2004-063 Nob Hill Enterprises Rezone (Gary Carnevali / Frank Paganelli)
ORDINANCE NO. 2004- 63 AN ORDINANCE concerning land use regulation and planning and rezoning, with conditions, two parcels of property located in the vicinity of Nob Hill Blvd. at South 38th Ave. from Local Business (B -2) (in part) and Two - Family Residential (R -2) (in part) to Small Convenience Center (SCC) as more fully described herem, and approving, with conditions, the recommendation of the Hearing Examiner for the City of Yakima regarding the same, Gary Carnevali and Frank Paganelli d /b /a Nob Hill Enterprises, as applicants herein. WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on August 26, 2004 (the "recommendation "), recommending that the City approve the rezoning of two certain parcels of property as more fully described herein, and WHEREAS, the City Council finds that the findings of the Hearing Examiner set forth in the recommendation in response to the requirements of Yakima Municipal Code ( "YMC") § 15.23 030(E) and § 1515 040(5) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein, and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON. Section 1. The following parcels of property located in the vicinity of Nob Hill Blvd. and South 38th Ave. within the City of Yakima shall be, and the same hereby are, rezoned from Local Business (B -2) (in part) and Two - Family Residential (R -2) (in part) to Small Convenience Center (SCC) 181327 -42494 and -41519 Attached hereto and incorporated herein as Exhibit "A" are legal descriptions of said property Section 2. The findings of the Hearing Examiner's recommendation in this matter dated August 26, 2004, are hereby adopted by the City Council as its findings in Page 1 of 2 support hereof pursuant to YMC § 15.23 030(F), and are incorporated herein by this reference as if fully set forth herein. Section 3 The rezone is hereby approved subject to conditions set forth in the Hearing Examiner's recommendation, which conditions are incorporated herein by this reference as if fully set forth herein. Section 4. Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect this rezone. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor Section 5. Severability• If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The Hearing Examiner conducted a public hearing on August 12, 2004, and has issued this Recommendation within ten business days thereof. The staff report presented by Assistant Planner Jeff Peters recommended approval of the rezone application. The applicants' representative, Mr. Mark Fickes of the law firm of Velikanje, Moore and Shore, P.S., testified in favor of the application, as did one of the applicants, Mr. Gary Carnevali. A resident whose property abuts the applicants' property on the south, Ms. Clarvine Van Epps, testified in opposition to the rezone application. Her main objections related to notice of the proposal, compatibility issues and a concern about soil contamination on the applicants' property. The City's Planning & Code Administration Manager, Mr. Doug Maples, addressed that neighbor's concerns relative to the notices provided to neighbors which invited them to call Assistant Planner Jeff Peters for more information if they had any questions. He also explained that stormwater from future development will not be allowed to flow onto neighboring properties. A resident of the area, Mr. Dan Geffrey, disagreed with some of the concerns that had been raised by the neighbor and testified in favor of the application. Applicants' attorney Mark Fickes also responded to the concerns expressed by the neighbor and argued that those concerns do not justify denial of the requested rezone. Summary of Recommendation. The Hearing Examiner recommends approval of this Rezone application by the Yakima City Council, subject to conditions. Basis for Recommendation. Based upon a view of the site without anyone else present on August 11, 2004; the information contained in the staff report, exhibits, testimony and other evidence presented at an open record public hearing on August 12, 2004; and a review of both the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance; the Hearing Examiner makes the following: FINDINGS Applicants. The applicants are Gary Carnevali and Frank Paganelli d /b /a Nob Hill Enterprises, 2300 River Road #13, Yakima, WA 98902. Gary Carnevali & Frank Paganelli 2 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17-04 €4 .l Location. The location of the proposed rezone is two parcels of property on the south side of Nob Hill Boulevard at South 38 Avenue; parcel numbers 181327- 42494 and 181327- 41519. Application. This application requests a non - project rezone to the Small Convenience Center (SCC) zoning designation for a parcel abutting Nob Hill Boulevard that is presently zoned Local Business (B -2) on the northern portion and Two - Family Residential (R -2) on the southern portion. It also requests a non - project rezone from R -2 to SCC for a smaller parcel abutting the southernmost portion of the larger parcel on the east. Notices. Notices for the SEPA processes and the public hearing were provided in accordance with applicable ordinance requirements in the following manner: Mailing of notice of SEPA review and public hearing June 25, 2004 Posting of public hearing notice on property July 1, 2004 Mailing of notice of SEPA determination July 22, 2004 Publishing of SEPA determination July 22, 2004 Publishing of public hearing notice July 22, 2004 State Environmental Policy Act. A Determination of Nonsignificance (DNS) was issued by the City of Yakima on July 22, 2004, after the 20 -day comment period failed to result in any comments relative to the proposal. There was no appeal of the DNS within the 15 -day appeal period ending on August 6, 2004. Current Zoning and Land Uses. The 9.8 -acre site is primarily vacant and is currently zoned B -2 on the north abutting Nob Hill Boulevard and R -2 on the Gary Carnevali & Frank Paganelli 3 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17 -04 } south. The existing zoning and the land uses which currently exist on adjacent properties are: Location Zoning Land Use North B -2 Homes /Business South R -1 Single family homes East R -2 Single family homes/Business West R-2/B-2 Single family