AN ORDINANCE concerning land use regulation and comprehensive planning,
amending the Future Land Use Map of the Yakima Urban Area
Comprehensive Plan, changing the classification of the property
located at 1005 Washington Avenue (Parcel #181336- 24016) on the
Future Land Use Map from Medium Density Residential to
Neighborhood Commercial, changing the classification of the
property located at 3805 Tieton Drive (Parcel #181322 - 43023) on
the Future Land Use Map from Low Density Residential to
Neighborhood Commercial, changing the classification of the
property located at 1814 South 10th Avenue (Parcel #181336- 24014)
on the Future Land Use Map from Medium Density Residential to
Neighborhood Commercial, changing the classification of the
property located at 1407 -1409 South 16th Street (Parcel #191329-
31573 and #191329 - 31574) on the Future Land Use Map from
Medium Density Residential to Arterial Commercial, and
changing the classification of the property located at 5301 Tieton
Drive (Parcel #181321 - 43005) on the Future Land Use Map from
Low Density Residential to High Density Residential.
WHEREAS, the Washington State Growth Management Act (GMA) requires
counties and cities within them to prepare long -range comprehensive plans pursuant to
RCW Ch. 36 70A and related chapters, and
WHEREAS, RCW 36 70A.130 provides for continuing review and evaluation of
comprehensive plans and development regulations at least every five years and for the
revision or amendments to such plans not more than once a year but at least once every
five years, with certain exceptions, and
WHEREAS, RCW 36 70A.470 requires that counties and cities planning under
RCW § 36.70A.040 include in their development regulations a procedure for any
interested person, including applicants, citizens, hearing examiners, and staff of other
agencies, to suggest Comprehensive Plan or development regulation amendments, and
WHEREAS, RCW Ch. 36 70A further requires that the suggested amendments be
docketed and considered not more than once a year, consistent with the provisions of
RCW 36 70A.130, and
WHEREAS, on March 18, 2003, the City Council enacted YMC Chapter 16.10 to
provide procedures and criteria for amending and updating the Yakima Urban Area
Comprehensive Plan, and
WHEREAS, by application dated April 19, 2004, Hordan Planning Services, on
behalf of property owner Ron Valicoff, requested that the classification of the property

located at 1005 Washington Avenue (Parcel #181336- 24016) be changed from Medium
Density Residential to Neighborhood Commercial on the Future Land Use Map of the
Yakima Urban Area Comprehensive Plan (hereinafter "CPA #1 -04 "), and
WHEREAS, by application dated April 26, 2004, David B Trujillo requested that
the classification of the property located at 3805 Tieton Drive (Parcel #181322 - 43023) be
changed from Low Density Residential to Neighborhood Commercial on the Future
Land Use Map of the Yakima Urban Area Comprehensive Plan (hereinafter "CPA #3-
04"), and
WHEREAS, by application dated April 26, 2004, James Noel requested that the
classification of the property located at 1814 South 10th Avenue (Parcel #181336- 24014) be
changed from Medium Density Residential to Neighborhood Commercial on the Future
Land Use Map of the Yakima Urban Area Comprehensive Plan (hereinafter "CPA #4-
04"), and
WHEREAS, by application dated April 30, 2004, Hordan Planning Services, on
behalf of property owner Francisco Luna, requested that the classification of the
property located at 1407 -1409 South 16th Street (Parcel #191329 -31573 and #191329- 31574)
be changed from Medium Density Residential to Arterial Commercial on the Future
Land Use Map of the Yakima Urban Area Comprehensive Plan (hereinafter "CPA #6-
04"), and
WHEREAS, by application dated April 30, 2004, John Probst, on behalf of
property owner Catholic Bishop of Yakima Corporation, requested that the classification
of the property located at 5301 Tieton Drive (Parcel #181321 - 43005) be changed from
Low Density Residential to High Density Residential on the Future Land Use Map of the
Yakima Urban Area Comprehensive Plan (hereinafter "CPA #9 -04) and
WHEREAS, in accordance with YMC Chapter 16.10, the Regional Planning
Commission held appropriate meetings and hearings to review and consider the
requested Comprehensive Plan Amendments, and
WHEREAS, pursuant to YMC 16 10 080 and the approval criteria set forth in
YMC 1610 040, the Regional Planning Commission made a recommendation to a joint
meeting of the City Council and Yakima County Commissioners that the requested
Comprehensive Plan Amendments described above be approved, and
WHEREAS, pursuant to YMC 1610 090, on February 15, 2005, a public hearing
regarding the requested Comprehensive Plan Amendments described above was held
before a joint meeting of the City Council and Yakima County Commissioners, and City
Council directed City staff to prepare appropriate legislation to approve the requested
Comprehensive Plan Amendments, and
WHEREAS, it is in the best interests of the City to enact the following to approve
tle requested Comprehensive Plan Amendments described above, now, therefore,

BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1. Subject to the specific terms of this ordinance, the Yakima City
Council adopts the December 28, 2004, findings, conclusions and recommendations of
the Regional Planning Commission for CPA #1 -04, CPA #3 -04, CPA #4 -04, CPA #6 -04,
and CPA #9 -04. A copy of said Recommendations is attached as Exhibit A and
incorporated herein by this reference.
Section 2. Regarding CPA #1 -04 and the subject property located at 1005
Washington Avenue, Yakima County Assessor's Parcel #181336- 24016, the legal
description of which is attached to this ordinance as Exhibit B, which is incorporated by
reference in this ordinance, the City Council finds formally that, for the uses described
by the Applicant:
a. The subject property is suitable to be classified as Neighborhood Commercial on
the Future Land Use Map of the Yakima Urban Area Comprehensive Plan,
b Circumstances have changed since the property was classified as Medium
Density Residential that make the requested Comprehensive Plan Amendment
appropriate,
c. The requested Comprehensive Plan Amendment is consistent with and complies
with.
• The requirements and considerations set forth in Yakima Municipal Code
Chapter 1610,
• The goals and policies of the Yakima Urban Area Comprehensive Plan,
• The Growth Management Act, RCW Chapter 37 70A, and the Yakima County
Wide Planning Policy (CWPP),
d. The cumulative impacts of all Comprehensive Plan Amendments have been
considered. The requested Comprehensive Plan Amendment is consistent with
existing and proposed uses on properties that are immediately adjacent; and
e The requested Comprehensive Plan Amendment will not pose a significant
adverse environmental impact.
Section 3 Regarding CPA #3 -04 and the subject property located at 3805
Tieton Drive, Yakima County Assessor's Parcel #181322 - 43023, the legal description of
which is attached to this ordinance as Exhibit C, which is incorporated by reference in
this ordinance, the City Council finds formally that, for the uses described by the
Applicant:
a. The subject property is suitable to be classified as Neighborhood Commercial on
the Future Land Use Map of the Yakima Urban Area Comprehensive Plan,
b Circumstances have changed since the property was classified as Low Density
Residential which now make the requested Comprehensive Plan Amendment
appropriate,

c. The requested Comprehensive Plan Amendment is consistent with and complies
with.
• The requirements and considerations set forth in Yakima Municipal Code
Chapter 1610,
• The goals and policies of the Yakima Urban Area Comprehensive Plan,
• The Growth Management Act, RCW Chapter 37 70A, and the Yakima County
Wide Planning Policy (CWPP),
d. The cumulative impacts of all Comprehensive Plan Amendments have been
considered. The requested Comprehensive Plan Amendment and the
redesignation of the property can reasonably be considered a part of the current
professional office cluster around the South 40th Avenue /Tieton Drive
intersection and will have no negative cumulative impact; and
e The requested Comprehensive Plan Amendment will not pose a significant
adverse environmental impact.
Section 4. Regarding CPA #4 -04 and the subject property located at 1814
South 10th Avenue, Yakima County Assessor's Parcel #181336- 24014, the legal
description of which is attached to this ordinance as Exhibit D, which is incorporated by
reference in this ordinance, the City Council finds formally that, for the uses described
by the Applicant:
a. The subject property is suitable to be classified as Neighborhood Commercial on
the Future Land Use Map of the Yakima Urban Area Comprehensive Plan,
b Circumstances have changed since the property was classified as Medium
Density Residential which now make the requested Comprehensive Plan
Amendment appropriate,
c The requested Comprehensive Plan Amendment is consistent with and complies
with.
• The requirements and considerations set forth in Yakima Municipal Code
Chapter 16.10,
• The goals and pohcies of the Yakima Urban Area Comprehensive Plan,
• The Growth Management Act, RCW Chapter 37 70A, and the Yakima County
Wide Planning Policy (CWPP),
d. The cumulative impacts of all Comprehensive Plan Amendments have been
considered. The requested Comprehensive Plan Amendment is consistent with
existing and proposed uses on properties that are immediately adjacent; and
e The requested Comprehensive Plan Amendment will not pose a significant
adverse environmental impact.
Section 5. Regarding CPA #6 -04 and the subject property located at 1407 -1409
South 16th Street, Yakima County Assessor's Parcel #191329 -31573 and #191329 - 31574,

