Construction & Development, Inc.AN ORDINANCE ORDINANCE NO 2006- 25 relating to land use regulation and zoning, rezoning, with conditions, one parcel of property located in the vicinity of 1708 South 16th Avenue from Two -Family Residential (R-2) to Professional Business (B-1) as more fully described herein, and approving, with conditions, the recommendation of the Hearing Examiner for the City of Yakima regarding the same, D H Construction & Development, Inc , being identified as the applicant herein WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on April 27, 2006 (the "recommendation"), recommending that the City approve the rezoning of one certain parcel of property as more fully described herein, and WHEREAS, the City Council finds that the Hearing Examiner's findings set forth in the recommendation in response to the requirements of Yakima Municipal Code ("YMC") § 15.23 030(E) and § 15 15 040(5) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein, and WHEREAS, the City Council finds that it is in the best interest of the City to rezone the following described property; Now Therefore: BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1 The following parcel of property located in the vicinity of 1708 South 16th Avenue shall be, and the same hereby is, rezoned from Two -Family Residential (R-2) to Professional Business (B-1) parcel number 1 81 335-1 4402 Attached hereto and incorporated herein as Exhibit "A" is a legal description of said property Section 2. The findings of the Hearing Examiner's recommendation in this matter, dated April 27, 2006, are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23 030(F), and are incorporated herein by this reference as if fully set forth herein Section 3 The rezone is hereby approved subject to conditions set forth in the Hearing Examiner's recommendation, which conditions are attached hereto and incorporated herein by this reference as Exhibit "B" Section 4 Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect this rezone The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor (jc)ord/DH Construction -Rezone 1 Section 5. This application requests a rezone of one parcel that is about 24 of an acre m size at 1708 South 16th Avenue from Two -Family Residential (R-2) to Professional Business (B-1) so that the parcel can be merged with the applicant's adjouung parcel to the south which is zoned B-1 m order to construct a 5,244 square foot office complex on the combined parcels. The site (Parcel number 181335-14402) is currently zoned R-2 and occupied by a smgle-family dwelling. The applicant's parcel to the south (Parcel number 181335-14428) is currently zoned B-1 and is vacant. The property to the west is utilized as a mm -storage facility South 16th Avenue abuts the site on the east. Perry Street and professional offices abut the property on the south. No objection to the proposal has been registered by the owner or occupant of the residence to the north or of the residences to the east across South 16th Avenue 3) Recommendations from interested agencies and departments: No agency recommendations were submitted regarding this rezone request, but the following Department comments were submitted as a result of the Development Services Team meeting held on March 8, 2006 a) Engmeenng: Title 12 does not apply to a rezone When the proposal is developed, full frontage improvements will be required on South 16th Avenue and on Perry Street. Additional nght-of-way (currently estimated to be an additional 2 5 feet) may be required for frontage improvements, but Perry Street has sufficient nght-of-way Runoff generated from a 25 -year 24-hour storm must be retained or infiltrated on the site b) Code Administration Fire flow and fire hydrants appear to be adequate for the proposed office use Review of plans, permits and inspections will be required pnor to occupancy c) Water/Irngation. There is an existing looped 8 -inch waterline m South 16th Avenue and m Perry Street. The site has an existing 3/4 -inch service and 3/4 -inch meter The site is located m a Low Pressure Zone There is no City irrigation for the site d) Wastewater- Connection charges shall apply e) Traffic Engmeenng No comments D H. Construction Rezone from R-2 to B-1 1708 South 16th Avenue RZ # 2-06, EC #6-06 4 DOC INDEX # A -1 4) The extent to which the proposed rezone is in complia`� q and/or deviates from the goals and policies as adopted in the Yakima Area Comprehensive Plan and the intent of the Zoning Ordinance: a) The Comprehensive Plan: Since the Future Land Use Map (Map III -3) of the Yakima Urban Area Comprehensive Plan was recently amended on December 9, 2005 to designate the subject property as suitable for Neighborhood Commercial development, the B-1 zoning distnct is consistent with the comprehensive plan designation, and the R-2 zonmg distnct is not, according to the Future Land Use Map to Zoning Map Consistency Chart, Table II1-2 The proposed rezone to allow B-1 uses would be m compliance with Objectives and Policies of the 1997 Comprehensive Plan such as Objective G1 1 which is to encourage the physical development of the Yakima Urban Area m a manner that enhances its image as the cultural and busmess center; Policy G9 4 which is to encourage commercial, mdustnal, office and multi -family developments to locate m distinct clusters m planned growth areas, and Policy C2 3 which is to allow and encourage small-scale mixed-use retail, residential and professional development within neighborhoods. b) The Zoning Ordinance: Subsection 15 03 030(5) of the UAZO