The requirements for public notice of the rezone application and public hearing were satisfied; and b The Subject Property is suitable to be classified Professional Business (B -1), and c. The requested rezone is consistent with the Future Land Use Map designation for the Subject Property; and d The requested rezone is consistent with and complies with the Yakima Urban Area Zoning Ordinance, and Page 1 7389358 Page 2 of 14 rtry ri ro� nan to ran Y akim a rA e �8P Q e The requested rezone is consistent with and complies with the criteria, requirements and considerations set forth in Chapter 15.23 Yakima Municipal Code, and f The requested rezone is consistent with and complies with the goals and policies of the Yakima Urban Area Comprehensive Plan, and g. There have been significant changes in the land uses in the vicinity of the Subject Property that justify the proposed zoning change from low- density residential uses to professional business uses, and h The requested rezone and associated uses are compatible with neighboring land uses, and i There are adequate public services available to satisfy the utility and access requirements of future B -1 uses on the Subject Property; and j The requested rezone is in the public interest by providing increased investment in the community, increased tax base, increased employment opportunities and additional aesthetic benefits for the immediate area, and k. SEPA review resulted in the December 17, 2003, issuance of a Determination of Nonsignificance, and no appeal of that has been filed, and WHEREAS, it is in the best interests of the City to enact the following to approve the requested rezone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1. Subject to the specific terms of this ordinance, the Yakima City Council adopts the findings, conclusions and recommendations of the Hearing Examiner's Recommendation regarding UAZO RZ #5 -03, EC #26 -03, dated January 23, 2004, and incorporates the Hearing Examiner's Recommendation by reference as part of this ordinance Section 2. Regarding the Subject Property, Yakima County Assessor's Parcel No 181323 - 12441, a more complete description of which is attached to this ordinance as Exhibit A, which is incorporated by reference in this ordinance, and subject to conditions stated below, the City Council finds formally that, for the uses described by the Applicant: a. Bill Hordan of Hordan Planning Services for Tiger, LLC of 1017 South 40 Avenue, Yakima, WA 98908 Location. 406 North 23' Avenue, Yakima, Washington, Parcel number 181323 -12441 Application. This application requests a non - project rezone of a parcel of vacant land approximately 17 of an acre in size from Single- Family Residential (R -1) to Professional Business (B -1) and concurrent SEPA environmental review thereof. Notices. M YAima (:n WA period ending on December 16, 2003 A Determination of Nonsignificance (DNS) was issued by the City of Yakima on December 17, 2003 There was no appeal of the DNS within the 15 -day appeal penod ending on January 2, 2004 Current Zoning and Land Uses. The site is currently zoned R -1 and is vacant. The existing zoning and existing land uses on adjacent properties are Location Zoning Land Use North R -1 Single- family house East SCC Lincoln Center West B -1 Vacant South B -1 Vacant Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon criteria specified in Section 15.23 030 of the Yakima Municipal Code: 1. The testimony at the public hearing: The assistant planner, the applicant's representative and the owner's representative all testified in favor of the requested rezone at the hearing. No one spoke against it. 2. The suitability of the property for uses permitted under the proposed zoning: The property is well suited for those uses permitted within the B -1 zonmg district. The Urban Area Comprehensive Plan's Future Land Use Map was amended on November 4, 2003, to the Neighborhood Commercial designation. The Comprehensive Plan characterizes Neighborhood Commercial uses to mclude "Small scale shopping centers, with shared parking and access, usually located on arterial streets" and states that "Neighborhood commercial centers are dispersed throughout the Urban Service Area to provide convemence shopping to the residential population." The Neighborhood Commercial designation fully supports the Professional Business (B -1) zoning classification. Due to the size of the lot under consideration, it will probably be merged with undeveloped lots to the south and west in order to develop a B -1 use in the future. A conceptual drawing was submitted with the application, consistent with signage near the lot, which shows the possible configuration of a medical/professional office building and associated parking and landscaping on this lot and on four other lots north of West Lincoln Avenue between North 23 Avenue and North 24 Avenue. The proximity of this parcel to other parcels that are zoned B -1 and to other existing uses that are allowed in the B -1 zonmg district satisfy this criteria. 3. Recommendations from interested agencies and departments: No agencies or departments opposed this rezone request. 