ORDINANCE NO. 2005 -66
AN ORDINANCE of the City of Yakima, Washington, approving and confirming the
final assessment roll for South 7 8 & 9 Avenue Sewer Local
Improvement Distnct No 1056, which has been created and
established for the purpose of paying the cost of certain sewer
system improvements, and levying and assessing the amount
thereof against the lots, tracts, parcels of land and other property
shown on said roll.
WHEREAS, an assessment roll levying special assessments against the
properties located in Local Improvement District No 1056 ( "LID 1056 "), in Yakima,
Washington, created under Ordinance No. 2004 -35, was filed with the City Clerk of the
city of Yakima as provided by law; and
WHEREAS, notice of the time and place of a heanng on and of making
objections to the assessment roll was duly published at and for the time and in the manner
provided by law, fixing the time and place of heanng thereon for the 8 day of
November, 2005 at the hour of 8.30 a.m. in the Council Chambers, Yakima, Washington,
and further notice thereof was duly mailed by the City Clerk to each property owner on
the roll, and
WHEREAS, at the time and place fixed and designated in said notice, the hearing
on the assessment roll was duly held and the Council, sitting as a board of equalization,
gave due consideration to all written and oral protests received and all persons appearing
at said hearing.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF YAKIMA.
Section 1. The Council, sitting as a board of equalization and having made all
revisions to the roll it deems necessary, hereby finds and determines that the final
assessment roll for LID 1056 is just and equitable and that no assessment against property
within LID 1056 is greater than the special benefits to be denved from the improvements.
Accordingly, the final assessment roll, in the total amount of $376,384.82, is hereby
approved and confirmed, and the assessments set forth therein are hereby levied against
each lot, tract and parcel of property described in the roll.
Section 2. The Clerk of the City is hereby directed to place m the hands of the
Finance Director of the City for collection the fmal assessment roll for LID 1056 Upon
such placement, the amount of each assessment set forth m the roll, together with any
interest or penalty imposed from time to time, shall become a hen agamst the property so
assessed. The lien shall be paramount and superior to any other hen or encumbrance
whatsoever therefore, or thereafter created, except a hen for general taxes.
Section 3. Upon receipt of the final assessment roll for LID 1056, the Finance
Director of the City is hereby directed to publish notice at the times and m the manner
required by RCW 35 49 010, statmg that the roll is m his hands for collection and that
such assessments or any portion thereof may be paid to the City at any time withm 30
days from the date of the first publication of such notice, without penalty, interest or
costs.
Section 4. The amount of any assessment, or any portion thereof, agamst property
m LID 1056 not paid within the 30 day period from the date of the first publication of the
Finance Director's notice shall be payable m ten (10) equal annual mstallments, together
with mterest on the diminishing principal balance thereof at a rate of either (i) Y2% per
annum higher than the interest rate on bonds that may be sold to finance the costs of LID
1056, (ii) 8 75% per annum if the City provides mternal fmancmg for the costs of LID
1056, (Hi) m no case shall the rate exceed 8 75% per annum to the LID holder Interest
shall commence on the 30 day followmg first publication of such notice. The first
installment shall become due and payable one year from the expiration of the 30 -day
prepayment period. Annual mstallments, including mterest and any penalty, shall be paid
in full when due, and no partial payments shall be accepted by the Finance Director of the
City
Section 5. Any installment not paid when due shall thereupon become delmquent.
All delmquent installments shall be subject to a penalty equal to12% per annum of the
amount of the mstallment, mcluding mterest, from the date of the delinquency until paid.
Section 6. The hen of any assessment may be discharged at any time after the 30-
day prepayment period by payment of the entire prmcipal amount of the assessment
remammg unpaid together with interest thereon to the due date of the next installment.

