HomeMy WebLinkAbout1984-2769 REZONE PROPERTY IN THE BLOCK BETWEEN 11TH & 12TH AVENUES AND BETWEEN YAKIMA AVENUE & CHESTNUT STREET _ - ORDINANCE N9. in (5 9 AN ORDINANCE accepting the recommendation of the Planning 411 Commission and rezoning property in the block between llth, and 12th Avenues and between Yakima Avenue and Chestnut Street from R-3, Multiple- ", Family Zone to B-1, Modified Business Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 24th day of April, 1984, on the recommendation of the Planning Commission that real property situate in the block between llth and 12th Avenue and between Yakima Avenue and Chestnut Street in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-3, Multiple-Family Zone to B-1, Modified Business Zone, and 0 WHEREAS, as a result of its hearing, the City Council hereby makes its following findings and conclusions: FINDINGS: 1. Yakima Orthotics submitted a request for a rezone from R-3, Multiple-Family Zone to B-1, Modified Business Zone for property located at 9 South. 12th Avenue. The purpose of the request is the conversion of the existing residence on the site to a professional office. The Planning Commission initiated a rezone. to B-1 for the remaining residentially zoned proPerties • in the same block as Yakima Orthotics' request. The purpose of the Planning Commission's action was to hold a single combined hearing to consider zoning and future development of the block. 2. The rezone site includes ten R-3 zoned lots which form a narrow residential area between B-2, Local Business zoning along Yakima Avenue and B-1 zoning for the medical center professional area. The ten lots are occupied by a mix of resi- dential dwelling types and a non-conforming Optometrist's office. 3. The Optimal Land Use Element states that Proffesional 1111 Office (B-1) development is compatible with High Density Residential III (R-3) development. Professional Office development is conditionally compatible with Moderate Density Residential development which. is the present character of the area. 111 South. llth Avenue Is designated as a Collector • Street by the Transportation Element. 4. The Planning Commission, in public hearing on April 3, III 1984, recommended approval of the rezoning of all the property described below. CONCLUSIONS: • 1. The conditions necessary for compatibility are satisfied by street separation and transition of the residential area from low-moderate density to high density development. 2. The rezone area is adequately served by all public services including arterial and collector streets. Traffic to and from the rezone area will follow established routes and will not contribute to or cause traffic problems. • 3. The rezone area is a logical expansion of Medical Center professional area and conforms to the goals and policies of the Urban Area Plan. 4. The. recommendation of the Planning Commission to grant the rezone should be affirmed, and the rezone should be granted, now, therefore, BE IT ORDAINED BY THE CITY,OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate in the block between llth Avenue and 12th_ Avenue and bet- ween Yakima Avenue and Chestnut Street in the City of Yakima, 4 111/ Washington, and more particularly described as follows, to wit: Lots 3-7 and Lots 10, 11, 13 and 14, Block 411, Capitol Addition to North - Yakima, now Yakima, as recorded in Volume "A'! of Plats, Page 29, records of Yakima County, Washington. be rezoned from R-3, Multiple-Family Zone to B-1, Modified Business Zone be, and the same is hereby, approved and said real property is hereby rezoned to B-1, Modified Business Zone. Section 2. The above change in zoning shall be included 110 and depicted on the next regularly amended Use District Map prepared 41 / by and for the City. -2- Section 3. The City Clerk is hereby authorized and directed • to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
