AN ORDINANCE relating to City personnel, adopting a classification and compensation plan for
City employees to be effective June 20, 2004, amending Subsections 2.20 100 A,
2.20 100 C, 2.20 110 A, and 2 20 110 C, all of the City of Yakima Municipal
Code
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Subsection 2.20 100 A of the City of Yakima Municipal Code is hereby amended
to read as follows
"2.20 100 Classification Plan
A Plan Adopted. A classification plan for city employees is hereby adopted to be
effective June 20, 2004, which plan shall consist of the various following subsections of this section."
Section 2. Subsection 2 20 100 C of the City of Yakima Municipal Code is hereby amended
to read as follows.

Section 3. Subsection 2.20 110 A of the City of Yakima Municipal Code is hereby amended to
read as follows
"2.20 110 Compensation Plan. A. Pay ranges and pay steps, set out in the schedule
constituting Subsection B through G of this section, for the classes allocated to these pay ranges shall be
in full force and effect as of June 20, 2004 The pay rates shall constitute full compensation for those
employees with a work week of forty hours as set out in other sections of this code Employees whose
work week is less than forty hours shall be paid at the rate which is in the same proportion to the rates
set out herein that their work week bears to forty hours. The hourly rate for those employees of the Fire
Department whose work week exceeds forty hours shall be computed according to the provisions of
Section 2 22.030 of this code
The performance of employees in the senes designated Subsection B shall be evaluated annually
in accordance with a management performance evaluation plan The result of the performance
evaluations shall be the determination by the City Manager of the actual salary of each employee in the
designated positions, and the determination by the City Council of the actual salary of the City Manager,
which actual salanes shall be no less than the minimum nor no greater than the maximum set out in the
pay range applicable to the position, according to the following schedule "

RE Right of Way Technician
Thus report summanzes my findings relating to the creation of a new classification of
Right of Way Technician. The study included an on -site audit with the current
Engineenng Division employees including those currently perfornung the Right of Way
Technician functions, interviews with supervisory personnel, development of a draft
revised class description, comparisons with positions m the City of Yakima's
classification system with similar levels of complexity and responsibility and a
compensation survey of local and regional public employers. Pnvate sector employers
were not included m this review since right of way functions are exclusively within the
domain of public agencies.
Based on my finduigs discussed herein, it is my recommendation that the position of
Right of Way Techmcian be created and allocated to Pay Range 17 0 ($17 70 -
$21.25/hr)
SUMMARY: Persons in this classification appraise property within right -of -way plans
to develop fair market values, attend public meetings regarding construction projects to
explain the right -of -way process, and negotiate with property owners to secure purchase
or lease of land and rights -of -way This may require identifying and locating property
owners by accessing public records and tracing absentee owners.
The classification requires well - developed written commumcation skills required m the
preparation of acquisition offer packages detailing the property with improvements
proposed for purchase, maintaining logs, records and documents used in the acquisition
process as mandated by state and federal regulations, preparing legal descriptions and
deeds of property to be acquired, and prepanng excise affidavits and other administrative
papers necessary to complete the transfer of property
The classification also requires well- developed communication skills required when
making presentations at public meetings, City Council meetings, meeting with property
owners, in dealing with state and federal officials, and in giving testimony in court
proceedings.
Work is performed with considerable latitude for independent judgment and within
established federal, state and local guidelines and is done with limited supervision. This
is not a supervisory position.
COMPENSATION ANALYSIS
FACTORING ANALYSIS. A factoring analysis was conducted using the 12- factor
format used by the City and formulated by the U S Civil Service Commission. While a
factonng analysis is subjective in nature and provides a general internal relationship
between positions within the City of Yakima Charter Civil Service System, it should be
used as one of the considerations in determining an appropriate pay range for the
classification. The factoring analysis suggests a compensation level at or near Range

