HomeMy WebLinkAbout2006-012 Final Assessment Roll - Sewer LID 1057, North 84th Ave ORDINANCE NO 2006 -12 AN ORDINANCE of the City of Yakima, Washington, approving and confirming the final assessment roll for North 84 Avenue & Hawthorne Drive Sewer Local Improvement District No 1057, which has been created and established for the purpose of paying the cost of certain sewer system improvements, and levying and assessing the amount thereof against the Tots, tracts, parcels of land and other property shown on said roll WHEREAS, an assessment roll levying special assessments against the properties located in Local Improvement District No 1057 ( "LID 1057 "), in Yakima, Washington, created under Ordinance No 2004 -45, was filed with the City Clerk of the city of Yakima as provided by law; and WHEREAS, notice of the time and place of a hearing on and of making objections to the assessment roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 4 day of April, 2006 at the hour of 7 00 p m in the Council Chambers, Yakima, Washington, and further notice thereof was duly mailed by (the City Clerk to each property owner on the roll, and WHEREAS, at the time and place fixed and designated in said notice, the hearing on the assessment roll was duly held and the Council, sitting as a board of equalization, gave due consideration to all written and oral protests received, all documentation, evidence and testimony presented, and all persons appearing at said hearing, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 'YAKIMA. Section 1. The Council, sitting as a board of equalization and having made all revisions to the roll it deems necessary, hereby finds and determines that the final assessment roll for LID 1057 is just and equitable and that no assessment against property within LID 1057 is greater than the special benefits to be derived from the improvements Accordingly, the final assessment roll, in the total amount of $344,784 74, is hereby approved and confirmed, and the assessments set forth therein are hereby levied against each specially benefited lot, tract and parcel of property described in the roll Section 2. The Clerk of the City is hereby directed to place the final assessment roll for LID 1057 in the hands of the Finance Director of the City for collection Upon (jc)ord /84` Ave LID Assessment Roll 1 such placement, the amount of each assessment set forth in the roll, together with any interest or penalty imposed from time to time, shall become a Tien against the property so assessed The lien shall be paramount and superior to any other lien or encumbrance whatsoever therefore, or thereafter created, except a lien for general taxes Section 3. Upon receipt of the final assessment roll for LID 1057, the Finance Director of the City is hereby directed to publish notice at the times and in the manner required by RCW 35 49 010, stating that the roll is in his hands for collection and that such assessments or any portion thereof may be paid to the City at any time within 30 days from the date of the first publication of such notice, without penalty, interest or costs Section 4. The amount of any assessment, or any portion thereof, against property in LID 1057 not paid within the 30 day period from the date of the first publication of the Finance Director's notice shall be payable in ten (10) equal annual installments, together with interest on the diminishing principal balance thereof at a rate of either (i) ' /z% per annum higher than the interest rate on bonds that may be sold to . finance the costs of LID 1057, (ii) 8 75% per annum if the City provides internal financing- for the costs of LID 1057, (iii) in no case shall the rate exceed 8 75% per annum to the LID holder Interest shall commence on the 30 day following first publication of such notice The first installment shall become due and payable one year from the expiration of the 30 -day prepayment period Annual installments, including interest and any penalty, shall be paid in full when due, and no partial payments shall be accepted by the Finance 'Director of the City Section 5. Any installment not paid when due shall thereupon become delinquent. All delinquent installments shall be subject to a penalty equal to12% per annum of the amount of the installment, including interest, from the date of the delihquency until paid Section 6. The lien of any assessment may be discharged at any time after the 30 -day prepayment period by payment of the entire principal amount of the assessment remaining unpaid together with interest thereon to the due date of the next installment. Section 7. If any one or more of the provisions of this ordinance shall be declared by a court of competent jurisdiction to be contrary to law, then such provision shall be null and void and shall be deemed severable from the remaining provisions of (jc)ord /84 Ave LID Assessment Roll 2 this ordinance and shall in no way affect the validity of the other provisions of this ordinance Section 8. Wendell Adams, P.E., City Engineer Engineering Division Manager / 575 -6111 SUMMARY EXPLANATION The formation of this Sewer Local