HomeMy WebLinkAbout2005-047 Francisco Luna rezone ORDINANCE NO. 2005-47 AN ORDINANCE concerning land use regulation and planning and rezoning two parcels of property located in the vicinity of 1407 and 1409 South 16th Street from Two - Family Residential (R -2) to Central Business District Support (CBDS) as more fully described herein, and approving the recommendation of the Hearing Examiner for the City of Yakima regarding the same; Francisco Luna, applicant herein. WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on July 7, 2005 (the "recommendation "), recommending that the City approve the rezoning of two certain parcels of property as more fully described herein, and WHEREAS, the City Council finds that the findings of the Hearing Examiner set forth in the recommendation in response to the requirements of Yakima Municipal Code ( "YMC") § 15.23 030(E) and § 1515 040(5) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein, and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. The following parcels of property located in the vicinity of 1407 and 1409 South 16th Street shall be, and the same hereby are, rezoned from Two - Family Residential (R -2) to Central Business District Support (CBDS). 191329 -31573 and - 31574. Attached hereto and incorporated herein as Exhibit "A" are legal descriptions of said property Section 2. The findings of the Hearing Examiner's recommendation in this Itiatiet dated July 7, 2005, are hereby adopted by the City Council as its findings in Support hereof pursuant to YMC § 15.23 030(F), and are incorporated herein by this reference as if fully set forth herein. Page 1 of 2 Section 3. Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect this rezone. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor Section 4. Severability If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The Hearing Examiner conducted a public hearing on June 23, 2005, and has issued this recommendation within ten business days thereof. The staff report presented by Assistant Planner Jeff Peters addressed the pertinent considerations and recommended approval of the rezone application. The applicant's representative, Mr Bill Hordan of Hordan Planning Services, indicated that there has been no opposition throughout the process of this rezone or throughout the process of a recent comprehensive plan amendment which paved the way for this rezone No public comment or other testimony was submitted. Summary of Recommendation. The Hearing Examiner recommends approval of this rezone by the Yakima City Council. Basis for Recommendation. Based upon a view of the site without anyone else present on June 22, 2005, the information contained m the staff report, exhibits, Francisco Luna 1 Rezone from R -2 to CBDS 1407 & 1409 S. 16` Street RZ # 3 -05, EC #12 -05 DOC INDEX testimony and other evidence presented at an open record public hearing on June 23, 2005, and a review of both the Yakima Urban Area Comprehensive Plan and the Zoning Ordinance, the Hearing Examiner makes the following. FINDINGS Property Owner. The property owner is Francisco Luna, 1507 South 17 Street, Yakima, WA 98901 and his representative is Bill Hordan of Hordan Planning Services, 410 North 2 °d Street, Yakima, WA 98901 Location. The location of the requested rezone is 1407 and 1409 South 16 Street, Yakima, Washington, parcel numbers 191329 -31573 and 31574 Application. This application requests a rezone of two vacant parcels that are about .28 of an acre at 1407 and 1409 South 16 Street from Two - Family Residential (R -2) to Central Business District Support (CBDS) coupled with environmental review Notices. One comment was received from a SEPA reviewing agency as a result of notice of the SEPA process Notices for that process and for the public hearing were provided in accordance with applicable ordinance requirements m the following manner. A Determination of Nonsignificance was issued by the City of Yakima relative to this rezone request on May 20, 2005 There was no appeal of the SEPA determination during the appeal penod which ended on June 10, 2005 Current Zoning and Land Uses. The site is currently vacant and zoned Two - Family Residential (R -2) The charactenstics of adjacent properties are Location Zoning Land Use North CBDS Gas Station South R -2 Residential West CBDS Vacant East CBDS Gas Station Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon criteria specified in Section 15.23 030 of the Urban Area Zoning Ordinance (UAZO) 1) The testimony at the public hearing: The testimony at the hearing consisted of the testimony of Assistant Planner Jeff Peters and the applicant's representative Bill Hordan who both favored approval of the rezone request. No one testified in opposition to the request. 2) The suitability of the property for uses permitted under the proposed zoning. The property is well- suited for CBDS uses. The comprehensive plan's future land use map designation for both parcels was changed to Artenal Commercial on April 3, 2005 That designation fully supports the CBDS zoning classification. That zoning classification exists on three sides of the property The property is served with all urban services and is located in a Waxed use area of the City Francisco Luna 3 Rezone from R -2 to CBDS DOC 1407 & 1409 S. 16 Street INDEX RZ # 3 -05, EC #12 -05 3) Recommendations from interested agencies and departments: The following agency comment was submitted regarding this rezone request, and the following Department comments were submitted as a result of the Development Services Team meeting held on May 4, 2005 (i) Yakima Regional Clean Air Authority: The applicant shall file and gam approval of a site dust control plan to address site preparation, construction and landscaping phases The applicant is also encouraged to file a Construction Dust Control Plan for projects