Lot B is developed it might also serve as an access driveway for employees, who would arrive at work through that access driveway on the west border of the property.
