AN ORDINANCE of the City of Yakima, Washington, approving and confirming the
final assessment roll for North 84 Avenue & Hawthorne Drive
Sewer Local Improvement District No 1057, which has been
created and established for the purpose of paying the cost of
certain sewer system improvements, and levying and assessing
the amount thereof against the Tots, tracts, parcels of land and
other property shown on said roll
WHEREAS, an assessment roll levying special assessments against the
properties located in Local Improvement District No 1057 ( "LID 1057 "), in Yakima,
Washington, created under Ordinance No 2004 -45, was filed with the City Clerk of the
city of Yakima as provided by law; and
WHEREAS, notice of the time and place of a hearing on and of making
objections to the assessment roll was duly published at and for the time and in the
manner provided by law, fixing the time and place of hearing thereon for the 4 day of
April, 2006 at the hour of 7 00 p m in the Council Chambers, Yakima, Washington, and
further notice thereof was duly mailed by (the City Clerk to each property owner on the
roll, and
WHEREAS, at the time and place fixed and designated in said notice, the
hearing on the assessment roll was duly held and the Council, sitting as a board of
equalization, gave due consideration to all written and oral protests received, all
documentation, evidence and testimony presented, and all persons appearing at said
hearing,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF 'YAKIMA.
Section 1. The Council, sitting as a board of equalization and having made all
revisions to the roll it deems necessary, hereby finds and determines that the final
assessment roll for LID 1057 is just and equitable and that no assessment against
property within LID 1057 is greater than the special benefits to be derived from the
improvements Accordingly, the final assessment roll, in the total amount of
$344,784 74, is hereby approved and confirmed, and the assessments set forth therein
are hereby levied against each specially benefited lot, tract and parcel of property
described in the roll
Section 2. The Clerk of the City is hereby directed to place the final assessment
roll for LID 1057 in the hands of the Finance Director of the City for collection Upon

such placement, the amount of each assessment set forth in the roll, together with any
interest or penalty imposed from time to time, shall become a Tien against the property
so assessed The lien shall be paramount and superior to any other lien or
encumbrance whatsoever therefore, or thereafter created, except a lien for general
taxes
Section 3. Upon receipt of the final assessment roll for LID 1057, the Finance
Director of the City is hereby directed to publish notice at the times and in the manner
required by RCW 35 49 010, stating that the roll is in his hands for collection and that
such assessments or any portion thereof may be paid to the City at any time within 30
days from the date of the first publication of such notice, without penalty, interest or
costs
Section 4. The amount of any assessment, or any portion thereof, against
property in LID 1057 not paid within the 30 day period from the date of the first
publication of the Finance Director's notice shall be payable in ten (10) equal annual
installments, together with interest on the diminishing principal balance thereof at a rate
of either (i) ' /z% per annum higher than the interest rate on bonds that may be sold to .
finance the costs of LID 1057, (ii) 8 75% per annum if the City provides internal financing-
for the costs of LID 1057, (iii) in no case shall the rate exceed 8 75% per annum to the
LID holder Interest shall commence on the 30 day following first publication of such
notice The first installment shall become due and payable one year from the expiration
of the 30 -day prepayment period Annual installments, including interest and any
penalty, shall be paid in full when due, and no partial payments shall be accepted by the
Finance 'Director of the City
Section 5. Any installment not paid when due shall thereupon become
delinquent. All delinquent installments shall be subject to a penalty equal to12% per
annum of the amount of the installment, including interest, from the date of the
delihquency until paid
Section 6. The lien of any assessment may be discharged at any time after the
30 -day prepayment period by payment of the entire principal amount of the assessment
remaining unpaid together with interest thereon to the due date of the next installment.
Section 7. If any one or more of the provisions of this ordinance shall be
declared by a court of competent jurisdiction to be contrary to law, then such provision
shall be null and void and shall be deemed severable from the remaining provisions of

this ordinance and shall in no way affect the validity of the other provisions of this
ordinance
Section 8. This ordinance shall be in full force and effect thirty days after its
passage, approval and publication as provided by law and by the City Charter