states that the purpose of the Professional Business (B-1) zoning distnct is to establish and preserve areas for professional offices, to provide a buffer between commercial clusters and residential neighborhoods, and to locate professional offices m areas presently receiving a full range of urban services Professional offices and, m some areas, a mix of professional offices and multi -family dwellings are the primary uses m the distnct. Residential densities are generally greater than twelve dwelling units per net residential acre Building coverage may be as high as eighty percent of the site since site screening requirements have been established to soften the visual impact of large buildings and parking lots and to D H. An office complex is a use that is charactenstic of this chstncf9"pA The following development standards for the proposed use m the requested B-1 zoning distnct will promote the intent of that distnct and the compatibility of the proposed use i) Setbacks Structure setbacks are required by Table 5-1 of the UAZO The site plan submitted with the application shows that the proposed office complex meets the setback requirements of this chapter u) Parking: Parking requirements are hsted m Table 6-1 of the UAZO Professional office buildings require one space for each 200 square feet of gross floor area. The 24 parkmg spaces shown on the submitted site plan comply with the off-street parkmg requirements of the UAZO ni) Signage: A sign plan was not submitted with this application. Any proposed signage shall conform to sign standards as set forth m Chapter 15 08 of the UAZO iv) Site screening: Chapter 15 07 of the UAZO estabhshes site screening standards to provide a visual buffer between uses of different intensity, streets and structures, to reduce erosion and storm water runoff, to protect property values and to elunmate potential land use confhcts by mitigating adverse impacts from dust, odor, htter, noise, glare, hghts, signs, buildings or parking areas. Site screening requirements vary dependmg on the intensity of both the proposed use and its neighbors. After a site visit and review of Table 7-1 of the UAZO, it has been determined that site screening meetmg Standard B will be required on the north property line The apphcant indicated in section D of the supplemental narrative m the application and at the hearing that the more stringent site screening Standard C will be utilized on the north property line by installation of a view -obscuring fence that is six feet m height. v) Pubhc facilities: Adequate pubhc water and sanitary sewer currently serve this site 5) The adequacy of public facilities such as roads, sewer, water and other required public services: The property is currently served by all necessary public utilities Street access is from Perry Street which is classified as a Local D H. The proposal is an exempt activity under the Trans't4 iolk Capacity Management Ordinance-4 ti `cob 6) The compatibility of the proposed zone change and associated uses with neighboring land uses: The change of this property from R-2 to B-1 will bring it into conformance with the comprehensive plan and will pose little or no compatibihty conflicts with the existing mim-storage facihty or other nearby uses Traffic should be muumal to and from the site and it will not pass through residential areas Any code compliance issues that still exist if the rezone is granted will be addressed. Screening and setback requirements for the proposed office complex use will promote its compatibility with neighboring land uses. 7) The public need for the proposed change: The recent change m the comprehensive plan designation for the property from Medium Density Residential to Neighborhood Commercial created a need for rezoning the property from a residential to a business zoning district. B-1 zoning is consistent with the comprehensive plan designation and R-2 zoning is not. There is a public need for the City's zorung regulations to be consistent with its comprehensive plan designations. Consistency of the Rezone with Development Regulations and with the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the followmg factors 1) The types of land uses permitted at the site m the City's Professional Business (B-1) zoning distract would be consistent with the comprehensive plan's Neighborhood Commercial designation for the site 2) The density of residential development or the level of development D H. Construction Rezone from R-2 to B-1 1708 South 16th Avenue RZ # 2-06, EC #6-06 7 DOC INDEX # AA -2 3)f 9,0�� \'.G such as units per acre or other measures of density would not be 04,S44 r weighing against this rezone request because the proposed B-1 professional o complex use would have to be consistent with the density allowed by applicable zoning ordinance provisions or with adjustments allowed pursuant to requisite zomng ordinance procedures 3) The availability and adequacy of infrastructure and public facilities are not an issue and support the applicant's request for approval of the rezone 4) The characteristics of the development will have to be consistent with the B-1 zoning provisions and the applicable development regulations, or with any adjustments thereto that may be allowed after following the prescribed public notice and comment requirements CONCLUSIONS 1 The Hearing Examiner has jurisdiction under Subsections 15.23 030(C) and (E) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2 The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3 SEPA review resulted m the issuance of a Declaration of Non- significance without any appeal being filed. 