AN ORDINANCE concerning land use regulation and comprehensive planning
and amending the Future Land Use Map of the Yakima Urban
Area Comprehensive Plan as follows changing the
classification of the property located at 101 North Naches
Avenue (parcel no 191319 - 21482) from Professional Office to
CBD Core Commercial, changing the classification of the
properties located at 904 and 906 North Fourth Street (parcel no
191318 - 23584) from Low Density Residential to Neighborhood
Commercial, and changing the classification of the property
located at 1708 South 16th Avenue (parcel no 181335 - 14402)
from Medium Density Residential to Neighborhood
Commercial.
WHEREAS, the Washington State Growth Management Act (GMA) requires
counties and cities to prepare long -range comprehensive plans pursuant to Ch.
36 70A RCW and related laws and regulations, and
WHEREAS, RCW 36 70A.130 provides for continuing review and evaluation
of comprehensive plans and development regulations at least every five years and
for the revision or amendments to such plans not more than once a year but at least
once every five years, with certain exceptions, and
WHEREAS, RCW 36 70A.470 requires that counties and cities planning under
RCW 36 70A.040 include in their development regulations a procedure for any
interested person, including applicants, citizens, hearing examiners, and staff of
other agencies, to suggest comprehensive plan or development regulation
amendments, and
WHEREAS, RCW Ch. 36 70A further requires that the suggested amendments
be docketed and considered not more often than once a year, consistent with the
provisions of RCW 36 70A.130, and
WHEREAS, on March 18, 2003, the City Council enacted Ch. 1610 YMC to
provide procedures and criteria for amending and updating the Yakima Urban Area
Comprehensive Plan, and
WHEREAS, United Builders has submitted an application requesting that the
classification of the property located at 101 North Naches Avenue (parcel no 191319-
21482) be changed from Professional Office to CBD Core Commercial on the Future
Land Use Map of the Yakima Urban Area Comprehensive Plan (hereinafter "CPA
#1-05"), and

WHEREAS, D &R Garza Properties, LLC, has submitted an application
requesting that the classification of the properties located at 904 and 906 North
Fourth Street (parcel no 191318 - 23584) be changed from Low Density Residential to
Neighborhood Commercial on the Future Land Use Map of the Yakima Urban Area
Comprehensive Plan (hereinafter "CPA #2-05"), and
WHEREAS, DH Construction & Development, Inc., has submitted an
application requesting that the classification of the property located at 1708 South
16th Avenue (parcel no 181335 - 14402) be changed from Medium Density Residential
to Neighborhood Commercial on the Future Land Use Map of the Yakima Urban
Area Comprehensive Plan (hereinafter "CPA #3 -05 ") and
WHEREAS, in accordance with YMC Chapter 16 10, the Regional Planning
Commission held appropriate meetings and hearings to review and consider the
requested comprehensive plan amendments, and
WHEREAS, pursuant to YMC 16 10 080 and the approval criteria set forth in
YMC 16 10 040, the Regional Planning Commission made a recommendation to a
joint meeting of the City Council and Yakima County Commissioners that the
requested comprehensive plan amendments described above be approved, and
WHEREAS, pursuant to YMC 1610 090, on October 18, 2005, a public hearing
regarding the requested comprehensive plan amendments described above was held
before a joint meeting of the City Council and Yakima County Commissioners, and
City Council directed City staff to prepare appropriate legislation to - approve the
requested comprehensive plan amendments, and
WHEREAS, it is in the best interests of the City to enact the following to
approve the requested comprehensive plan amendments described above, now,
therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1. Subject to the specific terms of this ordinance, the Yakima City
Council adopts the August 17, 2005, findings, conclusions and recommendations of
the Regional Planning Commission for CPA # 1 -05, CPA # 2 -05, and CPA # 3 -05 A
copy of said recommendations is attached as Exhibit A and is incorporated herein by
this reference
Section 2. Regarding CPA #1 -05 and the subject property, the legal
description of which is attached to this ordinance as Exhibit B, which is incorporated
by reference in this ordinance, the City Council finds as follows
a. The subject property is suitable to be classified as CBD Core Commercial on
the Future Land Use Map of the Yakima Urban Area Comprehensive Plan,

