HomeMy WebLinkAbout2004-013 Appropriation - Kiwanis Park / Land Purchase ORDINANCE NO. 2004- 13 AN ORDINANCE amending the 2004 budget for the City of Yakima, and making an appropriation of $30,000 in the 331 - Parks and Recreation Capital Fund for expenditure during 2004 to provide for purchase of land for the Kiwams Park project. WHEREAS, the amount of $30,000 must be appropriated within the 331 - Parks and Recreation Capital Fund for expenditure during 2004 to provide for purchase of land for the Kiwams Park project, and WHEREAS, at the time of the adoption of the 2004 budget it could not reasonably have been foreseen that the appropriation provided for by this ordmance would be required, and the City Council declares that an emergency exists of the type contemplated by RCW 35.33 091 and that it is m the best mterests of the City to make the appropriation herein provided, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The amount of $30,000 is hereby appropriated from the Unappropriated Fund Balance m the 331 -Parks and Recreation Capital Fund to the various accounts and m the various amounts, and to provide for the purchase of land for the Kiwams Park project, all as specified in the Schedule attached hereto and mcorporated herein. Section 2. In order to properly acquire ownership interest, the attached ordinance (Item A) authorizes outside legal counsel, Lyon Weigand & Gustafson PS to negotiate for the property purchase, and authorizes the initiation of condemnation proceedings of the effected properties, if necessary The estimated cost to acquire these additional properties is about $24,000 plus legal expenses Funds for this acquisition are proposed to come from the City's Contingency Fund The attached appropriation ordinance (Item B) would authorize the transfer of resources up to $30,000 from the Contingency Fund to the Parks Capital Fund, and increases the capital expenditure budget for the Kiwanis Park project by the same amount.
