AN ORDINANCE relating to public safety and morals, allowing animal control officers a
limited commission to enforce animal control crimes, and adding new
section 6.20.200 to Chapter 6.20 of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1. Section 6.20.200 is herby enacted as a new section to Chapter 6.20 of the City
of Yakima Municipal Code to read as follows:
"6.20.200 Enforcement—animal control officers.
1 Law enforcement agencies and animal control officers may enforce
the provisions of chapters 618, 6.20 and 6.22.
2. Animal control officers enforcing this chapter shall comply with the
same constitutional and statutory restrictions concerning the execution of police
powers imposed on law enforcement officers who enforce other criminal laws of the
state of Washington.
3 Upon receiving a limited commission from the Chief of Police,
animal control officers have the following enforcement powers when enforcing
chapters 618, 6.20 and 6.22.
(a) The power to issue citations based on probable cause to offenders for
misdemeanor and gross misdemeanor violations of chapters 6.18, 6.20 and 6.22,
(b) The power to prepare affidavits in support of search warrants and to
execute search warrants when accompanied by law enforcement officers to
investigate criminal violations of chapters 6.18, 6.20 and/or 6.22, and to seize
evidence of those violations.
4. Upon request of an animal control officer who has probable cause to
believe that a person has violated provisions of 6.20 120, a law enforcement agency
officer may arrest the alleged offender "
Section 2. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter

The above - mentioned individual is granted a limited commission to enforce all Animal
Control Ordinances of the City of Yakima, including those ordinances relating to animal
cruelty, control, nuisances, and licensing. Said limited commission is at the pleasure of
the City and may be revoked at any time by the Chief of Police, City Manager, or their
designee

Animal Control and the Pit -Bull Ordinances of the Yakima Municipal
Code Chapters 6.18, 6.20 and 6.22 and Removing Office Support for
Animal ontrol from Yakima Municipal Code Chapter 1.18 015

SUMMARY EXPLANATION:
This action would amend the present Animal Control and Pit -Bull regulations found in the
Yakima Municipal Code (YMC) Chapters 6.20, and 618 respectively In addition, YMC
Chapter 6.22 for Animal License would be modified and updated. The Public Hearing will
provide an opportunity for testimony to be given by the public to the City Council regarding
the proposed changes.
In addition, there was a need to rectify the `MC 1 18.015 and remove requiring the City
Clerk to provide office support for animal control.
1) At the May 4, 2004 meeting, the Public Safety Committee City Council members
unanimously supported and recommended changes to the full City Council.
The major changes included:
• Removal of the age requirement to determine when a pit: bull is a pit
• Notification to Pit -Bull dog owners changed from 30 -days to 48 -hours
• Redemption of dogs and impound fee changes
• Clarification of the animal cruelty section
• Modification to the Civil infraction penalties section-
• Updating the dog license fees
• New section for animal control officers to issue citations •
