ORDINANCE NO. 272 8 411 AN ORDINANCE accepting the. recommendation of the Planning Commission and rezoning property at 503-511 Ranchltite Road from R-3, Multi-Family zone 41111 to M-1, Light Industrial zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 25th day of October, 1983, on the recommendation of the Planning Commission . that real property situate at 503-511 Ranch Rite Road in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-3, Multi-Family zone to M-1, Light Industrial zone, and WHEREAS, as a result of its hearing, the City Council hereby 41111 . makes its following findings and conclusions: : N FIDINGS: • , 1. Mr. Jesse Lawrence •and others have submitted a request to rezone property from R-3, Multi-Family zone to M-1, Light Industrial zone along 503-511 Ranch Rite Road. The stated.purpose of the rezone is to allow construction of an auto parts/repair facility. Most of the existing buildings will be for new construction. The applicants have stated that since this property is surrounded by commercial, that their proposal is the highest, 41111 and best use of the property. 2. This request was heard at the September 6, 1983, Planning .Commission meeting and was continued to the October meeting at - the request of staff. The request for continuance was based on the desire to have all properties lying between Ranch Rite Road and East Nob Hill Boulevard, east of the alley to South 6th Street presently zoned R-3, be included for rezone. All properties are now included in the rezone request, thereby eliminating any possible confusion over zoning boundaries or potential development conflicts between dissimilar zoning districts (i.e., M-1 vs. R-3). 3. The Optimal Land Use Plan indicates the proposal is cm- ", patible with surrounding commercial/industrial land uses. . ,. . • . . _ . . . • . . . , . . . ' _, .• . : • 4. To make the location desirable for multi-family residential living, a substantial amount of investment would III be required to reduce or mitigate adverse impacts. 111, 5. The proposed development will require paying particular attention to building setbacks, parking lot design and location of entrance and exit points. CONCLUSIONS: 1. The recommendation of the Planning Commission to grant the rezone should be affirmed, and the rezone should be granted, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property 41/P situate at 503-511 Ranch Rite Road in the City of Yakima, Wash- ington, and more particularly described as follows, to wit: All of that portion of Lot 9 of Fairchild Acre Tracts, as recorded inNolume "A" of Plats, page 115, records of Yakima County, Washington, lying south of the south right-of-way line of Nob Hill Boulevard, EXCEPT the west 50 feet of the south 120 feet thereof, AND EXCEPT the west 8 feet for alley. . be, and the same is hereby, approved and said real property is hereby rezoned to M-1, Light Industrial zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map 41/ prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with. the Yakima County Auditor a certified copy of this ordinance. Section 4.
