HomeMy WebLinkAbout2006-062 Yakima Urban Area Comprehensive Plan 2025 Amendments ORDINANCE NO. 2006 -62 AN ORDINANCE adopting by reference amendments to the Yakima Urban Area Comprehensive Plan, including amendments to the Introduction, Action Plan Implementation, Land Use, Housing, Transportation, Parks and Recreation, Natural Environment and Capital Facilities, and establishing an effective date for said amendments. WHEREAS, the City of Yakima is required to plan under the Washington State Growth Management Act (GMA) RCW 36 70A.040; and WHEREAS, every seven years, RCW 36.70A.130(1) requires the City of Yakima to take legislative action to review and, if needed, revise its comprehensive plan and development regulations, including its policies and regulations designating and conserving natural resource lands and designating and protecting critical areas to comply with the requirements in Chapter 36.70A RCW; and WHEREAS, on March 18, 2003 the Yakima City Council adopted Chapter 16 10 of the Yakima Municipal Code (Ordinance Number 2003 -19) which became effective on April 20, 2003, establishing a public participation program in accordance with RCW 36 70A.130(2) that identified procedures and schedules for reviewing and revising the Yakima Urban Area Comprehensive Plan and City development regulations, and WHEREAS, the City of Yakima has followed its adopted public participation program, including multiple opportunities for public participation in the 2006 Comprehensive Plan update, said opportunities being set forth, attached hereto and incorporated herein by this reference as Exhibit "A ", and WHEREAS, the City of Yakima has sought community -wide participation in the Comprehensive Plan update by providing specific notice of opportunities for comment to the Yakama Indian Nation, WSDOT, WSDOT Aviation, the Yakima Valley Business Times, the Yakima Herald Republic, the EPA, NOAA Fisheries, the Yakima School District, Washington State Department of Agriculture, Department of Health, US Fish and Wildlife, local neighborhood associations, and posting on the Yakima website, to name a few but non - inclusive notice recipients, and WHEREAS, the City of Yakima has established goals and policies within this Plan to facilitate and guide the development of new regulations, based upon "Best Available Science" (as defined within the GMA), to protect and enhance both critical areas and shorelines, as required; and WHEREAS, the City of Yakima Public Works Department with technical support from Kittelson & Associates, a professional Traffic Engineering firm, drafted a significant update of the mandatory transportation elements of the Comprehensive Plan, as required by RCW 36 70A.070 (6)B known as the Yakima Urban Area Transportation Plan 2025 and subsequently summarized into Chapter VI of the Yakima Urban Area Comprehensive Plan, and WHEREAS, the Yakima Urban Area Transportation Plan 2025 includes significant detail related to the Concurrency requirements of GMA as well as the requirements of consistency with land use assumptions for estimating future traffic impacts and a financing plan. These findings and policies have been summarized into Chapter VI of the Yakima Urban Area Comprehensive Plan; and WHEREAS, notice of all amendments to the Yakima Urban Area Comprehensive Plan and development regulations adopted to fulfill the requirements of RCW 36 70A.130 was sent to the Washington State Department of Community, Trade and Economic Development (CTED) and received by CTED on September 14, 2006, that date being at least sixty days before the amendments were adopted by the Yakima City Council, in accordance with RCW 36 70A.106, and WHEREAS, the City of Yakima conducted an Integrated GMA/ Washington State Environmental Review (SEPA) process for public comment on the Yakima Urban Area Comprehensive Plan Update, including the Transportation Plan Update, as provided in WAC 197 -11 -235 The Final EIS regarding this review was issued on November 15, 2006, and WHEREAS, under the schedule established in RCW 36 70A.130(4), the deadline for the City of Yakima to comply with the update required by RCW 36 70A.130(1) is December 1, 2006, and WHEREAS, City planning staff and Reid Shockey, a professional planning consultant hired by the City of Yakima to assist with the Yakima Urban Area Comprehensive Plan update, prepared an analysis of the comprehensive plan and development regulations currently in effect in the City of Yakima to determine the Plan's consistency with the requirements of Chapter 36 70A RCW Based upon this