homesBusiness Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon criteria specified in Section 15.23.030 of the Urban Area Zoning Ordinance (UAZO): 1. The testimony at the public hearing: Mr. Maples, Mr. Benson, Mr. Peters, Mr. Fickes, Mr. Carnevali and Mr. Geffrey all testified in favor of the proposed rezone. The only person who testified in opposition to the proposed rezone, Clarvine Van Epps, expressed several concerns at the hearing. Her concern that the neighbors did not understand the information provided to them did not account for their failure to appear at the hearing if they were opposed to the proposal or had questions about it. Mr. Maples, Mr. Benson and Mr. Peters all testified that they welcome questions and frequently have answered questions from members of the public who have called about proposed projects. The wording of the notices in the record which invite the recipients to call for further information or for answers to questions they may have was also read to the neighbor. The neighbor's assertion that the property proposed for rezone was formerly USDA property which had contaminated soil from arsenic, lead, sprays and /or other chemicals is true, but Mr. Benson testified that he asked Mr. Peters to check on the condition of the property because he was aware of a potential issue of soil contamination. Mr. Peters did check with the Department of Ecology and Gary Carnevaii & Frank Paganelli 4 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17 -04 l 1lq+ learned that the property had been taken off the EPA list about two years ago and that it is no longer considered hazardous. Mr. Fiekes also indicated that there is considerable documentation of the clean up process. In any event, approval of this rezone would not change any obligations relative to contaminated soil if same is still present on any part of the site. The neighbor favored a requirement of a six - foot -high view - obscuring wall made of concrete, masonry block or similar material to absorb noise from the adjoining property as well as landscaping, buffer area and building design requirements to insure compatibility with the adjoining residential properties. The requirement of a solid wall to absorb noise was discussed at length at the hearing. The discussion centered around whether such a requirement would be appropriate if development only takes place along Nob Hill Boulevard considerably more than one hundred feet away from the residential property. Mr. Benson pointed out that any development anywhere on a parcel triggers sight screening requirements, but that they are flexible and are subject to adjustment depending upon the nature of the specific type of development that is proposed. It is likely that no specific sight screening requirements are necessary at this stage in view of the flexibility and adjustment capability built into sight screening standards to address specific uses when they become known. But the requirement of a wall to absorb noise along the boundary of a parcel abutting a residential area where development of any nature will be within one hundred feet of that boundary, unless the type of development does not create any noise for the abutting residential property, would provide some degree of comfort to the concerned neighbor and will be a recommended condition of this rezone. The other compatibility issues raised by the neighbor at the hearing and her request that the southern portion of the applicants' property that is presently zoned Gary Carnevali & Frank Paganelli 5 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17 -04 I Two - Family Residential (R -2) be denied a rezone to Small Convenience Center (SCC) overlook the fact that some R -2 uses may also pose the type of compatibility issues she raises and the fact that the way was paved for this rezone of the entire property to SCC in 1998 when the entire property was designated Neighborhood Commercial in the Comprehensive Plan. Mr. Fickes correctly noted that this rezone would remedy the current split zoning of the large parcel which has two different zoning designations and would bring the zoning of both parcels into compliance with their Comprehensive Plan designation as required. He correctly asserted that the neighbor's objections to the rezone under the circumstances presented here are outweighed by the need to rezone the property to a zoning district that implements the Comprehensive Plan's Neighborhood Commercial designation for the entire property. He also correctly pointed out that the proposed Small Convenience Center (SCC) zone implements the Comprehensive Plan's. Neighborhood Commercial designation and that the current Two - Family Residential. (R -2). zone does not implement that Plan designation. 2. The suitability' of the property for uses permitted under the proposed zoning: It has already been determined in 1998 that both parcels here should be designated as Neighborhood Commercial in the Comprehensive Plan. The uses in that designation are characterized as "small scale shopping centers, with shared parking and access, usually located on arterial streets. Neighborhood commercial centers are dispersed throughout the Urban Service Area to provide convenience shopping to the residential population." Similarly, the uses in the SCC zoning district are characterized in Subsection 15.03.030(8) of the UAZO as "small commercial centers, generally three to ten acres in size, where most of the commercial uses have located in a coordinated manner around a common parking lot. Small convenience centers serve the day -to -day convenience shopping and Gary Carnevali & Frank Paganelli 6 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 3 8 Ave. RZ #3 -04 & EC #17 -04 " i v AA s services needs of the surrounding neighborhood and should be designed to minimize the undesirable impacts of the center on the neighborhood it serves." Although the applicants have not indicated the exact intended uses of the property, they have indicated that their uses will most likely be tailored to those kinds of retail businesses described in the Comprehensive Plan Neighborhood Commercial provisions and in the zoning ordinance SCC zone provisions which are very similar. Since the Comprehensive Plan's Neighborhood Commercial designation fully supports the requested Small Convenience Center zoning classification and enumerates similar uses, the SCC uses were already found in 1998 to be suitable for the two parcels which applicants seek to have rezoned. A denial of the requested rezone would leave the smaller parcel and the southern portion of the larger parcel in a zoning district that fails to implement the Comprehensive Plan designation for the property. 