ORDINANCE NO 2006 - 34 AN ORDINANCE relating to land use regulation and zoning, rezoning, with conditions, one parcel of property located in the vicinity of 904 North 4 Street, Yakima, Washington from Single Family Residential (R -1) to Historical Business (HB) as more fully described herein, and approving, with conditions, the recommendation of the Hearing Examiner for the City of Yakima regarding the same, D & R Garza Properties, LLC being identified as the applicant herein WHEREAS, by application dated February 14, 2006, D & R Garza Properties, LLC requested a rezone of Yakima County Assessor's Parcel No 191318-23584, located at 904 North 4 Street, Yakima, Washington (hereinafter "Subject Property "), from Single Family Residential (R -1) to Historical Business (HB), and WHEREAS, on April 27, 2006 the Hearing Examiner for the City of Yakima conducted an open- record public hearing regarding the requested rezone, and WHEREAS, on May 11, 2006 the Hearing Examiner issued Hearing Examiner's Recommendation regarding UAZO RZ #4 -06, EC #9 -06, (the "recommendation ") recommending that the Subject Property be rezoned from Single Family Residential (R -1) to Historical Business (HB), and WHEREAS, at a closed- record public hearing held on July 11 2006, the City Council considered the requested rezone, including the documents and other evidence which comprise the record developed before the Hearing Examiner, the Hearing Examiner's Recommendation, and the statements and comments of interested persons, and WHEREAS, the City Council finds that the considerations of the Hearing Examiner in response to the requirements and criteria of Yakima Municipal Code ( "YMC ") § 15.23 030(E) and § 15 15 040(5) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein, and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following to approve the requested rezone, Now Therefore, (jc)ord /D &R Garza Properties- Rezone 1 BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1 The property located at 904 North 4 Street, Yakima, Washington (Yakima County Assessor's Parcel No 191318-23584), legally described in Exhibit "A ", attached hereto and incorporated herein by this reference, is hereby rezoned from Single Family Residential (R -1) to Historical Business (HB) Section 2. The findings within the May 11, 2006 Hearing Examiner's Recommendation (UAZO RZ #4 -06, EC #9 -06) regarding this rezone are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23 030(F), and are incorporated herein by this reference as if fully set forth herein Section 3. The Official Yakima Urban Area Zoning Map and all other zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified, subject to the conditions stated below, to reflect this rezone Section 4 The rezone granted by this ordinance is expressly conditioned on the Owner's satisfaction of the following conditions stated on page 8 of the Hearing Examiner's Recommendation a. The site plan submitted with the application shall serve as the final site plan b Any future construction or renovation on the subject property is subject to plan review and building permits. Section 5. Severabilit• If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance Section 6. The applicant is D & R Garza Properties, LLC and the applicant's representative is Bill Hordan of Hordan Planning Services, 410 North 2 " Street, Yakima, WA 98901 Location. The location of the requested rezone is 904 North 4th Street, Yakima, Washington and the parcel number is 191318 -23584 Application. A Determination of Nonsigmficance (DNS) was issued by the City of Yakima on July 25, 2005 pursuant to WAC 197-11 - 600(4)(a) relative to the request to change the comprehensive plan designation of the parcel from Low Density Residential to Neighborhood Commercial. A DNS was issued by the City on April 7, 2006 pursuant to WAC 197 -11 -355 relative to this request to rezone the parcel from Single - Family Residential to Historical Business. No appeal was filed during the SEPA appeal penod. Current Zoning and Land Uses. The site is currently zoned Single- Family Residential (R -1) and is improved with a laundromat with office and associated parking area. Recommendations regarding rezone applications withm the Yakima Urban Area must be based upon the following cntena specified m Section 15.23 030 of the Urban Area Zoning Ordinance (UAZO) 1) The testimony at the public hearing: Community Development Specialist Vaughn McBride, planning consultant Bill Hordan and applicant Ray Garza testified m favor of the requested rezone. This conclusion is supported by the character of the neighboring land use to the south which is a neighborhood convenience store located on a parcel zoned Histoncal Business. Since the laundromat and convenience store are both permitted uses in the HB zoning district, since both uses complement each other and since both uses serve the residential uses m the neighborhood, the parcel is suitable for the uses allowed under the proposed Histoncal Busmess zoning district, mcludmg the existing laundromat use 3) Recommendations from interested agencies and departments: No agency recommendations were submitted regarding this rezone request, and no issues requiring mitigation were raised at the Development Services Team meeting held on March 8, 2006 4) The extent to which the proposed rezone is in compliance with and /or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Ilan and the intent of the Zoning Ordinance: a) The Comprehensive Plan: Since the Future Land Use Map of the Yakima Urban Area Comprehensive Plan was recently amended on October 18, 2005 to designate the subject property as suitable for Neighborhood Commercial development, the Future Land Use Map to Zoning Map Consistency Chart provides that the Histoncal Busmess zoning district, with appropriate site considerations, is consistent with the comprehensive plan designation. The proposed rezone to allow HB uses would be m compliance with Objectives and Policies of the 1997 Comprehensive Plan such as Objective G1 1 which is to encourage the physical development of the Yakima Urban Area in a manner that enhances its image as the cultural and business center; Policy G1 1 which is to strive to make the Yakima urban area the center for activities throughout the D &R Garza Properties, LLC 4 RECEIVED Rezone from R -1 to HB �� � 904 North 4 Street MAY 1 1. 