AN ORDINANCE concerning land use regulation and comprehensive planning, eliminating
applications or proposals for amendments to the comprehensive plan in
those years where GMA comprehensive Plan updates are required by
RCW; providing city council discretion to avoid the amendment
proceedings in a given year by resolution, if council so chooses, and
amending section 16 10 030(1) of the City of Yakima Municipal Code
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1 Section 16 10 030 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"16.10.030 Procedures.
(1) Applications or proposals for amendments to the comprehensive plan text or map
designations shall be accepted on an annual basis except in those years when GMA
comprehensive plan updates are required as provided in RCW 36 70A.130(4)(c) if the City
Council elects, by resolution, not to open the amendment process in any particular year For
those years that the comprehensive plan amendment process does open, the regional
planning commission shall hold a public meeting in February to announce that the
comprehensive plan amendment process is open to accepting applications At that time, the
regional planning commission will invite public comments and suggestions regarding proposed
changes to the comprehensive plan
(2) All comprehensive plan amendments shall be considered legislative actions and subject to
the procedures in this chapter
(3) Applications must comply with YMC Section 16 10 040 and be submitted by the last
business day in April in order for a proposed amendment to be included in that year's process
(4) Future land use map changes may be initiated by the subject property owner(s), or by
planning staff, by using the appropriate application forms. The regional planning commission
shall docket all future land use map amendment requests for further review and consideration
if the amendment application is deemed complete as provided for herein.
(5) Other plan policy map and /or text amendments may be initiated by any person, including
planning staff, by using the appropriate application forms The regional planning commission
shall docket all such amendments for further review and consideration if the amendment
application is deemed complete as provided for herein.
(6) After completion of the amendment docketing process, the regional planning commission
shall invite public comment regarding docketed amendment(s) concurrently with the notice
announcing the regional planning commission public hearing at which proposed amendments
will be reviewed.
(7) Additional documentation may be needed to address public facilities and services elements
that may be necessary for a proposed amendment. Examples of such services may include
water, sewer, storm drainage, transportation, police and fire protection, and schools. Planning
staff will assist applicants in identifying additional documentation necessary to enable
appropriate review
(8) After proposed amendments are docketed.
(a) The planning staff will review the docketed comprehensive plan amendments together with
such review as may be required under the State Environmental Policy Act (SEPA), Chapter
43.21C RCW, and Chapter 6 88 YMC

(9) No comprehensive plan amendment applications shall be docketed after the last business

Section 2 This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter

Re Proposed Revision to the Yakima Municipal Code regarding the Annual
Comprehensive Plan Amendment Process
NOTICE IS HEREBY GIVEN that the Yakima City Council will conduct a public
hearing to receive comments on a proposal to amend the Yakima Municipal Code
Chapter 16 10 to authorize the City Council to suspend the annual Comprehensive Plan
process under certain conditions. The amendment concerns land use regulation and
comprehensive planning, suspending the process to accept applications or proposals for
amendments to the comprehensive plan in those years where GMA comprehensive plan
updates are required by RCW, and providing city council discretion to avoid the
amendment proceedings in a given year by resolution, if council so chooses.
Written comments can also be submitted to the Council in two ways.
1) Send a letter via regular mail to "Yakima City Council, 129 N 2 " Street,
Yakima, Wa. 98901'; or,
2) E -mail your comments to ccouncil ci.yakima.wa.us. Include in the e-mail
subject line, "YMC 16 10 amendment." Please also include your name and
mailing address.
The public hearing will be held on December 6, 2005, at 2 00 p m., or soon
thereafter, in the Council Chambers at Yakima City Hall, 129 North 2 Street, Yakima,

SUMMARY EXPLANATION
This is a public hearing on the amendment to suspend the annual comprehensive
plan amendment process during required Washington State GMA mandated
comprehensive plan update years The City of Yakima's GMA present update is
required by 36 70A130(4) RCW to complete by December 1, 2006 Current State law
would require the next update for the City of Yakima to be December 1, 2013, which is
a seven -year cycle

COUNCIL ACTION The hearmg was held and closed, the amended ordinance was

Currently Chapter 16 10 030 YMC requires that, "Annually, the City Council shall
open the comprehensive plan amendment process " This becomes problematic
during those years when the city is also required by the Washington State GMA
36 70A to update the comprehensive plan every seven years The process of
concurrently both amending and updating the comprehensive plan is illogical and
duplicative of effort. The solution is to entirely forego the amendment process during
those years when an update is required The ordinance that you are being asked to
consider will affect this change Washington State GMA 36 70A states that the
comprehensive plan amendment process shall not occur "more frequently than once a
year Therefore it is understood that any city in Washington State can suspend the
amendment process
The City Council adopted the YMC 16 10 Comprehensive Plan and Development
Regulation Amendment Procedures in 2003, which included an annual amendment
process
In YMC Section 16 10 030 it states, "Annually, the city council shall open the
comprehensive plan amendment process and the regional planning commission shall
hold a public meeting in February to announce that the comprehensive plan
amendment process is open to accepting applications "
The Washington State mandatory 2006 Comprehensive Plan update will consume
the entire year to review, hold meetings, process each element and present to the
Regional Planning Commission and public. The City/County joint elected body will
hold a public hearing on the adoption of the Comprehensive Plan update late in 2006
For the above - mentioned process staff is requesting the City Council adopt the
ordinance amendment to suspend the Comprehensive Plan amendment process in
any one year by resolution and to automatically suspend the Comprehensive plan
amendment process in the Washington State mandated years (ie every seven years)
