2006-029 Rezone 101 North Naches Avenue; United Builders
ORDINANCE NO 2006- 29 AN ORDINANCE relating to land use regulation and zoning, rezoning, with conditions, one parcel of property located in the vicinity of 101 North Naches Avenue, Yakima, Washington from Professional Business (B -1) to Central Business District (CBD) as more fully described herein, and approving, with conditions, the recommendation of the Hearing Examiner for the City of Yakima regarding the same, United Builders of Yakima, Inc , being identified as the applicant herein WHEREAS, by application dated February 1, 2006, United Builders of Yakima, Inc., requested a rezone of Yakima County Assessor's Parcel No 191319 - 21482, located at 101 North Naches Avenue, Yakima, Washington (hereinafter "Subject Property "), from Professional Business (B -1) to Central Business District (CBD), and WHEREAS, on April 13, 2006 the Hearing Examiner for the City of Yakima conducted an open- record public hearing regarding the requested rezone, and WHEREAS, on April 27, 2006 the Hearing Examiner issued Hearing Examiner's Recommendation regarding UAZO RZ #3 -06, EC #8 -06, (the "recommendation ") recommending that the Subject Property be rezoned from Professional Business (B -1) to Central Business District (CBD), and WHEREAS, at a closed- record public hearing held on June 27 2006, the City Council considered the requested rezone, including the documents and other evidence which comprise the record developed before the Hearing Examiner, the Hearing Examiner's Recommendation, and the statements and comments of interested persons, and WHEREAS, the City Council finds that the considerations of the Hearing Examiner in response to the requirements and criteria of Yakima Municipal Code ( "YMC ") § 15.23 030(E) and § 15 15 040(5) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein, and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following to approve the requested rezone, Now Therefore, (jc)ord /United Builders- Rezone 1 BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1 The property located at 101 North Naches Avenue, Yakima, Washington (Yakima County Assessor's Parcel No 191319-21482), legally described in Exhibit "A ", attached hereto and incorporated herein by this reference, is hereby rezoned from Professional Business (B -1) to Central Business District (CBD) Section 2. The findings within the April 27, 2006 Hearing Examiner's Recommendation (UAZO RZ #3 -06, EC #8 -06) regarding this rezone are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23 030(F), and are incorporated herein by this reference as if fully set forth herein Section 3. The Official Yakima Urban Area Zoning Map and all other zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified, subject to the conditions stated below, to reflect this rezone Section 4 The rezone granted by this ordinance is expressly conditioned on the Owner's satisfaction of the following conditions stated on pages 6 -7 of the Hearing Examiner's Recommendation a. Permits and certificates of zoning review must be obtained from the City of Yakima for all specific projects proposed for the rezoned property, and such projects will comply with applicable development standards unless the standards are administratively varied or otherwise adjusted in accordance with the Yakima Urban Area Zoning Ordinance b Unless otherwise exempted, any specific project proposed for the rezoned property shall be subject to environmental review in accordance with the State Environmental Policy Act. c The mitigation conditions included in the Mitigated Determination of Nonsignificance issued by the City's SEPA Responsible Official on March 27, 2006, are adopted and incorporated by reference herein Section 5. Severability• If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance Section 6. The building is a former church which is currently being used for a dinner theater that was approved after Class (3) review in July, 2005 The approved use is subject to conditions necessary to assure consistency with the current B -1 zoning of the property United Builders, Inc. desires to use the building as a venue for a broader range of theatrical productions and music events. It obtained a comprehensive plan amendment in December of 2005 that changed the future land use designation of the property from Professional Office to CBD Core Commercial. CBD Core Commercial designation contemplates a range of uses that includes the entertainment uses planned by United Builders, Inc The applicant now seeks to have the property rezoned to effectuate the comprehensive plan designation. The Examiner conducted a public hearing on April 13, 2006. The staff report presented at the hearing by Associate Planner Mary Lovell recommended approval subject to a number of conditions. One commenter urged that the Examiner explore means of relieving the applicant from requirements for a configuration of restroom accommodations for disabled persons that might result in historic features of the former church building being compromised. There was no comment in opposition to the proposed