3. Recommendations from interested agencies and departments: No agencies or departments opposed this rezone request. 4. The extent to which the proposed rezone is in compliance with and /or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: a) The Comprehensive Plan: The Future Land Use Map (Map III -3) designates the subject property as being suitable for Small Convenience Center development. Since the subject property underwent a Comprehensive Plan Future Land Use Map amendment in 1998 changing the designation to Neighborhood Commercial, Small Convenience Center (SCC) uses on this property would be in compliance with the Comprehensive Plan. In addition, the proposed rezone would be in compliance with Goals, Objectives and Policies of the 1997 Comprehensive Plan such as Goal Cl which is to stabilize and revitalize existing commercial Gary Carnevali & Frank Paganelli 7 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17 -04 3 } facilities in the Urban Service Area; Goal C2 which is to provide convenient shopping locations consistent with the development of the community; Objective C5 which is to require new commercial development to be landscaped and existing landscaping to be maintained, especially for buffers between residential and commercial uses; Policy G1.4 which is to ensure that new development in the urban area enhances the "quality of life" within the urban area; and Policy G2.2 which is to protect existing neighborhoods from excessive commercial and industrial encroachments through the establishment of definite neighborhood boundaries and implementation of zoning standards which minimize the impact on adjacent properties. It will be a recommended condition of this rezone that any specific development of this property be designed to comply with Policy G1.4 and Policy G2.2 by satisfying the design requirements of the ordinance provisions which implement those policies in Subsection 15.03.030(8) of the UAZO. b) The Zoning Ordinance: Subsection 15.03.030(8) of the UAZO implements the compatibility policies of the Comprehensive Plan by providing that small convenience centers permitted in the SCC zone should be designed to minimize their undesirable impacts on the neighborhood they serve. This is a continuing requirement that cannot readily be evaluated at a non - project rezone stage, but can certainly be evaluated when specific uses are proposed. This continuing compatibility requirement ensures that the fourth requirement for approval of the rezone of compliance with the policies of the Comprehensive Plan and the intent of the zoning ordinance were in fact satisfied so as to allow the rezone to be approved. 5. The adequacy of public facilities such as roads, sewer, water and other required public services: Public utilities are available and currently serve the subject property, but services may need to be extended upon further Gary Carnevali & Frank Paganelli 8 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17 -04 development. The property is in the Nob Hill Water Association service area. The site fronts on Nob Hill Boulevard which is classified as a Principal Arterial and on South 38 Avenue which is classified as a Local Access Street. The City Engineering Division indicated at the Development Services Team meeting held on June 23, 2004 that an additional fifteen feet of right -of -way will be needed along Nob Hill Boulevard and an additional five feet of right -of -way with street improvements will be needed along South 38 Avenue. The Traffic Division indicated that traffic impacts cannot be determined without specific proposed uses at this time, but that specific development will likely require SEPA review and a traffic analysis when specific uses are proposed so that any needed traffic- related mitigation measures can be required. 6. The compatibility of the proposed zone change and associated uses with neighboring land uses:. Considering the vacant condition of the subject property, this requested non - project rezone will improve the current land use situation by providing opportunities in the community for a small business center which will provide services to the surrounding neighborhood with minimal undesirable effects on the neighborhood it serves as required by Subsection 15.03.030(8) of the UAZO. 7. The public need for the proposed change: Significant land use changes within the general vicinity of this development have resulted over time in the retreat of residential development and in the increase of commercial development. Mr. Fickes indicated that there is not an overabundance of SCC zoning in the area. Since Nob Hill Boulevard has been designated a Principal Arterial street, traffic upon this major thoroughfare has increased over time so as to cause property owners to sell their property or to seek a rezone of their property to a commercial zoning classification. As this trend continues, there will probably Gary Carnevali & Frank Paganelli 9 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17 -04 /4 /4 - continue to be more commercial development, including small convenience centers, along Nob Hill Boulevard. Consistency of the Rezone with Development Regulations and the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the following factors: a) The types of land uses permitted at the site in the Small Commercial Center (SCC) zoning district would be consistent with the Comprehensive Plan's Neighborhood Commercial designation of the site. b) The density of residential development or the level of development such as units per acre or other measures of density is not affected by this application because any use permitted on the two parcels will be consistent with the density allowed by the Comprehensive. Plan and zoning ordinance. c) The availability and adequacy of infrastructure and public facilities is not an issue relative to this non-project rezone request, but SEPA and traffic concurrency issues will likely be presented when the specific type of proposed development becomes known. d) The characteristics of the development, when the exact type of development becomes known in the future, will have to comply with the SCC zoning provisions relative to minimal undesirable impacts on the neighborhood and relative to development standards, as well as any SEPA or traffic concurrency or impact provisions that may be applicable. In this way the characteristics of the development will be consistent with the goals and objectives of the Comprehensive Plan, with the intent of the zoning ordinance and with all seven of the criteria necessary for approval of the rezone to SCC. Gary Carnevali & Frank Paganelli 10 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17 -04 CONCLUSIONS 1. The Hearing Examiner has jurisdiction to issue a recommendation to the City Council regarding this rezone application. 