2006 `ND� x_ RZ # 4-06, EC #9-06 CITY OF YAK /MA 4 � — `" PLANNING DIV Yakima Valley by formmg public /pnvate partnerships that diversify the economic, cultural and service opportunities offered m the urban area, Policy G9 4 which is to encourage commercial, mdustnal, office and multi - family developments to locate in distinct clusters in planned growth areas, Policy H3 8 which is to develop a comprehensive approach to neighborhood improvement; and Policy C2 3 which is to allow and encourage small -scale mixed -use retail, residential and professional development within neighborhoods. b) The Zoning Ordinance: Section 15 03 030 of the UAZO states that the purpose of the Histoncal Business (HB) zoning district is to recogmze existing isolated commercial structures in otherwise residential areas, to allow those structures to be occupied by traditional neighborhood business uses and to allow those uses to be replaced if destroyed. Examples of permitted HB uses are small grocery stores, laundromats and other businesses that serve the immediate residential neighborhood. The laundromat on the parcel here proposed for the HB zone is consistent with that zoning distnct. The existing use on the parcel, with the approved adjustments of lot coverage and rear yard standards, complies with all site design and improvement standards of the zoning ordmance which further the intent of the HB zoning district expressed in Section 15 03 030 5) The adequacy of public facilities such as roads, sewer, water and other required public services- The property is currently served by all necessary public utilities. A 12 -inch City water lme and a 12 -inch City sewer lme are considered sufficient for the current laundromat use of the parcel. The requested rezone satisfied Concurrency Analysis under the Transportation Capacity Management Ordinance on September 9, 2005 The City Traffic Engmeer has determined that the exnstmg land use will not exceed the capacity of the artenal street system and that reserve capacity exists on all impacted artenal streets. The change of this property from R -1 to HB will bang it into conformance with the comprehensive plan and will pose no compatibility conflicts with existing nearby uses. The Laundromat is compatible with the neighborhood grocery store located on the adjoining parcel to the south and uses a shared dnveway and parking area with that store A six- foot -high view - obscunng fence buffers the single- family residential use to the north. To the west is an alley and then single- family residences that are also screened with a six - foot- high view - obscuring fence To the east is North 4 Street. No compatibility concerns have been raised during the heanng process 7) The public need for the proposed change: The recent change m the comprehensive plan designation for the property from Low Density Residential to Neighborhood Comiercial created a need for rezoning the property from a residential to a business zoning distract. HB zoning is consistent with the comprehensive plan designation. There is a pubhc need for commercial uses outside the central business district that provide neighborhood services There is also a public need for the City's zoning classifications to be consistent with its comprehensive plan designations. Consistency of the Rezone with Development Regulations and with the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the following factors 1) The types of land uses permitted at the site m the City's Histoncal Business (HB) zoning distract would be consistent with the comprehensive plan's Neighborhood Commercial designation for the site ' D &R Garza Properties, LLC 6 MAY 1 Rezone from R -1 to HB 1 2006 904 North 4 Street CITY Of YAKIMA tt 1C RZ 1 4 -06, EC #9 -06 PLANNING DIV N �� / 2) The density of residential development or the level of development such as units per acre or other measures of density would not be a factor weighing against this rezone request because the existing HB laundromat use is consistent with the density allowed by applicable zoning ordinance provisions, including the adjustments that were allowed pursuant to requisite zomng ordinance procedures 3) The availability and adequacy of infrastructure and public facilities are not an issue and support the applicant's request for approval of the rezone 4) The characteristics of the development are consistent with the HB zoning provisions and the applicable development regulations as previously adjusted pursuant to the prescnbed public notice and comment procedures CONCLUSIONS 1 The Hearing Examiner has junsdiction under Subsections 15 23 030(C) and (E) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3 SEPA review resulted in the issuance of a Declaration of Non - significance without any appeal bemg filed. 4 Adequate public services are available to satisfy the utility and access requirements of the existing laundromat use on this property 5 No evidence was presented in opposition to this rezone request. 6 The property is located m an area that contains mixed land uses, and the requested rezone is consistent with the Neighborhood Commercial future land use map designation. Yakima Urban Area Zoning Ordinance Chapter 15.03,030 states that the purpose of the HB zoning district is to recognize existing isolated commercial structures in otherwise residential areas, to allow those structures to be occupied by traditional neighborhood business uses, and to allow those structures to be replaced if destroyed. This is not intended to allow structural expansion, or expansion of the use on to adjoining lots. It is further intended that this district is not to serve as a small convenience center (SCC). Examples of HB uses are: taverns, small grocery stores, Laundromats, and other businesses that serve the immediate residential neighborhood. Site Design and Improvement Standards The Zoning Ordinance sets forth specific standards for lot size, maximum lot coverage, minimum building setbacks, parking, building height, sight screening, etc. The existing structures on the subject property currently meet all site design and improvement standards; with an approved adjustment of the lot coverage and rear yard setback standards. If a future change is proposed at this site, all applicable development standards will be met or adjustments approved following the prescribed public notice and comment requirements. Chapter 15.23.030 Rezone criteria Within the Yakima Urban Area, recommendations for approval of rezone applications are governed by seven criteria specified in Section 15.23.030 YMC. 1. Testimony at public hearing. To be considered by the Hearing Examiner. 