rezoning application. The Hearing Examiner viewed the property prior to the hearing. SUMMARY OF RECOMMENDATION The Hearing Examiner recommends approval of this rezone application, subject to conditions. The existing uses on properties surroundmg the subject do not suggest any incompatibilities with the uses allowed in the CBD No public comments have been submitted that indicate neighboring property owner concerns with the compatibility of the potential uses with current neighboring property uses. e Agency recommendations. The applicant has not applied for any land use review other than for the rezone The city's Design Review Team comments addressed aspects of the prospective development of the subject property for musical and theatrical presentations. No comments have been provided with regard to the rezone per se. However, by its own terms the application in this case is for a non - project rezone Specific aspects of future development of this property are outside of the scope of the rezone application, and therefore, this recommendation. f. Adequacy of public facilities, such as roads, sewer, water and other required public. services. Utilities necessary for uses permitted in the CBD zone are available to the property The development of a specific project will be subject to compliance with infrastructure development standards and substantive environmental protection policies at the time of application. Development in the pertment portion of downtown Yakima is not subject to requirements for parking to accommodate customers or clients as might otherwise be applicable under the zomng ordinance g. The public need for the proposed change. There is not a public need that demands the requested rezone. Nevertheless, the proposed rezone is consistent with the December 2005 Future Land Use Map amendment. Bjarnson v Kitsap County,78 Wash.App 840, 846, 899 P.2d 1290 (1995). h. Public Testimony No public testimony was offered at hearing with respect to the rezoning of the property Written comments received by the city endorsed the rezone and the development of the theater and music venue on the property This suggests a local acceptance of the appropriateness of the CBD zoning designation for the subject property One public commenter requested a review of the requirements for restroom facilities for the prospective use of the property for a theater venue. Restroom facility requirements pursuant to the Americans with Disabilities Act are argued to be inconsistent with the preservation of the historical building on the property The applicant's representative at the hearing indicated that reconciling historic preservation of the property with access for disabled persons was challenging, but that the applicant was striving to find a balance in the matter The commenter requested that the examiner address this matter, but, as noted earlier, the application in this case is not for a project specific rezone. Accordingly, the issues pertaining to compliance with disabled person access and accommodation requirements are outside of the scope of this hearing process. The requirements for public notice of the applications and the hearing were satisfied. 3 The subject property is suitable for uses pernutted under the proposed zoning. 4 The proposed amendment is consistent with the amendments to the Future Land Use Map approved by the city in December of 2005 5 The proposed amendment complies with the intent of the zoning ordinance 6 The proposed amendment does not present any substantial incompatibility with neighboring land uses so long as actual uses comply with the design, development and review requirements in the Yakima Municipal Code. 7 Public facilities are adequate at the site to support the proposed professional business uses of the property, subject to compatibility and environmental impacts analysis of specific proposed uses. 8 The rezone is consistent with the public interest and is an appropriate action for implementing comprehensive plan amendments, subject to conditions. The building is a former church which is currently being used for a dinner theater that was approved after Class (3) review in July, 2005. The approved use is subject to conditions necessary to assure consistency with the current B -1 zoning of the property. United Builders, Inc. desires to use the building as a venue for a broader range of theatrical productions and music events. It obtained a comprehensive plan amendment in December of 2005 that changed the future land use designation of the property from Professional Office to CBD Core Commercial. CBD Core Commercial designation contemplates a range of uses that includes the entertainment uses planned by United Builders, Inc. The applicant now seeks to have the property rezoned to effectuate the comprehensive plan designation. The Examiner conducted a public hearing on April 13, 2006. The staff report presented at the hearing by Associate Planner Mary Lovell recommended approval subject to a number of conditions. One commenter urged that the Examiner explore means ofrelieving the applicant from requirements for a configuration of