WHEREAS, the City of Yakima, Washington (the "City"), now owns, operates and maintains a water supply and distribution system and 4 sewerage collection and disposal system, and said water and sewerage systems have been combined in the manner provided by law; and -- WHEREAS, by Ordinance No. 2677, the City provided for the 1111 issuance and sale of its Water and Sewer Revenue Bonds, 1983, in the aggregate principal amount of $4,050,000 (the "Bonds") to provide a portion of the funds necessary to pay the cost of certain additions and improvements to the combined water and sewerage system of the City; and WHEREAS, such bond issue is sufficient in amount to allow for the application of a portion of the proceeds of the Bonds to pay the cost of certain additions and improvements to the water system of the City; and WHEREAS, authorization of the use of a portion of the bond :7proceeds to pay the cost of said improvements to the water system 1 110 '' was not included in Ordinance No. 2677; and WHEREAS, it is deemed necessary and advisable by the City Council that the provisions in Ordinance No. 2677 regarding the application of the proceeds of the Bonds be supplemented by an amending ordinance; and WHEREAS, the Council hereby finds and determines as required by said Section 16.A.2 of the Bond Ordinance that such amendments 1110 are not inconsistent with such ordinance and shall not adversely AI ) affect the interests of the holders of any of the Bonds; ill ......._ .. NOW, THEREFORE, BE IT ORDAINED by the City of Yakima, Washington, as follows: 411 Section 1. Amendment of Definitions. Section 1(o) of Ordinance No. 2677 is hereby amended to read as follows: 41, (o) "Project" means the planned additions and improvements to the wastewater collection, treatment and disposal system of the City described in the Plan Ordinances and Ordinance No. 2148, as well as certain additions and improvements to the water system of the City described in Section 2 hereof. Section 2. Amendment to Plan of Additions and Improve- ments to and Extensions of the System. Section 2 of Ordin- ance No. 2677 is hereby amended to read as follows: The plan of additions and improvements to and ex- tensions of the System set forth in the Plan Ordinances 41/ is hereby ratified and confirmed. The City shall also acquire, construct and install certain improvements to the water supply and distri- bution system of the City, including in particular 1) High Zone Reservoir 2) Mid Zone Pump Station 3) Wa- ter Treatment Plant Filter Bed Covers 4) High Zone 12" diameter cross tie and 5) Water Treatment Plant Intake Structure Study. Such project is as more fully set forth in the final maps, plans and specifications, therefore prepared by the City of Yakima Engineering Division and CH2M-Hill and now on file with the City. The City shall acquire and install all equipment, lines, pump stations, valves, fittings and other appur- tenances necessary for the operation of such improve- ments, and shall acquire by purchase or condemnation, gift or grant, all property, both real and personal or ,.., any interest therein, and all easements, rights-of-way and franchises necessary to carry out such plan. The estimated cost of acquiring, constructing and installing said improvements to the water supply and 41/P distribution system of the City is hereby estimated and declared to be, as near as may be, the sum of $827,000, approximately $750,000 of which will be financed from the proceeds of the sale of bonds. The above of improvements shall be subject to such changes as shall be authorized by the Council and found to be necessary and desirable, so long as the same do not materially affect the nature or scope of such improvements. Section 3. Prior Acts. All acts taken pursuant to the authority of this ordinance but prior to its effective date 1110 are hereby ratified and confirmed. II, III D4 H1 .,. Section 4. Effective Date.
