HomeMy WebLinkAbout1983-2721 REZONE PROPERTY VICINITY OF 60TH AVENUE & SUMMITVIEW AVENUE ORDINANCE NO 27 2 — 1 III AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property in the vicinity of 60th Avenue and Summitview Avenue from R-1, One-Family Zone to Planned Development Zone. 4011 WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 27th day of September, 1983 on the recommendation of the Planning Commission that real property situate in the vicinity of 60th Avenue and Summitview Avenue in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-1, One-Family Zone to Planned Development Zone, and WHEREAS, as a result of its hearing, the City Council hereby III makes its following findings and conclusions: FINDINGS: 1. This application is for a rezone from R-1, One-Family 0 Zone to Planned Development Zone for property located in the vicinity of 60th Avenue and Summitview Avenue. The 1.59 acre parcel is proposed to be developed in two phases. Phase 1, which involves conversion, of the existing dwelling to a dental clinic, has two development steps. In Step 1, the residence would be converted to a dental clinic and a 2,400 square foot building expansion would be constructed. A 36 space off-street parking lb facility would be installed to serve this first stage of develop- ment. Step 2 would add another 2,400 square feet of floor area and an additional 31 parking spaces. That portion of the property designated as Phase 2 will re- main vacant until a specific use is approved by major modification at a later date. Phase 2 is included in this Planned Development request since its access is through Phase 1. P2. 2. The property under consideration is now occupied by a single family dwelling and garage, swimming pool, and shop building. The southerly portion of the property is vacant. Land use and zoning on adjacent properties is as follows: III ZONING LAND USE NORTH B-2 Orchard SOUTH PD El Sommerset Condominiums EAST PD Fontanelle Condominiums WEST R-1 Single Family Residential , . , , . 3. The Optimal Land Use element of the Comprehensive Plan indicates the requested professional office use is compatible 111 with B-2 zoning to the north and conditionally compatible with moderate density residential use to the south, east and west. Summitview is a designated major arterial street. Il k 4. Compatibility with adjacent residential uses can be achieved through adequate site screening and landscaping and maintenance of the residential building design. A site screening fence is already in place along the south and east sides of the site, therefore, only the western boundary along the Yakima Valley Canal will require site screening. While the professional office use would fall between, and somewhat separate, two residential developments, it would be of a similar intensity and relate well IlliP to other development in the vicinity. 5. The proposed number of off-street parking spaces is ap- proximately double the number required by the Zoning Ordinance. This will insure that parking problems do not occur in the future. 6. The Planning Commission recommended approval of the re- quest subject to certain conditions specified below: CONCLUSIONS: 1. The request is in conformance with the Yakima Urban Area Comprehensive Plan. 2. The recommendation of the Planning Commission to grant • the rezone should be affirmed, and the rezone should be granted, subject to the conditions specified below, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate in the vicinity of 60th Avenue and Summitview Avenue in the City of Yakima, Washington, and more particularly described 4111 as follows, to wit: Beginning 35 feet south of the northeast corner of the northwest quarter of the southwest quarter of Section 21, Township 13 North, Range 18 E.W.M.; thence south 642.34 feet; thence south 88°58' west 150 feet; thence north 111 01°02'. west 57.03 feet; thence north 38°40'25" east 20.30 feet, thence north 6 east 18.43 feet; thence north 30°23'30" west 23.24 feet; thence north 01°02' west 61.04 feet to the easterly right line of the Yakima Valley Canal; thence northwesterly along said right-of-way to a point lying west of the point of beginning; thence east to the point of beginning, EXCEPT the east 30 feet for street, situated in Yakima County, Washington. , , - be rezoned from R-1, One-Family Zone to Planned Development Zone 411 be, and the same is hereby, approved and said real property is hereby rezoned to Planned Development Zone, all in accordance with, and to conform to, the final development plan and program 41111 therefore approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided, the rezone granted by this ordinance is subject to the following conditions: 1. The applicant shall file for public record an easement 25 feet wide to protect access to property included in Phase II of the Planned Development Program. 2. Applicant shall submit a specific sign plan to the City 41110 Department of Community & Economic Development for review, and subject to approval, prior to the installation of any signs. 