2006-013 Final Assessment Roll - Sewer LID 1058, North 94th Place, North 90th Ave & West Yakima Avenue
ORDINANCE NO 2006 -13 AN ORDINANCE of the City of Yakima, Washington, approving and confirming the final assessment roll for North 94 Place, North 90 Avenue & West Yakima Avenue Sewer Local Improvement District No 1058, which has been created and established for the purpose of paying the cost of certain sewer system improvements, and levying and assessing the amount thereof against the Tots, tracts, parcels of land and other property shown on said roll WHEREAS, an assessment roll levying special assessments against the properties located in Local Improvement District No 1058 ( "LID 1058 "), in Yakima, Washington, created under Ordinance No 2004 -46, was filed with the City Clerk of the city of Yakima as provided by law; and WHEREAS, notice of the time and place of a hearing on and of making objections to the assessment roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 4 day of April, 2006 at the hour of 7 00 p m in the Council Chambers, Yakima, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner on the roll, and WHEREAS, at the time and place fixed and designated in said notice, the hearing on the assessment roll was duly held and the Council, sitting as a board of equalization, gave due consideration to all written and oral protests received, all documentation, evidence and testimony presented, and all persons appearing at said hearing, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA Section 1. The Council, sitting as a board of equalization and having made all revisions to the roll it deems necessary, hereby finds and determines that the final assessment roll for LID 1058 is just and equitable and that no assessment against property within LID 1058 is greater than the special benefits to be derived from the improvements. Accordingly, the final assessment roll, in the total amount of $200,534 00, is hereby approved and confirmed, and the assessments set forth therein are hereby levied against each specially benefited lot, tract and parcel of property described in the roll Section 2. The Clerk of the City is hereby directed to place the final assessment roll for LID 1058 in the hands of the Finance Director of the City for collection Upon (jc)ord /94' Ave. LID Assessment Roll 1 such placement, the amount of each assessment set forth in the roll, together with any interest or penalty imposed from time to time, shall become a lien against the property so assessed The lien shall be paramount and superior to any other lien or encumbrance whatsoever therefore, or thereafter created, except a lien for general taxes Section 3. Upon receipt of the final assessment roll for LID 1058, the Finance Director of the City is hereby directed to publish notice at the times and in the manner required by RCW 35 49 010, stating that the roll is in his hands for collection and that such assessments or any portion thereof may be paid to the City at any time within 30 days from the date of the first publication of such notice, without penalty, interest or costs Section 4. The amount of any assessment, or any portion thereof, against property in LID 1058 not paid within the 30 day period from the date of the first publication of the Finance Director's notice shall be payable in ten (10) equal annual installments, together with interest on the diminishing principal balance thereof at a rate of either (i) ' /z% per annum higher than the interest rate on bonds that may be sold to finance the costs of LID 1057, (ii) 8 75% per annum if the City provides internal financing for the costs of LID 1057, (iii) in no case shall the rate exceed 8 75% per annum to the LID holder Interest shall commence on the 30 day following first publication of such notice The first installment shall become due and payable one year from the expiration of the 30 -day prepayment period Annual installments, including interest and any penalty, shall be paid in full when due, and no partial payments shall be accepted by the Finance Director of the City Section 5. Any installment not paid when due shall thereupon become delinquent All delinquent installments shall be subject to a penalty equal to12% per annum of the amount of the installment, including interest, from the date of the delinquency until paid Section 6. The lien of any assessment may be discharged at any time after the 30 -day prepayment period by payment of the entire principal amount of the assessment remaining unpaid together with interest thereon to the due date of the next installment Section 7. If any one or more of the provisions of this ordinance shall be declared by a court of competent jurisdiction to be contrary to law, then such provision shall be null and void and shall be deemed severable from the remaining provisions of (jc)ord /94 Ave. LID Assessment Roll 2 this ordinance and shall in no way affect the validity of the other provisions of this ordinance Section 8. The estimated cost to install sewer in this area will be approximately $60,000.00 West Yakima Avenue: The project will consist of the construction of approximately 480 lineal feet of fl- inch sewer pipe and appurtenances beguning at the existing sewer math at the east end of West Yakima Avenue extending to North 90 Avenue. The estimated cost to install sewer in this area will be approximately $80,000.00. North 90 Avenue: The project will consist of the construction of approximately 1,330 lineal feet of 8- inch sewer pipe and appurtenances beginning at the existing sewer main at West Chestnut Avenue extending north to Summitview Avenue. The estimated cost to install sewer in this area will be approximately $210,000.00 Section 3. There is hereby created a Local Improvement District, to be called "Local Jmproy i*e it District No. 1058 ", which said district shall include all of the above described property Section 4. The assessments shall be made according to special benefits derived from the alk improvements without regard to the zone and termini