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3. SEPA review resulted in the issuance of a Declaration of Non - significance on July 22, 2004, without any appeal being filed. 4. Adequate public services are available to satisfy the utility requirements of future SCC uses on this property, but the need for street dedication and/or improvement requirements may have to be determined through SEPA and /or traffic concurrency or impact review when the specific uses of the property become known so as to satisfy the fifth criteria required for approval of this rezone discussed above. 5. The weight of the testimony at the hearing was in favor of this rezone request. 6. The requested rezone is consistent with and fully supported by the future land use map designation for the property. 7. There have been significant changes in the land uses in the vicinity of the property under consideration that justify the proposed zoning change from B -2 and R -2 to SCC. 8. The requested rezone satisfies the seven criteria in Section 15.23.030 of the UAZO to allow for approval of the requested rezone so long as the specific type of future development will have a minimal undesirable impact on the neighborhood in accordance with Subsection 15.03.030(8) of the UAZO and will be served with adequate streets in accordance with the findings of any applicable Gary Carnevali & Frank Paganelli 11 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17 -04 7 6 SEPA analysis and /or traffic concurrency or impact review process. 9. Approval of this rezone application will benefit the public in several ways by providing a convenient source of goods and services, increased investment in the community, increased tax base, increased employment opportunities and aesthetic benefits for the area near the proposed rezone. RECOMMENDATION The Hearing Examiner recommends that this application for a Rezone of property from Local Business (B -2) and Two - Family Residential (R -2) zoning to the Small Convenience Center (SCC) zoning classification be APPROVED by the Yakima City Council, subject to the following conditions: 1) A final site plan showing existing improvements on the property will be submitted to the Planning Division within thirty days of approval of the rezone. 2) Prior to any development of the rezoned property, a lighting diagram showing the direction and intensity of on -site lighting shall be provided and approved by the City of Yakima Planning Department. 3) Prior to any development of the rezoned property, approval of a dust control plan to effectively control dust from demolition, site preparation, construction and landscaping phases shall be obtained from the Yakima Regional Clean Air Authority in accordance with Regulation 3.08A and other pertinent YRCAA regulations. 4) A six - foot -high view - obscuring wall made of concrete, masonry block or similar material to absorb noise shall be installed along the entire segment of any parcel's boundary line which abuts a residential area before development of any nature is allowed at any point within one hundred feet of that boundary line, Gary Carnevali & Frank Paganelli 12 Rezone from B -2 & R -2 to SCC S. of Nob Hill Blvd. at S. 38 Ave. RZ #3 -04 & EC #17 -04 unless an adjustment is allowed because the type of development does not create any noise for the abutting residential property. 5) Specific uses proposed for the rezoned property in the future must have a minimal undesirable impact on the neighborhood in accordance with Subsection 15.03.030(8) of the UAZO and must be served with adequate streets in accordance with the findings of any applicable SEPA and/or traffic concurrency or impact review process in order to satisfy the fourth and fifth criteria for approval of the rezone relative to compliance with the Comprehensive Plan, with the intent of the zoning ordinance and with the rezone requirement of adequate streets. This application is a non - project rezone from Local Business (B -2) and Two - Family Residential (R -2), to Small Convenience Center (SCC) coupled with an environmental review. The hearing examiner is authorized to render a recommendation to the City Council on this application. CURRENT ZONING AND LAND USE. The subject property consists of two parcels, currently zoned (B -2), Local Business & (R -2) Two - Family Residential. The subject lots are currently vacant and are approximately 9.8 acres in size. COMPREHENSIVE PLAN COMPLIANCE. The Future Land Use Map (Map III -3) designates the subject property as being suitable for Small Convenience Center development. The subject property underwent a Comprehensive Plan Future Land Use Map amendment in 1998 changing the designation to Neighborhood Commercial. Under this designation (SCC) Small Convenience Center uses are approved. The Comprehensive Plan defines Neighborhood Commercial as "Small scale shopping centers, with shared parking and access, usually located on arterial streets. Neighborhood commercial centers are dispersed throughout the Urban Service Area to provide convenience shopping to the residential population." The applicant has not indicated the exact use of the property, but indicates that their use will most likely be tailored to the kinds of businesses mentioned above therefore meeting the goals and objectives of the Comprehensive Plan. The Goals, Objectives and Policies of the 1997 Comprehensive Plan include: Goal C1: Stabilize and revitalize