restroom accommodations for disabled persons that might result in historic features of the former church building being compromised. There was no comment in opposition to the proposed rezoning application. The Hearing Examiner viewed the property prior to the hearing. SUMMARY OF RECOMMENDATION. YMC 15.23.030.E provides the following criteria to be considered in making a recommendation on a zoning map amendment, which are respectively analyzed below: (i) The suitability of the property in question for uses permitted under the proposed zoning; (ii) The extent to which the proposed amendments are in compliance with and /or deviate from the goals and policies as adopted in the Yakima urban area comprehensive plan and the intent of the Urban Area Zoning Ordinance; (iii) The compatibility of the proposed zone change and associated uses with neighboring land uses; (iv) The recommendation from interested agencies and departments; (v) The adequacy of public facilities, such as roads, sewer, water and other required public services; (vi) The public need for the proposed change; and (vii) The testimony at the public hearing. b. Suitability of the property for Central Business District uses. The property presents no physical characteristics that suggest any unsuitability for permitted uses in the CBD use district. c. Compliance with the YUACP and UAZO intent. The future land use map designation for this property was changed from Professional Office to CBD Core Commercial in December 2005. This designation fully supports the requested rezone to CBD. The area is the regional center for commerce, cultural and governmental land uses. This area provides for a wide variety of intense retail, office, institutional and high density residential land uses. Based on the YUACP Land Use Compatibility chart, CBD Core Commercial uses can be considered generally compatible with uses on neighboring Professional Office properties. HEARING EXAMINER RECOMMENDATION - 3 UNITED BUILDERS, INC. rl A RZ #3 -06 . , According to YMC 15.03.030, the purpose of the CBD zoning distr i s to � 0 ° preserve the central business district of the City of Yakima as the region's center of commerce, industry, recreation and culture. This district is characterized by very intensive development and a variety of land uses including retail sales and service establishments, high- density residential development, financial institutions, professional buildings and government offices. There is no evidence that the rezone would not comply with the intent of the CBD use district. d. Compatibility of uses allowed in the CBD zone with neighboring land uses. The existing uses on properties surrounding the subject do not suggest any incompatibilities with the uses allowed in the CBD. No public comments have been submitted that indicate neighboring property owner concerns with the compatibility of the potential uses with current neighboring property uses. e. Agency recommendations. The applicant has not applied for any land use review other than for the rezone. The city's Design Review Team comments addressed aspects of the prospective development of the subject property for musical and theatrical presentations. No comments have been provided with regard to the rezone per se. However, by its own teems the application in this case is for a non - project rezone. Specific aspects of future development of this property are outside of the scope of the rezone application, and therefore, this recommendation. f. Adequacy of public facilities, such as roads, sewer, water and other required public services. Utilities necessary for uses permitted in the CBD zone are available to the property. The development of a specific project will be subject to compliance with infrastructure development standards and substantive environmental protection policies at the time of application. Development in the pertinent portion of downtown Yakima is not subject to requirements for parking to accommodate customers or clients as might otherwise be applicable under the zoning ordinance. g. The public need for the proposed change. There is not a public need that demands the requested rezone. Nevertheless, the proposed rezone is consistent with the December 2005 Future Land Use Map amendment. The CBD use district clearly implements the CBD Core Commercial � \ - P O _future land use map designation of the property. Though a change in circumstances is G usually necessary to support a rezone, when the rezone is intended to implement a comprehensive plan provision, it need not be based on changed circumstances. Bjarnson v. Kitsap County,78 Wash.App. 840, 846, 899 P.2d 1290 (1995). h. Public Testimony. No public testimony was offered at hearing with respect to the rezoning of the property. Written comments received by the city endorsed the rezone and the development of the theater and music venue on the property. This suggests a local acceptance of the appropriateness of the CBD zoning designation for the subject property. One public commenter requested a review of the requirements for restroom facilities for the prospective use of the