Section 7. If any one or more of the provisions of this ordmance shall be declared
by a court of competent jurisdiction to be contrary to law, then such provision shall be
null and void and shall be deemed severable from the remaining provisions of this
ordmance and shall m no way affect the validity of the other provisions of this ordmance.
Section 8. This ordmance shall be m full force and effect thirty days after its
passage, approval and publication as provided by law and by the City Charter

South 7`n 8th & 9 Avenue Sewer Local Improvement District
To The Honorable, The City Council of Yakima, Washington
Complying with Ordinance No.2004 -45, being an ordinance creating Local
Improvement District No 1056, I have prepared the following Assessment Roll in
accordance with Yakima Municipal Code 8 12 and the Laws of the State of Washington.
I find that the actual cost of said improvement was and is the sum of $376,384 82 and
that said amount is equitably apportioned in the within roll to the property therein
described according to the benefits resulting from said improvements to each lot, tract,
piece or parcel thereof, as set opposite each of said tracts respectively in the column
marked "Final Assessment ", and I certify that this Assessment Roll, consisting of twelve
sheets and one diagram, is a true and correct assessment roll for the aforesaid
improvement.
I hereby transmit this roll for equalization and confirmation.

Notice is hereby given by the undersigned, the city clerk of the City of Yakima,
Washington, that the assessment roll covering Local Improvement District No 1056 (South
7 8 and 9` Avenues Sewer LID) as created and established by Ordinance No 2004 -35 of
the ordinances of the City of Yakima is now on file in the office of the City Clerk of said City
and open for public inspection Notice is also given that Tuesday, the 8 of November,

WHEREAS, all persons who may desire to be heard with reference to said proposed
final assessments are hereby directed to appear at a meeting of the City Council to be held in
its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of
8:30 o'clock a.m. on Tuesday November 8, 2005 which time and place are hereby fixed for
the hearing of all matters relating to said proposed improvement or objections thereto, and
for determing the method of payment for said improvement; and the City Clerk is hereby
directed to give due notice of said heanng and of the intention to make the aforesaid
improvements.
WHEREAS, all costs and expenses in connection with the construction of said

It is time to meet to determine the cost to be shared by each property owner for the
installation of sewer lines in the South 7` 8` and 9 Avenue areas The LID provides
for construction of the improvement, with financing over a 10 -year period The actual
construction costs determine the final assessment, with the cost shared by the property
owners. Property owners are not required to connect to the sewer upon completion of the
project, but the service is available if a septic failure should occur
A meeting will be held on Wednesday October 26 2005 to discuss the shared cost to

The City will finalize the LID process after costs are determined The LID option allows
the City to assist you with all aspects of the project, including financing over a 10 -year

SUMMARY EXPLANATION
The 7th, 8th & 9th Ave. Sewer Local Improvement District (LID) was formed to construct a new
sewer main to serve 79 parcels. Approximately 3,910 lineal feet of 8 -inch sewer main and
appurtenances was installed beginning at the existing sewer line located at the north end of South
7th Avenue on Mead Ave. to King St., the north end of South 8th Ave. on Mead to Spokane St. and
the north end of S. 9th Ave. on Mead to Spokane St.
Final Assessment Roll
The Final Assessment Roll identifies the properties in the L.I.D boundary by Yakima County
Parcel numbers. The parcels correspond to the location map The Assessment Roll provides the
name of the property owner as shown on the tax rolls of the County Treasurer, and the
Preliminary and Final 'ssessment. The complete names and addresses by which the Public
Hearing Notices were mailed are on tile in the Engineering Division.
The Final Assessment Roll of $376,384.82 is pro -rated to 79 parcels within the S. 7th, 8th, & 9th Ave
Sewer L.I.D based on the cost per parcel and improvements. Proceedings for this L.I.D are
proper and in conformance with L.I.D statutes. Proper notice has been given in accordance with
State law The City has met the intent of the State Law with assessments proportional within the
district to the special benefit derived.