SUMMARY EXPLANATION
The North 84 Avenue & Hawthorn Drive Sewer Local Improvement District (LID) was formed to
construct a new sewer main to serve 36 parcels Approximately 4,070 lineal feet of 8 -inch sewer
main and appurtenances was installed beginning at the existing sewer line located at the south
end of North 84 Avenue including part of Viewcrest Place East to Viewmont Drive, and beginning
from the east end of Hawthorn Drive and ending at the west end of Hawthorth Drive
Final Assessment Roll
The Final Assessment Roll identifies the properties in the L.I D boundary by Yakima County
Parcel numbers The parcels correspond to the location map The Assessment Roll provides the
name of the property owner as shown on the tax rolls of the County Treasurer, and the Preliminary
and Final Assessment. The complete names and addresses by which the Public Hearing Notices
were mailed are on file in the Engineering Division
The Final Assessment Roll of is $344,784 74 pro -rated to 36 parcels within the North 84 Avenue
& Hawthorn Drive Sewer L.I D based on the cost per parcel plus square footage and
improvements Proceedings for this L.I D are proper and conform with L.I D statutes Proper
notice has been given in accordance with State law The City has met the intent of the State law
with assessments proportional within the dis to the speci benefit derived

NOTICE TO EACH OWNER OR REPUTED OWNER OF ANY LOT, TRACT OR PARCEL
OF LAND OR OTHER PROPERTY ESPECIALLY BENEFITED OR AFFECTED BY THE
PROPOSED IMPROVEMENT HEREINAFTER SET FORTH
YOU ARE HEREBY NOTIFIED that it is the intention of the City Council to improve the
following described property by constructing the necessary sewer main and all necessary
appurtenances.
The district to be served by and especially benefited by and assessed for the above described
improvements for sewer service is situate in the County of Yakima, Washington The formation of
this Sewer Local Improvement District (LID) for the North 84 Avenue & Hawthorne Drive
Avenue consists of thirty -six (36) parcels and described as follows.
• The project will consist of the construction of approximately 4,070 lineal feet of 8 -inch sewer
pipe and appurtenances beginning at the existing sewer main on the south end of North 84`'`
Avenue extending north to Viewcrest Way then east to Viewmont Drive, beginning at the sewer
line on North 84` Avenue extending west to the west end of Hawthorne Drive. The final cost to
install sewer in this area will be approximately $615,600 00

The total cost of said improvements is $344,784 74 which is to be borne by assessments against
the properties within the district especially benefited by such improvement
The hearing upon the proposed improvements will be held at a meeting of the City Council in the
City Council Chambers in the City Hall, Yakima, Washington, at 7.00 PM, Tuesday April 4,
2006, which time and place have been fixed for the hearing of all matters relating to said
improvements, all objections thereto, and for determining the method of payment therefore

A RESOLUTION fixing April 4, 2006 at 7 00 p.m as a time and date for a hearing on the

WHEREAS, the City Council of the City of Yakima adopted Resolution No 2004-
101, declaring its intention to order certain local improvements and to create a local
improvement district; and
WHEREAS, a hearing was held on Tuesday, July, 2004, and after due consideration
the Council adopted Ordinance No 2004 -45, ordering the improvements and creating Local
Improvement District No 1057 ( "L I D No 1057 "), and
WHEREAS, the County and the City agree that having the sewer mainline project
constructed in combination with the County's road improvement project is mutually
beneficial, and
WHEREAS, construction of the improvements within L.I D No 1057 is now
complete and the assessment roll for L.1 D No 1057 will be filed with the City Clerk, now,
therefore,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA•
A hearing on the final assessment roll shall be held at 7:00 p.m. on Tuesday,
April 4, 2006, in the Council Chambers in Yakima, Washington. All persons who may
desire to object to such improvements are hereby notified to appear and present such
objections at such hearing. The City Clerk is hereby directed to give notice of said hearing
with the date of the second publication to be at least fifteen days prior to the date of said
hearing, and to mail a notice of such hearing at least fifteen days before the date thereof, to
each owner or reputed owner of any lot, tract, parcel of land, or other property in L.I D No
1057 at the address shown on the tax rolls of the County Treasurer