property for a theater venue. Restroom facility requirements pursuant to the Americans with Disabilities Act are argued to be inconsistent with the preservation of the historical building on the property. The applicant's representative at the hearing indicated that reconciling historic preservation of the property with access for disabled persons was challenging, but that the applicant was striving to fmd a balance in the matter. The commenter requested that the examiner address this matter, but, as noted earlier, the application in this case is not for a project specific rezone. Accordingly, the issues pertaining to compliance with disabled person access and accommodation requirements are outside of the scope of this hearing process. From the foregoing findings, the Hearing Examiner makes the following CONCLUSIONS 1. The Hearing Examiner has jurisdiction to conduct an open record hearing on the application to change the zoning of the property identified in the findings from B -1 to CBD and to make a recommendation to the City Council accordingly. The requirements for public notice of the applications and the hearing were satisfied. 3. The subject property is suitable for uses permitted under the proposed zoning. 4. The proposed amendment is consistent with the amendments to the Future Land Use Map approved by the city in December of 2005. 5. The proposed amendment complies with the intent of the zoning ordinance. 6. The proposed amendment does not present any substantial incompatibility with neighboring land uses so long as actual uses comply with the design, development and review requirements in the Yakima Municipal Code. 7. Public facilities are adequate at the site to support the proposed professional business uses of the property, subject to compatibility and environmental impacts analysis of specific proposed uses. 8. The rezone is consistent with the public interest and is an appropriate action for implementing comprehensive plan amendments, subject to conditions. RECOMMENDATION The application of United Builders, Inc. to rezone property from B -1, Professional Business to CBD, Central Business District should be APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS: 1. Permits and certificates of zoning review must be obtained from the City of Yakima for all specific projects proposed for the rezoned property, and such projects will comply with applicable development standards unless the standards are administratively varied or otherwise adjusted in accordance with the Yakima Urban Area Zoning Ordinance. Uses characteristic of this district include the proposal to establish a performing arts center in conjunction with a wine center /bistro on the Subject property. Site Design and Improvement Standards The Yakima Urban Area Zoning Ordinance at Section 15.05.010 establishes basic development requirements as minimum criteria, which must be met to assure land use compatibility and promote the public health, safety and general welfare. The applicant's proposal to utilize the former church building as a performing arts center in conjunction with a wine center/bistro is subject to applicable development standards. The following is an overview of the proposal's compliance with the aforementioned development standards: Setbacks - Structure setbacks are required by the UAZO (Table 5 -1). The existing church building complies with these standards. Any proposed structural changes shall meet the requirements of the Ordinance. Parking — Parking requirements are listed in Chapter 15.6 (Table 6 -1) of the UAZO. The subject property is located in the Downtown Business District Exempt area as defined in Chapter 15.06.040.B (Figure 6 -1) of the UAZO. The applicant is exempted from the provisions of Chapter 15.06, provided that all other requirements of the chapter shall apply to any parking that may be provided. Signage - A sign plan was not submitted with this application. Any proposed signage shall conform to sign standards as set forth in Chapter 15.08 of the Yakima Urban Area Zoning Ordinance. Site screening — Chapter 15.07 of the Yakima Urban Area Zoning Ordinance establishes site screening standards to provide a visual buffer between uses of different intensity, streets and structure, reduce erosion and storm water runoff, protect property values and eliminate potential land use conflicts by mitigating adverse impacts from dust, odor, litter, noise, glare, lights, signs, building or parking areas. Site screening requirements vary depending on the intensity of both the proposed use and its neighbors. After a site visit and review of Table 7 -1 of the UAZO, it has been determined that no additional site screening is required at this time Public facilities - Adequate public water and sanitary sewer currently serve this site. The property is well suited for the range of uses permitted within the CBD zoning district. 3. Recommendations from interested agencies. The Washington State Department of Archaeology & Historic Preservation requested that the applicant submit a Historic Property Inventory for evaluation of the project. 