4. The extent to which the proposed amendments are in compliance with and/or deviate from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: Due to the Comprehensive Plan designation amendment approved in November of 2003 to Neighborhood Commercial, the Professional Busmess (B -1) zoning designation and the Comprehensive Plan designation are fully consistent and compatible with each other The Goals, Objectives and Policies of the 1997 Comprehensive Plan include Policy C2.2 which is to encourage office development to locate within city limits, Objective S1 which is to encourage the location of public and semi -public facilities in appropriate locations throughout the urban area, Objective S2 which is to require public and semi -public uses to be developed in a manner which does not detract from surrounding uses, and Goal Cl Tiger, LLC 4 Rezone at 406 No. 23r Ave. DOC UAZO RZ #5 -03, EC #26 -03 INDEX # A --/ 7389358 Page 10 of 14 63/„5/ :004 02 28P MTV N CM' non M7 RR Yakima Cm WA which is to stabilize and revitalize existing commercial facilities in the Urban Service Area. The zoning ordinance sets forth specific standards for minimum lot size, maximum lot coverage, minunum building setbacks, parking, building height, sight screening and other details that will have to be satisfied when a specific use is proposed for the lot. Project review and environmental review will take place at the time of development. 5. The adequacy of public facilities such as roads, sewer, water and other required public services: Public utilities are available, but the subject property is currently not served by them. North 23' Avenue, a local access street, currently provides requisite access to the lot. The Development Services Team noted at its meeting on December 17, 2003, that this single parcel rezone is not subject to Title 12 Development Standards until the specific project is proposed, that when the specific use is known, the development will then likely be subject to review under the Transportation Concurrency Ordinance; that a Yakima County drainage line or DID runs through the area, that the New Shano Ditch Company has an irrigation canal within the general area of the lot that should be located prior to its development; and that prior to specific development in the future a site dust control plan addressing site preparation, construction and landscaping phases and a description of the intended future uses must be filed with and approved by the Yakima Regional Clean Air Authonty to determine which regulations are applicable to the specific development at that time. 6. The compatibility of proposed zone change and associated uses with neighboring land uses: This is a non - project rezone. Considering the vacant condition of the subject property, this proposal will improve the current land use situation by providing opportunities in the community for a small business center or facility which will buffer the residential properties to the north from more Tiger, LLC 5 Rezone at 406 No. 23r Ave. DOC UAZO RZ #5 -03, EC #26-03 INDEX 7389358 03/1512004 2 2SP MTV ri cov non r4o AA Yakima Co, WA intense uses while providing a service to the surrounding neighborhood and the residents of the City 7. The public need for the proposed change: Significant land use changes, such as the recent remodel of the Lincoln Shopping Center and current development of the Farmers Clinic across the street from this proposed rezone have occurred within this general area since the subject property was zoned R -1 The recent Comprehensive Plan Map amendment that occurred on November 4, 2003 in conjunction with the development of the surrounding neighborhood fully supports this requested rezone. Approval of this rezone request would benefit the public by providing increased investment in the community, increased tax base, increased employment opportunities and additional aesthetic benefits for the immediate area around the requested rezone. Consistency of the Rezone with Development Regulations and the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the following factors which will be considered in greater detail during future project review a) The types of land uses permitted at the site in the B -1 zoning district would be consistent with the Comprehensive Plan designation of the site. b) The density of residential development or the level of development such as units per acre or other measures of density is not affected by this application because any use permitted on the lot will be consistent with the density allowed by the Comprehensive Plan and zoning ordinance. c) The availability and adequacy of infrastructure and public facilities is not an issue here as previously explained above. d) The characteristics of the development, when the exact type of Tiger, LLC 6 Rezone at 406 No 23 Ave. D4C. CONCLUSIONS 1 The Hearing Examiner has jurisdiction to issue a recommendation to the City Council regarding this rezone application. 2 The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3 SEPA review resulted in the issuance of a Declaration of Non - significance on December 17, 2003, without any appeal being filed. 4. Adequate public services are available to satisfy the utility and access requirements of future B -1 uses on this lot. 5 Testimony at the hearing was in favor of this rezone request. 6 The requested rezone is consistent with the future land use map designation for the property 7 There have been significant changes in the land uses in the vicimty of the property under consideration that justify the proposed zoning change from low - density residential uses to high - density residential or professional business uses. 8 The requested rezone satisfies the seven cnteria in Section 15.23 030 of the Yakima Municipal Code to allow for approval of the rezone for the reasons detailed above. 