ORDINANCE NO 2005 -46 AN ORDINANCE concerning land use regulation and planning and rezoning, with conditions, one parcel of property located in the vicinity of 1005 West Washington Avenue from Two - Family Residential (R -2) to Local Business (B -2) as more fully described herein, and approving, with conditions, the recommendation of the Hearing Examiner for the City of Yakima regarding the same, Ron Valicoff, applicant herein. WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on June 23, 2005 (the "recommendation "), recommending that the City approve the rezoning of one certain parcel of property as more fully described herein, and WHEREAS, the City Council finds that the findings of the Hearing Examiner set forth in the recommendation in response to the requirements of Yakima Municipal Code ( "YMC ") § 15.23 030(E) and § 1515 040(5) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein, and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON Section 1 The following parcel of property located in the vicinity of 1005 West Washington Avenue shall be, and the same hereby is, rezoned from Two - Family Residential (R -2) to Local Business (B -2) 181336 -24016 Attached hereto and incorporated herein as Exhibit "A" are legal descriptions of said property Section 2. The findings of the Hearing Examiner's recommendation in this matter dated June 23, 2005, are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23 030(F), and are incorporated herein by this reference as if fully set forth herein. The Hearing Examiner conducted a public hearing on June 9, 2005, and has issued this recommendation within ten business days thereof. The staff report presented by Associate Planner Mary Lovell addressed the pertinent considerations and recommended approval of the rezone application with conditions. The applicant's representative, Mr Bill Hordan of Hordan Planning Services, explained the applicant's desire to install landscaping and an asphalt strip on an adjoining lot to provide better access to the vacuum cleaners at his car wash facility The only public comment was a letter from the neighbor to the west, Mr Bill Chichenoff, who expressed support for the requested rezone, but requested an eight- foot -high block fence be required on the west property line in lieu of a six- foot -high vinyl fence with arborvitae to reduce noise and light. INDEX customer will disturb his tenant with loud music. He indicated that the cost of both methods of site screening would be comparable. He also noted that the grassy landscaped areas between the asphalt step for the vacuum cleaners and the west property line could later be converted to a different B -2 use. Bill Hordan recalled that Mr Chichenoff has received Class (3) approval for a mini- storage facility on the property to the west which has not been developed and that his site screening request is different from what is required by the ordinance. He indicated that arborvitae are being planted in addition to the construction of a new fence on the west boundary even though only the fence is required by the ordmance Mary Lovell indicated that it would be very unusual to allow an eight- foot -high fence or wall Six feet is the maximum height allowed for a wall. Summary of Recommendation. The Hearing Examiner recommends approval of this rezone application by the Yakima City Council, subject to conditions. Basis for Recommendation. The location of the requested rezone is at 1005 West Washington Avenue, Yakima, Washington, parcel number 181336 -24016 Application. This application requests a rezone of a vacant parcel that is about .23 of an acre at 1005 West Washington Avenue from R -2 to B -2 m order to allow application for a Class (2) use to expand an existing car wash facility by installing an asphalt strip and landscaping to the west of existing vacuum cleaners for the facility Notices. Several comments were received from SEPA reviewing agencies as a result of notices for the SEPA process. A Determination of Nonsignificance was issued by the City of Yakima relative to this rezone request on May 16, 2005, based on SEPA guidelines m WAC 197 -11 -355 There was no appeal of the SEPA determination during the appeal period which ended on May 31, 2005 Current Zoning and Land Uses. Recommendations regardmg rezone applications within the Yakima Urban Area must be based upon cntena specified in Section 15.23 030 of the Urban Area Zoning Ordmance (UAZO) 1) The testimony at the public hearing: The testimony at the hearing consisted of the testimony of Associate Planner Mary Lovell and the applicant's representative Bill Hordan who both favored approval of the rezone request. No one testified in opposition to the request. 