HomeMy WebLinkAbout2007-018 Nonconforming Uses & Structures (re: professional slaughter of livestock animals); YMC Addition ORDINANCE NO. 2007 - 18 AN ORDINANCE relating. to Yakima urban area zoning ordinances regarding nonconforming uses and structures, allowing for the professional slaughter of livestock animals when the approved nonconforming use is an animal husbandry operation, adding a new Section 15 19 120 and amending Sections 6.20 140 and 6 44 020 of the City of Yakima Municipal Code BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1 Section 15 19 120 of the City of Yakima Municipal Code is hereby added as a new section to read as follows 15.19.120 Animal husbandry as nonconforming use. A. When the approved nonconforming use is an animal husbandry operation, the slaughter of animals may continue when the following conditions are met: 1 The slaughter of the animal is performed by a licensed professional butcher; and, 2 If the slaughtering of the animal involves the discharge of a firearm, notice shall be provided to the Yakima Police Department at least two hours prior the discharge of the firearm The notice shall be made by phone to the Yakima Police Department non - emergency number and shall include the location of the discharge, the approximate time of the discharge, and the name of the professional butcher who will be discharging the firearm B This ordinance is meant to be an exception to YMC 6 20 140, which prohibits the slaughtering of animals within public or private property view, and YMC 6 44 020, which prohibits the discharge of a firearm within the City of Yakima. Section 2. Section 6.20 044 of the City of Yakima Municipal Code is hereby amended to read as follows 6.20.140 Slaughtering, dressing and butchering of animals and fowl CIM/animalhusbandry/Page 1 of 2 No person shall slaughter, dress or butcher any fowl or animal so as to unreasonably expose such act or acts to the view of any person on public or private property This section does not apply when the conditions of YMC 15.19.120 are met. Section 3 Section 6 44 020 of the City of Yakima Municipal Code is hereby amended to read as follows 6.44.020 Firearms -- Discharging. A. Any person who, within the city of Yakima, willfully fires or discharges any air gun, b b gun or firearm of any kind without lawful authority is declared to be a disorderly person This section shall not apply to peace officers nor to persons shooting on any regularly established and authorized rifle range, gun club or shooting gallery, or when the conditions of YMC 15.19.120 are met.