method. Section 5. All costs and expenses in connection with the construction of said improvements, including the engmeermg inspection, advertismg, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefore as provided by law and as above described. The work necessary to be done in connection with the making of said improvements shall be done by contract upon competitive bids according to specifications and plans as prepared by the Engineering Division of the Department of Community and Economic Development, and the City shall have the power to reject any and all bids. There is herby created a special fund, to be known as "Local Improvement Fund, District No. 1058 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. Section 8. Bonds shall be issued in payment of the costs and expense of said improvements, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, which assessments, with interest, shall be payable annually under the mode of payment "payment by bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima, provided, this improvement may be financed the issuance of notes, under the authority of R.C.W 39.50 and Section 8.12.100 of the City of Yakima Municipal Code. The term and interest rate of bonds and special assessments contemplated by this section shall conform to provisions, terms and conditions to be specified by a subsequent ordinance of the City of Yakima. It is the intent of the City to reunburse a portion of the costs of these improvements with the proceeds of bonds (Reimbursement Bonds) to be issued by the City The interest on these bonds is excludable from gross income under Section 103 of the Internal Revenue Code of 1986, as amended. The maximum le principal amount of Reimbursement Bonds expected to be issued is S350,000.00. This declaration of official intention is made pursuant to Section 1 103 -18 of the Income Tax Regulations promulgated by the U.S. Department of Treasury Section 9 The actual assessments levied for this improvement may vary from the assessment estimates so long as they do not exceed a figure equal to the increased true fair value the improvement adds to the property Section 10. Wendell Adams, P.E., City Engineer Engineering Division Manager / 575 -6096 SUMMARY EXPLANATION On July 6, 2004, the City Council adopted a Resolution of Intent to create the North 90th, North 94th & West Yakima Avenues Sewer Local Improvement District (Resolution No. R- 2004 -102) by conducting a public hearing on August 3rd, 2004. The proposed North 90th, North 94th & West Yakima Avenues Sewer Local Improvement District (LID) involves 46 parcels. The City has received petitions requesting formation of this LID from property owners representing over 75% of the assessed property value. The project consists of approximately 2188 lineal feet of 8 -inch sewer line. This project will connect into the sewer main on South 88th Ave. The estimated LID assessment for the respective parcels of land is attached. The rates were calculated on a rate per parcel. This method of computation was selected based on equity of fairness. The City is in compliance with State law and City policy in the formation of this LID Before the final assessment roll is formed a meeting is held with all participants in the LID If the final Engineering estimates have come in higher than expected and the citizens feel that the cost would cause a hardship the LID process would end without completing the project. LID assessments may be financed by the City of Yakima on a ten-year plan through the sale of bonds or the issuance of promissory notes. We believe that the City's plan to include property from two intersecting streets in a single LID complies both with the statutory requirements for LID formation and with the City's Outside Utility Policy We base this conclusion on the following information that Kay provided to me today and Friday' • There are three streets in the same general area outside of the City where some of the residents wish to form a sewer LID prior to a County repaving project. Two of the streets intersect, while the other street is 3 or 4 blocks away • The City has completed the LID process through the formal petition phase for all three streets, with one formal petition listing all three streets. • On two of the streets, the City received Outside Utility Agreements ( "OUA ") from more than 80% of the residents, while on the third OUA participation was just less than 75% However, combining the two intersecting streets into a single LID would raise the OUA participation rate for them to over 75% The following requirements apply to LID formation in Yakima. • RCW 35 43 050 provides broad authority to form LIDs "even though the improvements thus made are not connected or continuous." • Under the Outside Utility Policy, the City requires a 75% OUA participation rate to form an LID outside of the City, which is a requirement in addition to RCW 35 43 120's requirement for "a petition signed by the owners of property aggregating a majority of the area within the proposed district." The City's plan does meet the statutory requirements for LID formation However, the City's Outside Utility Policy has been designed to promote future annexation, a process that, unlike LID formation, requires contiguity As a • result, because the streets are intersecting and their areas are connected, the plan to combine the two to achieve the minimum OUA participation level also meets the goals of the City's Outside Utility Policy Construction Timing I asked Nancy Neraas about the City's ability to proceed with some construction preparation 6/29/2004 Liu ana uutsiae Utility Policy Page 2 of 2 activity in advance of the Council's LID ordinance. Under RCW 35 43 070, the ordinance "orders the improvement." However, if the Council did not approve the LID or if it failed for some other reason, the City would have to pay the costs associated with those activities out of other funds. We were very pleased with the turnout for the meeting and the high level of interest expressed by the