Return To: Yakima City Clerk 129 North Second Street Yakima, WA 98901 Document Title ORDINANCE NO. 2007 - 34 Rezoning 424 S 50 Avenue, 5015 Tieton Drive & a parcel of land at South 51 Avenue & Tieton Drive Grantor City of Yakima Grantee Rosemary Holm LEGAL DESCRIPTION: Lots 10, 24 and 25 of the Plat of Arleta, as recorded in Volume "0" of Plats, page 44, records of Yakima County, Washington, EXCEPT for the south ten feet of Lot 25 for public right -of way PARCEL NUMBERS: 181321 - 44408, 181321- 44420, and 181321 -44421 1111 111111 11 1111 I 7574528 Page 1 of 15 0713112007 83 58P MALT rn �Q ORDINANCE NO 2007 -34 AN ORDINANCE relating to land use regulation and zoning, rezoning, with conditions, three parcels of property located at 424 South 50 Avenue, 5015 Tieton Drive and South 51 Avenue / Tieton Drive, Yakima, Washington from Two Family Residential, (R -2) and Light Industrial, (M -1) to Local Business, (B -2) as more fully described herein, and approving, with conditions, the recommendation of the Hearing Examiner for the City of Yakima regarding the same, Rosemary Holm being identified as the applicant herein WHEREAS, by application dated February 22, 2007, Rosemary Holm requested the rezone of Yakima County Assessor's Parcel No 's 181321 - 44408, 181321 -44420 and 181321- 44421, located at 424 South 50 Avenue, 5015 Tieton Drive and South 51 Avenue / Tieton Dnve, Yakima, Washington (hereinafter "Subject Property "), from Two Family Residential, (R -2), and Light Industrial, (M -1), to Local Business, (B -2), and WHEREAS, on May 10, 2007 the Hearing Examiner for the City of Yakima conducted an open- record public hearing regarding the requested rezone, and WHEREAS, on May 16, 2007 the Hearing Examiner issued Hearing Examiner's Recommendation regarding UAZO RZ #1 -07 and EC #3 -07, (the "recommendation ") recommending that the Subject Property be rezoned from Two Family Residential, (R -2), and Light Industrial, (M -1), to Local Business, (B -2), and WHEREAS, at a closed- record public hearing held on June 19, 2007, the City Council considered the requested rezone, including the documents and other evidence which comprise the record developed before the Hearing Examiner, the Hearing Examiner's Recommendation, and the statements and comments of interested persons, and WHEREAS, the City Council finds that the considerations of the Hearing Examiner in response to the requirements and criteria of Yakima Municipal Code ( "YMC ") § 15 23 030(E) and § 15 15 040(5) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein, and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following to approve the requested rezone, Now Therefore, BE IT ORDAINED BY THE CITY OF YAKIMA Section 1 The property located at 424 South 50 Avenue, 5015 Tieton Drive and South 51 Avenue / Tieton Drive, Yakima, Washington (Yakima County Assessor's Parcel No 's 181321 - 44408, 181321 -44420 and 181321 - 44421), legally described in Exhibit "A ", attached hereto and incorporated herein by this reference, is hereby rezoned from Two Family Residential, (R -2), and Light Industrial, (M -1), to Local Business, (B -2) Section 2. The findings within the May 16, 2007 Hearing Examiner's Recommendation (UAZO RZ #1 -07, EC #3 -07) regarding this rezone are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15 23 030(F), and are incorporated herein by this reference as if fully set forth herein (jc)ord/Rosemary Holm Rezone 1 11 11 11 111 I 11 11 11 I I 11 7574528 Page 2 of 15 07/31/2007 03 58P Section 3. The Official Yakima Urban Area Zoning Map and all other zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified, subject to the conditions stated below, to reflect this rezone Section 4 The rezone granted by this ordinance is expressly conditioned on the Owner's satisfaction of the following conditions stated on page 10 of the Hearing Examiner's Recommendation a Future development of the subject property for uses not stated in the application is subject to environmental review, traffic concurrency, plan review and building permits All development at the site shall comply with the applicable building and fire code requirements b If additional development is proposed at this site in the future, all applicable development standards will be met or adjustments approved following the prescribed public notice and comment requirements c. The two lots having parcel numbers 181321 -44420 and 44421 shall be merged into one lot in order to eliminate an existing encroachment of a structure over a shared property line Section 5. Severability If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance Section 6. The Hearing Examiner recommends approval of this rezone by the Yakima City Council, subject to conditions Basis for Recommendation. The applicant is Rosemary Holm, 5901 West Chestnut Avenue, Yakima, Washington, and the applicant's