2) The suitability of the property for uses permitted under the proposed zoning: The property is well- suited for B -2 uses. Both parcels front along an urban arterial street. The property is now designated Neighborhood Commercial in the comprehensive plan and is served with all urban services. Mixed uses already exist in the general area where the property is located. The application for a Class (2) car wash use on the property will be an extension of the use on existing Local Business (B - 2) zoned property to the east which is under the same ownership 3) Recommendations from interested agencies and departments: No agencies submitted recommendations regarding this rezone request. Department recommendations and observations as a result of the Development Services Team meeting held on April 27, 2005 may be summarized as follows (i) Code Administration. There will not be enough changes to affect Code Administration if the Class (2) use application is submitted as Ron Valicoff 4 DOC Rezone from R -2 to B -2 1005 W Washington Ave. INDEX RZ # 4 -05, EC #13-05 8± planned. No review or permit is required for asphalting the proposed 20- foot strip or for the proposed landscaping. (ii) Water: The site has an existing one -inch water service that will be abandoned by the City if service to the lot is no longer needed. The site is located in the Low Level Pressure Zone. (iii) Wastewater: The car wash already has a unique samplmg site and an oil separator (iv) Traffic Engineering: From the information submitted by the applicant, it appears this is a "project specific" rezone. If so, a condition that the parcels have a cross - easement for access and parkmg (or the parcels be combined) is recommended m order to limit future driveways and maxumze possible turning movement conflicts from Washington Avenue. 4) The extent to which the proposed rezone is in compliance with and /or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance. a) The Comprehensive Plan: The Future Land Use Map (Map IIl- 3) of the Yakima Urban Area Comprehensive Plan designates the subject property as suitable for Neighborhood Commercial development. The Regional Planning Commission, Joint Board, and the City Council and County Commissioners jointly approved the amendment to Neighborhood Commercial from the Medium Density Residential designation. The City Council's approval of the amendment was on March 4, 2005 The Future Land Use Map to Zoning Map Consistency Chart, Figure III -3, indicates that the Local Business (B -2) zoning distract is compatible with the Neighborhood Commercial comprehensive plan designation. The proposed rezone would be m compliance with Objectives and Policies of the 1997 Comprehensive Plan such as Objective Gl 1 which is to encourage the physical development of the Yakima urban area m a manner that enhances its image as the cultural and business center; Policy C9.3 which is to encourage mfill development with new construction that is compatible with the scale and density of the surrounding housing; and Policy C9 4 which is to encourage commercial, Ron Valicoff 5 DOC Rezone from R -2 to B -2 INDEX 1005 W Washington Ave. RZ # 4 -05, EC #13 -05 A A ( _ industrial, office and multi- family developments to locate in distinct clusters in planned growth areas. b) The Zoning Ordinance: Subsection 15 03 030(6) of the UAZO states that the purpose of the B -2 zoning district is to (i) provide areas for commercial activities outside the Central Business District that meet the retail shopping and service needs of the community and (ii) accommodate small scale commercial uses requiring high visibility and easy access to major arterials Uses characteristic of this district include small retail sales and service establishments Chapter 15 05 of the UAZO establishes basic development requirements as minimum cntena which must be met to assure land use compatibility and promote the public health, safety and general welfare. Any future development will comply with applicable development standards unless adjustments are approved following the prescribed public notice and comment requirements. The zoning ordinance sets forth specific standards for minimum lot size, maximum lot coverage, muumum building setbacks, requisite parkmg, maximum building height and requisite sight screening. For example, those standards would apply as follows to the planned asphalt strip and landscaped area that will be requested as a Class (2) expansion of the existing car wash facility if this rezone is approved. (i) Setbacks. Structure setbacks are required by Table 5 -1 of the UAZO The setback standard would not be applicable if no new construction is proposed. (ii) Parking: Parking requirements are listed m Table 6 -1 in Chapter 15 06 of the UAZO The intended Class (2) expansion of the existing car wash facility on the subject parcel would not require additional off -street parking. (iii) Signage. Any proposed signage must conform to sign standards as set forth in Chapter 15 08 of the UAZO (iv) Site screening: Site screening would be required along the property lines m accordance with the provisions of UAZO 15 07 Site screening requirements vary depending on the intensity of both the Ron Valicoff 6 DOC. Site screening meeting Standard `C' would be required on the north