Assessment Roll for North 84 Avenue & Hawthorne Drive, LID 1057
At that time the Yakima City Council will decide whether to accept the recommendation
for this assessment or revise the assessment cost to your parcel Although the majority of
LID participants voted on the proposed assessment, City Council has the final authority to
accept or change the final assessment method.
Property owners are not required to attend this public hearing but advised that their
individual assessment(s) may change.

RE Sewer LID Meeting
It is time to meet to determine the cost to be shared by each property owner for the
installation of sewer lines in the North 84 Avenue & Hawthorne Drive areas. The LID
provides for construction of the improvement with financing over a l0 -year period The
actual construction costs determine the final assessment, with the cost shared by the
property owners. Property owners are not required to connect to the sewer upon
completion of the project, but the service is available if a septic failure should occur 0
A meeting will be held on Tuesday, February 28, 2006 to discuss the shared cost to install
sewer lines in your area.
The City will finalize the LID process after costs are determined The LID option allows
the City to assist you with all aspects of the project, including financing over a 10 -year
period If you choose to install the side sewer on your own. City staff is available to
answer your questions and provide basic construction information

SUMMARY EXPLANATION
The formation of this Sewer Local Improvement District (LID) for North 84th
Avenue /Hawthorn Drive consists of forty (40) parcels as shown on the attached LID
boundary map The project will consist of the construction of approximately 4,100 linear
feet of 8 -inch sewer pipe.
The City has received signed Petitions from property owners within the LID boundary
representing over 84% of the property values of the property owners.
• The attached Resolution is to set the date of LID Public Hearing for August 3, 2004. The
estimated cost to install sewer along 84th Avenue and Hawthorn Drive is $615,600.00
This project will commence upon execution of this agreement.

AN ORDINANCE providing for the improvement of certain property by constructing an 8 -inch
public sewer system; establishing a Local Improvement District, providing for
the method of payment thereof, and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1. The following described property situated in Yakima County, Washington, shall
be improved by constructing an 8 -inch public sewer system:

Section 2. The nature and territorial extent of said proposed improvements is as follows.
ROUTE OF 8 -INCH LINE.

The project will consist ,off ,.�Ir o n pproximately 4,070 lineal feet of 8 -inch sewer pipe and
appurtenances beg n g i .hi� is� ewe main on the south end of North 84 Avenue extending
north to Viewcrest Way then east to Viewmont Drive, beginning at the sewer line on North 84 Avenue
extending west to the west end of Hawthorne Drive. The estimated cost to install sewer in this area will
be approximately $615,600.00.
Section 3. There is hereby created a Local Improvement District, to be called "Local Improvement
District No. 1057 ", which said district shall include all of the above described property ,_ 99
Section 4. The assessments shall be made according to special benefits derived from the
improvements without regard to the zone and termini method.
Section 5. All costs and expenses in connection with the construction of said improvements, including
the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto,
shall be levied and assessed against all of the property legally and properly assessable therefore as
provided by law and as above described.
Section 6. The work necessary to be done in connection with the making of said improvements shall
be done by contract upon competitive bids according to specifications and plans as prepared by the
Engineering Division of the Department of Community and Economic Development, and the City shall
have the power to reject any and all bids.
Section 7. There is herby created a special fund, to be known as "Local Improvement Fund, Distract
No. 1057 ", into which shall be placed all sums paid on account of the aforesaid special assessments,
including all mterest and penalties thereon, and in the event of the sale of local improvement bonds by the
City, all premmm and interest on said bonds issued for said improvement.
Section 8. Bonds shall be issued in payment of the costs and expense of said improvements, which
bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the
property within said district, which assessments, with interest, shall be payable annually under the mode
of payment "payment by bonds" as defined by the, statutes of the State of Washington and the ordinances
of the City of Yakima; provided, this improvement may be financed the issuance of notes, under the
authority of R.C.W 39.50 and Section 8.12.100 of the City of Yakima Municipal Code. The term and
interest rate of bonds and special assessments contemplated by this section shall conform to provisions,
terms and conditions to be specified by a subsequent ordinance of the City of Yakima.
It is the intent of the City to reimburse a portion of the .costs .of these improvements with the proceeds
of bonds (Reimbursement Bonds) to be issued by the City The interest on these bonds is excludable
from gross income under Section 103 of the Internal Revenue Code of 1986, as amended. The maximum
principal amount of Reimbursement Bonds expected to be issued is $$615,600.00 This declaration of
official intention is made pursuant to Section 1 103 -18 of the Income Tax Regulations promulgated by the
U.S. Department of Treasury
Section 9 The actual assessments levied for this improvement may vary from the assessment
estimates so long as they do not exceed a figure equal to the increased true fair value the improvement
adds to the property
Section 10. This ordinance is one relating to local improvements or assessments therefore, and shall
become effective immediately upon its passage, approval and publication as provided by law and by the
City Charter