Improvement District (LID) for North 84th Avenue /Hawthorn Drive consists of forty (40) parcels as shown on the attached LID boundary map The project will consist of the construction of approximately 4,100 linear feet of 8 -inch sewer pipe. The City has received signed Petitions from property owners within the LID boundary representing over 84% of the property values of the property owners. • The attached Resolution is to set the date of LID Public Hearing for August 3, 2004. The estimated cost to install sewer along 84th Avenue and Hawthorn Drive is $615,600.00 This project will commence upon execution of this agreement. BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1. The nature and territorial extent of said proposed improvements is as follows. ROUTE OF 8 -INCH LINE. • The project will consist ,off ,.�Ir o n pproximately 4,070 lineal feet of 8 -inch sewer pipe and appurtenances beg n g i .hi� is� ewe main on the south end of North 84 Avenue extending north to Viewcrest Way then east to Viewmont Drive, beginning at the sewer line on North 84 Avenue extending west to the west end of Hawthorne Drive. The estimated cost to install sewer in this area will be approximately $615,600.00. Section 3. There is hereby created a Local Improvement District, to be called "Local Improvement District No. 1057 ", which said district shall include all of the above described property ,_ 99 Section 4. The assessments shall be made according to special benefits derived from the improvements without regard to the zone and termini method. Section 5. All costs and expenses in connection with the construction of said improvements, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefore as provided by law and as above described. Section 6. The work necessary to be done in connection with the making of said improvements shall be done by contract upon competitive bids according to specifications and plans as prepared by the Engineering Division of the Department of Community and Economic Development, and the City shall have the power to reject any and all bids. Section 7. There is herby created a special fund, to be known as "Local Improvement Fund, Distract No. 1057 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all mterest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premmm and interest on said bonds issued for said improvement. Section 8. Bonds shall be issued in payment of the costs and expense of said improvements, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, which assessments, with interest, shall be payable annually under the mode of payment "payment by bonds" as defined by the, statutes of the State of Washington and the ordinances of the City of Yakima; provided, this improvement may be financed the issuance of notes, under the authority of R.C.W 39.50 and Section 8.12.100 of the City of Yakima Municipal Code. The term and interest rate of bonds and special assessments contemplated by this section shall conform to provisions, terms and conditions to be specified by a subsequent ordinance of the City of Yakima. It is the intent of the City to reimburse a portion of the .costs .of these improvements with the proceeds of bonds (Reimbursement Bonds) to be issued by the City The interest on these bonds is excludable from gross income under Section 103 of the Internal Revenue Code of 1986, as amended. The maximum principal amount of Reimbursement Bonds expected to be issued is $$615,600.00 This declaration of official intention is made pursuant to Section 1 103 -18 of the Income Tax Regulations promulgated by the U.S. Department of Treasury Section 9 The actual assessments levied for this improvement may vary from the assessment estimates so long as they do not exceed a figure equal to the increased true fair value the improvement adds to the property Section 10. The City shall provide 24 -hour prior notice for testing services identified in item 3 5 and 3 6 of this agreement. My parcel # in that area is 181319 -13404 I am not able to attend the hearing on August 3` 2004, so I am writing this letter of objection in lieu of my attendance to that specific meeting. I am a single mother of three teenagers, one of which, if going off to college in September. My finances are such that it would cause a significant burden on me to make such a financial commitment at this time. My other son will be in his senior year in high school and will also be going off to college in September of 2005. Then, I have a daughter that will follow him in 2 years. As you can see, this would not be an ideal time for any such undertaking. The Council sitting as a board of equalization and having made all revisions to the roll it deems necessary, hereby finds and determines that the final assessment roll for LID 1057 is just and equitable and that no assessment against property within LID 1057 is greater than the special benefits to be derived from the improvements Accordingly, the final assessment roll, in the total amount of $344,784 74 is hereby approved and confirmed, and the assessments set forth therein are hereby levied against each specially benefited