now and in the future Since this rezone warranted a nonproject SEPA determination, and the applicant has given no indication about the intended future uses, the applicant or a future business owner needs to contact the Yakima Clean Air Authority with a descnption of the intended future business. If a new source review is required, a second SEPA determination will be required. (ii) Code Administration. Since this is a nonproject rezone, no code admjmstration issues will be presented until development occurs (iii) Water & Irrigation. There is an existing looped 8 -inch water line in South 16` Street and each lot has an existing 3 /4 -inch domestic water service This site is located within a low -level pressure zone, with static pressure ranging from 92 -104 psi. Any new services to these lots must be installed by the City Service installation shall be coordinated with the Water Distribution Supervisor (iv) City Engineer: This site is currently vacant. Any development that is proposed for this site following the requested rezone (if it is approved) shall require installation of frontage improvements (Title 12) including curb, gutter, sidewalk and street lights (as may be required) along South 16 Street. All driveway approaches shall be commercial type All utilities exist. (v) Traffic Engineering: South 16 Street is a lightly surfaced Local Access street, with no curbing, gutter, sidewalks or streetlights. The proposed rezone site has access only to South 16 Street. Therefore, Traffic Engineering recommends that any development on the two parcels of the subject rezone should construct full- frontage street improvements, including curb, gutter, sidewalk and other requirements of the Engineering Division. Francisco Luna 4 Rezone from R -2 to CBDS 1407 & 1409 S 16 Street DOC RZ # 3 -05, EC #12 -05 INDEX 4) The extent to which the proposed rezone is in compliance with and/or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance. a) The Comprehensive Plan: The Future Land Use Map (Map III- 3) of the Yakima Urban Area Comprehensive Plan designates the subject property as suitable for Arterial Commercial development pursuant to an amendment on April 3, 2005 The Future Land Use Map to Zoning Map Consistency Chart, Figure III -3, indicates that the Central Business District Support (CBDS) zoning district is compatible with the Arterial Commercial comprehensive plan designation. That designation includes land uses which require high auto visibility such as restaurants, service stations, car washes, as well as wholesale and retail activities. The proposed rezone to allow CBDS uses would be in compliance with Objectives and Goals of the 1997 Comprehensive Plan such as Objective L3 which is to maintain the Central Business district as a vital and primary business area, Goal C2 which is to provide convenient shopping locations, Objective C5 which is to require that new commercial development will be landscaped and existing landscaping will be maintained, especially for buffers between residential and commercial uses, Objective S1 which is to encourage the location of public and semi - public facilities m appropriate locations throughout the urban area, Objective S2 which is to require public and semi- public uses to be developed m a manner which does not detract from surrounding uses, and Goal C 1 which is to stabilize and revitalize existing commercial facilities in the Urban Service Area. b) The Zoning Ordinance. Subsection 15 03 030(6) of the UAZO states that the purpose of the CBDS zoning distnct is to accommodate wholesale and retail activities with some high- density residential development. This district is primarily located near the Central Business District and along the major arterials leading to the Central Business District. The intensity of development is intended to be less than m the CBD distract. Chapter 15 05 of the UAZO establishes basic development requirements as mmunum criteria which must be met to assure land use compatibility and promote the pubhc health, safety and general welfare Any future development will comply with applicable development standards unless adjustments are approved following the public notice and comment requirements 5) The adequacy of public facilities such as roads, sewer, water and other required public services: The property is currently served by all necessary public facilities and services Street access is from South 16 Street which is classified as a Local Access Street and which provides safe access to the urban arterial street, East Nob Hill Boulevard, about 250 feet north of the property The proposal is an exempt activity under the Transportation Capacity Management Ordinance The property can be served with all other infrastructure including water, sewer, natural gas, electricity, telephone and any other needed utilities 6) The compatibility of the proposed zone change and associated uses with neighboring land uses: The change of this property from R -2 to CBDS will bring it into conformance with the comprehensive plan and will result in a more regular boundary for the CBDS zoning district. The property abuts the Tiger Oil Distribution Facility and is east of a Schuck's Auto Supply retail store. Site screening and other development standards will provide protection for neighboring land uses when specific uses are proposed for the property 7) The public need for the proposed change: Besides the recent change in the comprehensive plan designation for the property, there has been a general change in the area toward commercial development since the subject property was zoned R -2 Schuck's Auto Supply and the Carribean Casino are recent examples State Route 24 is being improved. The evidence indicated that there is a public Francisco Luna 6 Rezone from R -2 to CBDS 1407 & 1409 S 16 Street DEC RZ # 3 -05, EC #12 -05 INDEX _ ___ -' _�_ __. need for additional commercial property in the area to serve the commuruty and the travelling public Consistency of the Rezone with Development Regulations and the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the following factors 1) The types of land uses permitted at the site in the City's Central Business District Support (CBDS) zoning district would be consistent with the comprehensive plan's Arterial Commercial designation for the site 2) The density of residential development or the level of development such as units per acre or other measures of density would not be a factor weighing against this rezone request because any future CBDS uses would have to be consistent with the density allowed by applicable zoning ordinance provisions. 