and west property lines of the subject parcel for the planned asphalt strip and landscaped area expanding the existing car wash facility 5) The adequacy of public facilities such as roads, sewer, water and other required public services: The property is currently served by all necessary public facilities and services Street access is from West Washington Avenue which is classified as an Arterial Street. The proposal is an exempt activity under the Transportation Capacity Management Ordinance The property can be served with all other infrastructure including domestic water, sanitary sewer, natural gas, electricity, telephone and any other needed utilities 6) The compatibility of the proposed zone change and associated uses with neighboring land uses: This parcel abuts a car wash facility owned by the applicant on the east, a parcel on the north containing a construction office and storage area that also has recently been designated Neighborhood Commercial, property on the south in Union Gap zoned for commercial uses which contains a mini- market and property on the west that has been approved for a mini- storage facility which presently contains Mr Chichenoff s rental house. Mr Chichenoff questioned the compatibility of the parcel even as a vacant lot because of noise and light which was allowed to reach the neighbor's rental home after the residence on the parcel was removed. The applicant's planned use of the parcel is comparable to a vacant lot which would not require site screening. But since automobiles will be dnvmg on the east side of the parcel, site screening standard "C" would be recommended by the Planning Division for the Class (2) use. The six- foot -high view - obscuring fence, which is the highest fence allowed for this parcel, together with arborvitae along the west property line which is not required by the ordinance, would minimize noise and light to the adjoining property on the west resulting from that type of use. Compatibility of the future B -2 uses would Ron Valicoff 7 Rezone from R -2 to B -2 Dec 1005 W Washington Ave. INDEX RZ # 4 - o5,EC #13 -o5 # -1_ be determined through the respective types of review set forth m Table 4 -1, Permitted Land Uses, of the UAZO In view of the zoning classifications and existing uses of surrounding properties, the respective types of review listed for uses to be located within the B -2 zoning distract would suffice to ensure their compatibility with land uses near the subject property 7) The public need for the proposed change. The testimony and other evidence submitted at the hearing established that there is a need for commercial activities outside the central business distract that meet the demand for local service needs of the community in a manner consistent with the City's comprehensive plan Neighborhood Commercial designation. Consistency of the Rezone with Development Regulations and the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the following factors 1) The types of land uses permitted at the site m the City's Local Busmess (B -2) zoning district would be consistent with the comprehensive plan's Neighborhood Commercial designation for the site 2) The density of residential development or the level of development such as units per acre or other measures of density would not be a factor weighing against this rezone application because this rezone would not result in additional residential use of the property and any future B -2 uses would have to be consistent with the density that is allowed by the applicable zoning ordinance provisions. 3) The availability and adequacy of infrastructure and public facilities support the applicant's request for approval of the rezone. 4) The characteristics of the development will have to be consistent with the B -2 zoning provisions and the applicable development regulations, or with any Ron Valhcoff 8 DOC Rezone from R -2 to B -2 INDEX 1005 W Washington Ave RZ # 4 -05, EC #13 -05 adjustments thereto that may be allowed after following the prescribed public notice and comment requirements. CONCLUSIONS 1 The Hearing Examiner has junsdiction under Subsection 15.23 030(C) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2 The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3 SEPA review resulted in the issuance of a Declaration of Non - significance on May 16, 2005, and the time penod for appeal expired on May 31, 2005 without any appeal being filed. 4 Site screening that meets Standard "C" would be required on the north and west property lines of the parcel for the planned car wash expansion use which this rezone would permit the apphcant to request. 5 Adequate pubhc services are available to satisfy the utility and access requirements of future B -2 uses on this property, and all public agencies and City departments indicate that this rezone would not cause any problems for infrastructure 6 All of the testimony at the hearing was in favor of this rezone request, and the neighbor's comments by letter were addressed by those present at the hearmg. 