0 AN ORDINANCE property in the 400 Block; North Naches
Avenue, from R-3, Multiple-Family Zone to 8-1,
II Modified Business Zone.
WHEREAS, on the 27th. day of March, 1984, the City Council
held its final hearing on the application by Mike and Linda
, .
Lopez for the rezone of property in the 400 block, North Naches
Avenue, from R-3, Multiple-Family Zone to B-1, Modified Business
Zone, and
..,
WHEREAS, as a result of its hearing, the City Council
hereby makes its following findings and conclusions:
FINDINGS:
1110 1. The properties are currently zoned R-3, Multiple-Family
Zone. Actual land uses include single family, duplex and multiple-
family. The land use and zoning of adjacent properties is as
follows:
• Zoning Land Use
North B-1- Masonic Center Office Complex
South PD Multi-family residential
B-2 Parking Lot
East R-3 Single-family, duplex and multi-family
West B-1 Single-family, duplex and multi-family
B-2 Multi-family (vacant)
2. No significant increase in vehicular .traffic, nor
increased conflict in traffic patterns, will result from granting
01 the rezone.
3. The Optimal Land Use Plan indicates that B-1 development
may be allowed adjacent to low-moderate density residential develop-
ment if the project can demonstrate compatibility. Compatibility
between the property under consideration and the surrounding area
would result from granting the rezone application because of the
other B-1 properties in close proximity to the rezone area and

because of the straightening of zone boundary lines which would

result from the rezone, all without increasing hazards on account
of vehicular traffic patterns or volume.

• 4. The owners of other property in the neighborhood do not
oppose the rezone.

5. The Yakima City Planning Commission recommended denial
of the rezone.
CONCLUSIONS: •
1. The requested rezone is in compliance with. the Yakima
411r Urban Area Comprehensive Plan.
2. The granting of the rezone would result in compatibility
of land uses in the neighborhood.
' • 3. The recommendation of the Yakima City Planning CoMmission
should be overruled, and the rezone should be granted, now, therefore:
BE IT ORDAINED BY THE 'CITY OF YAKIMA:
Section 1. The following described real property situate in
the 400 block of North Naches Avenue in the City of Yakima, Washing-
ton, and more particularly described as follows, to wit:

Lots. 1, 2, 6, 7, and 8, Block 86, Town of North Yakima,
now Yakima, according to the official plat thereof
recorded in Volume "A" of Plats, page 10, and re-recorded
in Volume "E" of Plats, page 1, records of Yakima County,
Washington.
should be, and is hereby, rezoned from R-3, Multiple-Family Zone to
B-1, Modified Business Zone.
Section 2. The above change .in zoning shall be included and
depicted on the next regularly amended use district map prepared
by and for the City.
Section 3.. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a,certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter-.