At this time we have received 59% land value from neighbors in your area that are in
favor of forming a Local Improvement Sewer District. The City will proceed with the
LID formation process if we receive a positive response from property owners totaling
75% of the land value. The LID option allows the City to assist you with all aspects of
the project, including financing over a 10 -year period. The option of constructing the
III sewer as a private project was discussed at a previous meeting. If you chose to work
cooperatively to install the sewer main on your own, City staff is available to answer your
questions and provide basic construction information.
However, we need a Petition and Outside Utility Agreement (OUA) signed by each
property owner that wants to participate in the L.I.D A copy of the Agreement has been
sent to you for you to review, sign and return to City Engineering. A Notary Public must
witness your signature on Page 7 We can provide this service free of charge at City
Hall, or you may have it witnessed by a Notary at your workplace or financial institution.
Also, you would need to enclose a check for each parcel to the City of Yakima, $50 00 to
cover a City fee, and a check to Yakima County, $31 00, to cover the recording fee.
These documents will not be recorded until the project is complete, and they will be
returned to you if the project is cancelled for any reason. OUA's must be received in this
office by June 25, 2004.

A meeting was held on February 19, 2004 to discuss the possibility of expanding sewer
service into your neighborhood. We were very pleased with the turnout for the meeting
and the high level of interest expressed by the property owners
We discussed the plans that Yakima County has to pave N 84 Avenue this summer and
the importance of installing sewer lines before paving begins. After the street is paved
there is a 5 -year moratorium stating that there will be no cutting into the pavement for
five years.
At this time, we need to measure your desire to continue with this project. The City will

The most common method we use for sewer expansion is the creation of a Local Improvement

Avenue (south of Summitview) had a final assessment to each lot of approximately $6,000, with
40 additional connection fees of $2,500 to $4,200 per lot. Property owners are not required to

should occur
At this time, we would like to measure your interest in creating a LID in your neighborhood. If a
majority of the property owners are interested in the project, our staff will schedule a
neighborhood meeting to provide you with additional information and determine the scope of the