ORDINANCE NO 2005 -66
AN ORDINANCE of the City of Yakima, Washington, approving and confirming the
final assessment roll for South 7 8`", & 9 Avenue Sewer Local
Improvement District No 1056, which has been created and
established for the purpose of paying the cost of certain sewer
system improvements, and levying and assessing the amount
thereof against the lots, tracts, parcels of land and other property
shown on said roll.
WHEREAS, an assessment roll levying special assessments against the
properties located in Local Improvement Distnct No 1056 ( "LID 1056 "), in Yakima,
Washington, created under Ordinance No 2004 -35, was filed with the City Clerk of the
city of Yakima as provided by law; and
WHEREAS, notice of the time and place of a hearing on and of making
objections to the assessment roll was duly published at and for the time and in the manner
provided by law, fixing the time and place of hearing thereon for the 8 day of
November, 2005 at the hour of 8 30 a.m. in the Council Chambers, Yakima, Washington,
and further notice thereof was duly mailed by the City Clerk to each property owner on
the roll, and
WHEREAS, at the time and place fixed and designated in said notice, the heanng
on the assessment roll was duly held and the Council, sitting as a board of equalization,
gave due consideration to all wntten and oral protests received and all persons appearing
at said heanng.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF YAKIMA.
Section 1. The Council, sitting as a board of equalization and having made all
revisions to the roll it deems necessary, hereby finds and determines that the final
assessment roll for LID 1056 is dust and equitable and that no assessment against property
within LID 1056 is greater than the special benefits to be derived from the improvements.
Accordingly, the final assessment roll, in the total amount of $376,384 82, is hereby
approved and confirmed, and the assessments set forth therein are hereby levied against
each lot, tract and parcel of property described in the roll.

Section 2. The Clerk of the City is hereby directed to place in the hands of the
Finance Director of the City for collection the final assessment roll for LID 1056 Upon
such placement, the amount of each assessment set forth in the roll, together with any
interest or penalty imposed from time to time, shall become a hen against the property so
assessed. The hen shall be paramount and superior to any other hen or encumbrance
whatsoever therefore, or thereafter created, except a hen for general taxes
Section 3. Upon receipt of the final assessment roll for LID 1056, the Finance
Director of the City is hereby directed to publish notice at the times and in the manner
required by RCW 35 49 010, stating that the roll is in his hands for collection and that
such assessments or any portion thereof may be paid to the City at any time within 30
days from the date of the first publication of such notice, without penalty, interest or
costs.
Section 4. The amount of any assessment, or any portion thereof, against property
in LID 1056 not paid within the 30 day period from the date of the first publication of the
Finance Director's notice shall be payable in ten (10) equal annual installments, together
with interest on the diminishing principal balance thereof at a rate of either (i) '/2% per
annum higher than the interest rate on bonds that may be sold to finance the costs of LID
1056, (ii) 8 75% per annum if the City provides internal financing for the costs of LID
1056, (in) in no case shall the rate exceed 8 75% per annum to the LID holder Interest
shall commence on the 30 day following first publication of such notice. The first
installment shall become due and payable one year from the expiration of the 30 -day
prepayment period. Annual installments, including interest and any penalty, shall be paid
in full when due, and no partial payments shall be accepted by the Finance Director of the
City
Section 5. Any installment not paid when due shall thereupon become delinquent.
All delinquent installments shall be subject to a penalty equal to12% per annum of the
amount of the installment, including interest, from the date of the delinquency until paid.
Section 6. The lien of any assessment may be discharged at any time after the 30-
day prepayment penod by payment of the entire pnncipal amount of the assessment
remaining unpaid together with interest thereon to the due date of the next installment.

