AN ORDINANCE authorizing and.directing the law firm of Lyon,
• Beaulaurier, Weigand, Suko & Gustafson to insti-
tute and prosecute legal proceedings for the
condemnation and acquisition of real property for
the widening and improving of the intersection of
40th Avenue and Summitview Avenue and for the in-
• • stallation of curbs, gutters, sidewalks, drainage
facilities and public utility facilities related
thereto; providing for the condemnation and
taking of such real property and declaring the
condemnation and taking thereof to be necessary
for a public use required by the public inter-
ests; directing that compensation for such taking
be paid from fund number 142 - Arterial Street
Fund of the City of Yakima and fund number 143 -
Urban Arterial Board Fund of the City of Yakima.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section I The - law firm of Lyon, Beaulaurier, Weigand,
Suko & Gustafson, hereafter called law firm, is hereby autho-
rized and directed to institute and prosecute an in the
Superior Court of the State of Washingtonip and for *Yakima

County, for the condemnation and acquisition of'the •

of the intersection of 40th Avenue aad .:,Summitview Avenue in
the City of Yakima, Washington, and fOt'? 016 :i-iiStallation of
curbs, gutters, sidewalks, drainage facilities and public
utility facilities related thereto, all in accordance with
preliminary plans for such imptovement project as depicted on
drawings prepared by the Yakima City Engineer, a copy of which
drawings is on file in the office of the City Engineer and
incorporated herein by reference. Said real property is

legally described on "Exhibit A to Condemnation Ordinance"
attached to this ordinance and by reference made a part
hereof.
Section 2. The acquisition of said real property for the
purposes herein mentioned is required for the interests of the
public and of the City of Yakima, and the uses and purposes
411 herein mentioned do constitute a public use of said property,
and said real property is necessary for the use and purposes
mentioned herein.

Section 3: The 'compensation for said real property to be
taken shall be payable from fund number 142 - Arterial Street
Fund of the City of Yakima and fund number 143 - Urban Arte-
rial Board fund of the City of Yakima.

Section 4. This ordinance shall be in full force and

effect thirty days after its passage, approval and publication
as provided by law and by the City Charter.

EXHIBIT A TO CONDEMNATION ORDINANCE
The north 10 feet of the south 98 feet of the north 118 feet
of the east 145 feet of the west 170 feet of the east half of
the northwest quarter of the northwest quarter of the south-
east quarter of Section 22, Township 13 North, Range 18,
E.W.M.
and
Beginning at a point on the north line of the south 88 feet of
the north 118 feet of the east 145 feet of the west 170 feet
of the east half of the northwest quarter of the northwest
quarter of the southeast quarter of Section 22, Township 13
North, Range 18, E.W.M., which is 10 feet east of the north-
west corner thereof; thence southwesterly in a straight line
to a point on the west line of said subdivision which is 10
feet south of the northwest corner thereof; thence north to
the northwest corner of said subdivision; thence east to the
point of beginning.
The north 8 feet of the following described property:
That part of the northeast quarter of the southwest quarter of
Section 22, Township 13 North, Range 18, E.W.M., described as
follows:
Beginning at a point 160 feet west and south 0 19'30" east 30
feet from the northeast corner of said subdivision; thence
west 170 feet to the west line of the east half of the east
half of said subdivision; thence south 9,19'30" east 263.31
feet to the right-of-way of the Yakima 1.711ey Canal Company's
canal; thence north 82 50' east along said right-of-way line
39.91 feet; thence north 85 17' east along said right-of-way
line 21.18 feet; thence north 87 29' east along said right-of-
way line 38.08 feet; thence south 81 57' east along said
right-of-way line 31.14 feet; thence 66 04' east along said
right-of-way line 28.16 feet; thence south 55 22' east along
said right-of-way line 17.96 feet; thence north 0 19'30" west
280.92 feet to the point of beginning.
EXCEPT the north 3 feet conveyed to City of Yakima for street.