representative is Bill Hordan of Hordan Planning Services, 410 North Second Street, Yakima, Washington Location. The location of the requested rezone is 424 South 50 Avenue 5015 Tieton Dnve and South 51 Avenue /Tieton Dnve, Yakima, Washington The parcel numbers are 181321- 44408, 181321 -44420 and 181321 -44421 Application This application requests a rezone of two parcels from Light Industrial (M -1) and one parcel from Two - Family Residential (R -2) to Local Business (B -2) No development projects are associated with this request. The rezone would bang the subject property into compliance with the current Neighborhood Commercial designation of the property in the Comprehensive Plan. The three parcels form an "L" and total about 58 acres m size The two abutting lots along the north side of Tieton Dnve extend between South 50 and South 51 Avenues Tieton Dnve in that location is a fully improved four -lane arterial with curb, gutter and sidewalk. Notices were provided rn the following manner Posting of notice on property March 22, 2007 Mailing of notice of application, SEPA review & hearing March 23, 2007 Publishing of said notice in Yakima Herald - Republic March 23, 2007 Mailing of notice of SEPA Determination (DNS) Apnl 16, 2007 Publishing of said notice in Yakima Herald- Republic Apnl 16, 2007 State Environmental Policy Act. The charactenstics of adjacent properties are Location Zoning Land Use North M -1/R -2 IndustnaUResidential South M -1 Warehouse East R -2 Residential West M -1 Animal Clinic Rosemary Holm 3 DOC Rezone M -1 & R -2 to B -2 Tieton Dr & 50 Ave INDEX RZ # 1 -07, EC 43 -07 # r r Ill 111111111111 Se3714/25080275031558P Rezone Review Criteria Recommendations regarding rezone applications within the Yakima Urban Area must be based upon the following cntena specified m Subsection 15 23 030(E) of the Urban Area Zoning Ordinance (UAZO) 1) The testimony at the public hearing Associate Planner Mary Lovell and applicant's representative Bill Hordan of Hordan Planning Services testified in favor of the requested rezone No testimony was submitted in opposition to the requested rezone Testimony at the hearing addressed the traffic, noise, parking, cnme and other concerns submitted m the letter of Julie Ethier who lives some distance from the subject property on South 49 Avenue Some of her concerns were du at other businesses along Tieton Dnve located to the east of the subject property The main point to response to her concerns boiled down to the fact that the applicant's retail/service center has been continuously located on this property since 1958 without causing any known harm to the neighborhood 2) The suitability of the property for uses permitted under the proposed zoning The property is well suited for the range of uses permitted within the B -2 zoning district and has in fact been used for such uses since 1958 The existing Neighborhood Commencal Future Land Use designation fully supports the Local Business (B -2) zoning classification 3) Recommendations from interested agencies and departments Recommendations or comments from agencies or departments were as follows a) Agencies Recommendations or comments submitted by agencies during the SEPA comment penod were as follows (1) Washington State Department of Ecology. Parcels 181321 -44420 and 44421 have to be merged as a condition of this rezone Structures cannot extend over a property line per Table 602 of the 2003 International Building Code Address changes are not warranted since everything is existing and there are no plans at this tune to alter the site other than the rezone (ui) Wastewater: Wastewater Division does not have any concerns about this rezone request (iv) Traffic Engineenng. In general, Tieton Dnve currently operates at Level of Service "A" and has ample reserve capacity 4) The extent to which the proposed rezone is in compliance with and /or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance a) The Comprehensive Plan Durmg the annual Comprehensive Plan amendment process m 2001, the applicant requested a change to the Future Land Use Map from Medium Density Residential and Industrial to Neighborhood Commercial The Regional Planning Cornnussion, Joint Board and the Joint City Council and County Comnussioners approved the amendment to Neighborhood Commercial The Yakima City Council adopted the change in Ordinance 2001- 56 The Future Land Use Map to Zoning Map Consistency Chart provides that the Comprehensive Plan's Neighborhood Commercial designation is compatible with the Local Business (B -2) zoning distract The proposed rezone to allow B -2 uses would be in compliance with Objectives and Policies of the 1997 Comprehensive Plan such as Objective G1 1 which is to encourage the physical development of the Yakima Urban Area in a manner that enhances its image as the cultural and business center, Policy