7 The parcel is located in an area that contains mixed land uses, and the proposed rezone is consistent with the Neighborhood Commercial future land use map designation. 8 The requested rezone satisfies the seven rezone criteria in Section Ron Vahcoff 9 Rezone from R -2 to B -2 DEC. 1005 W Washington Ave. INDEX RZ # 4 -05, EC #13 -05 AA 15.23 030 and the four consistency criteria m Subsection 16 06 020(B) of the Yakima Municipal Code which are the applicable cnteria to determine whether the requested rezone should be approved. RECOMMENDATION The Hearing Examiner recommends to the Yakima City Council that this apphcation for a rezone of property from the Two-Family Residential (R -2) zoning designation to the Local Business (B -2) zoning designation described in the documentation submitted for UAZO RZ #4 -05 and EC 13 -05 be APPROVED, subject to the following conditions 1) Development of the subject property for the use described m the apphcation will require Class (2) review if this rezone is approved and any future development thereafter will be subject to all requisite environmental review, traffic concurrency, plan review, building permit and related requirements. 2) If the subject property is merged with the adjacent car wash, the existing residential dnveway approach must be removed and replaced with curb, gutter and sidewalk, and all traffic to Washington Avenue must utilize the commercial driveway approach. 3) If additional development is proposed at this site m the future, all applicable development standards will be met unless adjustments are approved following the prescribed public notice and comment requirements. The application for a Class (2) car wash use on the property will be an extension of the use on existing Local Business (B -2) zoned property to the east which is under the same ownership. 3) Recommendations from interested agencies and departments: No agencies submitted recommendations regarding this rezone request. If so, a condition that the parcels have a cross - easement for access and parking (or the parcels be combined) is recommended in order to limit future driveways and maximize possible turning movement conflicts from Washington Avenue. 4) The extent to which the proposed rezone is in compliance with and /or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: a) The Comprehensive Plan: The Future Land Use Map (Map III - 3) of the Yakima Urban Area Comprehensive Plan designates the subject property as suitable for Neighborhood Commercial development. The Regional Planning Commission, Joint Board, and the City Council and County Commissioners jointly approved the amendment to Neighborhood Commercial from the Medium Density Residential designation. The City Council's approval of the amendment was on March 4, 2005. The Future Land Use Map to Zoning Map Consistency Chart, Figure 11I -3, indicates that the Local Business (B -2) zoning district is compatible with the Neighborhood Commercial comprehensive plan designation. The proposed rezone would be in compliance with Objectives and Policies of the 1997 Comprehensive Plan such as Objective G1.1 which is to encourage the physical development of the Yakima urban area in a manner that enhances its image as the cultural and business center; Policy C9.3 which is to encourage infill development with new construction that is compatible with the scale and density of the surrounding housing; and Policy C9.4 which is to encourage commercial, Ron Valicoff 5 DOG. Washington Ave. 4 _ ( RZ # 4 -05, EC #13 -05 � 1 \ 1 , • industrial, office and multi - family developments to locate in distinct clusters in planned growth areas. b) The Zoning Ordinance: Subsection 15.03.030(6) of the UAZO states that the purpose of the B -2 zoning district is to (i) provide areas for commercial activities outside the Central Business District that meet the retail shopping and service needs of the community and (ii) accommodate small scale commercial uses requiring high visibility and easy access to major arterials. Uses characteristic of this district include small retail sales and service establishments. Chapter 15.05 of the UAZO establishes basic development requirements as minimum criteria which must be met to assure land use compatibility and promote the public health, safety and general welfare. Any future development will comply with applicable development standards unless adjustments are approved following the prescribed public notice and comment requirements. The zoning ordinance sets forth specific standards for minimum lot size, maximum lot coverage, minimum building setbacks, requisite parking, maximum building height and requisite sight screening. For example, those standards would apply as follows to the planned asphalt strip and landscaped area that will be requested as a Class (2) expansion of the existing car wash facility if this rezone is approved: (i) Setbacks: Structure setbacks are required by Table 5 -1 of the UAZO. The setback standard would not be applicable if no new construction is proposed. (ii) Parking: Parking requirements are listed in Table 6 -1 in Chapter 15.06 of the UAZO. The intended Class (2) expansion of the existing car wash facility on the subject parcel would not require additional off - street parking. (iii) Signage: Any proposed signage must conform to sign standards as set forth in Chapter 15.08 of the UAZO. (iv) Site screening: Site screening would be required along the property lines in accordance with the provisions of UAZO 15.07. Site screening meeting Standard `C' would be required on the north and west property lines of the subject parcel for the planned asphalt strip and landscaped area expanding the existing car wash facility. 