INTERNAL COMPARISONS. This proposed classification was compared to a variety
of administrative classifications in the City's workforce. The property appraisal function
is somewhat unique in the workforce but there are similarities and differences in the
knowledge, skills and abilities required and in the complexity of the work performed.
Current classifications compared include
Range 13.0 ($14.87 - $17.70/hr)
Engineering Technician I (design) — There are some similarities in this classification
including vanous levels of research, record keeping and public contact. However, the
proposed classification requires more detailed research and effort m identifying absentee
property owners, more contentious public contact; property appraisals, negotiations with
property owners, legal documentation, and, extensive community involvement.
Range 16.0 ($16.95 — 20.28/hr)
Engineering Utility Specialist — There are considerably more and greater similanties in
this classification particularly in researching legal descriptions, and dealing with the
public through public meetings and making presentations before the City Council and
other groups. However, the personal interactions are generally conducted in a manner of
providing information rather than in the confrontational arena of property acquisition.
Corrections Administrative Specialist — This is another administrative classification
working primarily within the internal structure of the Police Department. The
classification requires well - developed administrative skills and prepares and maintains a
variety of records required by local, state and federal agencies. Public contact is non-
confrontational and generally restncted to within the department and dealing with

prisoners Inter - agency communications are limited to issues relating to statistical
reporting and the classification has limited responsibilities for communicating with the
City Council or other regulatory agencies
Range 16.5 ($17.35 - $20.82/hr)
Engineering Technician II — This classification may work in the office performing skilled
design drafting or in the field as an instrument operator and/or assistant to a survey party
chief It may do some construction work dealing with contractors on various issues The
classification may be more technically oriented which is a considerable difference It
lacks the reporting requirements or the significant public contact, Council, and
negotiations elements of the new classification.
Range 17.0 ($17.70 - $21.25/hr)
Construction Inspector — This classification has some of the elements of the proposed
classification, particularly in working with significant independent initiative, interpreting
plans and specifications, dealing with property owners regarding the effects of
construction on their property This is a paraprofessional engineering classification
requiring three years experience and the equivalent of a high school diploma. A
significant part of the workday is spent in the field although some is spend conducting
miscellaneous office work including preparing property descriptions
Engineering Technician III (design) — This is a drafting position that also performs
survey work. There are some similarities but the classification lacks many of the
responsibilities of the proposed classification primarily in public contact, licensing,
public /Council meetings, and dealings with regulatory agencies. It requires a para-
professional background.
Street Inspector — This classification may work closely with the proposed Right -of -Way
Technician in that it inspects street breaks, a variety of street construction projects
including right -of -way construction. It requires a well - developed ability to deal tactfully
with a variety of people including contractors and property owners who may resent the
work in progress. It has responsibilities for generating and maintaining records, which
will serve as legal documents.
Range 18.0 ($18.53 - $22.25/hr)
Neighborhood Development Rehabilitation Specialist II — The work of this classification
is generally administrative in nature but requires journey -level skills and/or experience in
the construction or rehabilitation of residential or commercial structures It is the
principal classification that inspects properties to determine building, mechanical,
plumbing, electrical, weathenzatron code and HUD property standards deficiencies and
also identifies a variety of environmental issues such as the presence of asbestos or lead -
based paint. It requires significant interpersonal communications both with property
owners and contractors in both pnvate and public settings and serves as a mediator in