G9 4 which is to encourage commercial, industrial, office and multi-family developments to locate in distinct clusters m planned growth areas, and Policy C2 3 which is to allow and encourage small scale mixed -use retail/residential/professional development within neighborhoods Rosemary Holm 6 DOC Rezone M -1 & R -2 to B -2 INDEX Tteton Dr & 50 Ave # A /(- I RZ # 1 -07, EC #3 -07 II 11 11 111 I 11111 0 I 11 7574528 Page 11 of 15 67/31/2007 03 58P CITY OF YAKIMA - CODES DI ORO $54 00 Yakima Co, OR • b) The Zoning Ordinance Section 15 03 030 of the UAZO states that the purpose of the Local Business (B -2) zoning district is to provide areas for commercial activities outside the central business distract that meet the retail shopping and service needs of the community and accommodate small scale commercial uses requiring high visibility and easy access to major artenals Uses charactenstic of this distract include small retail sales and service establishments such as those currently located on the subject property Those uses comply with the development standards m the B -2 zoning distract m the following particulars (1) Setbacks. The structure setbacks set forth in Table 5 -1 of Chapter 15 05 of the UAZO are not applicable at this time because no new construction is proposed However, a merger of the two lots having parcel numbers 181321 -44420 and 181321 -44421 will be required since a structure is currently located over the shared property line (i) Parking The parking requirements Ln Table 6 -1 of Chapter 15 06 of the U AZO are also not applicable at this tune because no new development or expansion is anticipated. No additional parking is required for the businesses currently in operation at this location. (in) SignaQe. A sign plan was not submitted and any proposed signage must comply with sign standards in Chapter 15 08 of the UAZO (iv) Site Screening. Adequate public water and sanitary sewer currently serve this site 5) The adequacy of public facilities such as roads, sewer, water and other required public services The subject property is currently served by all necessary public facilities Access is from Tieton Dnve which is classified as an Arterial Street and South 50 and 51 Avenues which are both classified as Local Access Streets The rezone is an exempt activity under the Transportation Capacity Management Ordinance, but future expansion of the business or redevelopment of the site may require concurrency review if deemed necessary by the City Traffic Engineer 6) The compatibility of the proposed zone change and associated uses with neighboring land uses The change of this property from the Industrial and Two - Family Residential zoning distracts to the Local Business zoning distract would bnng the subject property into conformance with the Comprehensive Plan The existing uses and other Local Business uses are compatible with the goals and objectives of the Comprehensive Plan and the intent of the UAZO 7) The public need for the proposed change The requested rezone would fulfill the public need for zoning classifications that are consistent with Comprehensive Plan designations There is a public need for commercial uses outside the central business distract that provide the retail shopping and service needs of the conununity Consistency of the Rezone with Develo i ment Regulations and with the Comprehensive Plan under the Cntena Required by YMC 16 06 020(B) is determined by consideration of the following factors DOC Rosemary Holm 8 INDEX Rezone M -1 & R -2 to B -2 Tieton Dr & 50` -51 Ave r' RZ # 1 -07, EC #3 -07 11 13 th 111111 1 7574528 Page 13 of 15 07/31/2007 03 58P ,..,, ed. unutMe _ rnnrc nt n an 454 00 Yakima Co, WR 1) The types of land uses permitted at the site m the City's Local Business (13-2) zoning district are consistent with the Comprehensive Plan's Neighborhood Commercial designation for the site 2) The density of residential development or the level of development such as units per acre or other measures of density are not a factor weighing against this rezone request because existing uses are consistent with the density allowed by applicable B -2 zoning ordinance provisions 3) The availability and adequacy of infrastructure and public facilities are not an issue and support the applicant's request for approval of the rezone 4) The characteristics of the development are consistent with the B -2 zoning provisions and the applicable development regulations CONCLUSIONS 1 The Hearing Examiner has junsdiction under Subsections 15 23 030(C) and (E) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2 The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied 3 This project was determined to be exempt from review under the Transportation Capacity Management Ordinance 4 SEPA review resulted in the issuance of a Determination of Non - In general, Tieton Drive currently operates at Level of Service "A" and has ample reserve capacity. 