5) The adequacy of public facilities such as roads, sewer, water and other required public services: The property is currently served by all necessary public facilities and services. Street access is from West Washington Avenue which is classified as an Arterial Street. The proposal is an exempt activity under the Transportation Capacity Management Ordinance. The property can be served with all other infrastructure including domestic water, sanitary sewer, natural gas, electricity, telephone and any other needed utilities. 6) The compatibility of the proposed zone change and associated uses with neighboring land uses: This parcel abuts a car wash facility owned by the applicant on the east, a parcel on the north containing a construction office and storage area that also has recently been designated Neighborhood Commercial, property on the south in Union Gap zoned for commercial uses which contains a mini- market and property on the west that has been approved for a mini - storage facility which presently contains Mr. Chichenoff s rental house. Mr. Chichenoff questioned the compatibility of the parcel even as a vacant lot because of noise and light which was allowed to reach the neighbor's rental home after the residence on the parcel was removed. The applicant's planned use of the parcel is comparable to a vacant lot which would not require site screening. But since automobiles will be driving on the east side of the parcel, site screening standard "C" would be recommended by the Planning Division for the Class (2) use. The six - foot -high view - obscuring fence, which is the highest fence allowed for this parcel, together with arborvitae along the west property line which is not required by the ordinance, would minimize noise and light to the adjoining property on the west resulting from that type of use. In view of the zoning classifications and existing uses of surrounding properties, the respective types of review listed for uses to be located within the B -2 zoning district would suffice to ensure their compatibility with land uses near the subject property. 7) The public need for the proposed change: The testimony and other evidence submitted at the hearing established that there is a need for commercial activities outside the central business district that meet the demand for local service needs of the community in a manner consistent with the City's comprehensive plan Neighborhood Commercial designation. Consistency of the Rezone with Development Regulations and the Comprehensive Plan under the Criteria Required by YMC 16.06.020(13) is determined by consideration of the following factors: 1) The types of land uses permitted at the site in the City's Local Business (B -2) zoning district would be consistent with the comprehensive plan's Neighborhood Commercial designation for the site. 2) The density of residential development or the level of development such as units per acre or other measures of density would not be a factor weighing against this rezone application because this rezone would not result in additional residential use of the property and any future B -2 uses would have to be consistent with the density that is allowed by the applicable zoning ordinance provisions. 3) The availability and adequacy of infrastructure and public facilities support the applicant's request for approval of the rezone. 4) The characteristics of the development will have to be consistent with the B -2 zoning provisions and the applicable development regulations, or with any Ron Valicoff 8 DOC. CONCLUSIONS 1. The Hearing Examiner has jurisdiction under Subsection 15.23.030(C) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3. SEPA review resulted in the issuance of a Declaration of Non - significance on May 16, 2005, and the time period for appeal expired on May 31, 2005 without any appeal being filed. 4. Site screening that meets Standard "C" would be required on the north and west property lines of the parcel for the planned car wash expansion use which this rezone would permit the applicant to request. 5. Adequate public services are available to satisfy the utility and access requirements of future B -2 uses on this property, and all public agencies and City departments indicate that this rezone would not cause any problems for infrastructure. 