HomeMy WebLinkAbout1984-2741 REZONE PROPERTY AT 505 NORTH 40TH AVENUE 14 r ORDINANCE NO: 27 4 1 AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at 505 North. 40th Avenue in the City of Yakima, Washington, from R-1, One-Family Zone to R-3, Multiple-Family Zone. glib\ NO WHEREAS, pursuant to due and legal notice the City Council of the City of Yakima held a hearing on the 3rd day of January, 1984, upon the recommendation of the Planning Commission that real property situate at 505 North 40th Avenue in the City of Yakima, Washington the legal description of which is set out hereinbelow, be rezoned from R-1, One-Family Zone to R-3, Multiple-Family Zone, and WHEREAS, as a result of its hearing, the City Council hereby 4110 makes its following findings and conclusions: FINDINGS: 1. Mr. H. Norman Hyatt, Crescent Convalescent Center, has submitted an application for a rezone from R-1, One-Family Zone, to R-3, Multiple-Family Zone for property located at 505 North 40th Avenue. The Crescent Convalescent Center property is presently split by a zoning district boundary. The westerly portion of the property is appropriately zoned R-3, Multiple- Family Zone while the easterly portion (rezone site) is zoned R-1, One-Family Zone as a result of an annexation which occurred 4110 in 1967. The rezone, if granted, would enable the applicant to apply for a Special Property Use Permit for a proposed expansion of the convalescent facility on the rezone site Chapter 12.52 of the City Zoning Code requires the issuance of a Special Property Use Permit for establishment or expansion of a con- valescent home and specifically excludes this use from the R-1, One-Family Zone and R-2, Two-Family Zones. 110 2. The rezone site is already occupied by a wing of the convalescent center, a small shop/maintenance building, and parking. Land use and zoning on adjacent properties is as follows: Zoning Land Use NORTH. R-1 City Water Reservoir SOUTH , R-1 Single Family Residential EAST PD Yakima Tennis Club WEST R-3 Crescent Convalescent 4 3. A convalescent center-is best categorized as High Density Residential as regards to use and development intensity. The Optimal Land Use element of the Plan states that High, Density Residential may locate adjacent to Low Density Residential uses provided compatibility can be demonstrated. 4. The location of th.e site and the specific adjacent uses establishes the compatibility of this request and, therefore, achieves conformance with the Urban Area Plan. The requested zoning and proposed development is compatible with the water reservoir site to the north and th.e Tennis Club to the east. The single-family development to the south is buffered by a private driveway, canal, and existing vegetative barrier. 411/ 5. The Special Property Use Permit hearing will provide the public an opportunity to .identify and address any specific compatibility problems associated with the proposed plan of development. 6. Crescent Convalescent already occupies the site and no other use of the property could reasonably be expected. 7. On December 6, 1983, the City Planning Commission recommended approval of the rezone. CONCLUSIONS: 1. The recommendation of the Planning Commission to grant 4110 the rezone should be affirmed, and the rezone should be granted, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that th.e following described real property situate at 505 North 40th Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: Lots 28, 29, 30 and 31, as shown on Plat of Crescent -Hill Half Acre Tracts, recorded in Volume "E" of Plats, Page 33, records of Yakima County, Washington be rezoned from R-1, One-Family Zone to R-3, Multiple-Family Zone be, and th.e same is hereby, approved and said real property is hereby rezoned to R-3, Multiple-Family Zone. -2- Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared by and for the City. 410 Section 3. The City Clerk is hereby authorized and directed to file with. the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter. PASSED BY.