4) The extent to which the proposed rezone is in compliance with and/or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: a) The Comprehensive Plan: During the annual Comprehensive Plan amendment process in 2001, the applicant requested a change to the Future Land Use Map from Medium Density Residential and industrial to Neighborhood Commercial. The Regional Planning Commission, Joint Board and the Joint City Council and County Commissioners approved the amendment to Neighborhood Commercial. The Yakima City Council adopted the change in Ordinance 2001- 56. The Future Land Use Map to Zoning Map Consistency Chart provides that the Comprehensive Plan's Neighborhood Commercial designation is compatible with the Local Business (B -2) zoning district. The proposed rezone to allow B -2 uses would be in compliance with Objectives and Policies of the 1997 Comprehensive Plan such as Objective G1.1 which is to encourage the physical development of the Yakima Urban Area in a manner that enhances its image as the cultural and business center; Policy G9.4 which is to encourage commercial, industrial, office and multi- family developments to locate in distinct clusters in planned growth areas; and Policy C2.3 which is to allow and encourage small scale mixed -use retail /residential/professional development within neighborhoods. Uses characteristic of this district include small retail sales and service establishments such as those currently located on the subject property. Those uses comply with the development standards in the B -2 zoning district in the following particulars: (i) Setbacks: The structure setbacks set forth in Table 5 -1 of Chapter 15.05 of the UAZO are not applicable at this time because no new construction is proposed. However, a merger of the two lots having parcel numbers 181321 -44420 and 181321 -44421 will be required since a structure is currently located over the shared property line. (ii) Parking: The parking requirements in Table 6 -1 of Chapter 15.06 of the UAZO are also not applicable at this time because no new development or expansion is anticipated. No additional parking is required for the businesses currently in operation at this location. (iii) Signage: A sign plan was not submitted and any proposed signage must comply with sign standards in Chapter 15.08 of the UAZO. (iv) Site Screening: Chapter 15.07 of the UAZO establishes site screening standards to provide a visual buffer between uses of different intensity, streets and structures; to reduce erosion and stormwater runoff; to protect property values; and to eliminate potential land use conflicts by mitigating adverse impacts from dust, odor, litter, noise, glare, lights, signs, buildings or parking areas. Site screening requirements vary depending on the intensity of both the proposed use and its neighbors. The rezone is an exempt activity under the Transportation Capacity Management Ordinance, but future expansion of the business or redevelopment of the site may require concurrency review if deemed necessary by the City Traffic Engineer. 6) The compatibility of the proposed zone change and associated uses with neighboring land uses: The change of this property from the Industrial and Two - Family Residential zoning districts to the Local Business zoning district would bring the subject property into conformance with the Comprehensive Plan. The existing uses and other Local Business uses are compatible with the goals and • objectives of the Comprehensive Plan and the intent of the UAZO. 7) The public need for the proposed change: The Tequested rezone would fulfill the public need for zoning classifications that are consistent with Comprehensive Plan designations. CONCLUSIONS 1. The Hearing Examiner has jurisdiction under Subsections 15.23.030(C) and (E) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3. This project was determined to be exempt from review under the Transportation Capacity Management Ordinance. 4. SEPA review resulted in the issuance of a Determination of Non - significance on April 16, 2007 without any appeal being filed by April 30, 2007. 