4. Compliance with the Comprehensive Plan. During the annual Comprehensive Plan amendment process in 2005, the applicant requested a change to the future land use map from Professional Office to CBD Core Commercial. The Regional Planning Commission, Joint Board, and the Joint City Council and County Commissioners approved the amendment to CBD Core Commercial. The Yakima City Council adopted the Ordinance authorizing the change to the future land use map on December 9, 2005. 5. Adequacy of public utilities. This property is currently served by all necessary public utilities. Street access is from Naches Avenue and East `A' Street, both classified as Local Access Streets. 6. Compatibility of proposed use. The proposed use of the former church building for a performing arts center in conjunction with a wine center/bistro is compatible with the goals and objectives of the Urban Area Zoning Ordinance. 7. Public Need This rezone fulfills the public need for zoning regulations that are consistent with the City's Comprehensive Plan. Development Services Team comments A Development Services Team meeting was held on March 15, 2006 to discuss the technical aspects of this proposal. The following is a summary of the comments received from DST members: Engineering: Title 12 does not affect a rezone. Sampling port (manhole) required on side sewer for Pretreatment to sample and monitor. Traffic Engineering: No traffic related concerns regarding the rezone of this property. Transportation Capacity Management Ordinance This proposal is an exempt activity under the Transportation Capacity Management Ordinance. Future expansion of the business may require concurrency review if deemed necessary by the City Traffic Engineer. State Environmental Policy Act A Mitigated Determination of Nonsignificance (MDNS) was issued by the City of Yakima on March 27, 2006. This determination was based on SEPA guidelines (WAC 197 -11 -350). One comment letter was received on the environmental review of this rezone during the 20 -day SEPA comment period. So is the center of the road Naches Avenue Park and the publicly owned lawned planting strip between the sidewalk and street curb. Presently, there is some on site parking on the north side of the building next to the alley. Presently this parking area is used for the handicap and employee parking and for unloading equipment and supplies. It has been suggested that these parking sites be eliminated forcing all parking to the public curb or onto adjourning property. This building was constructed before we were aware of the need for handicap parking and facilities. Even so, this building has handicap parking sites located close to an suitable handicap entrance on its north east comer. That area, inside the present building would be the place to convert the present rest room to multiple handicap facilities. The largest of six (6) rest room facilities that are on the west side of the building closest to the main entrance have access via stairs. There is plenty of room to construct more stalls in both of these lobby rest rooms but only if they would not be handicap accessible. It would destroy the historical aspect of the lobby to convert these stairs to be handicap accessible. Besides, the lobby is hard for a person in a wheelchair to maneuver during intermission crowds. The building is a former church which is currently being used for a dinner theater that was approved after Class (3) review in July, 2005. The approved use is subject to conditions necessary to assure consistency with the current B -1 zoning of the property. United Builders, Inc. desires to use the building as a venue for a broader range of theatrical productions and music events. It obtained a comprehensive plan amendment in December of 2005 that changed the future land use designation of the property from Professional Office to CBD Core Commercial. CBD Core Commercial designation contemplates a range of uses that includes the entertainment uses planned by United Builders, Inc. The applicant now seeks to have the property rezoned to effectuate the comprehensive plan designation. The Examiner conducted a public hearing on April 13, 2006. The staff report presented at the hearing by Associate Planner Mary Lovell recommended approval subject to a number of conditions. One commenter urged that the Examiner explore means of relieving the applicant from requirements for a configuration of restroom accommodations for disabled persons that might result in historic features of the former church building being compromised. There was no comment in opposition to the proposed rezoning application. The Hearing Examiner viewed the property prior to the hearing. SUMMARY OF RECOMMENDATION. This designation fully supports the requested rezone to CBD. The area is the regional center for commerce, cultural and governmental land uses. This area provides for a wide variety of intense retail, office, institutional and high density residential land uses. Based on the YUACP Land Use Compatibility chart, CBD Core Commercial uses can be considered generally compatible with uses on neighboring Professional