b The requested Comprehensive Plan Amendment would better implement
relevant Comprehensive Plan policies pertaining to the use of the downtown
area as the regional center for commerce and cultural land uses,
c. The requested Comprehensive Plan Amendment is consistent with and
complies with.
• The requirements and considerations set forth in Yakima Municipal Code
Chapter 16 10,
• The goals and policies of the Yakima Urban Area Comprehensive Plan,
• The Growth Management Act, RCW Chapter 37 70A, and the Yakima
County Wide Planning Policy (CWPP),
d. The cumulative impacts of this request together with all previous
Comprehensive Plan Amendments have been considered and support the
requested amendment.
Section 3 Regarding CPA #2 -05 and the subject property, the legal
description of which is attached to this ordinance as Exhibit C, which is incorporated
by reference in this ordinance, the City Council finds as follows
a. The subject property is suitable to be classified as Neighborhood Commercial
on the Future Land Use Map of the Yakima Urban Area Comprehensive Plan,
b Circumstances have changed since the property was classified as Low Density
Residential which now make the requested Comprehensive Plan Amendment
appropriate,
c. The requested Comprehensive Plan Amendment is consistent with and
complies with.
• The requirements and considerations set forth in Yakima Municipal Code
Chapter 1610,
• The goals and policies of the Yakima Urban Area Comprehensive Plan,
• The Growth Management Act, RCW Chapter 37 70A, and the Yakima
County Wide Planning Policy (CWPP),
d The cumulative impacts of this request together with all previous

Section 4. Regarding CPA #3 -05 and the subject property, the legal

a. The subject property is suitable to be classified as Neighborhood Commercial
on the Future Land Use Map of the Yakima Urban Area Comprehensive Plan,

b Circumstances have changed since the property was classified as Medium
Density Residential which now makes the requested Comprehensive Plan
Amendment appropriate,
c. The requested Comprehensive Plan Amendment is consistent with and
complies with.
• The requirements and considerations set forth in Yakima Municipal Code

• The goals and policies of the Yakima Urban Area Comprehensive Plan,
• The Growth Management Act, RCW Chapter 37 70A, and the Yakima

Section 5. The official Future Land Use Map of the Yakima Urban Area
Comprehensive Plan shall be amended or modified to reclassify the subject real
properties set forth herein consistent with the above sections of this ordinance
Section 6. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance is declared invalid or unconstitutional for any reason, such decision
shall not affect the validity of the remaining portions of this ordinance
Section 7 The City Clerk is hereby authorized and directed to file a
certified copy of this ordinance with the Yakima County Auditor
Section 8. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter

approved this 6th day of December , 2005

COMPREHENSIVE PLAN AMENDMENTS
August 17, 2005
WHEREAS
The Yakima Urban Area Comprehensive Plan was adopted by the City and County in April 1997
The Washington Growth Management Act and local ordinances provide a process for the annual
review of amendments to the Plan as requested by citizens, property owners and/or local
government
For the 2005 amendment review process, three requests were made for possible amendments to
the Future Land Use Map
The Yakima Urban Area Regional Planning Commission is responsible for the review of each
request and for recommending approval, modification or denial of each request.
Public Hearmg and Commission discussions were conducted by the RPC on said requests on
June 27, 2005 and July 13, 2005
The RPC concluded its consideration of these three applications on August 10, 2005
Now therefore, the Yakima Urban Area Regional Planning Commission presents the
following findings and recommendations to the Board of Yakima County Commissioners
and Yakima City Council:
SUMMARY OF RECOMMENDATION FOR CPA # 1 -05
APPLICANT: United Builders
LOCATION. 101 N Naches Avenue
PARCEL NO: APN #191319 -21482
DESCRIPTION OF REQUEST:
The applicant requests a change m the Future Land Use Map from Professional Office to CBD
Core Commercial. Future zoning would be Central Business District (CBD), if the amendment
is approved.

DESCRIPTION OF REQUEST:
The applicant requests a change in the Future Land Use Map from Professional Office to CBD
Core Commercial. Future zoning would be Central Business Distnct (CBD), if the amendment
is approved.
This property contains the building that was until recently the Christian Science Church. It
recently underwent a Class (3) review and was approved for a restaurant and uses accessory
thereto
FINDINGS:
The subject property is adjacent to CBD Core Commercial property and the requested land use
change will not have any significant affect on adjoining properties. The residential/commercial
buffer currently provided by the Professional Office land use designation will not be affected.
Adaptive reuse of the existing church property would not cause higher intensity commercial uses
to abut residential uses.
The Comprehensive Plan mdicates that the downtown area is to be the regional center for
commerce and cultural land uses.
The granting of this request would fulfill a major objective of the existmg Comprehensive Plan
without conflicting with other goals and policies.
Approval of this request will not affect the cumulative impacts of other Comprehensive Plan
applications.
RPC CONCLUSIONS:
The amendment is minor in nature.
No adverse impacts have been identified by tills amendment request.
The amended land use boundaries would be a logical extension of existing commercial
boundaries.
MOTION
Based upon the analysis, findings and conclusions outlined above, it was moved and seconded
that the Regional Planning Commission recommend APPROVAL of the amendment request
from Professional Office to CB Core Commercial. The motion carried unanimously