analysis, planning staff and Mr Shockey prepared proposed revisions deemed necessary to comply with Chapter 36 70A RCW At public hearings held on June 26, 2006 and July 10, 2006, planning staff and Mr Shockey forwarded their analysis and proposed revisions to the Yakima Urban Area Regional Planning Commission; and WHEREAS, the Yakima Urban Area Regional Planning Commission reviewed the analysis and proposed revisions prepared by City planning staff and Mr Shockey and then held a public hearing on September 25, 2006 to receive public comments on the analysis and proposed revisions. Based upon its review of the requirements of Chapter 36 70A RCW, the analysis and proposed revisions prepared by planning staff and Mr Shockey, and the public comments received, the Yakima Urban Area Regional Planning Commission modified the analysis and proposed revisions to more fully comply with Chapter 36.70A RCW and then forwarded their recommendations to the Yakima City Council on October 3, 2006; and WHEREAS, the Yakima City Council held a public hearing on November 14, 2006, said meeting being continued on December 5, 2006, to receive public comments on the Regional Planning Commission's recommended findings on review and proposed revisions to the Yakima Urban Area Comprehensive Plan, and WHEREAS, based upon its review of the requirements of Chapter 36 70A RCW, the analysis and proposed revisions prepared by planning staff and Mr Shockey, the recommended findings on review and proposed revisions forwarded by the Regional Planning Commission, and the public comments received, the Yakima City Council finds and declares that the review and needed revisions have been prepared in conformance with applicable law, including Chapter 36 70A RCW, Chapter 43.21 C RCW, and the process set forth in Chapter 16 10 of the City of Yakima Municipal Code for the provision of public participation and adoption of Comprehensive Plan amendments, and WHEREAS, based upon its review of the requirements of Chapter 36 70A RCW, the analysis and proposed revisions prepared by planning staff and Mr Shockey, the recommended findings on review and proposed revisions forwarded by the Regional Planning Commission, and the public comments received, the Yakima City Council modified the analysis and proposed revisions to more fully comply with Chapter 36 70A RCW and hereby finds and declares that the City of Yakima's comprehensive plan and development regulations, as revised by this ordinance, comply with the requirements of Chapter 36 70A RCW; Now, Therefore, BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1 Findinas, Analysis and Conclusions. After reviewing the record and considering the arguments in the record and at public meetings, the Yakima City Council hereby adopts the findings, analysis and conclusions contained in Exhibit "B ", attached hereto and incorporated herein by this reference as if set forth in full. Section 2. Revision of Sections of Existing Comprehensive _Plan Elements. The Yakima Urban Area Comprehensive Plan is hereby amended to revise the text, policies and related provisions of the specific sections of the Plan set forth in Exhibit "C", attached hereto and incorporated herein by this reference, as if set forth in full. Section 3. Amendments to Replace and Supercede. The Yakima Urban Area Comprehensive Plan is amended by these changes and all such changes are intended to replace and supercede all sections of the Comprehensive Plan that are or may be inconsistent with the amendments contained herein. Amendments to the Comprehensive Plan include related documents adopted by reference such as the Yakima Urban Area Transportation Plan 2025, the Yakima Parks Plan 2006 -2011, Water Master Plan, 2004, Sewerage Comprehensive Plan, 2005 and other documents listed in Appendix D of the Yakima Urban Area Comprehensive Plan, 2006 Section 4. Transmittal to State Pursuant to RCW 36 70A.106, this Ordinance shall be transmitted to the Washington Department of Community, Trade and Economic Development as required by law Section 5. Preparation of Final Comprehensive Plan Document. City staff are hereby directed to complete preparation of the final Yakima Urban Area Comprehensive Plan document, including the Final Transportation Plan Update and the correction of any typographical edits, and inclusion of appropriate graphics and illustrations. Section 6. SeverabilityNalidity The provisions of this ordinance are declared separate and severable If any section, paragraph, subsection, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this