HomeMy WebLinkAbout2004-035 Local Improvement District No. 1056 (sewer LID) ORDINANCE NO 2004- 35 AN ORDINANCE providing for the improvement of certain property by constructing an 8 -inch public sewer system, establishing Local Improvement District No 1056, providing for the method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA. Section 2. The nature and territorial extent of said proposed improvements is as follows ROUTE OF 8 -INCH LINE Beginning at existing sewer line located on Mead Avenue, thence south on South 7 Avenue to King Street, from Mead Avenue south on 8 Avenue to Spokane street and from Mead Avenue south on 9 Avenue to Spokane Street a total of 83 parcels, consisting of approximately 3910 lineal feet of 8 -inch sewer line and appurtenances Section 3 There is hereby created a Local Improvement District, to be called "Local Improvement District No 1056 ", which said district shall include all of the above described property Section 4 The assessments shall be made according to special benefits derived from the improvements without regard to the zone and termini method. Section 5 All costs and expenses in connection with the construction of said improvements, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefore as provided by law and as above described. Section 6. The work necessary to be done in connection with the making of said improvements shall be done by contract upon competitive bids according to specifications and plans as prepared by the Engineering Division of the Department of Community and Economic Development of the City of Yakima, and the City shall have the power to reject any and all bids. Section 7 There is herby created a special fund, to be known as "Local Improvement Fund, District No. 1056 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. Section 8. Bonds shall be issued in payment of the costs and expense of said improvements, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, which assessments, with interest, shall be payable annually under the mode of payment "payment by bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima, provided, this improvement may be financed by the issuance of notes, under the authority of RCW Chapter 39.50 and Section 8.12.100 of the City of Yakima Municipal Code. The term and interest rate of bonds and special assessments contemplated by this section shall conform to provisions, terms and conditions to be specified by a subsequent ordinance of the City of Yakima. It is the intent of the City to reimburse a portion of the costs of these improvements with the proceeds of bonds (Reimbursement Bonds) to be issued by the City The interest on these bonds is excludable from gross income under Section 103 of the Internal Revenue Code of 1986, as amended. The maximum principal amount of Reimbursement Bonds expected to be issued is $405,276 46 This declaration of official intention is made pursuant to Section 1 103 -18 of the Income Tax Regulations promulgated by the U S Department of Treasury Section 9 The actual assessments levied for this improvement may vary from the assessment estimates so long as they do not exceed a figure equal to the increased true fair value the improvement adds to the property Section 10. This ordinance is one relating to local improvements or assessments therefore, and shall become effective immediately upon its passage, approval and publication as provided by law and by the City Charter PASSED BY THE CITY COUNCIL, signed and asproved this 1st day of June 2004 4P. The LID provides for construction of the improvement, with financing over a 10 -year period. The actual construction costs determine the final assessment, with the cost shared by the property owners. Our recent Sewer LID on N 85 Avenue (south of Summitview) had a final assessment to each lot of approximately $6,000, with additional connection fees of $2,500 to $4,200 per lot. Property owners are not required to connect to the sewer upon completion of the project, but the service is available if a septic failure should occur At this time, we would like to measure your interest in creating a LID in your neighborhood. If a majority of the property owners are interested in the project, our staff will schedule a neighborhood meeting to provide you with additional information and determine the scope of the project. Sewer "Local Improvement District" (LID) for South 7 8 and 9th Avenues. This is our protest to the formation of the sewer "LID" for South r', 8 and 9 Avenues. Following is our reasons against the "LID" formation. Since the petition is a means to secure a number of citizens interested in the "LID ", and in the end majority rules, I'm concerned about `uninformed consent" m the signing of the petition and the amount of information given at public meetings. My copy of the initial petition doesn't give a simple paragraph to touch on what costs will be the responsibility of property owners in an immediate out -of- pocked expense. Without this information, property owners could misunderstand and believe "total costs" would be included within their yearly property taxes. In a recent phone conference, May 18, 2004, I talked to Pat Huff and K. Wendell Adams, City Engineering, about informing property owners adequately "They said there had been Informational meetings." " I said we were not notified about any meetings," I can only surmise that detractors are not welcome at such meetings. Those who didn't sign the petition are still, "parties to the fact." In the city certified mailing, May 13, 2004, giving our parcels "estimated" costs to have the benefit of the city sewer, I find the bid high and vague. Domg the math, property owners should see the excessive additional cost on yearly property taxes. Our parcel $4,767 09, in addition, treatment and trunk -line @ $1,393.56, not including an estimated interest charge for this 10 year financing period, would be approximately $6,160 65 and, at yearly assessment, could be well over $616.65 as an addition to our now yearly property taxes. We question the connection fee in relation to "treatment" We think the treatment charge would be included in the utility billing and not an up -front extra charge? In addition, have the property owners been informed concerning the lateral pipe line? A pipe from main city sewer pipe to property owners property line. Is this pipe lute included in the financing? Is this pipe going to be an added immediate expense, included in the property owners bid from an independent contractor, to run the sewer pipmg from house to city sewer line? Do property owners understand the added cost in permits, sales tax and requirements of the "Washington State Uniform Plumbing Code" concerning abandoned septic systems? (See attached Uniform Plumbing Code sections 722.0 thru 722.5, and 19 -1 11. Sewer Required: Sections 713.0 to 713 6) We recently received information for financial help from the Office of Neighborhood Development Services (ONDS). We were not offered this information at an earlier date. The Grant loan suggested for private sewer hookup and the second deferred loan for connection fee, we believe is little help for most property owners. Even when the interest is at 0% on the proposed $1,000 00 as a portion of total costs, costs that can run much higher than $1,000,00 , this is still an extra burden to pay at $200 00 per year for five years, in addition to