The property is located near the central business district and along a major arterial leading to the central busmess district (South 6th Street/Nob Hill Boulevard) The property adjoms areas to the south and west that are zoned CBDS The purpose of the rezone request is to make the existing use a RECEIVED Contreras & Sons Auto Service 3 Rezone from B -2 to CBDS MAY 11 2006 DO( 1317 South 6 Street INDEX RZ # 1 -06, EC #5 -06 CITY OF YAKIMA PLANNING DIV 7_11 /-1: permitted use so that lending institutions will be willing to loan money on the property after it is properly zoned for the use that presently exists there 3) Recommendations from interested agencies and departments: No agency recommendations were submitted regarding this rezone request, and no significant concerns were expressed at the Development Services Team meeting held on February 15, 2006 regarding the requested rezone 4) The extent to which the proposed rezone is in compliance with and /or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: a) The Comprehensive Plan: Since the Future Land Use Map of the Yakima Urban Area Comprehensive Plan designates the subject property as suitable for Neighborhood Commercial development, the Future Land Use Map to Zoning Map Consistency Chart provides that the CBDS zoning district, with appropnate site considerations, is consistent with the comprehensive plan designation. The proposed rezone to allow CBDS uses such as the existing auto repair facility would be m compliance with Objectives and Policies of the 1997 Comprehensive Plan such as Objective G1 1 which is to encourage the physical development of the Yakima Urban Area in a manner that enhances its image as the cultural and business center; Policy G1 1 which is to strive to make the Yakima urban area the center for activities throughout the Yakima Valley by forming public /pnvate partnerships that diversify the economic, cultural and service opportunities offered m the urban area, Policy G9 4 which is to encourage commercial, mdustnal, office and multi- family developments to locate m distinct clusters m planned growth areas, Policy H3 8 which is to develop a comprehensive approach to neighborhood improvement; and Policy C2.3 which is to allow and encourage small -scale mixed -use retail, residential and professional development within neighborhoods RECEIVED Contreras & Sons Auto Service 4 MAY 1 1 2006 DOC Rezone from B -2 to CBDS 1317 South 6 Street CITY OF YAKIMA INDEX I RZ # 1 -06, EC #5 -06 PLANNING DIV 4 t b) The Zoning Ordinance: Section 15 03 030 of the UAZO states that the purpose of the Central Busmess District Support (CBDS) zoning distnct is to provide areas for commercial activities outside the central business district that meet the retail shopping and service needs of the community and to accommodate small scale commercial uses requiring high visibility and easy access to major artenals. Uses charactenstic of this zoning district mclude small retail sales and service establishments such as the existing auto repair facility on the property The existing use of the parcel complies with all site design and improvement standards of the zoning ordinance which further the mtent of the CBDS zomng distract expressed m Section 15 03 030 5) The adequacy of public facilities such as roads, sewer, water and other required public services: The property is currently served by all necessary public utilities. A six -inch City water line and an eight -inch City sewer line are considered sufficient for the current auto repair facility use of the parcel. The requested rezone was determined to be exempt under the Transportation Capacity Management Ordinance The property has street frontage on the west to South 6`" Street and east through the alley to adjoming local access streets 6) The compatibility of the proposed zone change and associated uses with neighboring land uses. The change of this property from B -2 to CBDS would be consistent with the comprehensive plan and would pose no compatibility conflicts with existmg nearby uses. The auto repair facihty is compatible with the large warehouse located on the adjoming parcel to the south. There is an alley along the east side of the property The general neighborhood consists of commercial uses to the south and west. This property is the only parcel zoned B -2 m the entire area. It is wedged between the CBDS and R -2 zoning districts and the existing use is more consistent with the CBDS zoning district than the B -2 zoning district. The facility is completely fenced. Drainage trenches are located m the front and rear to capture storm water No compatibility concerns have been raised during the hearing process 7) The public need for the proposed change: The requested rezone would fulfill the pubhc need for zonmg classifications that are consistent with comprehensive plan designations and would allow the existmg business to operate under the proper zoning district. The requested rezone would eliminate a B -2 island that is surrounded by property which is zoned CBDS and R -2. There is a public need for commercial uses outside the central business