DESCRIPTION OF REQUEST:
The applicant requests a change in the Future Land Use Map from Low Density Residential to
Neighborhood Commercial. Future zoning would be HB, Historical Busmess if the amendment
is approved.
FINDINGS:
There have been land use changes since the adoption of the Comprehensive Plan.
There was an error made in 1997 by not including this property in the original mapping of the
HB zoning district.
A granting of this request would affirm the current use of the site without negatively affecting
the surroundmg area. This would be consistent with the CWPP policies regardmg Plan
flexibility
The impact of this application's approval when considered along with the cumulative impacts of
previous amendments and the ongmal Comprehensive Plan were determmed to be of no
consequence.
RPC CONCLUSIONS:
The amendment is minor m nature.
No adverse impacts have been identified by this amendment request.
The amended land use boundaries will serve to correct an obvious mapping error

LOCATION: 1708 South 16 Avenue
PARCEL NO: APN #181315 -14402
DESCRIPTION OF REQUEST:
The apphcant requests a change m the Future Land Use Map from Medium Density Residential
to Neighborhood Commercial. Future zoning would be B -1, Professional Business, if the
amendment is approved.
FINDINGS:
There have been significant land use changes m this area. This property and the two properties
located immediately to the north are the only remaining residentially utilized properties to be
found along the west side of S 16 Avenue when traveling north from the airport to Midstate
Monument Co
Commercial redevelopment of this property would cause commercial uses and/or parking to abut
the side yard of the northerly residential parcel. Ultimately, however, the goal of this request is
to use this land for B -1 types of land use, which are considered to be compatible with the land
uses permitted in the R -2 zoning district.
The Professional Office Future Land Use Map designation is more appropriate for a rezone to B-
1 than would be Neighborhood Commercial.
A granting of this request would conform better with existmg uses. This would be consistent
with the CWPP policies regarding Plan flexibility
Approval of this application may prompt the future rezoning of the two remaining R-2 lots
located to the north.
DISCUSSION OF ENVIRONMENTAL ANALYSIS (SEPA)
The Environmental Checklist submitted by the Applicant divulges no direct sigmficant adverse
environmental impacts.
One June 30, 2004 a preliminary Determmation of Nonsignificance (DNS) was issued for this
proposal. The final DNS was issued on July 25, 2005 and the 15 -day appeal period lapsed on
August 9, 2005
RPC CONCLUSIONS:
The amendment is minor m nature.

Yakima County Code (YCC) Title 15A section references are intended to be equivalent to provisions of
the Yakima Urban Area Zoning Ordinance codified as the City of Yakima Municipal Code (YMC) Title 15
Section 1 Amend Section 15A.02.020 Definitions by adding the following new definition
between the terms Standard and State Siting:
State Fair Park means the area of land and various properties owned, leased or occupied by the
Central Washington State Fair, a unique fixed location campus specifically authorized by 15 76
RCW and this Title that is dedicated to providing a special venue for Community Uses,
Commercial Uses, Trade Shows and Exposition Uses, Special Event Uses, Destination Attraction
Uses, Permitted Uses and similar events (See Table 4 -1 and Section 15A.04 135)
Section 2. Amend Section 15A.04.030 Table of Permitted Land Uses as follows
A) Amend Table 4 -1 Amusement and Recreation use list as follows
(1) Delete "Fairgrounds" and related class review from Ml District;
(2) Add "State Fair Park (sec 15A.0'.135) ( *) "; and
(3) Add "1" under CBDS for this use.
B) Amend Table 4 -1 Community Services use list as follows
(1) Add new use "State Fair Park (see 15A.04 135) ( *)" between "Schools" and
"Storage of Gravel ", and
(2) Add "1" under CBDS for this use
Section 3 Amend Chapter 15A.04 by adding the following new Section.
15A.04.135 State Fair Park - Exposition & Special Events Center
(a) Purpose to establish permitted uses and special development standards for the very
unique fixed campus of uses and activities of the Central Washington Fairgrounds,
hereafter known as the State Fair Park - Exposition & Special Events Center This
section is intended to provide regulatory guidance that will ensure production integrity
and economic performance of existing uses and continued development of the campus
The State Fair Park produces and hosts activities in multi -use facilities established
specifically to address the unique market response, operations and sustainable economic
performance requirements of the fair, exposition and special events industry These
include production and operational requirements of the annual Central Washington State
Fair and non -fair events and use activities, a broad array of land uses and the overall mix
of types of uses found to be consistent with the State statutory authorizations for
Agricultural Fairs (RCW 15 76) and County Fairs (RCW 36.37), in addition to those uses
allowed in the Central Business District Support (CBDS) zoning district.

On October 18, 2005, following a joint City /County hearing, it was voted to accept the Regional
Planning Commission's findings and recommendations concerning the 2005 Comprehensive
Plan Amendment requests The ordinance that will affect these changes to the Future Land
Use Map of the Comprehensive Plan is herein submitted and you are now being requested to
adopt it.