ordinance. The Yakima City Council hereby declares that they would have passed this ordinance and each section, paragraph, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, paragraphs, clauses or phrases were unconstitutional or invalid. Section 7 Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 8. Meeting continued to December 4, 2006 December 4, 2006 Public Hearing to Adopt City Hall Yakima's 2006 Comprehensive Plan Update and Integrated SEPA EIS Note: All of the above listed activities and notices were included on the City of Yakima's Web Page 5 `4 Exhibit "B" YAKIMA URBAN AREA COMPREHENSIVE PLAN 2025 CITY OF YAKIMA CITY COUNCIL FINDINGS OF FACT, CONCLUSIONS AND ADOPTION OF THE YAKIMA URBAN AREA COMPREHENSIVE PLAN 2025 WHEREAS, the Washmgton State Growth Management Act (RCW Chapter 36.70A), hereinafter "Act ", requires certain counties and cities to update their Comprehensive Plans every seven years; and WHEREAS, The City and County of Yakima are required to update their Urban Area Comprehensive Plan by December 1, 2006; and WHEREAS, The Yakima Urban Area Regional Planning Commission, hereinafter "RPC ", is responsible for the review of this updated Plan and for providing the Yakima City and County Joint Board with a recommendation to adopt, modify or deny proposed amendments to the Plan, and WHEREAS, the RPC conducted Public Hearings and Commission discussions on July 10, 2006, September 25, 2006 and October 23, 2006, and WHEREAS, the Yakima County Commissioners and Yakima City Council, acting as a Joint Board hereafter referred to as "Council ", conducted a public hearing on November 14, 2006, continued to December 4, 2006, to receive public comment, discuss and ultimately make determinations regarding the RPC's recommendations for amendments to the Yakima Urban Area Comprehensive Plan, Now therefore, the Council presents the following findings and recommendation: 1 An integrated SEPA/GMA Final Environmental Impact Statement for the Plan was issued and made final on December 6, 2006. 2. The Yakima Urban Area Comprehensive Plan 2025 was reviewed by the Council and approved for adoption. 3 The Yakima Urban Area Transportation Plan 2025 was reviewed by the Council and approved for adoption. City of Yakima City Council 1 Yakima Urban Area Comprehensive Plan 2025 Findings of Fact 4 The RPC's recommendations for amendments to the September, 2006 draft Yakima Urban Area Comprehensive Plan 2025 was presented to the Council, the Council considered the compatibility, consistency, clanty and updating of the 1997 Plan, as well as certain specific corrections in several of the recommendations to more accurately state the determinations of the RPC that were not properly set forth in the November 2006 draft version of the Plan, and finally Council considered the additional testimony provided during the public hearing held before them on November 14 and December 4 2006 5 The RPC's recommendation to add Table III-11 a was reviewed by the Council and after discussion of the potential benefits and problems the table might result in during future land use application decisions the Council voted to remove this table from the Yakima Urban Area Comprehensive Plan 2025, based primarily upon the likely confusion and potential restriction to future land development, as well as apparent conflict with Table III -11 and other provisions of the Plan. 6. Council reviewed the RPC's recommendation to not restrict the application of CBDS (Central Business Distract Support) zoning to only Artenal Commercial Future Land Use designations, Council voted to uphold the RPC's recommendation because the proposal to limit the application of CBDS zoning was too restrictive on future development. 7 The RPC's recommendation to add the word "use" in policy 3.3.2 was considered by the Council. They voted to remove the word from the policy due to the belief that the term was too regulatory and not in the nature of a policy issue, as well creating the potential for the word to cause confusion in application of the policy as well as the likelihood the term would result m excessively restrictive land use decisions. The Council felt that the public comment process that was presently available to citizens would provide reasonable opportunity for consideration of potential adverse impacts of a proposed land use. 8 The RPC recommendation to mclude "Transitional Zonmg" as an additional method to provide a buffer between commercial and residential development was reviewed by the Council, Council voted to uphold the RPC's recommendation and implement the recommendation, determining that it provides additional direction and opportunity for buffering methods. 