AGREEMENT FOR SANITARY SEWER IMPROVEMENTS
AND FUNDING
THIS AGREEMENT is entered into between the City of Yakima, (hereinafter the "City ")
whose address is 129 North 2 Street, Yakima, Washington 98901, and Yakima County,
Washington (hereinafter the "County ") through its Public Works Department, whose address is
128 North 2 Street, Room 408 County Courthouse, Yakima, Washington 98901
1 RECITALS
1 1 The County intends to construct a road improvement project known as the C2859,
north 84th Avenue Improvement Project Summitview Avenue to Viewcrest (hereinafter "the
Road Project ")
1 2 The City wants to have sanitary sewer and side sewer lines (hereinafter "the
Sewer Project ") constructed at certain locations within the limits of the Road Project The
location of the Sewer Project is shown on Exhibit 'A'
1 3 The County and City agree that having the Sewer Project constructed in
combination with the Road Project is mutually beneficial
• 1 4 The City has determined that it is in its best interest to provide funding for the
Sewer Project and to allow Yakima County to do the construction
1 5 The Yakima County Engineer has deterrruned that it is in the best interests of the
County that the Yakima County Public Works Department contract for the construction of the
Sewer Project within the same construction contract as the Road Project
NOW, THEREFORE IT IS HEREBY AGREED
2 THE CITY SHALL.
2 1 Provide the design, details, specifications, and estimate for the Sewer Project to
the County
2 2 Review the County's final contract plans and specifications and provide written
approval of the Sewer Project plans and specifications to the County before the advertisement of
the project.
2 3 Review construction bids provided by the County and provide written notice of
approval or disapproval of the Sewer Project bids to the County before the award of a
construction contract Written notice will be provided to the County no later than five working
days following opening of bids
2 4 Review and approve all Source pp o ce of Materials submittals regarding the Sewer
Project
2 5 Provide all on -site field inspection for the construction of the Sewer Project
except those services to be provided by the County identified in items 3 5 and 3 6 of this
agreement. The City shall provide 24 -hour prior notice for testing services identified in item 3 5
and 3 6 of this agreement. The field inspection will be consistent with the Washington State
Department of Transportation's 2004 Standard Specifications for Road, Bridge, and Municipal
Construction and Washington State Department of Transportation's Construction Manual The
City shall prepare Daily Inspector Reports consistent with the standard of the industry The
Daily Inspector Reports shall clearly identify all bid items and quantities to be paid and list any
agreed to change order work or any work paid under the bid item Minor Changes The City shall
provide copies of the Inspector Daily Reports to the County at least once a week
2 6 Prepare a monthly progress estimate of quantities used on the Sewer Project using
the bid item schedule for the construction contract The progress estimate shall be provided to
the County no later than the 5 day of each month The progress estimate shall include all work
completed through the last day of the previous month.
2 7 Upon review and approval by the City of the amounts charged, provide monthly
progress payments to the County for work performed on the Sewer Project by the contractor
Progress payments shall be made to the County no later than the 20` day of each month The
progress payment shall be based on the progress estimate provided for in item 2 6 of this
agreement
2 8 Upon review and approval by the City of the amounts charged, provide a final
payment to the County for all costs reasonably incurred by the County that are directly related to
the Sewer Project These costs shall include actual sewer construction costs made to the
contractor, County personnel labor costs for time reasonably spent on the Sewer Project work,
and material testing expenses Final payment shall be made to the County no later than 30 days
after the City receives the report of final costs from the County
3 YAKIMA COUNTY SHALL
3 1 Incorporate the City's Sewer Project design, details, and specifications into the
County's Road Project The Sewer Project construction bid items shall be listed under a separate
pay schedule within the contract documents
3 2 Provide a copy of the final plans and specifications for the construction project to
the City Engineer for his review and approval before the advertisement of the project
3 3 Provide a copy of the bid results to the City Engineer for his review and approval
before the award of a construction contract

I am writing this letter m response to the letter I recently received
regarding the sewer L.I .D. for North 84 Avenue and Hawthorne Dnve.
My parcel # in that area is 181319 -13404
I am not able to attend the hearing on August 3` 2004, so I am writing
this letter of objection in lieu of my attendance to that specific meeting. I
am a single mother of three teenagers, one of which, if going off to college
in September. My finances are such that it would cause a significant burden
on me to make such a financial commitment at this time. My other son will
be in his senior year in high school and will also be going off to college in
September of 2005. Then, I have a daughter that will follow him in 2 years.
As you can see, this would not be an ideal time for any such undertaking.
In addition, I have had no problems with my septic tank or drain field, nor
has there been any history of any problems by the previous owner •
So, I would like to go on record as being opposed to this construction.