the legal description of which is attached to this ordinance as Exhibit E, which is
incorporated by reference in this ordinance, the City Council finds formally that, for the
uses described by the Applicant:
a. The subject property is suitable to be classified as Arterial Commercial on the
Future Land Use Map of the Yakima Urban Area Comprehensive Plan,
b Circumstances have changed since the property was classified as Medium
Density Residential which now make the requested Comprehensive Plan
Amendment appropriate,
c. The requested Comprehensive Plan Amendment is consistent with and complies
with.
• The requirements and considerations set forth in Yakima Municipal Code
Chapter 16 10,
• The goals and pohcies of the Yakima Urban Area Comprehensive Plan,
• The Growth Management Act, RCW Chapter 37 70A, and the Yakima County
Wide Planning Policy (CWPP),
d. The cumulative impacts of all Comprehensive Plan Amendments have been
considered The requested Comprehensive Plan Amendment is a freestanding
request and is unrelated to the other requests, and
e The requested Comprehensive Plan Amendment will not pose a significant
adverse environmental impact.
Section 6. Regarding CPA #9 -04 and the subject property of 5 77 acres more or
less located at 5301 Tieton Drive, Yakima County Assessor's Parcel #181321- 43005, the
legal description of which is attached to this ordinance as Exhibit F, which is
incorporated by reference in this ordinance, the City Council finds formally that, for the
uses described by the Applicant:
a. The subject property is suitable to be classified as High Density Residential on the
Future Land Use Map of the Yakima Urban Area Comprehensive Plan,
b Circumstances have changed since the property was classified as Low Density
Residential which now make the requested Comprehensive Plan Amendment
appropriate,
c. The requested Comprehensive Plan Amendment is consistent with and complies
with.
• The requirements and considerations set forth in Yakima Municipal Code
Chapter 16.10,
• The goals and policies of the Yakima Urban Area Comprehensive Plan,
• The Growth Management Act, RCW Chapter 37 70A, and the Yakima County
Wide Planning Policy (CWPP),

d. The cumulative impacts of all Comprehensive Plan Amendments have been
considered. The requested Comprehensive Plan Amendment does not affect and
is not affected by the other requests, and
e. The requested Comprehensive Plan Amendment will not pose a significant
adverse environmental impact.
Section 7 The Official Future Land Use Map of the Yakima Urban Area
Comprehensive Plan shall be amended or modified to reclassify the subject property of
CPA #1 -04 from Medium Density Residential to Neighborhood Commercial, reclassify
the subject property of CPA #3 -04 from Low Density Residential to Neighborhood
Commercial, reclassify the subject property of CPA #4 -04 from Medium Density
Residential to Neighborhood Commercial, reclassify the subject property of CPA #6 -04
from Medium Density Residential to Arterial Commercial, and reclassify the subject
property of CPA #9 -04 from Low Density Residential to High Density Residential.
Section 8. If any section, subsection, paragraph, sentence, clause or phrase of
this ordinance is declared invalid or unconstitutional for any reason, such decision shall
not affect the validity of the remaining portions of this ordinance.
Section 9 The City Clerk is hereby authorized and directed to file a certified
copy of this ordinance with the Yakima County Auditor
Section 10. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter
PASSED BY THE CITY COUNCIL at a regular meeting and signed and approved

COMPREHENSIVE PLAN AMENDMENTS
DECEMBER 28, 2004
WHEREAS
The Yakima Urban Area Comprehensive Plan was adopted by the City and County in April 1997
The Washington Growth Management Act and local ordinances provide a process for the annual
review of amendments to the Plan as requested by citizens, property owners and/or local
government
For the 2004 amendment review process, eight requests were made for possible amendments to
the Future Land Use Map and one request was submitted for a Comprehensive Plan Text -
Amendment
The Yakima Urban Area Regional Planning Commission is responsible for the review of each
request and for recommending approval, modification or denial of each request
Public hearings and Commission discussions were conducted by the RPC on said requests on
May 20th, July 15th, July 22nd and August 16` 2004
The RPC concluded its consideration of five of the eight remaining (one application was
withdrawn) amendments on August 16, 2004, the remaining three applications having been
continued pending further review
Now THEREFORE, THE YAKIMA URBAN AREA REGIONAL PLANNING COMMISSION PRESENTS
THE FOLLOWING FINDINGS AND RECOMMENDATIONS TO THE BOARD OF YAKIMA COUNTY
COMMISSIONERS AND YAKIMA CITY COUNCIL.
SUMMARY OF RECOMMENDATION FOR CPA # 1 -04

