2007-054 Classification and Compensation Plan; YMC Amendment
• ORDINANCE NO 2007 -54 AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective January 1, 2008, amending Subsections 2.20 100A, 2.20 100C, 2.20 110A, 2.20 110B, 2.20 110C, 2.20 110F and 2.20 110G all of the City of Yakima Municipal Code BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1 Subsection 2 20 100A of the City of Yakima Municipal Code is hereby amended to read as follows "2.20 100 Classification Plan A. Plan Adopted A classification plan for city employees is hereby adopted to be effective January 1, 2008, which plan shall consist of the various following subsections of this section " Section 2 (Outside) 9125 City Worker (Inside) 9126 Temporary Refuse Helper" Section 3 Subsection 2 20 110A of the City of Yakima Municipal Code is hereby amended to read as follows "2.20 110 Compensation Plan. A. Pay ranges and pay steps, set out in the schedule constituting Subsection B through G of this section, for the classes allocated to these pay ranges shall be in full force and effect as of January 1, 2008 The pay rates shall constitute full compensation for those employees with a work week of forty hours as set out in other sections of this code Employees whose work week is less than forty hours shall be paid at the rate which is in the same proportion to the rates set out herein that their work week bears to forty hours The hourly rate for those employees of the Fire Department whose work week exceeds forty hours shall be computed according to the provisions of Section 2 22 030 of this code The performance of employees in the series designated Subsection B shall be evaluated annually in accordance with a management performance evaluation plan The result of the performance evaluations shall be the determination by the City Manager of the actual salary of each employee in the designated positions, and the determination by the City Council of the actual salary of the City Manager, which actual salaries shall be no Tess than the minimum nor no greater than the maximum set (b) Change sick leave cash out at retirement to 60% of accumulated sick leave with a 1,440 hour cap, to be deposited directly in the MERP plan. The total settlement package for 2007, 2008 and 2009 is estimated to be 12 71% or an average annual increase of 4 24% The proposed increased cost for 2008 is $415,128 and for the three years is estimated at $1,228,379 2. Collective Bargaining Settlements The attached ordinance\ amends the Classification and Compensation Plan to implement wage adjustments pursuant to current collective bargaining agreements effective January 1, 2008 and July 1, 2008 where required. The 2007 -2009 AFSCME Municipal Collective Bargaining agreement contains a percentage adjustment for 2008. The 2007 -2009 Collective Bargaining Agreements for the IAFF PERS and IAFF Public Safety Communications bargaining units contain CPI based formulas for the 2008 wage adjustments and implementation of the "f" step in the pay plan effective 7/1/08 Negotiations are ongoing with AFSCME- Transit. The Memorandum of Understanding with the Battalion Chiefs for 2007 -2009 contains CPI based formulas for the 2008 wage adjustments and implementation of the "f" step in the pay plan effective 7/1/08 The Classification and Compensation Plan was amended earlier this year to reflect the YPPA settlement for 2008 3. Management Group Compensation Adjustments Pursuant to my October 26, 2007 notice to the Council, this ordinance also incorporates the management pay and compensation adjustments which would take effect pursuant to the current formula prescribed in the Yakima Municipal Code, Section 2.20 116B Based upon the PACA formula, the 2008 PACA adjustments are 4 72% effective January 1, 2008 and 1 48% effective July 1, 2008, for a total estimated cost of $680,000 A copy of the notice is attached for reference 4. Total Cost of Settlements for 2008 Budget The 2008 Preliminary Budget includes the costs of these wage adjustments and costs are estimated at $2,248,400. Last, this classification and compensation ordinance includes housekeeping changes shown below 1 Reflects the change in the minimum wage effective January 1, 2008 and deletes references to City Workers II, Ill and IV due to the adjustment in the minimum wage effective January 1, 2008 2. Compensation for Municipal Court Judge is set by YMC 1 60 040 (J) at 95% of the District Court Judges salary as set by the State Salary Commission. The