ORDINANCE NO 2006- 12
AN ORDINANCE of the City of Yakima, Washington, approving and confirming the
final assessment roll for North 84 Avenue & Hawthorne Drive
Sewer Local Improvement District No 1057, which has been
created and established for the purpose of paying the cost of
certain sewer systern improvements, and levying and assessing
the amount thereof against the lots, tracts parcels of land and
other property shown on said roll
WHEREAS, an assessment roll levying special assessments against the
properties located in Local Improvement District No 1057 ( "LID 1057 "), in Yakima
Washington, created under Ordinance No 2004 -45 was filed with the City Clerk of the
city of Yakima as provided by law; and
WHEREAS, notice of the time and place of a hearing on and of making
objections to the assessment roll was duly published at and for the time and in the
manner provided by law fixing the time and place of hearing thereon for the 4 day of
April, 2006 at the hour of 7 00 p m in the Council Chambers Yakima Washington, and
further notice thereof was duly mailed by the City Clerk to each property owner on the
roll, and
WHEREAS, at the time and place fixed and designated in said notice, the
hearing on the assessment roll was duly held and the Council sitting as a board of
equalization gave due consideration to all written and oral protests received all
documentation evidence and testimony presented, and all persons appearing at said
hearing
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF YAKIMA
Section 1. The Council sitting as a board of equalization and having made all
revisions to the roll it deems necessary hereby finds and determines that the final
assessment roll for LID 1057 is just and equitable and that no assessment against
property within LID 1057 is greater than the special benefits to be derived from the
improvements Accordingly, the final assessment roll, in the total amount of
$344,784 74 is hereby approved and confirmed, and the assessments set forth therein
are hereby levied against each specially benefited lot, tract and parcel of property
described in the roll
Section 2. The Clerk of the City is hereby directed to place the final assessment
roll for LID 1057 in the hands of the Finance Director of the City for collection Upon

such placement the amount of each assessment set forth in the roll, together with any
interest or penalty imposed from time to time, shall become a lien against the property
so assessed The lien shall be paramount and superior to any other lien or
encumbrance whatsoever therefore, or thereafter created, except a hen for general
taxes
Section 3. Upon receipt of the final assessment roll for LID 1057 the Finance
Director of the City is hereby directed to publish notice at the times and in the manner
required by RCW 35 49 010, stating that the roll is in his hands for collection and that
such assessments or any portion thereof may be paid to the City at any time within 30
days from the date of the first publication of such notice, without penalty, interest or
costs
Section 4. The amount of any assessment or any portion thereof, against
property in LID 1057 not paid within the 30 day period from the date of the first
publication of the Finance Director's notice shall be payable in ten (10) equal annual
installments together with interest on the diminishing principal balance thereof at a rate
of either (i) ' /A% per annum higher than the interest rate on bonds that may be sold to
finance the costs of LID 1057, (ii) 8 75% per annum if the City provides internal financing
for the costs of LID 1057, (iii) in no case shall the rate exceed 8 75% per annum to the
LID holder Interest shall commence on the 30 day following first publication of such
notice The first installment shall become due and payable one year from the expiration
of the 30 -day prepayment period Annual installments, including interest and any
penalty, shall be paid in full when due, and no partial payments shall be accepted by the
Finance Director of the City
Section 5. Any installment not paid when due shall thereupon become
delinquent. All delinquent installments shall be subject to a penalty equal to12% per
annum of the amount of the installment, including interest, from the date of the
delinquency until paid
Section 6. The lien of any assessment may be discharged at any time after the
30 -day prepayment period by payment of the entire principal amount of the assessment
remaining unpaid together with interest thereon to the due date of the next installment
Section 7. If any one or more of the provisions of this ordinance shall be
declared by a court of competent jurisdiction to be contrary to law, then such provision
shall be null and void and shall be deemed severable from the remaining provisions of

