AN ORDINANCE relating to public safety and morals, amending Subsection 6 20 180(C)
of the City of Yakima Municipal Code to properly identify the penalty for
leash law violations involving potentially dangerous /dangerous dogs and
to designate separate offense citations for multiple violations of
possession of dangerous dog
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1 Subsection 6 20 180(C) of the City of Yakima Municipal Code is hereby
amended to read as follows
"6.20.180 Civil infractions.
C Civil infraction penalties shall be assessed according to the following schedule
Violation of Section or Subsection of City of Yakima Municipal Code Penalty
6.20 010A Leash law $250 00
6 20 010GB Leash law (Potentially $500 00
Dangerous /Dangerous Dogs)
6 20 020 Howling /barking dogs $250 00
6 20 040 Female dogs in heat $250 00
6 20 050 Damage by dogs $250 00
6 20 060 Menacing dogs $250 00
6 20 070 Nauseous keeping of dogs $250 00
6 20 180(D) Possession of dangerous /potentially
dangerous dogs
1st Incident $250 00
2nd Incident $350 00
Lai 3rd Incident $500 00"
Section 2 This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter

ITEM TITLE. Ordinance amending Subsection 6.20 180(C) of the City of Yakima Municipal Code to
associate the monetary penalty for leash law violations involving potentially dangerous /dangerous
dogs with the correct ordinance section (6.20 010B rather than C) and to separately identify offense
penalties for multiple violations of the possession of dangerous dog ordinance (6.20 180(D)(1) for first
incident, (2) for second incident and (3) for third and subsequent incidents)

SUMMARY EXPLANATION Subsection 6.20 180(C) of the City of Yakima Municipal Code sets forth
the penalties for violations of the animal control ordinances The animal control ordinances were
recently updated, and as a result of the updates the penalty for a leash law violation regarding
potentially dangerous dogs must be amended to associate with the amended subsection of 6.20 010B
rather than the pre- amended subsection C Further, subsection 6.20 180(D) provides for separate
penalty amounts for first, second and third offenses of leash law violations involving potentially
dangerous /dangerous No separate offense designations were previously assigned for the separate
violation penalty levels, making it difficult for the Municipal Court personnel to determine what specific
charge was assigned to a citation This ordinance amends Subsection 6.20 180(C) and assigns
separate offense citations for first, second and third offenses, thereby making it clear to Municipal
Court personnel how to enter the citation into the court computer These are technical amendments to
correct an erroneous violation reference and to clarify for court personnel what level of violation has
been charged There is no cost associated with this requested amendment.