3. Applicant shall submit engineering details of a drainage system to the City Engineer for review, subject to approval, prior to installation of any drainage system. Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this 4111, ordinance. Section 4. This ordinance shall be in full force and effect thirty days afters its passage, approval and publication as provided by law and by the City Charter. GLASCAM BUILDERS, INC. Don Scone presented the staff report and findings, recommending the Final Plan and Program requested by G 1a scam Builders, Inc. for a rezone from R - 1 to Planned Development at 60th Avenue and Sun - mitview be approved subject to the conditions in the staff report. Citizen Comments (For) Ron Whitaker, Attorney, representing Glascam Builders, explained to the Commission that the proposed Planned Development would be conducted in two phases. Phase I would consist of Step 1: renova- tion of the existing building for a dental clinic and parking; Step 2: additional parking and addition to the renovated clinic. He also stated that grass would he planted during Phase I on the phase II site. It was understood that Phase II would be referred bade to the Commission at sudh time when the site is proposed to be dev- eloped. Rip Hollingbery, 214 So. 37th Ave., Ardzitect, requested infor- mation from Denny Covell, City Engineer, regarding the Yakima County storm drain in the vicinity. Mr. Covell advised Mr. Hol- lingbery that there could be a problem with connecting to that particular storm drainage system and advised Mr. Hollingbery to work with Yakima County. Mrs. Robert Kean, 105 Shamrock Drive, asked for further clari= fication on the project. MINUTE C9 Harry Stark, President of Fontanelle, stated he was concerned that if a stone drain is not installed, dry wells could cause overflows to the Fontanelle properties. Commission Comments After discussion, it was MOVED by Phillips, seconded by Snodgrass to accept the staff recammendations and rezone this property from R -1 to Planners Development with the stiff recommendations. Larry Wright presented the staff report and findings, recommending that the preliminary plan and program requested by Glascam Build- ers, Inc., for a rezone from R -1 to Planned Development at 6006 Summitview be approved, subject to oonditions as stated. Citizen Comments (For) Ron Whitaker, 305 No. 3rd Street #6, representing Glascam Builders, explained that there would be 6,700 square feet of office space on the pcposed property When Phase I and Phase II were completed; it is the intention of the developer to complete Phase I at this tins. When Phase II is proposed, the developer recognizes that it will be a major modification to a planned development and must care before the Planning Commission; the developer and owners are satisfied with the conditions and recommendations made by the staff. Dr. Mart Gravbrot, 5615 Sumrnitview, stated that if the preliminary plan and program is generally accepted, an architect will look at the various cptiors of retaining or removing the swimming pool currently on the property. Citizen Comments (Against) Harry Static, 5901 Barge #27, President, Fontanelle Board of Dir- ectors, stated that the Fontanelle did not have any objections to the proposal at this time, but requested clarification on the legal description presented. Larry Wright explained that the legal description had been obtained through the County Assessor's Office, but a title search by the proponent had determined that it was incorrect and would be corrected for the final hearing. MINUTE C4 Donald Wall, 100 No. 60th Avenue #13, resident of El Somerset, stated that he had no objection to the development, but suggested that Phase II be left as a R -1 zone at this time and not rezone to Planned Development until Phase II is ready to be developed. Larry Wright explained that this was possible but would be a lengthy process and the result would be the same as rezoning the property as planned developed at this time. Ccmanission Comments Since this was the preliminary hearing, the Commission members' commended staff on preparing their findings and recommendations and indicated that they favored the project as presented and asked the developer to proceed with submittal of the Final Plan and Program. Lee Campbell, representing Mrs. Ray Pickens and Dr. Michael Buehler, addressed the Commission regarding a possible project at 60th Avenue and Pickens Place and a request for a rezone from R -1 (single family residential) to B -1 (professional offices). He explained that this was an informal discussion and asked for the Commission's opinion regarding the project. Dr. M. Buehler explained that the proposed project would be a dentist office in the Pickens home with the possibility of three physicians also having offices in the same building. After discussion, it was suggested by the Commission that it may be in the best interest for the proponents to request a Planned Development Zone.