lot, tract and parcel of property described in the roll Section 2. Upon receipt of the final assessment roll for LID 1057, the Finance Director of the City is hereby directed to publish notice at the times and in the manner required by RCW 35 49 010, stating that the roll is in his hands for collection and that such assessments or any portion thereof may be paid to the City at any time within 30 days from the date of the first publication of such notice, without penalty, interest or costs Section 4. The amount of any assessment, or any portion thereof, against property in LID 1057 not paid within the 30 day period from the date of the first publication of the Finance Director's notice shall be payable in ten (10) equal annual installments, together with interest on the diminishing principal balance thereof at a rate of either (i) 1 /2% per annum higher than the interest rate on bonds that may be sold to finance the costs of LID 1057, (ii) 8 75% per annum if the City provides internal financing for the costs of LID 1057, (iii) in no case shall the rate exceed 8 75% per annum to the LID holder Interest shall commence on the 30 day following first publication of such notice The first installment shall become due and payable one year from the expiration of the 30 -day prepayment period Annual installments, including interest and any penalty, shall be paid in full when due, and no partial payments shall be accepted by the Finance Director of the City Section 5. Any installment not paid when due shall thereupon become delinquent. All delinquent installments shall be subject to a penalty equal to12% per annum of the amount of the installment, including interest, from the date of the delinquency until paid Section 6. The lien of any assessment may be discharged at any time after the 30 -day prepayment period by payment of the entire principal amount of the assessment remaining unpaid together with interest thereon to the due date of the next installment Section 7. The Council, sitting as a board of equalization and having made all revisions to the roll it deems necessary, hereby finds and determines that the final assessment roll for LID 1057 is just and equitable and that no assessment against property within LID 1057 is greater than the special benefits to be derived from the improvements. Accordingly, the final assessment roll, in the total amount of $344,784 74, is hereby approved and confirmed, and the assessments set forth therein are hereby levied against each specially benefited lot, tract and parcel of property described in the roll Section 2. The Clerk of the City is hereby directed to place the final assessment roll for LID 1057 in the hands of the Finance Director of the City for collection Upon (jc)ord /84` Ave LID Assessment Roll 1 111P111111111111111111111111 1111 I II 7529347 Page 2 of 5 09/27/2006 03 such placement, the amount of each assessment set forth in the roll, together with any interest or penalty imposed from time to time, shall become a lien against the property so assessed The lien shall be paramount and superior to any other lien or encumbrance whatsoever therefore, or thereafter created, except a lien for general taxes Section 3. Upon receipt of the final assessment roll for LID 1057, the Finance Director of the City is hereby directed to publish notice at the times and in the manner required by RCW 35 49 010, stating that the roll is in his hands for collection and that such assessments or any portion thereof may be paid to the City at any time within 30 days from the date of the first publication of such notice, without penalty, interest or costs. Section 4. The amount of any assessment, or any portion thereof, against property in LID 1057 not paid within the 30 day period from the date of the first publication of the Finance Director's notice shall be payable in ten (10) equal annual installments, together with interest on the diminishing principal balance thereof at a rate of either (i) 1/2% per annum higher than the interest rate on bonds that may be sold to finance the costs of LID 1057, (ii) 8 75% per annum if the City provides internal financing for the costs of LID 1057, (iii) in no case shall the rate exceed 8 75% per annum to the LID holder Interest shall commence on the 30 day following first publication of such notice The first installment shall become due and payable one year from the expiration of the 30 -day prepayment period Annual installments, including interest and any penalty, shall be paid in full when due, and no partial payments shall be accepted by the Finance Director of the City Section 5. Any installment not paid when due shall thereupon become delinquent All delinquent installments shall be subject to a penalty equal to12% per annum of the amount of the installment, including interest, from the date of the delinquency until paid Section 6. The lien of any assessment may be discharged at any time after the 30 -day prepayment period by payment of the entire principal amount of the assessment remaining unpaid together with interest thereon to the due date of the next installment Section 7.