9 Approval of this rezone application will benefit the public in several ways by providing increased investment in the community, increased tax base, Tiger, LLC 7 Rezone at 406 No. 23r Ave. fl0C• UAZO RZ #5 -03, EC #26 -03 INDEX dy / 7389358 Page 13 of 14 03/15/2004 02 29P r NTY ri CDV n M2 AA Yakima Co,. The applicant's representative, Mr. Bill Hordan of Hordan Planning Services, and the property owner's representative testified in favor of the application. No testimony or other evidence was presented at the hearing in opposition to the application. Summary of Recommendation. The Hearing Examiner recommends approval of this rezone application. Basis for Recommendation. Bill Hordan of Hordan Planning Services for Tiger, LLC of 1017 South 40 Avenue, Yakima, WA 98908. Location. 406 North 23 Avenue, Yakima, Washington; Parcel number 181323 - 12441. Application. This application requests a non - project rezone of a parcel of vacant land approximately .17 of an acre in size from Single - Family Residential (R -1) to Professional Business (B -1) and concurrent SEPA environmental review thereof. Notices. Notices for the SEPA processes and the public hearing were provided in accordance with applicable ordinance requirements in the following manner: Mailing of notice of SEPA review and public hearing November 25, 2003 Posting of public hearing notice on property December 16, 2003 Publishing of public hearing notice December 19, 2003 State Environmental Policy Act. There were no comments received regarding the environmental review of this Rezone proposal during the 20 -day comment Tiger, LLC 2 Rezone at 406 No. 23 Ave. UAZO RZ #5 -03; EC #26 -03 . INDEX period ending on December 16, 2003. A Determination of Nonsignificance (DNS) was issued by the City of Yakima on December 17, 2003. There was no appeal of the DNS within the 15 -day appeal period ending on January 2, 2004. Current Zoning and Land Uses. The site is currently zoned R -1 and is vacant. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon criteria specified in Section 15.23.030 of the Yakima Municipal Code: 1. The testimony at the public hearing: The assistant planner, the applicant's representative and the owner's representative all testified in favor of the requested rezone at the hearing. No one spoke against it. 2. The suitability of the property for uses permitted under the proposed zoning: The property is well suited for those uses permitted within the B -1 zoning district. The Urban Area Comprehensive Plan's Future Land Use Map was amended on November 4, 2003, to the Neighborhood Commercial designation. The Comprehensive Plan characterizes Neighborhood Commercial uses to include "Small scale shopping centers, with shared parking and access, usually located on arterial streets" and states that "Neighborhood commercial centers are dispersed throughout the Urban Service Area to provide convenience shopping to the residential population." Even though the exact use of the property Tiger, LLC 3 Rezone at 406 No. 23` Ave. Doe, UAZO RZ #5 -03; EC #26 -03 INDEX has not been determined, indications are that the use will most likely be tailored to the kinds of businesses that are convenient to the residential population. The Neighborhood Commercial designation fully supports the Professional Business (B -1) zoning classification. Due to the size of the lot under consideration, it will probably be merged with undeveloped lots to the south and west in order to develop a B -1 use in the future. A conceptual drawing was submitted with the application, consistent with signage near the lot, which shows the possible configuration of a medical /professional office building and associated parking and landscaping on this lot and on four other lots north of West Lincoln Avenue between North 23 Avenue and North 24 Avenue. The proximity of this parcel to other parcels that are zoned B -1 and to other existing uses that are allowed in the B -1 zoning district satisfy this criteria. 3. Recommendations from interested agencies and departments: No agencies or departments opposed this rezone request. 4. The extent to which the proposed amendments are in compliance with and /or deviate from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: Due to the Comprehensive Plan designation amendment approved in November of 2003 to Neighborhood Commercial, the Professional Business (B -1) zoning designation and the Comprehensive Plan designation are fully consistent and compatible with each other. The Goals, Objectives and Policies of the 1997 Comprehensive Plan include Policy C2.2 which is to encourage office development to locate within city limits; Objective S1 which is to encourage the location of public and semi - public facilities in appropriate locations throughout the urban area; Objective S2 which is to require public and semi - public uses to be developed in a manner which does not detract from surrounding uses; and Goal Cl Tiger, LLC 4 Rezone at 406 No. 23r Ave. DOC UAZO RZ #5 -03; EC #26 -03 INDEX LAcArri which is to stabilize and revitalize existing commercial facilities in the Urban Service Area. The zoning ordinance sets forth specific standards for minimum lot size, maximum lot coverage, minimum building setbacks, parking, building height, sight screening and other details that will have to be satisfied when a specific use is proposed for the lot. Project review and environmental review will take place at the time of development. 