existing commercial facilities in the Urban Service Area. Goal C2: Provide convenient shopping locations consistent with the development of the community. Objective C5: New commercial development will be landscaped, and existing landscaping maintained, especially for buffers between residential and commercial uses. Policy G1.4: Ensure that new development in the urban area enhances the "quality of life" within the urban area and that any environmental problems that arise from such development are corrected by the developer through the enforcement of subdivision controls and regulations. Policy G2.2: Protect existing neighborhood or excessive commercial and industrial encroachments through t through the establishment of definite neighborhood boundaries and implantation of zoning standards, which minimize the impact on adjacent properties. URBAN AREA ZONING ORDINANCE. The Urban Area Zoning Ordinance defines the intent of the small convenience center district is to: a. Provide areas for commercial activities outside the central business district that meet the retail shopping and service needs of the community. 2 Gary Carnevali & Frank Paganelli d/b /a Nob Hill Enterprises Vicinity of W. Accommodate small commercial centers, generally three to ten acres in size, where most of the commercial uses have located in a coordinated manner around a common parking lot. Small convenience centers serve the day -to -day convenience shopping and services needs of the surrounding neighborhood and should designated to minimize the undesirable impacts of the center on the neighborhood it serves. Uses in this district should be retail or personal service establishments dealing directly with the consumer, the primary occupants usually being a supermarket and drug store. The current Zoning Ordinance Small Convenience Center definition and Neighborhood Commercial Comprehensive Plan definition coincide and therefore support the requested rezone. REZONE CRITERIA. Recommendations for approval of rezone applications are governed by seven criteria specified in Section 15.23.030 YMC. 1. Testimony at public hearing. Testimony at the public hearing is crucial in determining compatibility for any proposed land use change. 2. Suitability of property for proposed use. The property is well suited for the range of uses proposed by the developer as the Urban Area Comprehensive Plan's Future Land Use Map designation was amended to the Neighborhood Commercial designation in 1998. This Neighborhood Commercial designation fully supports the SCC Small Convenience Center zoning classification. 3. Recommendations from interested agencies. No agencies have expressed opposition to this rezone. 4. Compliance with the Comprehensive Plan. This rezone is in compliance with the future land use Map III -3 and land use compatibility chart III -3 of the Comprehensive Plan. 5. Adequacy of public utilities. Public utilities are available, and currently serve the subject property, however services may need to be extended upon further development. Nob Hill Blvd. a primary arterial street and S. 38 Ave provide the required access to these properties. 6. Compatibility of proposed use. Considering the vacant condition of the subject property this proposal will improve the current land use situation, providing opportunities in the community for a small business center, which will provide service to the surrounding neighborhoods and general populous. 3 Gary Carnevali & Frank Paganelli d/b /a Nob Hill Enterprises Vicinity of W. Public Need /Change in Circumstance Significant land use changes have occurred within the general vicinity of this development causing the retreat of residential development and an increase in commercial development. Since Nob Hill Blvd. has been designated a Major Arterial street, traffic upon this major thoroughfare has increased causing property owners to sell or rezone their property to that of a commercial zoning district. As this trend continues development upon Nob Hill Blvd. will eventually become mainly commercial, which can be considered compatible with the Major Arterial street designation and traffic, which frequents this area. ZONING ORDINANCE DEVELOPMENT STANDARDS. The zoning ordinance sets forth specific standards for lot size, maximum lot coverage, minimum building setbacks, parking, building height, sight screening, etc. As no project has yet to be proposed all applicable zoning ordinance standards for development can be deemed to be in compliance. However, because the rezoning of this property will permit commercial use without the ability to further condition development, the Planning Division at this stage believes that it is necessary to condition the type of site screening that will be required at this location. The subject property is bordered along the south and east by neighboring R -1 and R -2 zoned properties. For this site to be developed commercially, in compliance with Urban Area Zoning Ordinance 15.07 Sight Screening Standard (C), consisting of a six - foot -high, view - obscuring fence made of wood, masonry block or slatted chain link is required along the south and southeast property lines. Commercial development will directly affect adjoining residential properties to such an extent that a wood or slatted chain link fence cannot sufficiently reduce the impacts. UAZO Chapter 15.07.030 Determination of Sitescreening Requirements indicates that the reviewing official may adjust the sitescreening standards in this chapter by approving other sitescreening plans pursuant to the provisions of Section 15.10.020 and Section 15.10.030 (Ord. 2947§1 (part), 1986). Under the above - mentioned sections this application will require that upon development of parcel number181327 -42494 a six -foot high view - obstructing fence made of concrete, masonry block or a similar type of material is required to be installed along the South property line. Also upon development of parcel number 181327 -41519 the six foot high view - obstructing fence shall be continued with like material along the south and east property lines regardless of the use of the subject property. This material specific sitescreening requirement meets the goals and objectives of UAZO 15.10.030. This requirement will help mitigate the negative noise impacts that are likely to occur with the development of this property. In addition it will also help insure compatibility of the development with existing neighboring land uses and assure consistency with the intent and character of the zoning district involved. As well as achieve and further the expressed intent, goals, objectives, and policies of the Yakima Urban Area Comprehensive Plan and this title. 