5. SI S ` Ave & Tieton # Yakima Urban Area Zoning Ordinance Chapter 15.03.030 states that the purpose of the B -2 zoning district is to provide areas for commercial activities outside the Central Business District that meet the retail shopping and service needs of the community and accommodate small scale commercial uses requiring high visibility and easy access to major arterials. Uses characteristic of this district include small retail sales and service establishments such as those currently located on the subject property. Site Design and Improvement Standards The Yakima Urban Area Zoning Ordinance at Section 15.05.010 establishes basic development requirements as minimum criteria, which must be met to assure land use compatibility and promote the public health, safety and general welfare. No development proposal was submitted with this application, and all structures have been in place for many years. The following is an overview of the proposal's compliance with the aforementioned development standards: Setbacks - Structure setbacks are required by the UAZO (Table 5 -1). The setback standard is not applicable at this time since no new construction is proposed. However, a merger of lots 181321 -44420 and 181321 -44421 will be required since a structure is currently located over the shared property line. Parking — Parking requirements are listed in Chapter 15.6 (Table 6 -1) of the UAZO. Since no new development or expansion is anticipated, no additional parking is required for the businesses currently in operation at this location. Signage - A sign plan was not submitted with this application. Any proposed signage shall conform to sign standards as set forth in Chapter 15.08 of the Yakima Urban Area Zoning Ordinance. Site screening — Chapter 15.07 of the Yakima Urban Area Zoning Ordinance establishes site screening standards to provide a visual buffer between uses of different intensity, streets and structure, reduce erosion and storm water runoff, protect property values and eliminate potential land use conflicts by mitigating adverse impacts from dust, odor, litter, noise, glare, lights, signs, building or parking areas. Site screening requirements vary depending on the intensity of both the proposed use and its neighbors. After a site visit and review of Table 7 -1 of the UAZO, it has been determined that no additional site screening is required at this time. Public facilities - Adequate public water and sanitary sewer currently serve this site. Chapter 15.23.030 Rezone criteria Within the Yakima Urban Area, recommendations for approval of rezone applications are governed by seven criteria specified in Section 15.23.030 YMC. During the annual Comprehensive Plan amendment process in 2001, the applicant requested a change to the future land use map from Medium Density Residential and Industrial to Neighborhood Commercial. The Regional Planning Commission, Joint Board, and the Joint City Council and County Commissioners approved the amendment to Neighborhood Commercial. The Yakima City Council adopted Ordinance No. 2001 -56 authorizing the change to the future land use map. 5. Adequacy of public utilities. This property is currently served by all necessary public utilities. Street access is from Tieton Drive, classified as an Arterial Street, and South 50 and South 51 Avenues, both classified as Local Access Streets. 6. Compatibility of proposed use. The existing uses on the subject property are compatible with the goals and objectives of the Urban Area Zoning Ordinance. 7. Public Need This rezone fulfills the public need for zoning regulations that are consistent with the City's Comprehensive Plan. The site plan does not include building sizes, floor area, lot dimensions, landscaping, lighting, or other details necessary for adequate review of the site. 2. Since this application is for re- zoning only, it is implied that future re -use of existing buildings or new construction will occur on -site. Upon redevelopment of the house, garage, or significant other use of the plaza buildings, we may have specific comments related to access, parking, frontage improvements, etc. Neither North 50th Ave or North 51st Ave has sidewalks. 3. There is no center left turn lane on Tieton Drive. Access to and from the site may be problematic if a high traffic generator is located on this property in the future. 4. Compliance with Transportation Concurrency cannot be determined for this "Non - Project" application. In general, Tieton Drive currently operates at Level of Service "A" and has ample reserve capacity. State of Washington Department of Community, Trade and Economic Development: We have forwarded a copy of this notice to other state agencies. If this is a draft amendment, adopted amendments should be sent to C1ED within ten days of adoption and to any other state agencies who commented on the draft. State of Washington Department of Ecology: The water purveyor is responsible for ensuring that the proposed use(s) are within the limitations of its water rights. If the proposal's actions are different than the existing water right (source, purpose, the place of use, or period of use) then it is subject to approval from the Department of Ecology pursuant to Sections 90.03.380 RCW and 90.44.100 RCW. Upon redevelopment of the house, garage, or significant other use of the plaza buildings, we may have specific comments related to access, parking, frontage improvements, etc. Neither North 50th Ave or North 51st Ave have sidewalks. 