3) The availability and adequacy of infrastructure and public facilities are not an issue and support the applicant's request for approval of the rezone 4) The characteristics of the development will have to be consistent with the CBDS zoning provisions and the applicable development regulations, or with any adjustments thereto that may be allowed after following the prescribed public notice and comment requirements CONCLUSIONS 1 The Hearing Examiner has jurisdiction under Subsection 15.23 030(C) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2 The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. Francisco Luna 7 Rezone from R -2 to CBDS i3CJC 1407 & 1409 S 16 Street iNDE RZ # 3 -05, EC #12 -05 � vl 3 SEPA review resulted in the issuance of a Declaration of Non - sigruficance on May 20, 2005, and the time period for appeal expired on June 10, 2005 without any appeal being filed. 4 Adequate public services are available to satisfy the utility and access requirements of future CBDS uses on this property 5 All of the testimony at the hearing was in favor of this rezone request. 6 The property is located m an area that contains mixed land uses, and the proposed rezone is consistent with the Arterial Commercial future land use map designation. 7 The requested rezone satisfies the seven rezone criteria m Section 15.23 030 and the four consistency cntena m Subsection 16 06 020(B) of the Yakima Municipal Code which are the applicable criteria to determme whether the requested rezone should be approved. RECOMMENDATION The Hearing Examiner recommends to the Yakima City Council that this application for a rezone of property from the Two - Family Residential (R -2) zoning designation to the Central Business District Support (CBDS) zoning designation described m the documentation submitted for UAZO RZ #3 -05 and EC 12 -05 be APPROVED. Public utilities are available and the subject property is currently served. South 16 Street a local access street provides required access. 6. Compatibility of proposed use. Considering the vacant condition of the subject property this proposal will improve the current land use situation, providing opportunities in the community for a small business center. The change of these properties from (R -2) Two - Family Residential to (CBDS) Central Business District Support will also bring the property into conformance with the Comprehensive Plan and provide a more regular boundary for the CBDS zoning district. 7. Public Need/Change in Circumstance Significant land use changes, such as the addition of Al's Auto Supply and the Caribbean Casino have occurred in the vicinity of this development, as well as a general change in the area twords commercial development since the subject property was zoned R -2. The recent Comprehensive Plan Map amendment to the Arterial Commercial designation that occurred on April 3, 2005 in conjunction with the development of the surrounding neighborhood fully supports this requested rezone. Francisco Luna 3 1407 & 1409 S. 16 Street Yakima, WA 98901 UAZO RZ #3 -05 & EC #12 -05 ZONING ORDINANCE DEVELOPMENT STANDARDS. The zoning ordinance sets forth specific standards for lot size, maximum lot coverage, minimum building setbacks, parking, building height, sight screening, etc. As no project has yet to be proposed all applicable zoning ordinance standards for development can be deemed to be in compliance. Subsequently, all project & environmental review will take place at the time of development. DEVELOPMENT SERVICES TEAM (DST) REVIEW. The DST meeting for this proposal was held on May 4, 2005 at which time the following comments were submitted. City Engineer This site is currently vacant. Any development that is proposed for this site following the requested Rezone (if it is approved) shall install frontage improvements (Title 12) including curb & gutter and sidewalk, and street lights (as may be required) along S. 16 Street. All driveway approaches shall be commercial type. All utilities exist. Building Codes Since this is a non- project rezone, there will be no issues coming forth until development occurs. Traffic South 16 Avenue is a lightly surfaced Local Access street, with no curbing, gutter, sidewalks or streetlights. The proposed rezone site has access only to South 16 Street. Therefore, Traffic Engineering recommends that any development on the two parcels of the subject rezone should construct full- frontage street improvements, including curb gutter, sidewalk and other requirements of the Engineering Division. Water & Irrigation 1. There is an existing looped eight inch water line in S. 16 Street and each lot has an existing 3 /4" domestic water service. This site is also located within a low -level pressure zone, with static pressure ranging from 92 — 104psi. 2. Any new services to these lots are required to be installed by the City. Service installation shall be coordinated with the Water Distribution Supervisor. Yakima Regional Clean Air Authority (YRCAA) The proponent shall file with, and gain approval from YRCAA, a site dust control plan to