disputes between owners and contractors. The classification requires good written skills
m wntmg project specifications.
Range 19.0 ($19.40 - $23.30/hr)
Engineenng Associate — This is a professional engineering classification requiring a
Bachelor's Degree and three years' expenence or seven years of professional civil
engineering experience and works in the development, design and preparation of public
improvement construction projects. It also prepares project cost estimates, plans,
specifications and other documents. It also participates in site surveying and coordmates
project planning, design and preparation. The classification requires interpersonal
communications by communicating projects to the public, coordination with other
agencies, contractors and developers.
Range 19.5 ($19.58 - $23.49/hr)
Code Inspector — This classification inspects buildings and construction projects to
ensure compliance with a vanety of municipal, state and federal codes and laws in areas
such as mechanical, plumbing and zomng. Interpersonal contacts may be contentious and
also involves public presentations at City Council meetings, community meetings,
dealing with special interest groups, and pre - construction meetings. It requires diligence
in preparing wntten descnptions of code deficiencies.
EXTERNAL COMPARISONS. - A salary survey was conducted with information
solicited from thirty-two (32) public agencies within Washington and Idaho Private
employers were not included in this survey since those normally surveyed do not perform
similar tasks. The survey was also expanded to include additional counties that contained
one or more of the surveyed municipalities because counties generally perform more
right -of -way work than do cities. Twenty -three (23) jurisdictions responded (71 88 %)
Of those responding, only 5 indicated a good match with the proposed classification. The
absolute minimum hourly rate paid for the good matches was $16 33/hr (State of
Washington DOT) and the highest minimum rate of pay was $21 71 /hr (Snohomish
County) The absolute maximum rate of pay was $26.37 (Snohomish Co) and the lowest
of the maximum rates reported was $20 90 (DOT). The mean minimum hourly rate of
pay was $19 39/hr and the mean maximum rate was $24 41/hr
It is interesting that one agency reported a classification with greater responsibilities than
Yakima's but the salary would rank second to last if included as a good match ($17 05 -
$23 11) and is considerably lower than the mean minimum and maximum rates reflected.
The minimum and maximum hourly rates paid to "lesser match" classifications generally
were higher than the "good match" results In fact, all exceeded the rates reported by the
DOT and the mean minimum and maximum rates both exceeded those for the good
matches ($20 05 min, $24 92 max vs. $19.39 min, $24 41 max) This may be explained
based on the composition of the good matches, which included three counties, DOT and

one city while the lesser matches included one county and four cities. The greater match
was also a county but as reported above, it would rank near the bottom of the good
matches. It would also rank ninth out of the eleven reporting a match of any kind. The
most probable cause for these unusual statistics may be that generally and histoncally,
cities have offered higher salary levels than have counties.
DISCUSSION: While this is reported as a new classification, the work is currently
being performed by an Engineenng Technician I (design) who is also receiving out -of-
class pay as additional compensation for the advanced work required.
The difficulty in assigning this classification to a salary range is that the salaries within
the Engineenng Division are tightly compressed as evidenced above where a degreed
engineer is compensated at Range 19 0 and a technical design classification is allocated
to Range 17 0, both of which are considerably lower than the mean maximum hourly
rates of the good classification matches reported in the salary survey By illustration, the
mean maximum salary of the good matches ($24 41/hr) would approximate the maximum
hourly rate of Range 20 0 ($24 38) and the maximum salary of the lesser matches
($24 92) would approximate the maximum hourly rate of Range 20 5 ($24 98). To
allocate the proposed Right -of -Way Technician even to the mean maximum hourly rate
of the good matches would significantly compromise the internal relationships of the
classifications of the Engineering Division. That should not be allowed to occur
Significant among the good matches is the Department of Transportation, the salary for
which has been retarded in recent years by a lack of cost of living adjustments of any sort
to keep pace with the inflationary trends statewide That has pushed the DOT' s salaries
lower and lower when compared to cities and counties. If the DOT' s classification was
removed from the good matches, the mean maximum would raise to $25.28/hr which is
slightly lower than the City's Range 21 0 ($25 52) and which includes the Development
Engineer
Often, hourly rates paid by eastern Washington agencies are lower than those paid west
of the Cascades. That is true in this study as well. Three respondents are from eastern
Washington. Yakima County; City of Walla Walla, and Walla Walla County Even the
lowest ranking lesser match respondent (Walla Walla County), which reported a Survey
Party Chief ($22 79/hr), reflects a maximum hourly rate approximating a City of Yakima
Range 18 5 ($22.83/hr)
Within the Engineering Division, the internal alignment would suggest allocating the
Right -of -Way Technician to Range 17 0 ($17 70 - $21.25), which is the rate, paid for the
Construction Inspector, Street Inspector, and Engineering Technician III (design)
Within the City overall, compensation should fall less than the Neighborhood
Development Rehabilitation Specialist II (Range 18 0) In either instance, the only
reporting agency that would then have a lower maximum hourly rate would be the
Department of Transportation.