2. Suitability of property for proposed use. The property is well suited for the range of uses permitted within the HB zoning district and may also be compatible with adjacent residential land uses. 3. Recommendations from interested agencies. No agencies have registered any recommendations concerning this rezone to continue the existing land use. 4. Compliance with the Comprehensive Plan. The Future Land Use Map to Zoning Map Consistency Chart, Figure III -3, provides a guide to the compatibility of land use designations and the zoning districts. Public Need This rezone fulfills the public need for zoning regulations that are consistent with the City's Comprehensive Plan. This rezone proposal raises no issues that require mitigation of the proposed land use. Other Comments Received Yakima Clean Air Authority — comments received pertain to issues of dust control, notification of demolition and renovation, and the removal of asbestos, should it be necessary. Transportation Capacity Management Ordinance This rezone has been approved for Concurrency Analysis September 9, 2005 under the Transportation Capacity Management Ordinance. Is the requested zoning change suitable with the property in question (subject property)? How so? The requested zoning change is suitable with the property in question because the property is served with all urban facilities and services and is an extension of the existing Historical Business zoning district which lies to the south. The subject property to the south contains a neighborhood convenience store. The use on the subject property, a laundromat compliments the convenience store and vis -a- versa, thus the zone change is suitable at this location because it serves a neighborhood need. The Comprehensive Land Use Designation of the property was changed in 2005 from Low Density Residential to Neighborhood Commercial. This rezone will bring the comprehensive land use designation and zoning into compliance with one another. For the reasons above, the zone change is suitable with the subject property. B. How is the rezone request in compliance with and /or how does the request deviate from the 1997 Yakima Urban Area Comprehensive plan as amended? The rezone request is in compliance with the 1997 Yakima Urban Area Comprehensive Plan because the proposal meets many of the goals, objectives and policies of the Plan which are listed in the General Development, Public Services, Commercial Development, Land Use, Transportation, Utilities and Capital Facilities element of the Plan. The rezone request is also in compliance with the amended plan because the underlying Comprehensive Plan was recently changed to Neighborhood Commercial in 2005 and the proposed rezone falls within the confines of the "Matrix" which was adopted as a previous Comprehensive Plan amendment. The Future Land Use Map to Zoning Map Consistency was added to the Comprehensive Plan in 1998, as an amendment, and it indicates that the proposed rezone can be compatible with the Plan, subject to review. This rezone request meets the intent of that amendment, as well as the amendment to the Future Land Use Map. DOC. The property has street frontage on the east and can provide safe points of ingress and egress to the transportation network, North 4th Street. A Traffic Capacity Analysis was conducted by the City for the laundromat and capacity existed for the construction of that facility. This ensures compliance with the transportation element of the Growth Management Act and City Development Standards. The property can be served with all other infrastructure including domestic water, sanitary sewer, natural gas, electricity, telephone and any other needed utilities. No mitigation is proposed, as it has already been put in place with the construction of the laundromat. Indications are, that all infrastructure needs can be met to service this facility. D. Is the proposed zone change and associated land use changes compatible with the existing neighboring uses? What mitigating measures are planned to address incompatibility, such as sitescreening, buffering building design, open space, traffic flow alternation, etc.,? Yes, the proposed zone change and associated land use change is compatible with the existing neighboring uses. The subject property contains a laundromat and abuts an existing convenience store on the south. In fact, the two businesses use a shared driveway and parking area. The compatibility is impeccable to the south. To the north is a single- family residence that is buffered by a 6 -foot view obscuring fence. No complaints have been registered with the City or the applicant since the construction of the laundromat. To the west is an alley, and beyond that, single- family residences. This area is also screened with a 6 -foot view obscuring fence. To the east, across North 4th Street, are single- family residences. Typical landscaping and distance from the proposed use are adequate buffering. Mitigation of adverse affects is subject to the development standards within Chapter 15.07; Sitescreening Standards. Enforcement of this chapter during project review and final construction ensures that adequate mitigation is in place to protect the surrounding uses. Is there a public need for the proposed change? The land use reclassification is needed because this rezone proposal permits the existing use to become compliant with the Future Land Use Designation of the property, a commercial use in a commercial zoning district. The current Single- family Residential Zoning District does not permit the current use on the property in that zoning district. The applicant's are currently operating under a Legal Nonconforming land use approval. It is their desire to bring this project into compliance with the Comprehensive Plan and Zoning Ordinance rules and regulations. They have successfully applied for, and have had approved, a legal nonconforming use expansion and comprehensive land use designation. This rezone, is the last aspect of the process. In every application, the public need was demonstrated. The public need is served because the rezone change provides an area for commercial activities outside the central business district that meets the demand for neighborhood service needs of the community.
