HomeMy WebLinkAbout1983-2734 REZONE PROPERTY ON PERRY STREET WEST OF 3RD AVENUE ORDINANCE N. 2 7 3 4 AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property on Perry Street west of 3rd Avenue from R-2, Two Family Zone to Planned Development Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 22nd day of November, 1983, on the recommendation of the Planning Commission that real property situate on Perry Street west of 3rd Avenue in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-2, Two Family Zone to Planned Development Zone, and WHEREAS, as a result of this hearing, the City Council hereby makes its following findings and conclusions: FINDINGS: 1. William and Tom Rehfield have submitted a Final Plan and Program for a rezone from R-2, Two Family Zone to Planned Development Zone for eight lots located on the north side of Perry Street west of 3rd Avenue. The request is to allow construction of a 105 unit mini-storage facility to be developed in three phases, each comprising approximately one-third of the development. 2. The site is zoned R-2, Two Family Zone and is vacant except for the most easterly lot on which there is a single- family residence. Surrounding zoning and land uses follow: Zoning Land Use North & East R-2 Multi-Family Residential West R-2 City Park South County Commercial Multi-Family (50%) Undeveloped (35%) Cabinet Shop (15%) 3. The Optimal Land Use element indicates that this proposal may be compatible with moderate and high density residential uses, and it states that all commercial uses shall be allowed along a principle or secondary arterial with access 110 by interior streets or with controlled access points. Perry Street is a local access street. 4. , An environmental checklist has been submitted and a declaration of non-significance issued pursuant to the Act. 5. The City Planning Commission recommended approval of the rezone request. CONCLUSIONS: 41110 1. Compatibility with adjacent residential uses can be achieved through. proposed site Screening, • 2. This location satisfies the intent of the Transporta- tion element of the Urban Area Plan. 3. The recommendation of the Planning Commission to grant the rezone should be affirmed, and the rezone should be granted, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission , of the City of Yakima that the 'following described real property f situate on Perry Street west of 3rd Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: Lots 11 through. 18 of Rehfield Addition as recorded on page 36, Volume "E" of the records of the Yakima County Auditor, Yakima, Washington. be rezoned from R-2, Two Family Zone to Planned Development Zone be, and the same is hereby, approved and said real property is hereby rezoned to a Planned Development Zone, all in accordance with, and to conform to, the final development plan and program 41IP therefore approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof. Section 2. The above change in zoning shall be included and depicted on the regularly amended use district map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City. Citizen Comments (Far) Tan Rehfield, 806 So. 1st Avenue, Partner, stated that he and William Rehfield are in accordance with the conditions set in the staff report. Citizers Comments (Against) No one present wished to speak against this proposal. WILLIAM REHFIELD Larry Lehman presented the staff report and findings, recommending denial of the request of William Rehfield for a rezone from R -3 to Planned Development at So. 3rd Avenue and Perry Street. Citizen Comments (For) Bill Rehfield, Rt. 5, explained that this proposed project would be for 80 -86 large storage units to be constructed in phases. And a further request to have the option to revert bads to the R -3 zone if all of the phases are not constructed. Darrel Haugen, 4504 Mountainview Road, owner of the 12 unit apart ments directly south of the proposal, is in favor fo the proposal. Citizen Comments (Against) No one present wished to speak against this proposal. Commission Comments After discussion, the Commission made the following oonments to the applicant to prepare the final plan and program: more detailed drawings and the possibility of proceeding with Phase III as the first phase.