4 Adequate public services are available to satisfy the utility and access requirements of the proposed professional office complex use on this property 5 No evidence was presented m opposition to this rezone request. 6 The property is located m an area that contains mixed land uses, and the proposed rezone is consistent with the Neighborhood Commercial future land use map designation. RECOMMENDATION The Hearing Examiner recommends to the Yakima City Council that this application for a rezone of property from the Two-Fanuly Residential (R-2) zoning designation to the Professional Business (B-1) zoning designation described m the documentation subnutted for UAZO RZ #2-06 and EC #6-06 be APPROVED, subject to the following conditions 1) Future development of the subject property for uses not stated m the application is subject to environmental review, traffic concurrency, plan review and building permits. 2) If additional development is proposed at this site m the future, all applicable development standards will be met or adjustments approved followmg the prescribed pubhc notice and comment requirements 3) Frontage improvements, including curb, gutter and sidewalks, are required on Perry Street and on South 16th Avenue at the time of development. Dedication of additional nght of way may be required for construction of a five- foot -wide sidewalk on South 16th Avenue Frontage improvements shall meet City of Yakima construction standards Construction plans must be reviewed and approved by the Yakima City Engineer prior to construction. Any proposed signage shall conform to sign standards as set forth in Chapter 15.08 of the UAZO. iv) Site screening: Chapter 15.07 of the UAZO establishes site screening standards to provide a visual buffer between uses of different intensity, streets and structures, to reduce erosion and storm water runoff, to protect property values and to eliminate potential land use conflicts by mitigating adverse impacts from dust, odor, litter, noise, glare, lights, signs, buildings or parking areas. Site screening requirements vary depending on the intensity of both the proposed use and its neighbors. After a site visit and review of Table 7-1 of the UAZO, it has been determined that site screening meeting Standard B will be required on the north property line. The applicant indicated in section D of the supplemental narrative in the application and at the hearing that the more stringent site screening Standard C will be utilized on the north property line by installation of a view -obscuring fence that is six feet in height. v) Public facilities: Adequate public water and sanitary sewer currently serve this site. 5) The adequacy of public facilities such as roads, sewer, water and other required public services: The property is currently served by all necessary public utilities. The proposal is an exempt activity under the Trans rtatio Capacity Management Ordinance. 46141-, 6) The compatibility of the proposed zone change and associated uses with neighboring land uses: The change of this property from R-2 to B-1 will bring it into conformance with the comprehensive plan and will pose little or no compatibility conflicts with the existing mini -storage facility or other nearby uses. Traffic should be minimal to and from the site and it will not pass through residential areas. Any code compliance issues that still exist if the rezone is granted will be addressed. Screening and setback requirements for the proposed office complex use will promote its compatibility with neighboring land uses. 7) The public need for the proposed change: The recent change m the comprehensive plan designation for the property from Medium Density Residential to Neighborhood Commercial created a need for rezoning the property from a residential to a business zoning district. B-1 zoning is consistent with the comprehensive plan designation and R-2 zoning is not. There is a public need for the City's zoning regulations to be consistent with its comprehensive plan designations. Consistency of the Rezone with Development Regulations and with the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the following factors: 1) The types of land uses permitted at the site in the City's Professional Business (B-1) zoning district would be consistent with the comprehensive plan's Neighborhood Commercial designation for the site. 2) The density of residential development or the level of development D. CONCLUSIONS 1. The Hearing Examiner has jurisdiction under Subsections 15.23.030(C) and (E) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3. SEPA review resulted in the issuance of a Declaration of Non- significance without any appeal being filed. 4. Adequate public services are available to satisfy the utility and access requirements of the proposed professional office complex use on this property. 5. No evidence was presented in opposition to this rezone request. 