6. All of the testimony at the hearing was in favor of this rezone request, and the neighbor's comments by letter were addressed by those present at the hearing. 7. The parcel is located in an area that contains mixed land uses, and the proposed rezone is consistent with the Neighborhood Commercial future land use map designation. 8. The requested rezone satisfies the seven rezone criteria in Section Ron Valicoff 9 DOC Rezone from R -2 to B -2 INDEX 1005 W. The property that we own next to this proposed rezone is used as a rental house for single family residence. After the house was removed on the lot between the car wash and my rental house the noise and light from this facility has made it difficult to retain renters. The normal car wash noises along with the patrons of this facility playing loud music at all hours is decreasing the value of my rental property. While this noise is not constant it seems that the occasional patron of the car wash, with the loud music may not be concerned with noise ordinances of the City of Yakima. Since this facility is open 24 hour a day, seven days a week, with no one monitoring the patrons we feel that an 8 -foot high concrete block wall between our properties should be included in the rezone requirements. After the property is rezoned to B -2 it could be used for other projects instead of a grassy area for car wash patrons. The concrete block fence would provide an acceptable buffer between these two properties. Is the requested zoning change suitable with the property in question (subject property)? How so? The requested zoning change is suitable with the property in question because the property is served with all urban services and is an extension of an existing Professional Business zoned property currently under the same ownership, which lies to the east. The subject property is connected to the existing parcel and they both front along an urban arterial (West Washington Avenue). The property is now designated Neighborhood Commercial by the Urban Area Comprehensive Plan and is located in a mixed use area of the City and Union Gap. B. How is the rezone request in compliance with and /or how does the request deviate from the 1997 Yakima Urban Area Comprehensive plan as amended? The rezone request is in compliance with the 1997 Yakima Urban Area Comprehensive Plan because the proposal meets many of the goals, objectives and policies of the plan which are listed in the General Development, Public Services, Commercial Development, Land Use, Transportation, Utilities and Capital Facilities element of the plan. The rezone request is also in compliance with the amended plan because the underlying Comprehensive Plan was recently changed to Neighborhood Commercial and the proposed rezone falls within the confines of the "Matrix" which was adopted as a previous Comprehensive Plan amendment. The Future Land Use Map to Zoning Map Consistency was added to the Comprehensive Plan in 1998 as an amendment and it indicates that the proposed rezone can be compatible with the plan, subject to review. The property has street frontage on the south and can provide safe points of ingress and egress to the Urban Arterial, West Washington Avenue. Subject to the Traffic Capacity Analysis of the City, the project will be in compliance with the transportation element of the Growth Management Act and City Development Standards. The property can be served with all other infrastructure including domestic water, sanitary sewer, natural gas, electricity, telephone and any other needed utilities. This parcel abuts the existing car wash to the east which is located on the corner of South 10th Avenue and West Washington Avenue. The owner of the car wash and this subject property are the same. It is the intent of the applicant to incorporate this newly rezoned parcel of land into the existing car wash facility (see attached site plan). Additionally, the property which lies to the north has recently had it comprehensive plan land use designation changed to Neighborhood Commercial. That property contains a construction office and storage area. Property across West Washington, to the south, is within the City of Union Gap and zoned commercial. It contains a convenience store. Property to the west was recently approved by the City Hearing Examiner for a residential mini - storage complex. In essence, the subject property is totally encompassed by commercially oriented zoning and /or land uses. Mitigation of adverse affects will be subject to the development standards within Chapter 15.07; Sitescreening Standards. Enforcement of this chapter during project review will ensure that adequate mitigation is in place to protect the surrounding uses. Is there a public need for the proposed change? The land use reclassification is needed because this proposal permits the existing use to expand. The current Two - family Residential Zoning District does not permit this opportunity to occur.