4 Gary Carnevali & Frank Paganelli d/b /a Nob Hill Enterprises Vicinity of W. Nob Hill Blvd. & S. 38 Ave. DOC. Yakima, WA INDEX UAZO RZ #3 -04 & EC #17 -04 DEVELOPMENT SERVICES TEAM (DST) REVIEW. The DST meeting for this proposal was held on June 23, 2004 at which time the following comments were submitted. City Engineer This site fronts on Nob Hill Blvd. Classified as a Principal Arterial. In accordance with Title 12, Development Standards, this classification requires 100 feet of right -of -way, 50 feet on each side of centerline. This existing right -of -way fronting this site is 35 feet wide. An additional 15 feet of right of way is required to be deeded to the City of Yakima as a part of this zone change. Nob Hill Blvd. is improved with curb, gutter and sidewalk. These improvements should remain in place at this time. This site also fronts on S. 38 Ave. classified as a Local Access Street. This classification requires 50 feet of right -of -way, 25 feet on each side of centerline. The existing right -of -way fronting this site is 20 feet. This proposal is required to deed an additional 5 feet for public right -of -way. In accordance with Title 12, Development Standards, this frontage is required to be improved with curb, gutter, 5 -foot wide sidewalk, street lights and a minimum of 20 feet of paving, 16 feet from new face of curb to centerline and 4 feet across centerline for a minimum of 20 feet of pavement fronting this site. Building Codes No comment at this time. Traffic Without a site plan that identifies proposed uses, traffic impacts can only be estimated. The Large Convenience Center zoning allows more intense development than the B -2 zone. With the entire 9.8 acres available for commercial development the building footprint can be significantly larger than within the existing B -2 zone. Therefore, development on site will likely require a SEPA checklist and traffic analysis in order to determine required street frontage improvements, driveway locations and other possible traffic related mitigation measures. Other issues of compatibility with the adjacent residential properties (such as parking lot light/glare, noise, etc) may need to be addressed at this rezone stage. Water & Irrigation This property is in the Nob Hill Water Association service area. Transportation No objections to the requested rezone. Nob Hill Blvd. & S. 38 Ave. INDEX Yakima, WA f UAZO RZ #3 -04 & EC #17 -04 • TRAFFIC CONCURRENCY. This project was determined to be exempt under the Transportation Capacity Management Ordinance. STATE ENVIRONMENTAL POLICY ACT. On July 22, 2004 the City of Yakima issued a Declaration of Non - significance for environmental checklist #14 -04. The 20 -day comment period, which precedes the issuance of this DNS, ended July 15, 2004 with no comments received during the 20 -day comment period. The 15 -day appeal period for this DNS ended on August 6, 2004. PUBLIC NOTICE. Notice for the hearing was provided in accordance with the UAZO requirements in the following manner: Mailing of notice June 25, 2004 Posting of property July 1, 2004 Legal Ad published July 22, 2004 No comments were received during the comment period. ANALYSIS. The only issue raised by this application is the appropriateness of rezoning the property from (B- 2), Local Business & (R -2) Two - Family Residential to (SCC) Small Convenience Center. This rezone is well supported by the Comprehensive Plan's Future Land Use Map, as the subject property's future land use designation is Neighborhood Commercial, this gives full support to the (SCC) Small Convenience Center zoning designation. In addition the infrastructure necessary to support the development is available and there have been numerous significant changes in the area that trend towards this Professional Business development. CONCLUSIONS. 1. The hearing examiner has jurisdiction to issue a recommendation on this application to the City Council. 2. During project review it has been determined that this request is in compliance with YMC 16.06.020(B) for making a Determination of Consistency as follows: a) The density of the development is not a factor with this application. b) Adequate public facilities are available to serve this site. 6 Gary Carnevali & Frank Paganelli d/b /a Nob Hill Enterprises Vicinity of W. This project is determined to be exempt under the Transportation Capacity Management Ordinance. 4. SEPA review resulted in the issuance of a DNS on July 22, 2004. The appeal period for this determination ended, August 6, 2004. 5. No adverse impacts have been identified from granting this approval. 6. Public Notice for this hearing was provided in accordance with zoning ordinance requirements. 7. This rezone is compatible with the future land use map III -3 and land use compatibility Figure III -3 of the Comprehensive Plan. 8. There have been significant land use changes within the area that support this move from Local Business (B -2) and Two - Family Residential (R -2), to Small Convenience Center (SCC) development. 9. An additional 15 feet of right of way along Nob Hill Blvd. is required to be deeded to the City of Yakima as a part of this zone change. 10. Five feet of right -of -way along S. 38 Ave. is required to be deeded to the City of Yakima. In addition this frontage is required to be improved with curb, gutter, 5 -foot wide sidewalk, street lights and a minimum of 20 feet of paving, 16 feet from the new face of curb to centerline and 4 feet across centerline for a minimum of 20 feet of pavement fronting this site. 11. Sitescreening standard "C" is required adjacent to residential properties. To mitigate commercial /residential compatibility issues a specific type of fencing material is being required that will provide for better buffering than wood or chain link fencing. 12. A plan to effectively control dust from demolition, site preparation, construction and landscaping phases, must be submitted and approved per §3.07.F, F and H of YRCAA Regulations upon development. 