The final issue is the manner in which the new classification will be filled. Normally,
new classifications are filled by competitive announcement. I do not believe the change
in duties was a gradual accretion of duties, a normal expansion of responsibilities beyond
the intended duties of the classification held by the person currently performing the
Right -of -Way functions, which then could be considered a reclassification and could
qualify the incumbent for reclassification with the position. Those functions are not an
extension of the Engineenng Technician I (design) classification, in fact, they are
significantly different. However, they are being performed, regardless and must be
considered as the assignment of additional duties out of the normal classification, rather
than a gradual accretion. It should also be noted that the duties have been performed for
a penod exceeding six months.
RECOMMENDATION: Based on my review of the duties and responsibilities to be
demanded of the Right -of -Way Technician and in consideration of both internal and
external compensation relationships, the following is recommended.
1 The Right -of -Way Technician classification should be established as proposed
and allocated to Pay Range 17 0 ($17 70 - $21.25/hr; $3067 94 - $3683.26/mo)
2 The classification should be filled by promotional announcement.
3 If the Engineenng Division classifications are revalued, this classification should
be included since the proposed allocation is based on internal alignments.

DEFINITION: Under general supervision negotiates with property owners to secure purchase
or lease of land and right -of -way for construction projects, utility easements and other uses.
Appraises property to develop fair market values Negotiates with property owners for
compensation due to lost land area, diminished utility and diminished amenities. Maintains
records and documents of acquisition processes, attends public meetings, identifies and locates
property owners. Work is performed with considerable latitude for independent judgment and
within established federal, state and local guidelines and is evaluated through direct observation,
meetings and conferences, public feedback, and results achieved.
DUTIES
Essential Functions:
Appraises property within right -of -way plans, describes the project and neighborhood and
identifies land and improved sales to be used for comparisons Attends public meetings regarding
construction projects with right -of -way issues and explains the right -of -way process.
Researches property and land use maps, identifies areas of concern that may become issues during
acquisition. Identifies and locates property owners including accessing public records and tracing
absentee owners, communicates with property owners by mail, telephone and in person regarding
the property acquisition process. Prepares acquisition offer packages including• introductory
letters, offer letters, including landscaping and improvements to be purchased, project map
reflecting affected property, informational pamphlet re right -of -way acquisition and procedures,
and other materials as may be necessary Conducts follow -up personal visits to review the plans
and proposals Exercises significant independent judgment in negotiating purchase price of
properties within the right -of -way project and property acquisition with property owner
Coordinates with property owners and City administrative staff to determine funding limitations.
Obtains owner acceptance of offer; writes and reviews legal descriptions of property to be
acquired, prepares deeds, completes excise affidavits and other administrative papers necessary to
complete the transfer of property
Maintains detailed log of each activity performed for each property involved including all contacts,
communications, processes and other matters. Presents completed acquisition files to the
Washington State Department of Transportation for review in order to assure compliance with
federal guidelines.

SUMMARY EXPLANATION
The attached ordinance amends the Classification and Compensation Plan to
implement compensation adjustments recommended by City Management and the
Charter Civil Service Commission for Right of Way Agent.
The Charter Civil Service approved the compensation and new classification for Right
of Way Agent for the Engineering Division at their May 3, 2004 meeting
Attached for Council's information is a memorandum outlining the new classification
and other supporting documentation
The budget impact of implementing the classification has been included in the
Engineering department's Budget.
All recommendations are subject to City Council review and approval
Council has the option to choose