5. The adequacy of public facilities such as roads, sewer, water and other required public services: Public utilities are available, but the subject property is currently not served by them. North 23 Avenue, a local access street, currently provides requisite access to the lot. The Development Services Team noted at its meeting on December 17, 2003, that this single parcel rezone is not subject to Title 12 Development Standards until the specific project is proposed; that when the specific use is known, the development will then likely be subject to review under the Transportation Concurrency Ordinance; that a Yakima County drainage line or DID runs through the area; that the New Shano Ditch Company has an irrigation canal within the general area of the lot that should be located prior to its development; and that prior to specific development in the future a site dust control plan addressing site preparation, construction and landscaping phases and a description of the intended future uses must be filed with and approved by the Yakima Regional Clean Air Authority to determine which regulations are applicable to the specific development at that time. 6. The compatibility of proposed zone change and associated uses with neighboring land uses: This is a non - project rezone. Considering the vacant condition of the subject property, this proposal will improve the current land use situation by providing opportunities in the community for a small business center or facility which will buffer the residential properties to the north from more Tiger, LLC 5 Rezone at 406 No. 23r Ave. DOG. UAZO RZ #5 -03; EC #26 -03 INDEX intense uses while providing a service to the surrounding neighborhood and the residents of the City. 7. The public need for the proposed change: Significant land use changes, such as the recent remodel of the Lincoln Shopping Center and current development of the Farmers Clinic across the street from this proposed rezone have occurred within this general area since the subject property was zoned R -1. The recent Comprehensive Plan Map amendment that occurred on November 4, 2003 in conjunction with the development of the surrounding neighborhood fully supports this requested rezone. Approval of this rezone request would benefit the public by providing increased investment in the community, increased tax base, increased employment opportunities and additional aesthetic benefits for the immediate area around the requested rezone. Consistency of the Rezone with Development Regulations and the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the following factors which will be considered in greater detail during future project review: a) The types of land uses permitted at the site in the B -1 zoning district would be consistent with the Comprehensive Plan designation of the site. b) The density of residential development or the level of development such as units per acre or other measures of density is not affected by this application because any use permitted on the lot will be consistent with the density allowed by the Comprehensive Plan and zoning ordinance. c) The availability and adequacy of infrastructure and public facilities is not an issue here as previously explained above. d) The characteristics of the development, when the exact type of Tiger, LLC 6 Rezone at 406 No. 23 Ave. UAZO RZ #5 -03; EC #26 -03 INDEX development becomes known in the future, will have to be consistent with the development regulations of the zoning ordinance as previously noted above. CONCLUSIONS 1. The Hearing Examiner has jurisdiction to issue a recommendation to the City Council regarding this rezone application. 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3. SEPA review resulted in the issuance of a Declaration of Non - significance on December 17, 2003, without any appeal being filed. 4. Adequate public services are available to satisfy the utility and access requirements of future B -1 uses on this lot. 5. Testimony at the hearing was in favor of this rezone request. 6. The requested rezone is consistent with the future land use map designation for the property. 7. There have been significant changes in the land uses in the vicinity of the property under consideration that justify the proposed zoning change from low - density residential uses to high - density residential or professional business uses. 8. The requested rezone satisfies the seven criteria in Section 15.23.030 of the Yakima Municipal Code to allow for approval of the rezone for the reasons detailed above. 9. Approval of this rezone application will benefit the public in several ways by providing increased investment in the community, increased tax base, Tiger, LLC 7 Rezone at 406 No. 23r Ave. UAZO RZ #5 -03; EC #26 -03 INDEX increased employment opportunities and additional aesthetic benefits for the area near the proposed rezone. Yakima Regional Clean Air Authority (YRCAA) The proponent shall file with, and gain approval from YRCAA, a site dust control plan to address site preparation, construction and landscaping phases. ANALYSIS. The only issue raised by this application is the appropriateness of rezoning the property from (R- 1) Single - Family Residential to (B -1) Professional Business. This rezone is well supported by the Comprehensive Plan's Future Land Use Map as the subject property's future land use designation was changed from Low Density Residential to Professional Office on November 4, 2003. The Professional Office Future Land Use Map designation gives full support to the (B -1) Professional Business zoning. In addition the infrastructure necessary to support the development is available and there have been numerous significant changes in the area that trend towards this Professional Business development. CONCLUSIONS. 1. The hearing examiner has jurisdiction to issue a recommendation on this application to the City Council. 