13. A lighting diagram showing the direction and intensity of on site lighting shall be provided and approved by the City of Yakima Planning Department upon development. 14. In addition this frontage is required to be improved with curb, gutter, 5 -foot wide sidewalk, street lights and a minimum of 20 feet of paving, 16 feet from the new face of curb to centerline and 4 feet across centerline for a minimum of 20 feet of pavement fronting this site. 3. It is very difficult to evaluate the nature and extend of traffic or other potential compatibility problems that may be created as a result of a Non - Project rezone. However, for evaluation purposes, it is helpful to compare the 9.8 -acre site to other similar properties within the Yakima Urban Area. For example, the Shopko development at 5800 West Summitview Avenue is zoned LCC and is located on a 8.47 acre parcel with a 0.99 acre Fast Food Out - parcel. Shopko is a Free - Standing Discount Store of approximately 97,200 square feet (ITE Trip Generation Land Use 813) that is expected to generate an average of 3.87 PM Peak Hour vehicle trips per 1,000 square foot of floor area (expected PM Peak Hour trip generation of 376 trips). Additionally the drive - through Burger King on the out - parcel is estimated to generate 159 PM Peak Hour trips, for a combined total of approximately 535 PM Peak Hour trips. Existing Zoning Impacts: The existing zoning of mixed commercial and moderate density residential would generate considerably less traffic (about 245 Total combined PM Peak Hour trips). The 4.5 acres in R -2 may be expected to develop at a moderate density, averaging 20 PM Peak Hour vehicle trips. • [If developed as Single Family detached homes (ITE Land Use #210), the trip generation would be approximately 12.33 PM Peak Hour trips. • If developed as a Mobile Home Park (ITE Land Use #240), the trip generation would be approximately 20.1 PM Peak Hour trips. • A Planned Development (ITE Land Use #270) would generate approximately 18.22 PM Peak Hour Trips]. The existing 5.3 acres in B -2, Local Business may be expected to develop as a Small Retail Center, similar to the size of Westpark Shopping Center (at 40 & Summitview, approximately 64,300 s.f of floor area) that would be expected to generate 225 PM Peak Hour trips (ITE Land Use #814). Summary of Impacts: As outlined above, if th,e rezone is approved, traffic generated from the site may be double that from the existing zoning. However, without a site plan that identifies proposed uses, traffic impacts can only be estimated. The Large Convenience Center zoning allows more intense development than the B -2 zone. With DOC. INDEX the entire 9.8 acres available for commercial development the building footprint can be significantly larger than within the existing B -2 zone. Therefore, development on site will likely require a SEPA checklist and traffic analysis in order to determine required street frontage improvements, drive -way locations and other possible traffic related mitigation measures. A construction dust plan must be filed with, and approved by, YRCAA. Property Description, Zoning and Land Use Designation The property to be rezoned ( "Property ") consists of Yakima County Assessor's Tax Parcels 18132742494 ( "Parcel A ") and 18132741519 ( "Parcel B "). Parcel A is 8.67 acres in size. The northern portion of Parcel A, consisting of approximately six acres, is zoned Local Business District (B -2). The remainder of Parcel A is currently zoned Two - family Residential District (R -2). Parcel B, which is located immediately east of Parcel A, is approximately one acre in size. Parcel B is zoned R -2 and is contiguous to the portion of Parcel A that is currently zoned R -2. Parcel A has approximately 626 feet of frontage on Nob Hill Blvd. This parcel is primarily vacant land, with present use limited to a contractor's office and garage and a drive -up coffee establishment located at the extreme northwest corner of the parcel. The properties east and west of Parcel A are developed for commercial purposes and front on Nob Hill Boulevard. Parcel B is vacant land. The Property is designated "Neighborhood Commercial" on the Future Land Use Map in the Yakima Urban Area Comprehensive Plan ( "Plan "). The Property is within the Yakima Urban Service Area. Applicant's Proposed Zoning Applicant requests that Parcels A and B be rezoned to Small Convenience Center ( "SCC "). The following statement of purpose and intent for the SCC District is provided in the City's Urban Area Zoning Ordinance ( "UAZO ") at YMC 15.03030(8): The purpose and intent of the small convenience center district is to: a. Provide areas for commercial activities outside the central business district that meet the retail shopping and service needs of the community; and b. Accommodate small commercial centers, generally three to ten acres in size, where most of the commercial uses have located in a coordinated manner around a common parking lot. Responses to Specific Questions Posed in Rezone Application A) Applicant's proposed zoning is suitable for the Property and consistent with the purposes of the SCC District. The Property is within the Urban Service Area and vacant, so development of the Property for uses consistent with Applicant's proposed zoning should not present any technical or service issues. Applicant's proposed zoning should not present any compatibility problems as the Property is designated "Neighborhood Commercial" and therefore planned for commercial uses. B) Given the Property's "Neighborhood Commercial" designation, Applicant's proposed zoning is consistent with the Future Land Use Map contained in the Plan, as amended in 1998. Properties identified as "Neighborhood Commercial" are designated for "(s)mall scale shopping centers, with shared parking and access, usually located on arterial street [sic] ...," Plan, 1998 Amendments, p. 5, which uses are consistent with the purposes and intent of the SCC District, as set forth in the UAZO. Further, the SCC district is identified as fully implementing the "Neighborhood Commercial" land use designation under the 1998 Amendments to the Plan. Plan, 1998 Amendments, Figure III -3. As noted above, areas of Parcel A and all of Parcel B are currently zoned