Description of Request:
The applicant requests a change in the Future Land Use Map from Medium Density Residential
to Neighborhood Commercial. Future zoning would be B -2, if the amendment is approved.
Findings
This request involves a minor adjustment to a map boundary, which provides for a more logical
development of the site.
Given its small size (0.35 acres), it will have no negative impacts on the integnty of the
comprehensive plan
Conclusions
The amendment request complies with the goals and policies of the Yakima Urban Area
Comprehensive Plan.
The amendment is minor in nature and will facilitate a manor expansion to the applicant's
business
No adverse impacts have been identified by this amendment request.

Recommendations
The Regional Planning Commission recommends the Approval of this requested amendment.
Description of Request.
The Applicant requests a change in the classification of this property from Low Density
Residential to Neighborhood Commercial. The current designation was adopted as part of the
1997 Plan adoption. There have been no recent amendment requests affecting this property or
other properties in the vicinity Future zoning would be B -2, if the amendment is approved.
Findings.
This request involves a minor adjustment to a map boundary, which provides for a more logical
development of the site
Given its small size (0.27 acres), it will have no negative impacts on the integrity of the
comprehensive plan.
Conclusions
The amendment request complies with the goals and policies of the Yakima Urban Area
Comprehensive Plan.
The proposed use of the Trujillo home is similar to the existing use.
No adverse impacts have been identified by this amendment request.
At the time of rezoning, the buffenng requirements between the residential and B -1 zone should
be reaffirmed and required of the applicant. Future requests for extension of the professional
office zone or other commercial activity should be restncted to ensure protection of residential
properties adjacent to South 37 Avenue and to ensure that continuous strip commercial
development does not occur easterly along Tieton Drive

to Neighborhood Commercial. Future zoning would be B -2, if the amendment is approved.
Findings
This request involves a manor adjustment to a map boundary, which provides for a more logical
development of the site.
Given its small size (0.50 acres), it will have no negative impacts on the integrity of the
comprehensive plan.
Conclusions:
The amendment request complies with the goals and policies of the Yakima Urban Area
Comprehensive Plan
The amendment is minor in nature and will facilitate a minor expansion to the applicant's
business.
No adverse impacts have been identified by this amendment request.
At the time of rezoning, the buffering requirements between the residential and B -2 zone should
be reaffirmed and required of the applicant. Future requests for extension of the local business
zone or other commercial activity should be restncted to ensure protection of residential
properties adjacent to the north.

This request involves a minor adjustment to a map boundary, which provides for a more logical
development of the site
Given its small size (0.55 acres), it will have no negative impacts on the integrity of the
comprehensive plan.
Conclusions.
The amendment is minor in nature
No adverse impacts have been identified by this amendment request.
The amended land use boundanes would be a logical extension of existing commercial
boundaries

Description of Request:
The applicant requests a change in the Future Land Use Map from Low Density
Residential to High Density Residential. Future rezoning to R -3 would be possible if this
amendment is approved. The current zoning is R -1.

Recommendations
Findings.
The Holy Family request is necessitated by plans for a new "Se ction 202" housing project
proposed for the westerly portion of the site. The project would provide housing for low - income
senior citizens.
Conclusions.
1 The amendment request complies with the goals and policies of the Yakima Urban Area
Comprehensive Plan.
2. Senior housing and affordable housing is supported in the community
3 The Holy Family amendment request is in line with the UACP polices allowing flexible
approaches to implementing the housing and neighborhood protection policies of the
comprehensive plan.
4 Additional environmental and development reviews will be required as more specific designs
are brought forward.
5 The overall Holy Family campus must have a master plan prior to additional Land Use Map
amendments occurring beyond the current request.
6 No adverse impacts have been identified by this amendment request.

On February 15, 2005, following a point City /County hearing, you voted to accept the Regional
Planning Commission's findings and recommendations concerning the 2004 Comprehensive
Plan Amendment requests. The ordinance that will affect these changes has been prepared and
you are now being requested to adopt it.

BOARD /COMMISSION RECOMMENDATION The RPC recommended the approval of five
of the nine comprehensive plan amendments submitted in 2004 Of the remaining four requests
one was withdrawn, and three had not yet completed the environmental review process.