6. The property is located in an area that contains mixed land uses, and the proposed rezone is consistent with the Neighborhood Commercial future land use map designation. D. H. To the east, is South 16th Avenue, an urban arterial. Property to the north is residential and contains an existing single-family residence. It is the intent of the applicant to incorporate this newly rezoned parcel of land into the adjoining parcel which lies to the south. This parcel is currently zoned B-1. The applicant intends to construct a 15,244 sq. ft. office complex on the combined parcels. Mitigation of adverse affects will be subject to the development standards within Chapter 15.07; (sitescreening Standards). Enforcement of this chapter during project review will ensure that adequate mitigation is in place to protect the surrounding uses. The land use reclassification is needed because this proposal permits the existing parcel at the corner of South 16th Avenue and Perry Street to be increased in size to accommodate a larger •project. Because the properties lie on a corner, required building setbacks are substantial and limit development. This rezone rectifies that issue and permits a development which can be constructed in compliance with the zoning ordinance. The proposed rezone to allow B-1 uses would be in compliance with Objectives and Policies of the 1997 Comprehensive Plan such as Objective G1.1 which is to encourage the physical development of the Yakima Urban Area in a manner that enhances its image as the cultural and business center; Policy G9.4 which is to encourage commercial, industrial, office and multi-family developments to locate in distinct clusters in planned growth areas; and Policy C2.3 which is to allow and encourage small-scale mixed-use retail, residential and professional development within neighborhoods. b) The Zoning Ordinance: Subsection 15.03.030(5) of the UAZO states that the purpose of the Professional Business (B-1) zoning district is to establish and preserve areas for professional offices; to provide a buffer between commercial clusters and residential neighborhoods; and to locate professional offices in areas presently receiving a full range of urban services. Professional offices and, in some areas, a mix of professional offices and multi-family dwellings are the primary uses in the district. Residential densities are generally greater than twelve dwelling units per net residential acre. Building coverage may be as high as eighty percent of the site since site screening requirements have been established to soften the visual impact of large buildings and parking lots and to D. H. The site plan submitted with the application shows that the proposed office complex meets the setback requirements of this chapter. ii) Parking: Parking requirements are listed in Table 6-1 of the UAZO. Professional office buildings require one space for each 200 square feet of gross floor area. The 24 parking spaces shown on the submitted site plan comply with the off-street parking requirements of the UAZO. iii) Signage: A sign plan was not submitted with this application. Any proposed signage shall conform to sign standards as set forth in Chapter 15.08 of the UAZO. iv) Site screening: Chapter 15.07 of the UAZO establishes site screening standards to provide a visual buffer between uses of different intensity, streets and structures, to reduce erosion and storm water runoff, to protect property values and to eliminate potential land use conflicts by mitigating adverse impacts from dust, odor, litter, noise, glare, lights, signs, buildings or parking areas. Site screening requirements vary depending on the intensity of both the proposed use and its neighbors. After a site visit and review of Table 7-1 of the UAZO, it has been determined that site screening meeting Standard B will be required on the north property line. The applicant indicated in section D of the supplemental narrative in the application and at the hearing that the more stringent site screening Standard C will be utilized on the north property line by installation of a view -obscuring fence that is six feet in height. v) Public facilities: Adequate public water and sanitary sewer currently serve this site. 5) The adequacy of public facilities such as roads, sewer, water and other required public services: The property is currently served by all necessary public utilities. Traffic should be minimal to and from the site and it will not pass through residential areas. Any code compliance issues that still exist if the rezone is granted will be addressed. Screening and setback requirements for the proposed office complex use will promote its compatibility with neighboring land uses. Capacity Management Ordinance. 7) The public need for the proposed change: The recent change in the comprehensive plan designation for the property from Medium Density Residential to Neighborhood Commercial created a need for rezoning the property from a residential to a business zoning district. B-1 zoning is consistent with the comprehensive plan designation and R-2 zoning is not. There is a public need for the City's zoning regulations to be consistent with its comprehensive plan designations. Consistency of the Rezone with Development Regulations and with the Comprehensive Plan under the Criteria Required by YMC 16.06.020(B) is determined by consideration of the following factors: 1) The types of land uses permitted at the site in the City's Professional Business (B-1) zoning district would be consistent with the comprehensive plan's Neighborhood Commercial designation for the site. 2) The density of residential development or the level of development D. CONCLUSIONS 1. The Hearing Examiner has jurisdiction under Subsections 15.23.030(C) and (E) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3. SEPA review resulted in the issuance of a Declaration of Non- significance without any appeal being filed. 4. Adequate public services are available to satisfy the utility and access requirements of the proposed professional office complex use on this property. 5. No evidence was presented in opposition to this rezone request. 6.
