AN ORDINANCE accepting the recommendation of the Planning
Commission and rezoning property in the vicinity
of Lincoln Avenue and 4th Avenue in the City of
Yakima, Washington, from R-3, Multiple-Family
Zone to B-2, Local Business Zone.
WHEREAS, pursuant to due and legal notice, the City
Council of the City of Yakima held a hearing on the 24th day
of May, 1983, upon the recommendation of the Planning
Commission that real property situate in the vicinity of
North 4th Avenue and West Lincoln Avenue in the City of
Yakima, Washington, the legal description of which is set
4111/ out hereinbelow, be rezoned from R-3, Multiple-Family zone
to B-2, Local Business zone, and
WHEREAS, as a result of its hearing the City Council
determined that the rezone should be granted, and hereby
makes its following findings and conclusions:
FINDINGS:
1. Mr. and Mrs. Robert Littleton, dba Yakima Adjustment
Service, have requested a rezone from R-3 to B-2 for three
parcels of property located at the northeast corner of North
4th and West Lincoln Avenues. The purpose of the rezone is
410 to construct a one story office building with suitable parking
and landscaping.
2. The Optimal Land Use Plan indicates the proposal may
be compatible with appropriate site considerations and where
conflicts with neighbors can be resolved. CBD support de-
velopment is potentially compatible at this location. West
Lincoln Avenue is a Major Arterial Street, one-way westbound.
3. The B-2, Local Business zone, contains minimum

standards that should assure general land use compatibility.
These development standards are:
(1) Generally uses shall be conducted within a building;
• (2) Lighting shall be positioned so as not to interfere
with adjacent residential property uses;
(3) No building shall exceed 2 1/2 stories or 35 feet
in height;
(4) Yard requirements are those of the residential
zone, the B-2 zone abutts;
(5) These yards shall be effectively sight screened
by tight fence or combination fence and landscaping; and •
(6) No building or accessory building shall occupy
more than 50% of the lot.
4. A signed petition has been submitted by adjoining
property owners and neighbors in favor of the rezone.
5. The Planning Commission recommended to the City
Council that the rezone request be granted.
CONCLUSIONS:
1. The recommendation of the Planning Commission to
grant the rezone should be affirmed, and the rezone should
be granted,
now, therefore,

BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real
property situate in the vicinity of North 4th. Avenue and
West Lincoln Avenue in the City of Yakima, Washington, and
more particularly described as follows, to wit:
Lots 15 and 16, Block 247, Syndicate Subdivision,
records of Yakima County, Washington, recorded in
Volume "A" of Plats, page 25, records of Yakima
County, Washington.
be rezoned from R -3, Multiple- Family zone to B -2, Local Business
zone be, and the same is hereby, approved and said real property
is hereby rezoned as B -2, Local Business zone.
Section 2. The above change in zoning shall be included
and depicted on the next regularly amended use district map
prepared by and for the City.
Section -3. The City Clerk is hereby authorized and
directed to file with the Yakima County Auditor a certified
copy of this ordinance.
Section 4. This ordinance shall be in full force and
effect thirty days after its passage, approval and publication
as provided by law and by the City Charter. •
