ORDINANCE NO 2004- 18
AN ORDINANCE relating to Park Rules and Regulations, updating the location of the
newly constructed senior citizen center and amending sections
1316 070 of the City of Yakima Municipal Code
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1 Section 1316 070 of the City of Yakima Municipal Code is hereby
amended to read as follows
"13.16.070 Intoxicating liquor regulated.
No intoxicating liquor of any kind or nature shall be possessed,
consumed or brought within the limits of any city park, city playground,
or any property owned, operated and / or managed by the Yakima
Greenway Foundation and its successors and assigns within the
boundaries of the city of Yakima, except for intoxicating liquor served
pursuant to a valid permit issued by the Washington State Liquor Control
Board at Sarg Hubbard Park, Sherman Park or the senior citizens Harman
eCenter at Miller Park Gailleon Park."
Section 2. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter
PASSED BY THE CITY COUNCIL, signed and approved this 13 day of April,
2004.

ITEM TITLE: Consideration of Legislation amending the Yakima Municipal Code
(YMC) with revised Rules and Regulations relating to City Parks
involving: (A) the use of alcohol dunng public rental activities, (B) the
use of motorized foot scooters, (C) the use of parking lots, and (D)
commercial advertising.

SUMMARY EXPLANATION
Staff respectfully submits for Council consideration legislation amending the Yakima
Municipal Code (YMC) with revised Park Rules and Regulations as outlined below
(A) Item A is an ordinance updating the location of the Senior Center to the newly
constructed Harman Center at Gailleon Park and transfemng the existing function of
regulating limited use of alcohol during public rental activities (pursuant to a valid
permit issued by the Washington State Liquor Control Board)
This ordinance is basically a housekeeping measure, not an expansion of service
This regulation also currently applies to Sarg Hubbard Park and Sherman Park.

STAFF RECOMMENDATION Staff respectfully requests the City Council to pass legislation
amending the Yakima Municipal Code (YMC) with revised Rules and Regulations relating to
City Parks as outlined in this Summary Explanation involving: (A) the use of alcohol during
public rental activities, (B) the use of motonzed foot scooters, (C) the use of parking lots, and
(D) commercial advertising.
BOARD /COMMISSION RECOMMENDATION The Parks and Recreation Commission has
reviewed these changes and recommends that the City Council pass legislation amending
the Yakima Municipal Code (YMC) updating park rules and regulations.
COUNCIL ACTION (A) Ordinance passed. ORDINANCE NO. 2004-18 / (B) Ordinance passed. ORDINANCE NO. 2004-19
(C) Ordinance passed. ORDINANCE NO. 2004 -20 / (D) Ordinance passed as amended to limit
advertising to within any City of Yakima ball park. ORDINANCE NO. 2004 -21

(B) Item B is an ordinance prohibiting the use of motorized foot scooters in city parks and
pathways. This does not apply to motorized vehicles specifically manufactured or
designed for the transportation of a physically or medically impaired wheelchair -
bound person. In addition, the word "bicycle" has been struck, therefore, allowing
bicycles on pathways and in parks. Finally, the word "boulevard" has been
eliminated from the ordinance.
(C) Item C is an ordinance regulating parking after hours in city parks therefore limiting
vehicles parked for a purpose other than patronizing the city park and regulating
vehicles parked during the hours of park closure Also included is a reference to the
enforcement of applicable provisions pursuant to YMC Chapter 9 60, Traffic
Enforcement.
(D) Item D is an ordinance that is also a housekeeping measure, eliminating the reference
to Dunbar Softball Field in Larson Park, and expanding authorization to advertise in
any City of Yakima park, with expressed permission from the Parks and Recreation
Manager This ordinance will allow advertising leases at the ballfields and other park
sites as deemed appropriate
