AN ORDINANCE granting a rezone to property located at 1218
South 6th Street from B-1, Professional Business
to CBDS, Central Business District Support.
WHEREAS, pursuant to Section 15.23.030 of the City of
111 Yakima Municipal Code Frank Rataezyk 'applied for a rezone of
his property located at 1218 South 6th Street, Yakima, Wash-
ington, from B-1, Professional Business, to CBDS Central
Business District Support. Said property is legally described
as:
Lot 13, Fairchild Acre Tracts, according to the
official plat. thereof recorded in Volume "A" of
Plats, Page 115, records of Yakima County, Washing-
ton, EXCEPT the West 10 feet thereof for alley,
situated in Yakima County, Washington.
and
WHEREAS, pursuant to Section 15.23.030 of the City of
Yakima Municipal Code the Hearing Examiner conducted a public
hearing on said rezone application on July 2, 1986, and
WHEREAS, the Hearing Examiner adopted written findings,
conclusion and recommendation denying said application for a
rezone, and
WHEREAS, pursuant to Section 15.23.030 of the City of
Yakima Municipal Code, on August 12, 1986, the City Council
held a public meeting at which it rejected the recommendation
of the Hearing Examiner followed by a public hearing at which
the City Council heard testimony of witnesses and accepted
exhibits regarding said application for a rezone, and
WHEREAS, as a result of its hearing the City Council
adopted the following findings and conclusion.
FINDINGS
1. The location of the proposed rezone is at 1218 South
6th Street (Northwest corner of South 6th Street and Central
410 Avenue). Access to the site would be from 6th Street which is
an arterial street.
2. The subject property is occupied by an older single
family dwelling and garage. Situate on property to the North
is an older single family dwelling. Property to the South and
West is vacant. To the East and immediately across South 6th

Street is a church (mission) and presumably a parish house.
While the property to the East is zoned R-2, it is noted that
in the near vicinity there are several multiple family
dwellings as well as single family dwellings. There are also
several vacant lots. A church is a Class (1) use in a CBDS

zone.
3. The present zoning of the immediately adjacent
property is:
North B-1
South B-1
West CBDS
East R-2
The B-1 zoning of the subject property and of property to the
North and South extends along the West side of South 6th
Street for about 1-1/2 blocks. North of that B-1 zone is an
area where an M-1 zone abuts an R-2 zone, and South of the
existing B-1 zoning is an area where a CBDS zone abuts an R-2
zone.
4. The subject property is adjacent to a CBDS zone, and
because of its location and the use of the land in the imme-
diate vicinity, it is more suitable for a CBDS use than a B-1
use. It is not suitable for professional offices nor is there
a likelihood that offices or a multiple family dwelling will
be built on the site in the future. It is not probable that
any of the presently zoned B-1 properties within the island of
properties zoned B-1 will ever provide a buffer (other than as
vacant lots or lots on which are situate the present older
homes) between the CBDS district to the West and the R-2
district to the East.
5. Notice of the aforementioned City Council meeting and
hearing was given consistent with the terms of Section 15.11.
090 of the City of Yakima Municipal Code.
6. The City Council has heard and considered all testi-
mony and exhibits at its public hearing all of which was
favorable to the requested rezone.

7. The subject property is served by adequate arterial
street and other street access and adequate sewer and water
service to permit the uses allowed in a CBDS zone.

8. The subject property is compatible to the uses of a
CBDS zone and the rezone to CBDS will benefit the community as
a whole.
9. A public need exists for the proposed rezone.
• 10. The City' s planning department has recommended re-
jection of the proposed rezone.
11. The proposed rezone conforms with the overall intent
of the Yakima Urban Area Comprehensive Plan and the City' s
zoning code.
CONCLUSIONS
1. The recommendation of the Hearing Examiner dated July
2, 1986 recommending against the rezone of the subject prop-
erty should be rejected and the subject property rezoned CBDS,
Central Business District Support.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The property located at 1218 South 6th
Street, Yakima, Washington and legally described as:
Lot 13, Fairchild Acre Tracts, according to the
official plat thereof recorded in Volume HA" of
Plats, Page 115, records of Yakima County, Washing-
ton, EXCEPT the West 10 feet thereof for alley,
situated in Yakima County, Washington.
is hereby rezoned from B-1, Professional Business to CBDS,
Central Business District Support.
Section 2. The above change in zoning shall be included
and depicted on the next regularly amended zoning map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and
directed to file with the Yakima County Auditor a certified
copy of this ordinance.
Section 4. This ordinance shall be in full force and
effect thirty days after its passage, approval and publication
as provided by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this
day of August, 1986.