Section 7. If any one or more of the provisions of this ordinance shall be declared
by a court of competent jurisdiction to be contrary to law, then such provision shall be
null and void and shall be deemed severable from the remaining provisions of this
ordinance and shall in no way affect the validity of the other provisions of this ordinance.
Section 8. This ordinance shall be in full force and effect thirty days after its
passage, approval and publication as provided by law and by the City Charter

ORDINANCE NO. 2005 -66
AN ORDINANCE of the City of Yakima, Washington, approving and confirming the
final assessment roll for South 7 8 & 9 Avenue Sewer Local
Improvement District No 1056, which has been created and
established for the purpose of paying the cost of certain sewer
system improvements, and levying and assessing the amount
thereof against the lots, tracts, parcels of land and other property
shown on said roll.
WHEREAS, an assessment roll levying special assessments against the
properties located in Local Improvement Distract No 1056 ( "LID 1056 "), in Yakima,
Washington, created under Ordinance No 2004 -35, was filed with the City Clerk of the
city of Yakima as provided by law; and
WHEREAS, notice of the time and place of a hearing on and of making
objections to the assessment roll was duly published at and for the time and in the manner
provided by law, fixing the time and place of hearing thereon for the 8 day of
November, 2005 at the hour of 8.30 a.m. m the Council Chambers, Yakima, Washington,
and further notice thereof was duly mailed by the City Clerk to each property owner on
the roll, and
WHEREAS, at the time and place fixed and designated in said notice, the hearing
on the assessment roll was duly held and the Council, sitting as a board of equalization,
gave due consideration to all wntten and oral protests received and all persons appearing
at said hearing.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF YAKIMA:
Section 1. The Council, sitting as a board of equalization and having made all
revisions to the roll it deems necessary, hereby finds and determines that the final
assessment roll for LID 1056 is dust and equitable and that no assessment against property
within LID 1056 is greater than the special benefits to be derived from the improvements.
Accordingly, the final assessment roll, in the total amount of $376,384 82, is hereby
approved and confirmed, and the assessments set forth therein are hereby levied against
each lot, tract and parcel of property described in the roll.

Section 2. The Clerk of the City is hereby directed to place m the hands of the
Finance Director of the City for collection the final assessment roll for LID 1056 Upon
such placement, the amount of each assessment set forth in the roll, together with any
interest or penalty imposed from time to time, shall become a lien against the property so
assessed. The hen shall be paramount and supenor to any other lien or encumbrance
whatsoever therefore, or thereafter created, except a hen for general taxes.
Section 3. Upon receipt of the final assessment roll for LID 1056, the Finance
Director of the City is hereby directed to publish notice at the times and in the manner
required by RCW 35 49 010, stating that the roll is in his hands for collection and that
such assessments or any portion thereof may be paid to the City at any time within 30
days from the date of the first publication of such notice, without penalty, interest or
costs.
Section 4. The amount of any assessment, or any portion thereof, against property
in LID 1056 not paid within the 30 day penod from the date of the first publication of the
Finance Director's notice shall be payable in ten (10) equal annual installments, together
with interest on the dimimshing principal balance thereof at a rate of either (i) ' /z% per
annum higher than the interest rate on bonds that may be sold to finance the costs of LID
1056, (ii) 8 75% per annum if the City provides internal financing for the costs of LID
1056, (iii) m no case shall the rate exceed 8.75% per annum to the LID holder Interest
shall commence on the 30 day following first publication of such notice. The first
installment shall become due and payable one year from the expiration of the 30 -day
prepayment penod. Annual installments, including interest and any penalty, shall be paid
in full when due, and no partial payments shall be accepted by the Finance Director of the
City
Section 5. Any installment not paid when due shall thereupon become delinquent.
All delinquent installments shall be subject to a penalty equal to12% per annum of the
amount of the installment, including interest, from the date of the delinquency until paid.
Section 6. The lien of any assessment may be discharged at any time after the 30-
day prepayment period by payment of the entire principal amount of the assessment
remaining unpaid together with interest thereon to the due date of the next installment.

Section 7. If any one or more of the provisions of this ordinance shall be declared
by a court of competent jurisdiction to be contrary to law, then such provision shall be
null and void and shall be deemed severable from the remaining provisions of this
ordinance and shall m no way affect the validity of the other provisions of this ordinance.
Section 8. This ordinance shall be m full force and effect thirty days after its
passage, approval and publication as provided by law and by the City Charter

of November, 2005