district that provide local service needs of the community Available CBDS land in the area is limited. Consistency of the Rezone with Development Regulations and with the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the followmg factors 1) The types of land uses permitted at the site m the City's Central Business District Support (CBDS) zoning district would be consistent with the comprehensive plan's Neighborhood Commercial designation for the site 2) The density of residential development or the level of development such as units per acre or other measures of density would not be a factor weighing against this rezone request because the existing auto repair facility use is consistent with the density allowed by applicable CBDS zoning ordinance provisions 3) The availability and adequacy of infrastructure and public facilities are not an issue and support the applicant's request for approval of the rezone 4) The characteristics of the development are consistent with the CBDS RECEIVED Contreras & Sons Auto Service 6 uUC Rezone from B -2 to CBDS MAY 1 1 2006 ), 1317 South 6 Street PNL7 AA-1 RZ # 1 -06, EC #5 -06 CITY OF YAKIMA PLANNING DIV -- "`- - -•- -- zonmg provisions and the applicable development regulations CONCLUSIONS 1 The Heanng Examiner has jurisdiction under Subsections 15.23 030(C) and (E) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2 The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3 SEPA review resulted m the issuance of a Declaration of Non - sigmficance without any appeal being filed. 4 Adequate public services are available to satisfy the utility and access requirements of the existing auto repair facihty on this property 5 No evidence was presented m opposition to this rezone request. 6 The property is located m an area that contains mixed land uses, and the requested rezone is consistent with the Neighborhood Commercial future land use map designation. 7 The requested rezone satisfies the seven rezone cntena m Section 15 23 030 and the four consistency cntena m Subsection 16 06 020(B) of the Yakima Municipal Code which are the applicable cntena to determine whether the requested rezone should be approved. Is the requested zoning change suitable with the property in question (subject property)? How so? B. How is the rezone request in compliance with and /or how does the request devjate from the 1997 Yakima Urban Area Comprehensive Plan as amended? C. Are there adequate public facilities, such as traffic capacity, sewer service, potable water, storm water and other public services and infrastructure existing on and around the subject property? Are the existing public facilities capable of supporting the most intensive use of the new (requested) zone? If not, what mitigating measures are going to be implemented to address any short falls in public, services that may exist? D. Is the proposed zone change and associated land uses changes compatible with the existing neighboring uses? What mitigating measures are planned to address incompatibility, such as site screening, buffering el ng,,design, open space traffic flow alternation, etc. ? E. Is there a public need for the proposed change? • ssa' x , r 48 6. SPECIFIC PROJECT If this request is for a specific project please include the following: t A. Written project description including number of housing units and parking spaces. If the proposal is for a business describe hours of operation, days per week and all other pertinent information related to business operations. B. Site Plan (Please use the City of Yakima Site Plan Checklist) Note: All submitted information will be forwarded to the Hearing Examiner along with your application and will become part of the public hearing record. Clear, comprehensive and accurate detail of the information is in the best interest of the applicant. \Revised 9 -98 RECEIVED JAN 1 9 2006 CITY OF YAKIMA SUPPLEMENTAL PLANNING DIV. WRITTEN NARRATIVE (PART 5 OF REZONE APPLICATION) A. Is the requested zoning change suitable with the property in question (subject property)? How so? The requested zoning change is suitable with the property in question because the property is currently developed with its existing use, an automotive repair shop. The current zoning is Local Business (B -2) and the proposed zoning is Central Business District Support (CBDS). The existing use is a Class 2 Review in the B -2 Zoning District and permitted outright as a Class 1 Review in the proposed CBDS Zoning District. This indicates the requested zoning change is suitable, as proposed because it is more acceptable in the CBDS Zoning District than the B -2 Zoning District. The proposed rezone also meets the criteria for the CBDS Zoning District as listed in the Yakima Urban Area Zoning Ordinance. Specifically, the proposal is located near the central business district and along a major arterial (South 6th Street /East Nob Hill Boulevard) leading to the central business district. Additionally, the subject property adjoins an existing area to the south and west which is all zoned CDBS. B. How is the rezone request in, compliance with and /or how does the request