WHEREAS, on March 18, 2003, the Yakima City Council passed Ordinance No. 2003 -16 which enacted Chapter 7.80 ("Transit Center Hours ") of the Yakima Municipal Code; and WHEREAS, when Ordinance No. 2003 -16 was formally incorporated and codified into Chapter 7 80 within the Yakima Municipal Code by an outside entity utilized by the City of Yakima for such purposes, the code reviser failed to include certain language of the ordinance; and WHEREAS, when Ordinance No. 2003 -16 was formally incorporated and codified into Chapter 7.80 within the Yakima Municipal Code by an outside entity utilized by the City of Yakima for such purposes, the code reviser failed to add Chapter 7.80 into the Yakima Municipal Code as it appears on the City of Yakima's website; and WHEREAS, on November 23, 2004, the Yakima City Council passed Ordinance No. 2004 -73 creating a storm water utility which inadvertently was identified as Chapter 7.80 of the Yakima Municipal Code; and WHEREAS, the Yakima City Council desires to rectify the omission of the referenced language, resolve the numbering conflict, and retain the designation of its storm water ordinance as Chapter 7.80 of the Yakima Municipal Code; and WHEREAS, this ordinance is intended to correct said language omission by addition of the missing language and to resolve the numbering conflict by redesignating and renumbering "Transit Center Hours" as Chapter 7.90 of the Yakima Municipal Code, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1 "Transit Center Hours" is hereby redesignated and renumbered as Chapter 7.90 of the City of Yakima Municipal Code, and Section 7.80.010 is hereby amended, all to read as follows: "Chapter 7.8090 TRANSIT CENTER HOURS Sections: 7.18990.010 Transit center hours. 718990.010 Transit center hours. The city council of the city of Yakima takes notice and finds that the Yakima transit center located at the comer of Fast Walnut Street and 4 Street has been subject to ongoing vandalism; that such vandalism largely occurs during hours when the Yakima transit center is not being used for transit activities and that the occupancy and use of the transit center during hours when transit services are not available constitutes a public nuisance. When conspicuously posted with signs warning against entry into or remaining in the Yakima transit center during prohibited hours. lit is unlawful for any person to enter upon or remain at the Yakima transit center between the hours of seven p.m. and six a.m. of the following day unless the presence of such person during prohibited hours is authorized by the Transit Manager or his or her designee. Violation of this section is a misdemeanor punishable by up to ninety days in jail and/or a fine of up to one thousand dollars. In addition the violator may be required to remain away from the Yakima transit center for a period of up to one year from the date of conviction." Section 2. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance.
