AN ORDINANCE relating to building codes and related regulation, adopting, with
certain amendments, the International Mechanical Code as the
City of Yakima Mechanical Code, repealing sections 11.32.030,
11.32.040, 11.32.050, 11.32.060, 11.32.070, 11.32.080, 11.32.090,
11.32.100, 11.32.110, and 11.32.120 of Chapter 11.32 of the
Yakima Municipal Code, amending sections 11.32.010 and
11.32.020 of Chapter 11.32 of the Yakima Municipal Code, and
adding new sections 11.32.1011, 11.32.101.2.2, 11.32.105.2.1,
11.32.106 4, 11.32.106 4.7, 11.32.106 5.2, 11.32.109, 11.32.202,
11.32.401.5.2, 11.32.502.7.3 6, and 11.32.807 to Chapter 11.32 of
the Yakima Municipal Code
WHEREAS, RCW Chapter 19.27 establishes the State Building Code Council and
mandates that the State Building Code Council adopt and maintain certain codes
including a building code, which, pursuant to RCW Chapter 19.27, are known as the
State Building Code, and
WHEREAS, pursuant to RCW Chapter 19.27 and WAC 51 -52 -003, the State
Building Code Council has, with certain additions, deletions, and exceptions, adopted
by reference, as part of the State Building Code, the 2003 edition of the International
Mechanical Code as published by the International Code Council, Inc , and
WHEREAS, pursuant to RCW 19.27 031, subject to certain additions, deletions
and exceptions provided in WAC Chapter 51 -52, the 2003 edition of the International
Mechanical Code as published by the International Code Council, Inc., shall be in effect
as of July 1, 2004, in the City of Yakima and supercedes earlier provisions of Chapter
11.32 of the Yakima Municipal Code that were based upon the 1997 edition of the
Uniform Mechanical Code, and
WHEREAS, pursuant to RCW 19.27 040, the City of Yakima is authorized to
amend certain provisions of the State Building Code so long as the minimum
performance standards of the State Building Code and the objectives of RCW 19.27 020
are not diminished, and

WHEREAS, it is in the best interest of the City of Yakima to adopt the
International Mechanical Code as adopted and maintained by the State Building Code
Council with certain additions, deletions and exceptions, now therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA, WASHINGTON
Section 1. Sections 11.32.030, 11.32.040, 11.32.050, 11.32.060, 11.32.070,
11.32.080, 11.32.090, 11.32.100, 11.32.110, and 11.32.120 of Chapter 11.32 of the Yakima
Municipal Code are hereby repealed.
Section 2. Section 11 032.010 of the City of Yakima Municipal Code is hereby
amended to read as follows.

The Mechanical Code of the City of Yakima shall be comprised of the
following as modified by the amendments, additions, deletions, and
excep tzori � provided it th is chapter

a. The 2003 edition of the International Mechanical Code, as
published b‘ the International Code Council, Inc , and as adopted and
maintained by the State Building Code Council in chapter 51 -52 WAC.
b Appendix A (Combustion Air Openings and Chimney Connector
Pass - l hroughs) to the 2003 edition of the International Building Code, and
as published by the International Code Council, Inc.
The above- referenced texts are incorporated m this chapter by reference
and the several sections or numbers of those texts shall constitute, and.
may be referred to as, the numbers ot this chapter. One or more copies of
the texts that comprise the Mechanical Code ot the City of Yakima shall be
maintained on tile in the office of the Code Administration Manager of the
City of Yakima "
Section 3. Section 11 032.020 of the City of Yakima Municipal Code is hereby
amended to read as follows
"11.32.020 Heating and/or comfort - cooling journeyman certificate —
Requirements.
11.32.020.1 Journeyman Certification. It is unlawful for any person to
install or service any heating or comfort- cooling appliance without first
having obtained and being the authorized holder of a valid and subsisting
City of Yakima Heating and / or Comfort - Cooling Journeyman Certificate,
issued pursuant to this section, authorizing the holder to service and
install the appliance
11.32.020.2 Journeyman Certification Fee. The fee for each City of
Yakima Heating and / or Comfort - Cooling Journeyman Certificate shall be
eleven dollars ($11), and eleven dollars ($11) for renewal, per year for each
person payable to the City of Yakima Code Administration Division.
11.32.020.3 Journeyman Certificate Examinations. No City of Yakima
Heating and /or Comfort- Cooling Journeyman Certificate shall be issued
until the applicant has passed an examination administered by the