Office properties. HEARING EXAMINER RECOMMENDATION - 3 \ % \I)) UNITED BUILDERS, INC. RZ #3 -06 4, According to YMC 15.03.030, the purpose of the CBD zoning district is to I,,f, O preserve the central business district of the City of Yakima as the region's center of *$'1� 6. commerce, industry, recreation and culture. This district is characterized by very intensive development and a variety of land uses including retail sales and service establishments, high- density residential development, financial institutions, professional buildings and government offices. There is no evidence that the rezone would not comply with the intent of the CBD use district. d. Compatibility of uses allowed in the CBD zone with neighboring land uses. The existing uses on properties surrounding the subject do not suggest any incompatibilities with the uses allowed in the CBD. No public comments have been submitted that indicate neighboring property owner concerns with the compatibility of the potential uses with current neighboring property uses. e. Agency recommendations. The applicant has not applied for any land use review other than for the rezone. The city's Design Review Team comments addressed aspects of the prospective development of the subject property for musical and theatrical presentations. No comments have been provided with regard to the rezone per se. However, by its own teems the application in this case is for a non - project rezone. Specific aspects of future development of this property are outside of the scope of the rezone application, and therefore, this recommendation. f. Adequacy of public facilities, such as roads, sewer, water and other required public services. Utilities necessary for uses permitted in the CBD zone are available to the property. The development of a specific project will be subject to compliance with infrastructure development standards and substantive environmental protection policies at the time of application. Development in the pertinent portion of downtown Yakima is not subject to requirements for parking to accommodate customers or clients as might otherwise be applicable under the zoning ordinance. g. The public need for the proposed change. There is not a public need that demands the requested rezone. Nevertheless, the proposed rezone is consistent with the December 2005 Future Land Use Map amendment. There is a public value to implementation of zoning regulations that are consistent with comprehensive plans or HEARING EXAMINER RECOMMENDATION - 4 1 N1 1, .h UNITED BUILDERS, INC. Though a change in circumstances is �V usually necessary to support a rezone, when the rezone is intended to implement a comprehensive plan provision, it need not be based on changed circumstances. Bjarnson v. Kitsap County,78 Wash.App. 840, 846, 899 P.2d 1290 (1995). h. Public Testimony. No public testimony was offered at hearing with respect to the rezoning of the property. Written comments received by the city endorsed the rezone and the development of the theater and music venue on the property. This suggests a local acceptance of the appropriateness of the CBD zoning designation for the subject property. One public commenter requested a review of the requirements for restroom facilities for the prospective use of the property for a theater venue. Restroom facility requirements pursuant to the Americans with Disabilities Act are argued to be inconsistent with the preservation of the historical building on the property. The applicant's representative at the hearing indicated that reconciling historic preservation of the property with access for disabled persons was challenging, but that the applicant was striving to find a balance in the matter. The commenter requested that the examiner address this matter, but, as noted earlier, the application in this case is not for a project specific rezone. Accordingly, the issues pertaining to compliance with disabled person access and accommodation requirements are outside of the scope of this hearing process. From the foregoing findings, the Hearing Examiner makes the following CONCLUSIONS 1. The Hearing Examiner has jurisdiction to conduct an open record hearing on the application to change the zoning of the property identified in the findings from B -1 to CBD and to make a recommendation to the City Council accordingly. The proposed amendment does not present any substantial incompatibility • with neighboring land uses so long as actual uses comply with the design, development and review requirements in the Yakima Municipal Code. 7. Public facilities are adequate at the site to support the proposed professional business uses of the property, subject to compatibility and environmental impacts analysis of specific proposed uses. 8. The rezone is consistent with the public interest and is an appropriate action for implementing comprehensive plan amendments, subject to conditions. RECOMMENDATION The application of United Builders, Inc. to rezone property from B -1, Professional Business to CBD, Central Business District should be APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS: 1.