deviate from the 1997 Yakima Urban Area Comprehensive Plan as amended? The rezone request is in compliance with the 1997 Yakima Urban Area Comprehensive Plan because the proposal meets many of the goals, objectives and policies of the plan which are listed in the General Development, Public Services, Commercial Development, Land Use, Transportation, Utilities and Capital Facilities element of the plan to change the zoning to CBDS. The rezone request is also in compliance with the amended plan because the underlying Comprehensive Plan is Neighborhood Commercial. With this comprehensive land use designation and the proposed rezone, the project is considered a minor rezone because the comprehensive land use designation does not need to be changed. This is consistent with the "Matrix" (Figure III -3) which was adopted as a previous Comprehensive Plan Amendment. The Future Land Use Map to Zoning Map Consistency was added to the Comprehensive Plan in 1998 as an amendment and it indicates that the proposed rezone can be compatible with the plan, subject to review. This rezone request meets the intent of that amendment. 1NDF., a JAN 1 9 2006 CITY OF YAKBMA PLANNING DIV. C. Are there adequate public facilities, such as traffic capacity, sewer service, potable water, stormwater and other public services and infrastructure existing on and around the subject property? Are the existing public facilities capable of supporting the most intensive use of the new (requested) zone? If not, what mitigating measures are going to be implemented to address any short falls in public services that may exist? Yes, there are adequate public facilities to serve this proposal. The property has street frontage on the west to South 6th Street and east, through the alley to adjoining local access streets. Since the facility is currently in existence, it is connected to all urban services. The property is served with all other infrastructure including domestic water, sanitary sewer, natural gas, electricity, telephone and any other needed utilities. No mitigation is proposed at this time; as preliminary indications are that all infrastructure needs are at the site. D. Is the proposed zone change and associated land use changes compatible with the existing neighboring uses? What mitigating measures are planned to address incompatibility, such as sitescreening, buffering building design, open space, traffic flow alternation, etc.,? Yes, the proposed zone change and, associated land use change is compatible with the existing neighboring uses. This parcel abuts a large warehouse on the south, ap alley along the east, residential structures on the north and South 6th Street along the west. The general neighborhood consists of commercial properties particularly to the south and west. The subject parcel is an "orphan" parcel, wedged between the Two - family Residential (R -2) Zoning District and CBDS Zoning District. It is the only parcel zoned B -2 in the entire area. The characteristics of the subject property are more CBDS in nature than Local Business (B -2). The existing facility is completely fenced. Along the north and south lines are 6 -foot high view obscuring slatted chain -link fencing. This sitescreening meets code along those property lines. The east line, adjacent to the alley, consists of an open 6 -foot high chain -link fence and large gate for ingress and egress. The west line, adjacent to the South 6th Street, also consists of an open 6 -foot high chain -link fence and large gate for ingress and egress. The parking area in the front and the storage area in the rear are paved to prevent dust. Additionally, drainage trenches are located in the front and rear to capture storm water. D®C " riN e - d . ?W. `t. r :1` :..yNfin i ! JAN 1 9 2000 CITY CF YAKIMA PLANNING DIV. It is the intent of the applicant to maintain the existing business, yet to have it in a zone where it is permitted out- right. In years past, the owner has tried to sell the property to others. However, lending institutions would not lend any money on the business because it is not properly zoned. This minor rezone will ensure that financial institutions will be able to loan money on the property, once the rezone is approved. Mitigation of any adverse affects will be subject to the development standards within Chapter 15.07; Sitescreening Standards. E. Is there a public need for the proposed change? The land use reclassification is needed because this proposal permits the existing business to operate under the proper zoning district. It is important to the public that uses and zoning be consistent. This rezone will ensure that consistency is accomplished. This minor rezone also cleans up a "spot zone" that exists, as this is the only parcel in the area zoned B -2. The public need would be served because the change recognizes an existing commercial activity outside the central business district that meets the demand for local service needs of the community. Additionally, several existing parcels of property zoned CBDS in the area have been built upon and available CBDS zoned land in the area is limited.
