AN ORDINANCE relating to Park Rules and Regulations, adding the Gateway Sports
Complex at the Kiwanis Park as a location where liquor may be
served pursuant to a valid permit and amending Section 13.16.070
of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 13.16.070 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"13.16.070 Intoxicating liquor regulated.
No intoxicating liquor of any kind or nature shall be possessed,
consumed or brought within the limits of any city park, city playground,
or any property owned, operated and /or managed by the Yakima
Greenway Foundation and its successors and assigns within the
boundaries of the city of Yakima, except for intoxicating liquor served
pursuant to a valid permit issued by the Washington State Liquor Control
Board at Sarg Hubbard Park, Sherman Park, the Gateway Sports Complex
at Kiwanis Park, and /or the Harman Center at Gailleon Park."
Section 2. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter
PASSED BY THE CITY COUNCIL, signed and approved this 17th day of
August, 2004.

ITEM TITLE: Consideration of an Ordinance amending the Yakima Municipal Code
(YMC) with revised Park Rules and Regulations regulating the limited
use of alcohol dunng pubhc rental activities at Kiwams Park.

SUMMARY EXPLANATION
Staff respectfully submits for Council consideration an ordinance amending
Section 13 16 070 of the Yakima Municipal Code (YMC) to update Park Rules and
Regulations to include Kiwanis Park.
This amendment pertains to the limited use of alcohol during public rental activities
pursuant to a valid permit issued by the Washington State Liquor Control Board and is
basically a housekeeping measure to include Kiwanis Park. This rule currently apphes to
public rental activities at Sarg Hubbard Park, Sherman Park, and the Harman Center at
Gailleon Park.

STAFF RECOMMENDATION Staff respectfully requests the City Council to pass the
ordinance amending the Yakima Municipal Code (YMC) with revised Rules and Regulations
relating to City Parks to include Kiwanis Park involving the limited use of alcohol dunng
pubhc rental activities as regulated by a permit issued by the Washington State Liquor
Control Board.
BOARD /COMMISSION RECOMMENDATION The Parks and Recreation Commission has
reviewed these changes and recommends that the City Council pass the ordinance amending
the Yakima Municipal Code (YMC) updating park rules and regulations to include Kiwanis
Park involving the limited use of alcohol during public rental activities as regulated by a
permit issued by the Washington State Liquor Control Board.
