HomeMy WebLinkAbout1983-2723 REZONE PROPERTY AT 50TH & 51ST AVENUES, BETWEEN SUMMITVIEW & CHESTNUT AVENUES _ - ORDINANCELNO 2 7 2 'a .'—' -"- 110 AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property located at 50th and 51st Avenues 1111 between Summitview and Chestnut Avenues from R-1, One- Family Zone to R-2, Two-Family Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 4th day of October, 1983, on the recommendation of the Planning Commission that real property situate at 50th and 51st Avenues between Summitview and Chestnut Avenues in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-1, One-Family to R-2, Two-Family Zone, and 411, WHEREAS, as a result of its hearing, the City Council hereby makes its following findings and conclusions: FINDINGS: * 1. Professional Investors Associates applied for a rezone from R-1 to R-2 and preliminary plat approval of approximately 19 acres located at 50th and 51st Avenues between Summitview and Chestnut Avenues. The purpose of this request is to allow the construction of duplexes on 54 proposed lots. The proposal is divided into 5 phases, each to be done separately and in numerical order. At the request of the Planning Commission with concurrence of the applicant, the proposal was scaled down to approximately 4 410 10 acres and 28 lots, covering the southern half of the site. 2. The subject area is presently zoned R-1 and is in agri- cultural production. The surrounding land use and zoning is as follows: ZONING LAND USE North R-1 (Single Family Residential) Single Family Residential South M-1 (Light Industrial) Business Office JD R-2 (Two Family Residential) Duplexes East R-4 (Suburban Residence) Orchard West R-1 (Single Family Residential) Single Family M-1 (Light Industrial) Mini-Storage 3. The Urban Area Plan indicates that this proposal is III generally compatible with the surrounding properties. However, the plan indicates that this proposal is not compatible with the M-1 property to the south and R-4 Property to the east. Summitview Avenue is designated as a major arterial and a truck route. 4. The average lot size for the proposed subdivision is approximately 12,500 square feet with lots ranging from approx- imately 10,000 to 14,800 square feet. This is well within the minimum requirement for the R-2 minimum lot size of 8,000 square feet. 41 11/ 5. The proposed density is 6.33 DU/NRA. 6. At the September 6, 1983, Planning Commission meeting, the Planning Commission recommended that the proposal be scaled down to include only the first three phases. Based on this, the Commission recommended that the request for rezone from R-1 to R-2 be granted and that the preliminary plat be approved subject to certain conditions as set out on Resolution No. of the Yakima City Council, approving that preliminary plat, adopted 411 simultaneously-with the enactment of this ordinance. CONCLUSIONS: 1. Although the Urban Area Plan indicates that this proposal is not compatible with the 14-1 zone, this proposal does not repre- sent an increased impact upon that zone. Furthermore, the R-4 property is not expected to develop at its current 1 DU/acre designation, therefore making this proposal compatible. 2. The recommendation of the Planning Commission to grant the rezone should be affirmed, and the rezone should be granted, now, therefore, 411 BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate at 50th and 51st Avenues between Summitview and Chestnut Avenues in the City of Yakima, Washington, and more particularly described as follows, to wit: That portion of the west half of the northeast quarter of the southeast quarter of Section 21, Township 13 North, Range 18 East, W.M. described as follows: Commencing at the Southeast corner of said subdivision; thence North 0°00' East along the east line thereof 680.01 feet; thence North 88°49'23" West parallel to the south line of said subdivision 420.02 feet; thence 411 South 0°00 West parallel to the east line of said subdivision 25.00 feet; thence North 88°49'23" West parallel to the south line of said subdivision 253.97 feet to the west line of said subdivision; thence South 0°02'10" West along said west line 655.00 feet to the southwest corner thereof; thence South 88°49'23" East to the point of beginning; -2- Except the South 25.00 feet for road. (contains 9.99 Acres) 411 be rezoned from R-1, One-Family Zone to R-2, Two-Family Zone be, and the same is hereby, approved and said real property is hereby 11110 rezoned R-2, Two-Family Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this . ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided 1 110 by law and by the City Charter.