address site preparation, construction and landscaping phases. The Proponent is also encouraged to file a Construction Dust Control Plan for projects now and in the future. Since this rezone warranted a non - project SEPA determination, and the applicant has given no indication about the intended future uses, the applicant or a future business owner needs to contact the Yakima Clean Air Authority with a description of the intended future business. If a new source review is required, a second SEPA determination will be required. Francisco Luna 4 1407 & 1409 S. 16 Street Yakima, WA 98901 UAZO RZ #3 -05 & EC #12 -05 No other comments were received TRAFFIC CONCURRENCY. This project was determined to be exempt under the Transportation Capacity Management Ordinance. STATE ENVIRONMENTAL POLICY ACT. On May 20, 2005 the City of Yakima issued a Declaration of Non - significance for environmental checklist #12 -05. The 20 -day comment period, which precedes the issuance of this DNS, ended May 19, 2005 with one comment received during the 20 -day comment period. The 15 -day appeal period for this DNS ended on June 10, 2005. PUBLIC NOTICE. Notice for the hearing was provided in accordance with the UAZO requirements in the following manner: Mailing of notice April 29, 2005 Posting of property April 27, 2005 Legal Ad published April 29, 2005 No comments were received during the comment period. ANALYSIS. The only issue raised by this application is the appropriateness of rezoning the property from (R- 2) Two - Family Residential to (CBDS) Central Business District Support. This rezone is well supported by the Comprehensive Plan's Future Land Use Map as the subject property's future land use designation was changed from Low Density Residential to Arterial Commercial on April 3, 2005. The Arterial Commercial Future Land Use Map designation gives full support to the (CBDS) Central Business District Support zoning. In addition the infrastructure necessary to support the development is available and there have been significant changes in the area that trend towards this type of commercial development. CONCLUSIONS. 1. The hearing examiner has jurisdiction to issue a recommendation on this application to the City Council. 2. During project review it has been determined that this request is in compliance with YMC 16.06.020(B) for making a Detellnination of Consistency as follows: a) The density of the development is not a factor with this application. The appeal period for this determination ended, June 10, 2005. 5. No adverse impacts have been identified from granting this approval. 6. Public Notice for this hearing was provided in accordance with zoning ordinance requirements. 7. This rezone is compatible with the future land use map III -3 and land use compatibility Figure III -3 of the Comprehensive Plan. 8. There have been significant land use changes within the area that support this move from moderate density residential development to high- density commercial development. 9. Approval of this rezone application will have the following public benefits: increased investment, increased tax base with the improvement of the property, and increased employment opportunities as well as increased ascetic values. RECOMMENDATION. However, development allowed by the rezone can and will do so. Notification of Demolition and Renovation (NODR) Per §3.07 of YRCAA Regulations; Survey Requirements: Prior to any demolition, or renovation work, an asbestos survey must be conducted. Notification Requirements: For demolition, a Notification of Demolition and Renovation (NODR), must be filed with and approved by YRCAA. For renovation, only when the work would disturb asbestos, must an NODR be filed. The NODR fee is based on quantity of asbestos to be removed. Removal Requirements: All asbestos must be removed prior to demolition. For renovation, only when the work would disturb asbestos, must the asbestos be removed. Dust Control If the project includes any work that would disturb soil stability, it is subject to the requirement to submit a dust control plan. A construction dust plan must be filed with, and approved by, YRCAA. The dust control plan needs to address demolition, site preparation, construction and landscaping phases, per §3.08A of YRCAA Regulations. Proponent is also encouraged to file a Master Construction Dust Control Plan for projects planned now and in the future. The fee for a Master Construction Dust Control Plan is $226. Parcel Nos. 191329 -31573 & 191329 -31574 Your application was initially submitted on March 24, 2005 and has been determined to be complete for further processing April 11, 2003. Continued processing of your request will include, but is not limited to, the following actions: 1. A Notice of Application is to be sent to all property owners within 500 feet of your site. This notice will include a request for public comments during a 20 --day comment period as is required by the City of Yakima. Notice of Application is scheduled to be issued on. April 15, 2005 and the comment period will end on May 5, 2005. 2. Following the comment period a SEPA Threshold determination will be issued after May 6, 2005. This is followed by a 15 day SEPA .Appeal period that ends approximately May 23, 2005. If not appealed a staff report will be prepared by the Planning Division, which will include a recommendation to the hearing examiner as well as any recommended conditions of approval. 3. An open record public hearing is scheduled before the City of Yakiina's hearing examiner for June 23, 2005 at 9:OOAM in the City Council's hearing chamber at City Hall. The hearing examiner will issue a recommendation to the City Council. 4. Following the receipt of the Hearing Examiner's recommendations, a closed record public hearing will be scheduled for a City Council decision of your Rezone.