2. During project review it has been determined that this request is in compliance with YMC 16.06.020(B) for making a Determination of Consistency as follows: a) The density of the development is not a factor with this application. b) Professional offices are a Class (1) permitted use in the B -1 zoning district. c) Adequate public facilities are available to serve this site. d) The proposal is consistent with development standards of the zoning ordinance. 3. This project is determined to be exempt under the Transportation Capacity Management Ordinance. 4. SEPA review resulted in the issuance of a DNS on December 17, 2003. Is the requested zoning change suitable with the property in question (subject property)? How so? The requested zoning change is suitable with the property in question because the property is served with all urban services and is an extension of a block of existing Professional Business zoned property currently under the same ownership. This additional property is connected to the block which is located along an urban arterial. The property is now designated Neighborhood Commercial by the Urban Area Comprehensive Plan and is located in a mixed use area of the City. B. How is the rezone request in compliance with and /or how does the request deviate from the 1997 Yakima Urban Area Comprehensive plan as amended? The rezone request is in compliance with the 1997 Yakima Urban Area Comprehensive Plan because the proposal meets many of the goals, objectives and policies of the plan which are listed in the General Development, Public Services, Commercial Development, Land Use, Transportation, Utilities and Capital Facilities element of the plan. The rezone request is also in compliance with the amended plan because the underlying Comprehensive Plan was recently changed to Neighborhood Commercial and the proposed rezone falls within the confines of the "Matrix" which was adopted as a previous Comprehensive Plan amendment. The Future Land Use Map to Zoning Map Consistency was added to the Comprehensive Plan in 1998 as an amendment and it indicates that the proposed rezone can be compatible with the plan, subject to review. The total block of property has street frontage on three sides (east, west and north) and can provide safe points of ingress and egress, particularly if access is limited to the local access streets. Subject to the Traffic Capacity Analysis of the City, the project will be in compliance with the transportation element of the Growth Management Act and City Development Standards. To the north is a single- family residential structure which is heavily buffered from the proposal by its own fencing and on -site vegetation. To the west is North 23rd Avenue and a multi - family complex. To the South is West Lincoln Avenue and single- family residences. A large retaining wall is also located along the south side of West Lincoln Avenue and is a tremendous buffer for the uses behind and above it. The neighborhood in general along West Lincoln Avenue, east towards downtown Yakima, is becoming a small medical cluster. To the east are such businesses as the Central Washington Family Medicine Center, Pro - Motion Physical Therapy, Group Health and Keeler's Medical Supply. The addition of a new professional office building in this area is likely to house this type of use. The mixture of uses in the neighborhood creates a good environment for additional professional businesses to locate in this area. DOC INDEX RECEIVED NOV 1 0 2003 CITY OFYAKavIA PLANNING DIV. As part of this proposal, the property owner is willing to limit the use of the property to professional businesses, as he has indicated in past applications. This will help transition from the Small Convenience Center and its more commercial uses to professional business and ultimately residential uses. The property owner is also willing to meet the sitescreening standards of the zoning ordinance to ensure compatibility issues associated with the rezone and adjoining uses are mitigated. Traffic is initially proposed to have ingress and egress onto either North 23rd Avenue, North 24th Avenue or both. It is anticipated that through good building placement, parking lot location and point(s) of ingress and egress, the proposal will be compatible with surrounding uses. E. Is there a public need for the proposed change? The land use reclassification is needed because the existing Small Convenience Center Zoning District which lies easterly of this proposal is at or near capacity. The only vacant parcel of property in the center is not listed for sale. The property owner of this proposal has been contacted by several different professional businesses which would like to locate in this area; particularly at this site. However, proposed plans to develop the property indicate that the existing block of lots is too small for the size building and number of parking spaces that potential purchasers of the property desire. By rezoning and adding this one additional lot to the existing block of lots, it provides additional land for needed improvements of the property. One additional advantage to the rezone of this property is that it makes a straight line between the Professional Business Zone and residential zoning district. This straight line will help better define the two separate zoning districts. The current Two - family Residential Zoning District does not permit any business opportunities to occur. However, with the change in Comprehensive Plan designation, the opportunity to have business uses are now possible. The proposed reclassification would permit the existing land use to occur while appearing to expand the adjacent Small Convenience Center in an orderly manner.