R -2. By reference to Figure III -3 of the 1998 Plan Amendments, R -2 zoning does not fully implement the "Neighborhood Commercial" land use designation. Current land use law and the State's Growth Management Act, RCW 36.70A ( "GMA "), require that zoning designations implement and are consistent with the City's Plan. Current R -2 zoning does not implement and is not consistent with the Plan. C) Because the Property is within the Plan's designated Urban Service Area, public facilities adequate to support all uses allowed within the SCC zone are assumed to be available or readily accessible. Thus, no mitigation is proposed to address shortfalls in public services resulting from the proposal. D) The Property is located along Nob Hill Boulevard, which the City recognizes as a major arterial leading to the City's Central Business District. In approving a rezone of Congdon Orchards' property two miles west of the Property to the CBDS District, the City has contractually and legally supported substantially more intensive commercial rezoning than that requested by Applicant on property much farther from the City's Central Business District. SCC zoning on the Property should not present compatibility problems because the properties east and west of that Property on Nob Hill Boulevard are developed for commercial uses. Further, because the Property is already planned for the various commercial uses associated with the "Neighborhood Commercial" land use designation, any compatibility issues associated with Page 2 of 3 DOC. INDEX 3 � Applicant's proposed zoning change were impliedly considered and addressed in the process that resulted in the Property's present land use designation. To the extent that compatibility issues are recognized in the approval process, it is anticipated that such issues can be mitigated at the project stage through compliance with the City's general development and site screening standards. E) The public need for this proposed change is greater than any public need that supported the City's rezone of the Congdon property to CBDS. The Property is closer to the Central Business District than the Congdon property, and the Property is bordered by commercial properties. There is an extremely limited supply of vacant, SCC -zoned property in the entire Urban Area. Rezoning of the Property will benefit the public by eliminating the split parcel zoning that impedes development of the Property in a manner consistent with its Plan's designation and by creating consistency between the Property's zoning and the changed circumstances around the Property since its original zoning. Nob Hill Blvd. & S. 38 Ave Parcel Nos. 18132742494 & 41519 Your application was initially submitted on May 26, 2004 and has been determined to be complete for further processing June 23, 2004. Continued processing of your request will include, but is not limited to, the following actions: 1. A Notice of Application is to be sent to all property owners within 500 feet of your site. This notice will include a request for public comments during a 20 -day comment period as is required by the City of Yakima. Notice of Application is scheduled to be issued on June 25, 2004 and the comment period will end on July 15, 2004. 2. Following the comment period a SEPA Threshold determination will be issued after July 15, 2004. This is followed by a 15 day SEPA Appeal period that ends approximately July 31, 2004. If not appealed a staff report will be prepared by the Planning Division, which will include a recommendation to the hearing examiner as well as any recommended conditions of approval. 3. An open record public hearing is scheduled before the City of Yakima's hearing examiner for Thursday, August 12, 2004 at 9:OOAM in the City Council's hearing chamber at City Hall. The hearing examiner will issue a recommendation to the City Council. 4. Following the receipt of the Hearing Examiner's recommendations, a closed record public hearing will be scheduled for a City Council decision of your Rezone. I have lived in the neighborhood for 28 years. I am here to preserve the integrity of our neighborhood and to retain the responsibility of our neighborhood as a good citizen neighborhood for the City of Yakima, Especially since we have recently been annexed in to City limits Our neighborhood consists of elderly retired and very young families. In talking to the neighbors they either don't understand the language -1 don't understand the language or they feel it is useless to fight "City Hall" in light of the recent events with the Congdon rezone. In short - it just doesn't seem worth the energy. 2. I understand the intensification of use. I understand the use of a re -zone to increase the value of the property for a possible sale at a later date. I understand that there could be more possible uses of this property than under the current zoning 3. This is a non project re -zone -how can I support or object to the property if I don't know what is to happen ? How can I possibly judge the capabilities of the property and its effect on my property if the developers are not forthright with their plans ? I have to assume the "worst case" scenario. 4. A few years ago these same gentlemen came forward with a re -zone application - it was denied - why is this application accepted again and why was the request denied the first time ? 5. Why wasn't the staff proposal /recommendation study sent out to all the affected neighborhood ? I had to ask that it be e mailed to get the information - most citizens simply don't know that the document exists. 6. Soil conditions - this is the old USDA experimental fields - has the fields been checked for "hazardous" west ? If so - why weren't residents informed of such ? and the results ? ii, 7. It is obvious that the developers are represented by a lawyer ? In fairness to the citizens at what point will my lawyer be given the same option ? Paperwork is presented with a lawyer name. The fairness of "Iawyerese" against "John Q Citizen" is not acceptable and insulting to your citizens 8. I am not understanding the references to Congdon in this proposal ? What has that fiasco have to do this property rezone ? 9. I am not understanding some of descriptions of parcel a & b - is the area in parcel a <along Nob Hill> zoned B -2 or zoned R -2 ? 10.