increases m yearly property taxes for the main street sewer installation. And considering the deferred connection fee, who wants a lien put on their property? It sounds like people are going to need a lot of ready cash to keep from being in debt, We question the possible connection between the recent provision of the federal Clean Water Act and the interest in the sewer Local Improvement District in our area and other districts. Could it be that city property owners are being pushed to relinquish their septic tanks because of this Act? "The law requires cities and urban areas to remove pollutants such as raw sewage. The cost to property owners $50 00 a year. Churches, schools and shopping centers would pay thousands of dollars, and the tax would increase each year until 2010." (YFIR paper May 17, 2004) It appears private septic tanks would come under the federal Clean Water Act, and property owners ask to relinquish their septic tanks would be paying double taxes or fees that should be covered through the Clean Water Act city collection monies. Who is responsible for the costs of septic tank failures in our district? In the mid 1990's, our district was considered to have polluted shallow water wells and, due to public health concerns, property owners were hooked up to city water at no cost. This connection was a necessary evil in that property owners with septic systems were now discharging chlorine treated water, and other chemicals, into their septic tanks. As a result, the bacteria that digests solid waste is diminished. Septic tank failure is a public health concern and should be considered in the federal Clean Water Act mandate. In considering extra costs on utilities, there is a fee that is to be added to city utilities for a recent litigation settlement concerning "foul odor" contamination from the city water treatment plant. For those property owners who add the city sewer utility, "after the fact of the settlement," are they responsible for this fee? In summary, "the truth is in the details" The cost to property owners is high at a time of economic troubles. Curry ' � "' 722.0 — 723.0 UNIFORM PLUMBING CODE /)' 722.0 Abandoned Sewers and Sewage Disposal Facilities • 722.1 Every abandoned building (house) sewer, or part thereof, shall be plugged or capped in an approved manner within five (5) feet (1.5 m) of the property line. 722.2 Every cesspool, septic tank, and seepage pit which has been abandoned or has been discontinued otherwise from further use or to which no waste or soil pipe from a plumbing fixture is connected, shall have the sewage removed therefrom and be completely filed with earth, sand, gravel, concrete, or other approved material. 2 722.3 The top cover or arch over the cesspool, septic tank, or seepage pit shall be removed before filling and the filling shall not extend above the top of the vertical portions of the sidewalls or above the level of any outlet pipe until inspection has been called and the cesspool, septic tank, or seepage pit has been inspected. (4) If design is predicated on soil tests, the system shall be installed at the same location and depth as the tested area. (b) Testing (1) Septic tanks or other primary components shall be filled with water to flow line prior to requesting inspection. All seams or joints shall be left exposed (except the bottom) and the tank shall remain watertight. (a) Plot plan drawn to scale completely dimensioned, showing direction and approximate slope of surface, location of all present or proposed retaining walls, drainage channels, water supply lines or wells, paved areas and structures on the plot, number of bedrooms or plumbing fixtures in each structure and location of the private sewage disposal system with relation to lot lines and structures. (b) Details of construction necessary to assure compliance with the requirements of this appendix together with a full description of the complete installation including quality, kind and grade of all materials, equipment, construction, workmanship, and methods of assembly and installation. (c) A log of soil formations and ground water level as determined by test holes dug in close proximity to any proposed seepage pit or disposal field, together with a statement of water absorption characteristics of the soil at proposed site as determined by approved percolation tests. 258 713.0 — 714 1 UNIFORM PLUMBING CODE PART 11 BUILDING SEWERS .- 7110 Sewer Required 713.1 Every building in which plumbing fixtures are installed and every premises having drainage piping thereon, shall have a connection to a public or private sewer, except as provided in Sections 101 4.1.3, 713.2 and 713.4. 14713.2 When no public sewer, intended to serve any lot or premises, is available in any thoroughfare or right of way abutting such lot or premises, drainage piping from any building or works shall be connected to an approved private sewage disposal system. solp 713 3 Within the limits prescribed by Section 713 4 hereof, the rearrangement or subdivision into smaller parcels of a lot which abuts and is served by a public sewer shall not be deemed cause to permit the construction of a private sewage disposal system, and all plumbing or drainage systems on any such smaller parcel or parcels shall connect to the public sewer tro 713.4 The public sewer may be considered as not being available when such public sewer or any building or any exterior drainage facility connected thereto, is located more than two hundred (200) feet (60.8 m) from any proposed building or exterior drainage facility on any lot or premises which abuts and is served by such public sewer 713.5 No permit shall be issued for the installation, alteration, or repair of any private sewage disposal system, or part thereof, on any lot for which a connection with a public sewer is available. 713.6 On every lot or premises hereafter connected to public sewer, all plumbing and drainage systems or parts thereof, on such lot or premises shall be connected with such public sewer Exception. The proposed South 7th, South 8th & South 9th Avenues Sewer Local Improvement District (LID) involves 83 parcels. The City has received petitions requesting formation of this LID from property owners representing over 60% of the assessed property value. The project consists of approximately 3910 lineal feet of 8 -inch sewer line. This project will connect into the sewer main on Mead Avenue. The estimated LID assessment for the respective parcels of land is attached. The rates were calculated on a rate per parcel. This method of computation was selected based on equity of fairness. The City is in compliance with State law and City policy in the formation of this LID Please note the attached protest from Mr and Mrs. Curry They are concerned about the additional costs of connecting to the sewer mainline They perceive these costs to be undisclosed and misleading. In fact, these costs have been explained at all the formation meetings we have held with the neighbors. Before the final assessment roll is formed a meeting is held with all participants in the LID If the estimates have come in higher than expected and the citizens feel that the cost would cause a hardship the LID process would end without completing the project. LID assessments may be financed by the City of Yakima on a ten -year plan through the sale of bonds or the issuance of promissory notes.