codebuilding official, paid all certification and examination fees
authorized by this chapter and completed a mechanical journeyman
certificate application form. The examination authorized by this section
shall test the applicant's knowledge of that portion of the City Mechanical
Code applicable to the types of heating and comfort - cooling appliances
the applicant intends to install or service.
11.32.020.4 Journeyman Certificate Application. Prior to taking such
examination, the applicant shall complete an application form provided
by the codebuilding .official The application shall contain the following
information. applicant's name, home address, business address, place and
date of birth, whether the applicant has served an apprenticeship in the
heating and comfort- cooling appliance installation trade, and if so, which
trade, whether the applicant has achieved journeyman status in such
trade, and what types of heating and /or comfort- cooling appliances the
applicant seeks to be certified to install and/ or service and what related
work the applicant seeks to be certified to perform. The codebuilding
official shall issue a City of Yakima Heating and /or Comfort - Cooling
Journeyman Certificate to applicants who pass the examination. The City
of Yakima Heating and/ or Comfort- Cooling Journeyman Certificate shall
specifically state what heating and / or comfort - cooling apphances the
Journeyman is certified to install and /or service and what related work
the Journeyman is certified to perform.
11.32.020.5 Journeyman Certificate Examination Fee. The fee for Heating
and /or Comfort - Cooling Journeyman Certificate examination shall be five
dollars ($5) payable in advance to the City of Yakima Code
Administration Division.
11.32.020.6 Appeal of Examination Results. Any applicant who does not
pass the Heating and/ or Comfort - Cooling Journeyman Certificate
examination may appeal to the board of appeals established by YMC

Section 11 04.112 for a review of any irregularity in the administration or
scoring of the examination by the codebuilding official by filing a written
notice of appeal with the codebuilding official within ten (10) calendar
days of receipt by the applicant of the result of the examination. The
notice of appeal shall specify the irregularity on which the appeal is based.
The codebuilding official shall promptly notify the board of the filing of
the appeal.
On receipt of an appeal, the board shall promptly give written
notice to the code building official and the applicant /appellant of the
time, date and place of hearing on such appeal, not less than seven (7)
calendar days prior to the date of the hearing The board shall then hear
the appeal and determine whether the examination results at issue should
be upheld or modified.
11.32.020.7 Suspension or Revocation of Journeyman Certificate;
Appeal. The code building official may, in writing, suspend or revoke a
certificate issued under the provisions of this section whenever the
certificate is issued in error, or on the basis of incorrect information
supplied in application for the certificate, or the certificate holder either
installs or services any heating or comfort - cooking appliance for which
he /she is not certified, or otherwise fails to, comply with any provision of
the City Mechanical Code. The holder of any certificate suspended or
revoked by the code building official shall have the right of appeal to the
board of appeals established by YMC Section 11 04.112 from such action
by filing a notice of appeal with the board of appeals within ten days after
receiving notice of the codebuilding official's action. At the hearing, the
holder of the certificate shall be entitled to be heard in person, to produce
witnesses and to be represented by counsel The action of the board of
appeals on the question shall be final and conclusive

Section 4. Section 11.32.101 1, is hereby enacted as a new section to chapter
11.32 of the Yakima Municipal Code to read as follows
"11.32.101.1 Amendment to Section 101.1.
Section 1011 of the International Mechanical Code as adopted and
maintained by the State Building Code Council is amended to read as
follows.
These regulations shall be known as the Mechamcal Code of the city
of Yakima, hereinafter referred to as "this code. '
Section 5. Section 11.32.101.2.2 is hereby enacted as a new section to Chapter
11.32 to read as follows.
"11.32.101.2.2 Addition to Section 101.2.
Subsection 101.2.2 is added to Section 101.2 of the International
Mechanical Code as adopted and maintained by the State Building Code
Council to read as follows
101.2.2 The standards set forth in NFPA 58 (Storage and
Handling of Liquefied Petroleum Gases) and ANSI Z2231 /NFPA
54 (National Fuel Gas Code) shall be considered equivalent to the
International Fuel Gas Code for the purpose of installation of
liquefied petroleum gas piping and equipment."
Section 6. Section 11.32.105.2.1 is hereby enacted as a new section to Chapter
11.32 to read as follows.
"11.32.105.2.1 Addition to Section 105.2
Subsection 105.2.1 is added to Section 105.2 of the International
Mechanical Code as adopted and maintained by the State Building Code
Council to read as follows
105.2.1 The requirements of the International Mechanical Code
(IMC) or the International Fuel Gas Code (IFGC) shall be generally
recognized as at least equivalent to the requirements of this code in
suitability, strength, eftectiveness, fire resistance, durability and