property owners. We discussed the plans that Yakima County has to pave N 90 Avenue, N 94 Place and West Yakima Avenue this summer and the importance of installing sewer lines before paving begins. After the street is paved there is a 5 -year moratonum stating that there will be no cutting into the pavement for five years. At this time, we need to measure your desire to continue with this project. The City will proceed with the LID formation process if we receive a positive response from property owners totaling 75% of the land value. The LID option allows the City to assist you with all aspects of the project, including financing over a 10 -year penod. The option of constructing the sewer as a pnvate project was also discussed at the meeting. If you chose to work cooperatively to install the sewer main on your own, City staff is available to answer your questions and provide basic construction information. However, we also need a Petition and Outside Utility Agreement (OUA) signed by each property owner that wants to participate in the L.I.D A copy of the Agreement is enclosed for your review and signature A Notary Public must witness your signature on Page 7 We can provide this service free of charge at City Hall, or you may have it witnessed by a Notary at your workplace or financial institution. 31437,181319- 3143 8,181319- 31439,181319- 31440,181319- 31441,181319 - 31442,181319- 31443,181319- 31444,181319- 31445,181319 -31446 7529348 Page 1 of 5 09/2712006 03 08P ORDINANCE NO 2006 -13 AN ORDINANCE of the City of Yakima, Washington, approving and confirming the final assessment roll for North 94`" Place, North 90 Avenue & West Yakima Avenue Sewer Local Improvement District No 1058, which has been created and established for the purpose of paying the cost of certain sewer system improvements, and levying and assessing the amount thereof against the lots, tracts, parcels of land and other property shown on said roll WHEREAS, an assessment roll levying special assessments against the properties located in Local Improvement District No 1058 ( "LID 1058 "), in Yakima, Washington, created under Ordinance No 2004 -46, was filed with the City Clerk of the city of Yakima as provided by law; and WHEREAS, notice of the time and place of a hearing on and of making objections to the assessment roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 4 day of April, 2006 at the hour of 7 00 p m in the Council Chambers, Yakima, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner on the roll, and WHEREAS, at the time and place fixed and designated in said notice, the hearing on the assessment roll was duly held and the Council, sitting as a board of equalization, gave due consideration to all written and oral protests received, all documentation, evidence and testimony presented, and all persons appearing at said hearing NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA Section 1. The Council, sitting as a board of equalization and having made all revisions to the roll it deems necessary, hereby finds and determines that the final assessment roll for LID 1058 is just and equitable and that no assessment against property within LID 1058 is greater than the special benefits to be derived from the improvements Accordingly, the final assessment roll, in the total amount of $200,534 00, is hereby approved and confirmed, and the assessments set forth therein are hereby levied against each specially benefited lot, tract and parcel of property described in the roll Section 2: The Clerk of the City is hereby directed to place the final assessment roll for LID 1058 in the hands of the Finance Director of the City for collection Upon (ic)ord /94' Ave LID Assessment Roll 1 II 111111 II III 1111 I 7529348 Page 2 of 5 09/27/2006 03 08P such placement, the amount of each assessment set forth in the roll, together with any interest or penalty imposed from time to time, shall become a lien against the property so assessed The lien shall be paramount and superior to any other lien or encumbrance whatsoever therefore, or thereafter created, except a lien for general taxes Section 3. Upon receipt of the final assessment roll for LID 1058, the Finance Director of the City is hereby directed to publish notice at the times and in the manner required by RCW 35 49 010, stating that the roll is in his hands for collection and that such assessments or any portion thereof may be paid to the City at any time within 30 days from the date of the first publication of such notice, without penalty, interest or costs Section 4. The amount of any assessment, or any portion thereof, against property in LID 1058 not paid within the 30 day period from the date of the first publication of the Finance Director's notice shall be payable in ten (10) equal annual installments, together with interest on the diminishing principal balance thereof at a rate of either (1) 1 /2% per annum higher than the interest rate on bonds that may be sold to finance the costs of LID 1057, (n) 8 75% per annum if the City provides internal financing for the costs of LID 1057, (iii) in no case shall the rate exceed 8 75% per annum to the LID holder Interest shall commence on the 30` day following first publication of such notice The first installment shall become due and payable one year from the expiration of the 30 -day prepayment period Annual Installments, including interest and any penalty, shall be paid in full when due, and no partial payments shall be accepted by the Finance Director of the City Section 5. Any installment not paid when due shall thereupon become delinquent. All delinquent installments shall be subject to a penalty equal to12% per annum of the amount of the installment, including interest, from the date of the delinquency until paid Section 6. The lien of any assessment may be discharged at any time after the 30 -day prepayment period by payment of the entire principal amount of the assessment remaining unpaid together with interest thereon to the due date of the next installment Section 7.