9 The RPC recommendation to reduce the amount of acreage and population served for Neighborhood Commercial Future Land designation was reviewed by the Council, Council voted to leave the language as presently written in the September 2006 Yakima Urban Area Comprehensive Plan 2025 version. 10 The RPC requested modification of policy 3 14.2 by removing the word "unreasonably" Council heard comment, deliberated and voted to do so with additional clarification on access to institutions by modifying the policy to add "the nearest" and removmg "a principal" "Unreasonable" was deleted from the policy because it seemed ambiguous and difficult to apply consistently City of Yakima City Council 2 Yakima Urban Area Comprehensive Plan 2025 Findings of Fact 11 Council considered the RPC's recommendation to add additional policy pertaining to boundaries for the Institutional Future Land Use designation areas to protect established residential neighborhoods, to promote compatibility with residential neighborhoods and to encourage development of growth master plans for development; they voted to uphold the RPC's considerations and recommendations, but retamed the word "reasonably" It was decided that the word "reasonably" m this context demonstrated a trust m the staff to deal honestly and fairly with application considerations. 12. Council considered the modification of policy 3.3 1 and they voted to change the word "age" to "historical character" so the mtent of this policy was preserved and to eliminate any confusion or misunderstanding regarding the preservation of existing neighborhoods. 13 Council reviewed the proposal to add a policy to the Parks & Recreation chapter; they voted to add policy 9.6.5 so that the Parks & Recreation Plan discussion and policy pertaining to skate parks was mentioned in the Yakima Urban Area Comprehensive Plan 2025, insofar as this issue had been presented in the Parks & Recreation planning. 14 The addition of an Action Step to the Parks & Recreation section was reviewed by the Council and they voted add skate parks as a future action item, for the same reason as the action in number 13 was taken to address. 15 On the basis of public comment, Council reviewed proposed modification to policy 10.9 6, after consideration and deliberation Council voted to modify the policy to bring clarification to when stormwater retention regulations would apply during development. 16 Policy 6.3 1 that addresses the required construction of sidewalks on both sides of all streets with all new development was reviewed by the Council and County Commissioners with the understanding that in the unincorporated areas inside the UGA but outside the city boundary an interlocal agreement may be used between the City and County to facilitate this policy uniformly COUNCIL CONCLUSIONS: The Council is authorized to conduct meetings and hearings concermng the 2006 update of the Yakima Urban Area Comprehensive Nan 2025 and to direct legislation be prepared for an ordinance to the Plan. All Notice Requirements for the adoption of the 2006 update of the 2006 update of the Yakima Urban Area Comprehensive Plan 2025 have been completed. All hearings and meetings necessary for the Council to adopt the 2006 update of the Yakima Urban Area Comprehensive Plan 2025 have been completed. All matters matenal to the issuance of a Final Environment Impact Statement on the Plan have been completed. Page I-4 in the November 2006 Comp Plan version, which removed tract 31 from this paragraph. Growth occurred most in the west and north, but remained stable in the south and east side of the City Census Tract 9, 15, 16 and 28 had the largest increase in population (see Figure 1— Yakima Census Tracts) Page II -5 in the November 2006 Comp Plan version that added this action step Explore park districts for neighborhoods wishing to own, develop, and maintain local parks. Page II -6 in the November 2006 Comp Plan version that added this action step Add a skate park facility within Kiwanis Park site. Page III -7 in the November 2006 Comp Plan version, which changed the title "Older and Newer. Neighborhoods" Changed the =title of the paragraph from Older Neighborhoods and Newer Neighborhoods to "Neighborhoods ". 1 Page III -10 in the November 2006 Comp Plan version that removed correctional facilities and airports from the Institutional paragraph. Institutional uses include colleges, health care facilities and hospitals.