safety, and a proposed alternate design that meets the requirements
of the IMC of the IFGC shall be approved if the building official
finds the proposed design is satisfactory for the intended use and
otherwise complies with the provisions of this code "
Section 7. Section 11.32.106 4 is hereby enacted as a new section to Chapter
11.32 to read as follows
"11.32.106.4 Amendment to Section 106.4.
Section 106 4 of the International Mechamcal Code as adopted and
maintained by the State Building Code Council is amended to read as
follows.
106.4 Permit issuance. The application, construction documents,
plans, specifications, computations and other data filed by an
applicant for a permit shall be reviewed by the code official. Such
plans may be reviewed by other departments of this jurisdiction. to
verity compliance with applicable laws under their jurisdiction. If
the code official finds that the proposed work described in an
application for a permit and the plans, specifications and other data
filed therewith conforms to the requirements of this code and all
laws and ordinances applicable thereto, that the applicant is
properly certified under. Section 11.32.020, and that the fees
specified in Section 106 5 have been paid, a permit shall be issued
to the applicant."
Section 8. Section 11.32.106 4.7 is hereby enacted as a new section to Chapter
11.32 to read as follows
"11.32.106.4.7 Addition to Section 106.4.
Subsection 106 4.7 is added to Section 106 4 of the International
Mechanical Code as adopted and maintained by the State Building Code
Council to read as follows.

106.4.7 To Whom Permits May Be Issued
106.4.7.1 A permit may be issued to a person, firm or corporation
properly certified under Section 11.32.020 who is also complying
with applicable contractor registration laws
106.4.7.2 No permit shall be issued to any person to do or
cause to be done any work regulated by this code except to a
person holding a valid unexpired and non - revoked City of Yakima
Heating and / or Comfort-Cooling Journeyman Certificate as
required by Section 11.32.020 of this chapter
EXCEPTION A permit for mechanical work regulated by this
code may be issued to the owner of a single- family residence, if
the following conditions are all satisfied.
1 The residence, including buildings or other structures
customarily recognized as accessory to such residence, is
used exclusively for residential purposes,
2. The residence is the residence of the owner;
3 The owner shall personally purchase all materials,
4. The owner shall personally perform all labor in connection
therewith."
Section 9 Section 11.32.106.5.2 is hereby enacted as a new section to Chapter
11.32 to read as follows
"11.32.106.5.2 Addition to 106.5.2.
The following schedule of permit fees is added to Section 106 5.2 of the
International Mechanical Code as adopted and maintained by the State
Building Code Council to read as follows.

106.5.2 Fee Schedule. The fees for mechanical work shall be as
indicated in the following schedule.

Section 10. Section 11.32.109 is hereby enacted as a new section to Chapter
11.32 to read as follows.
"11.32.109 Amendment to Section 109.
Section 109 of the International Mechanical Code as adopted and
maintained by the State Building Code Council is amended to read as
follows
109.1 Application for appeal. A person shall have the right to
appeal a decision of the code official to the board of appeals
established bi. YMC 11.04.112. An application for appeal shall be
based on a claim that the true intent of this code or the rules legally
adopted thereunder have been incorrectly interpreted, the
provisions of this code do not fully apply, or an equally good or
better form of construction is proposed. The application shall be
filed on a form obtained from the code official within 20 days after
the notice was served.
109.1.1 Limitation of authority The board of appeals shall
have no authority relative to interpretation of the
administration of this code nor shall such board be
empowered to waive requirements of this code
The remainder of Section 109 of the 2003 edition of the International
Mechanical Code as adopted and maintained by the State Building Code
Council in chapter 51 -52 WAC is hereby deleted."

Section 11. Section 11.32.202 is hereby enacted as a new section to Chapter
11.32 to read as follows
"Section 11.32.202 Addition to Section 202.
The following definitions are added to Section 202 of the International
Mechanical Code as adopted and maintained by the State Building Code
Council.
HEATING and/or COMFORT COOLING APPLIANCE. An
appliance which utilizes gas, liquid, solid fuel or electricity for the
purpose of heating and /or cooling, and shall include all necessary
piping and duct work, and shall also include piping for all gas
appliances including such appliances as gas refrigerators.
HEATING and/or COMFORT COOLING CONTRACTOR. Any
person, firm or corporation who installs, contracts to install or
services, repairs, alters or cleans any or all types of heating and
cooling appliances and is listed by the Washington Department of
Labor and Industries as a Washington State Mechanical
Journeyman.
HEATING and/or COMFORT - COOLING JOURNEYMAN Any
person engaged in the actual work of installing or servicing any
heating or comfort - cooling appliance, and who is the authorized
holder of a valid and subsisting city of Yakima Heating and /or
Comfort - Cooling Journeyman Certificate "
Section 12. Section 11.32.401 5.2 is hereby enacted as a new section to Chapter
11.32 of the Yakima Municipal Code to read as follows
"11.32.401.5.2 Amendment to Section 401.5.2.
Section 401.5.2 of the 2003 edition of the International Mechanical Code as
adopted and maintained by the State Building Code Council is amended
to read as follows

