AN ORDINANCE relating to building codes and related regulation, adopting the
revised Washington State Energy Code, amending Section
11 05 010 of Chapter 11 05 (Energy Code) of the Yakima
Municipal Code, and repealing sections 11 05 020,11 05 030, and
11 05 040 of Chapter 11 05 of the Yakima Municipal Code
WHEREAS, RCW Chapter 19.27 establishes the State Building Code Council and
mandates that the State Building Code Council adopt and maintain certain codes, which
are known as the State Building Code, and
WHEREAS, RCW 19.27A.020 mandated that no later than January 1, 1991, the
State Building Code Council adopt a Washington State Energy Code as part of the State
Building Code, and
WHEREAS, effective January 1, 1991, the State Building Code Council adopted a
Washington State Energy Code which is codified in WAC Chapter 51 -11, and
WHEREAS, effective July 1, 2004, the State Building Code Council adopted a
revised version of the State Energy Code which is codified in WAC Chapter 51 -11, and
WHEREAS, it is in the best interest of the City of Yakima to adopt said revised
State Energy Code, now therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA, WASHINGTON•
Section 1. Sections 11 05 020, 11 05 030, and 11 05 040 of Chapter 11 05 of the
Yakima Municipal Code are hereby repealed.
Section 2. Section 11 05 010 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"11.05.010 Adoption of the Washington State Energy Code.
The Washington State Energy Code adopted by a Washington State
Building Code Council, effective July 1, 1991, and as subsequently revised
and amended, codified as Chapter 51 -11 of the Washington

Administrative Code of which not less than one copy has been and now is
on file in the office of the city clerk code administration and planning
manager of the city of Yakima, is adopted and incorporated as fully as if it
were set out in full herein as the energy code of the city of Yakima, except
: - - - - - - - - : - ., and the provisions and regulations of the city of
Yakima and the several sections and numbers herein shall constitute, and
may be referred to as, the numbers of this chapter "
Section 3. If any section, subsection, paragraph, sentence, clause or phrase of
this ordinance, or any provision of the Yakima Municipal Code established by this
ordinance, is declared invalid or unconstitutional for any reason, such decision shall not
affect the validity of the remaining portions of this ordinance or other provisions of the
Yakima Municipal Code established by this ordinance
Section 4. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter
PASSED BY THE CITY COUNCIL at a regular meeting and signed and
approved this 15th day of February, 2005

Code, 2003 International Mechanical Code, 2003 Washington State Energy

SUMMARY EXPLANATION
This ordinance would adopt the State International Building WAC 51 -50, Mechanical WAC
51 -52, Residential WAC 51 -51 and Washington State Energy WAC 51 -11 Codes by
reference as provided by statutory authority pursuant to RCW Chapter 19 27
Before the City Council at this time is the adoption and local amendments to the
International Building, Residential, Mechanical, and Washington State Energy Code
Early in 2004, an adhoc Community and Economic Development Committee of
professionals from the development community and City staff, began meeting to discuss
local amendments to several of the construction codes used in the City of Yakima Again
the local group met February 8, 2005 to review the attached proposed amendments
The International family of codes has been adopted throughout the United States as a
common code for the entire country This provides consistency for the construction
industry Within the International codes there is more flexibility while continuing to provide
safety to the citizens in Yakima
Again the group was successful to keeping the local amendments to a minimum, while
addressing climatic weather conditions or conditions unique to the local area We plan to
bring the remaining 2003 International Codes, Fire, Plumbing, and Existing Building to
Council for consideration within the next 30 to 60 days