ORDINANCE NO 2006- 12
AN ORDINANCE of the City of Yakima, Washington, approving and confirming the
final assessment roll for North 84 Avenue & Hawthorne Drive
Sewer Local Improvement District No 1057, which has been
created and established for the purpose of paying the cost of
certain sewer system improvements, and levying and assessing
the amount thereof against the lots, tracts, parcels of land and
other property shown on said roll
WHEREAS, an assessment roll levying special assessments against the
properties located in Local Improvement District No 1057 ( "LID 1057 "), in Yakima,
Washington, created under Ordinance No 2004 -45, was filed with the City Clerk of the
city of Yakima as provided by law; and
WHEREAS, notice of the time and place of a hearing on and of making
objections to the assessment roll was duly published at and for the time and in the
manner provided by law, fixing the time and place of hearing thereon for the 4 day of
April, 2006 at the hour of 7 00 p m in the Council Chambers, Yakima, Washington, and
further notice thereof was duly mailed by the City Clerk to each property owner on the
roll, and
WHEREAS, at the time and place fixed and designated in said notice, the
hearing on the assessment roll was duly held and the Council, sitting as a board of
equalization, gave due consideration to all written and oral protests received all
documentation, evidence and testimony presented and all persons appearing at said
hearing
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF YAKIMA
Section 1. The Council sitting as a board of equalization and having made all
revisions to the roll it deems necessary, hereby finds and determines that the final
assessment roll for LID 1057 is just and equitable and that no assessment against
property within LID 1057 is greater than the special benefits to be derived from the
improvements Accordingly, the final assessment roll, in the total amount of
$344,784 74 is hereby approved and confirmed, and the assessments set forth therein
are hereby levied against each specially benefited lot, tract and parcel of property
described in the roll
Section 2. The Clerk of the City is hereby directed to place the final assessment
roll for LID 1057 in the hands of the Finance Director of the City for collection Upon

such placement, the amount of each assessment set forth in the roll, together with any
interest or penalty imposed from time to time, shall become a lien against the property
so assessed The lien shall be paramount and superior to any other hen or
encumbrance whatsoever therefore, or thereafter created, except a lien for general
taxes
Section 3. Upon receipt of the final assessment roll for LID 1057, the Finance
Director of the City is hereby directed to publish notice at the times and in the manner
required by RCW 35 49 010, stating that the roll is in his hands for collection and that
such assessments or any portion thereof may be paid to the City at any time within 30
days from the date of the first publication of such notice, without penalty, interest or
costs
Section 4. The amount of any assessment, or any portion thereof, against
property in LID 1057 not paid within the 30 day period from the date of the first
publication of the Finance Director's notice shall be payable in ten (10) equal annual
installments, together with interest on the diminishing principal balance thereof at a rate
of either (i) 1 /2% per annum higher than the interest rate on bonds that may be sold to
finance the costs of LID 1057, (ii) 8 75% per annum if the City provides internal financing
for the costs of LID 1057, (iii) in no case shall the rate exceed 8 75% per annum to the
LID holder Interest shall commence on the 30 day following first publication of such
notice The first installment shall become due and payable one year from the expiration
of the 30 -day prepayment period Annual installments, including interest and any
penalty, shall be paid in full when due, and no partial payments shall be accepted by the
Finance Director of the City
Section 5. Any installment not paid when due shall thereupon become
delinquent. All delinquent installments shall be subject to a penalty equal to12% per
annum of the amount of the installment, including interest, from the date of the
delinquency until paid
Section 6. The lien of any assessment may be discharged at any time after the
30 -day prepayment period by payment of the entire principal amount of the assessment
remaining unpaid together with interest thereon to the due date of the next installment
Section 7. If any one or more of the provisions of this ordinance shall be
declared by a court of competent jurisdiction to be contrary to law, then such provision
shall be null and void and shall be deemed severable from the remaining provisions of

Section 8. This ordinance shall be in full force and effect thirty days after its
passage, approval and publication as provided by law and by the City Charter