401.5.2 Exhaust openings. Outside exhaust openings shall be
located so as not to create a nuisance. Exhaust air shall not be
directed onto walkways. In all other respects, outside exhaust
openings shall be located in accordance with. Chapter 5 of said
International Mechanical Code."
Section 13. Section 11.32.502.7.3 6 is hereby enacted as a new section to Chapter
11.32 of the Yakima Municipal Code to read as follows.
"11.32.502.7.3.6 Amendment to Section 502.7.3.6
Section 502.7.3 6 of the International Mechanical Code as adopted and
maintained by the State Building Code Council is amended to read as
follows.
502.7.3.6 Termination point. The termination point for exhaust
ducts discharging to the atmosphere shall be located with the
following minimum distances
1 For ducts conveying explosive or flammable vapors, fumes or
dusts 30 feet (9144 mm) from the property line, 10 feet (3048
mm) from openings into the building; 6 feet (1829 mm) from
exterior walls and roofs, 30 feet (9144 mm) from combustible
walls and openings into the building which are in the direction
of the exhaust discharge, 10 feet (3048 mm) above adjoining
grade.
2. For other product- conveying outlets 10 feet (3048 mm) from
the property line, 3 feet (914 mm) from exterior walls and roofs,
10 feet (3048 mm) from openings into the building; 10 feet (3048
mm) above adjoining grade
3 For environmental air duct exhaust: 3 feet (914 mm) from the
property line, 3 feet (914 mm) from operable openings into the
building tor all occupancies other than Group U, and 10 feet
L3048 min) from a mechanical air intake

Exceptions:
1 The separation. between an air intake and exhaust outlet on a
sin 71e listed acka_e HVAC unit.
2. Exhaust from environmental air systems other than garages
rnav be dischar ed into an 0 en arkin, _ara <Fe.
3 Except tor Group I occupancies, where ventilation system
design circumstances require building HVAC air to he relieved,
such as during economizer operation, such air may be relieved
into an 0 en or enclosed arkin r craze within the same
building."
Section 14. Section 11.32.807 is hereby enacted as a new section to Chapter
11.32 of the Yakima Municipal Code to read as follows.
"11.32.807 Amendment to Chapter 8.
Section 807 is added to Chapter 8 of the International Mechanical Code as
adopted and maintained by the State Building Code Council to read as
follows
Section 807 Gas Venting into Existing Masonry Chimneys.
Existing lined masonry chimneys and unlined chimneys with not
more than one side exposed to the outside may be used to vent gas
appliances, provided that an approved liner shall be installed in an
existing unlined masonry chimney when deemed necessary by the
building official considering local problems of vent gas condensate
Section 15. If any section, subsection, paragraph, sentence, clause or phrase of
this ordinance, or any provision of the Yakima Municipal Code established by this
ordinance, is declared invalid or unconstitutional for any reason, such decision shall not
affect the validity of the remaining portions of this ordinance or other provisions of the
Yakima Municipal Code established by this ordinance

Section 16. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter

SUMMARY EXPLANATION
This ordinance would adopt the State International Building WAC 51 -50, Mechanical WAC
51 -52, Residential WAC 51 -51 and Washington State Energy WAC 51 -11 Codes by
reference as provided by statutory authority pursuant to RCW Chapter 19 27
Before the City Council at this time is the adoption and local amendments to the
International Building, Residential, Mechanical, and Washington State Energy Code
Early in 2004, an adhoc Community and Economic Development Committee of
professionals from the development community and City staff, began meeting to discuss
local amendments to several of the construction codes used in the City of Yakima Again
the local group met February 8, 2005 to review the attached proposed amendments
The International family of codes has been adopted throughout the United States as a
common code for the entire country This provides consistency for the construction
industry Within the International codes there is more flexibility while continuing to provide
safety to the citizens in Yakima.
Again the group was successful to keeping the local amendments to a minimum, while
addressing climatic weather conditions or conditions unique to the local area We plan to
bring the remaining 2003 International Codes, Fire, Plumbing, and Existing Building to
Council for consideration within the next 30 to 60 days