3. There is no center left turn lane on Tieton Drive. Access to and from the site may be problematic if a high traffic generator is located on this property in the future. 4. Yes, the requested zoning change is suitable with the property in question because the site has contained local business activities since 1958 when Suites 1 & 2 were developed and further expanded in 1976 when suites A & C were developed. Through -out these years the site has contained numerous retail and service businesses. These businesses have served the local market area and have been compatible with surrounding uses. At no time did the property ever contain Industrial Uses. Two of the parcels within this rezone request are zoned Light Industrial (M -1). The two parcels are 181321 -44420 & 44421. These are the two parcels which contain the existing improvements associated with Suites 1 & 2 and A & C. A small portion of the improvements, mainly parking, have been constructed on the west end of 181321- 44408. The exact date of this activity commencement is not known. Parcel 181321- 44408, listed above, is the third parcel which is also the subject of this rezone request. It is currently zoned Two - family Residential (R -2). It too, is suitable for rezone because of the current status of improvements on the property, i.e., the parking for Suites 1 & 2 and A & C. Now we face commercial development around us. The house that is proposed to become commercial is wrong, and we simply oppose of having the residential house turned into commercial. for the reasons, facts, and possible risks that are listed below: 1. More traffic, which makes it unsafe for children that just want to ride their bikes in their neighborhood. There is a school bus stop on that street. 2. Noise: People coming and going at all times of the day. 3. Parking: People will be parking in front of resident's driveways. 4. Congestion: Location is too close to the end of the road / stop sign. There will be problems with people trying to turn into and out of the street. 5. Possible risk of the proposed area to become an illegal drug dealing business. 6. Downgrade the Neighborhood: The rezoning will cause actual "homeowners" to sell their homes, and then more homes will be at risk of becoming rentals. People that rent homes do not have pride of ownership, and do not take care of the property. A rental is a rental. The facts listed below are what we are experiencing right now with the businesses we have on 49th and 48 at this time. Below is what we put up with right now: 1. Jackson's Sport Bar: Increase in traffic (usually drunk and are driving at very unsafe speeds on South 49th) I worry about my son getting hit. 2. Jackson's Sports Bar: Noise, they sit in their cars and turn their music as loud as they can. You can call the cops, or just tell them yourself to shut it off, but it will happen again and again and again. 3. Paws and Claws, Parking, you need to be very careful when turning onto S. 49 because of their client's park to close to the end of the street. Their clients tend to let their dogs relieve themselves on neighbor's yards. I will note that the owners are nice, and understanding but their clients aren't. 4. World Treasures Imports located at 4811 %z Tietion that is in the same building as "Bobs Barber" and "Golden Chiropractic" along Tietion. Is known to be selling illegal drugs at this time. Their store is basically a facade. If you go inside you will notice that the merchandise does not move, and has nothing "DOC. INDEX # • to offer. The store is open at odd times of the day, and night. Sad... but its really true. Go ask the residence behind the store, or contact one of the police • detectives. The main reason for this letter of opposition is fo our son. We want to raise him in a halfway decent neighborhood, which is hard to come by in this town when you are not earning a very good wage. We are parents that are concerned, and our hands are tied. • If you have been a parent I can only "hope and pray" that the City of Yakima can understand the opposition and frustration. The homes were built for residential use, I plead that you would please leave them that way. None of the parcels is currently zoned for commercial use and consequently most changes in use (tenant changes) have become problematic. In December of 2001 the Future Land Use designation for these properties was changed to Neighborhood Commercial, a designation that fully supports the requested B -2, Local Business zoning. On May 10, 2007 the Hearing Examiner held an open record public hearing to consider this request. There was one letter received in opposition prior to the hearing and no comments during the hearing. With staff recommending approval the Hearing Examiner closed the public hearing and on May 16, 2007 issued his written recommendation that this rezone be approved subject to the merger of two of the lots.