District Court Judges salary was set at $134,232 per year 95% equals $127,520 or $10,626 86 /month at Pay Code 1000 effective 9/1/07 For 9/1/08, the District Court Judges salary was set at $141,710 per year 95% equals $134,624 50 or $11,218 71 /month at Pay Code 1000 Because the City adopted the formula of judges' compensation as set forth by the State Administrative Office of the Courts (AOC), the city is eligible to receive a revenue distribution from the State. For both 2007 and 2008, the estimated revenue is $20,800 in each year 3 Corrections to previous amendments of the Classification and Compensation Plan discovered during the review of this section by the codifiers of the Municipal Code. The corrections amending Subsection 2.20 100C provide for the inclusion of the job titles for Public Safety & Education Officer (6340), Technical Training Supervisor (6341), and Park Supervisor I (8111) Further, this ordinance corrects Subsection 2.20 110C to correct the title of Computer Operator /Programmer (2105) MEMORANDUM DATE. Dick Zais, City Manager SUBJ Notice of 2008 Management Pay and Compensation Adjustment (PACA) As you are aware, the wages for all employee groups m the City of Yakima were frozen at the 2006 level for 2007 as a cost savmg measure to help balance the City's budget durmg a time of economic constraint. The management group was the first to agree to the wage freeze The acceptance of the wage freeze by management helped to lay the foundation for agreement by the other employee groups for 2007 The City wide budgetary cost savings from the wage freeze was approximately $1.5 million. The wage freeze savmgs attributable to the Management group for 2007 is estimated at $430,000' assuming a 3.5% wage adjustment for 2007. Section 2.20 116A of the' Yakima Municipal Code adopted by the City Council m December 1994 requires the City Manager to give written notice of the anticipated management compensation adjustment (PACA) for the next year This adjustment is applicable to all general management, supervisors and confidential employees Section 2.20 116B of the Yakima Municipal Code provides "A management pay and compensation adjustment shall be computed as of January 1st of each successive reference year based upon the following formula. Management PACA = Average Bargaining Urut PACA + Balancmg Adjustment." Further, Section 2.20115 defines PACA as "the total annualized percentage change in the economic value of employee compensation and benefits, including, but not limited to, salary, longevity, paid leave, holidays, deferred compensation and other forms of employee compensation, said change to be measured from one calendar year to the next succeedmg calendar year " Based upon the criteria outlined above, the Management 2008 PACA for total compensation as of January 1, 2008 is estimated to be 4.72% above the 2007 level. The application of the formula outlined above is presented below. • 2008 PACA ADJUSTMENT The PACA process is calculated based on the average of all pay and compensation adjustments approved by City Council for employee bargairung uruts for 2008 Exhibit A is a summary of the calculations of the Pay and Compensation Adjustment resultmg m an • adjusted 2008 PACA of 4.72% effective January 1, 2008 Since there are several employee groups with a mid -year adjustment, the July 1, 2008 PACA adjustment is 1 48% AFCSME Transit is the only bargaining group which has not settled their contract for 2008, therefore, a subsequent "balancing adjustment" will be necessary when a settlement is reached. Additionally, the PACA Adjustment is applicable to employees based on satisfactory or better job performance The Legislation implementing the 2008 PACA and the wage adjustments required by collective bargaining will be presented to Council on November 6, 2007 to be effective January 1, 2008 The cost of the management adjustments are estimated at $680,000 The 2008 Preliminary Budget includes these adjustments. Since the July 1, 2008 adjustment will only affect the 2008 budget for the last 6 months of the year, that increase is halved for budgeting purposes. 3) The 2008 Preliminary Budget adequately provides for this PACA adjustment (and all settled bargaining unit contracts) No modification to the budget is required. Note: The Management Group eligible to receive the PACA includes approximately 155 permanent budgeted positions made up of managers, supervisors, and confidential employees who are not unionized. cje 10/26/2007