ORDINANCE NO 2006 -12
AN ORDINANCE of the City of Yakima, Washington, approving and confirming the
final assessment roll for North 84 Avenue & Hawthorne Drive
Sewer Local Improvement District No 1057, which has been
created and established for the purpose of paying the cost of
certain sewer system improvements, and levying and assessing
the amount thereof against the Tots, tracts, parcels of land and
other property shown on said roll
WHEREAS, an assessment roll levying special assessments against the
properties located in Local Improvement District No 1057 ( "LID 1057 "), in Yakima,
Washington, created under Ordinance No 2004 -45, was filed with the City Clerk of the
city of Yakima as provided by law; and
WHEREAS, notice of the time and place of a hearing on and of making
objections to the assessment roll was duly published at and for the time and in the
manner provided by law, fixing the time and place of hearing thereon for the 4 day of
April, 2006 at the hour of 7 00 p m in the Council Chambers, Yakima, Washington, and
further notice thereof was duly mailed by the City Clerk to each property owner on the
roll, and
WHEREAS, at the time and place fixed and designated in said notice, the
hearing on the assessment roll was duly held and the Council, sitting as a board of
equalization, gave due consideration to all written and oral protests received, all
documentation, evidence and testimony presented, and all persons appearing at said
hearing,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF YAKIMA
Section 1. The Council, sitting as a board of equalization and having made all
revisions to the roll it deems necessary, hereby finds and determines that the final
assessment roll for LID 1057 is just and equitable and that no assessment against
property within LID 1057 is greater than the special benefits to be derived from the
improvements. Accordingly, the final assessment roll, in the total amount of
$344,784 74, is hereby approved and confirmed, and the assessments set forth therein
are hereby levied against each specially benefited lot, tract and parcel of property
described in the roll
Section 2. The Clerk of the City is hereby directed to place the final assessment
roll for LID 1057 in the hands of the Finance Director of the City for collection Upon

such placement, the amount of each assessment set forth in the roll, together with any
interest or penalty imposed from time to time, shall become a lien against the property
so assessed The lien shall be paramount and superior to any other lien or
encumbrance whatsoever therefore, or thereafter created, except a lien for general
taxes
Section 3. Upon receipt of the final assessment roll for LID 1057, the Finance
Director of the City is hereby directed to publish notice at the times and in the manner
required by RCW 35 49 010, stating that the roll is in his hands for collection and that
such assessments or any portion thereof may be paid to the City at any time within 30
days from the date of the first publication of such notice, without penalty, interest or
costs.
Section 4. The amount of any assessment, or any portion thereof, against
property in LID 1057 not paid within the 30 day period from the date of the first
publication of the Finance Director's notice shall be payable in ten (10) equal annual
installments, together with interest on the diminishing principal balance thereof at a rate
of either (i) 1/2% per annum higher than the interest rate on bonds that may be sold to
finance the costs of LID 1057, (ii) 8 75% per annum if the City provides internal financing
for the costs of LID 1057, (iii) in no case shall the rate exceed 8 75% per annum to the
LID holder Interest shall commence on the 30 day following first publication of such
notice The first installment shall become due and payable one year from the expiration
of the 30 -day prepayment period Annual installments, including interest and any
penalty, shall be paid in full when due, and no partial payments shall be accepted by the
Finance Director of the City
Section 5. Any installment not paid when due shall thereupon become
delinquent All delinquent installments shall be subject to a penalty equal to12% per
annum of the amount of the installment, including interest, from the date of the
delinquency until paid
Section 6. The lien of any assessment may be discharged at any time after the
30 -day prepayment period by payment of the entire principal amount of the assessment
remaining unpaid together with interest thereon to the due date of the next installment
Section 7. If any one or more of the provisions of this ordinance shall be
declared by a court of competent jurisdiction to be contrary to law, then such provision
shall be null and void and shall be deemed severable from the remaining provisions of

this ordinance and shall in no way affect the validity of the other provisions of this
ordinance
Section 8. This ordinance shall be in full force and effect thirty days after its
passage, approval and publication as provided by law and by the City Charter
PASSED BY THE CITY COUNCIL, signed and approved this 4th day of April,
2006
