HomeMy WebLinkAbout1984-2779 REZONE PROPERTY IN THE 900 BLOCK OF SOUTH NACHES AVENUE 7 7 9 ORDINANCE 1110. 2 2 ' II AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property in the 900 Block of South Naches Avenue from R-3, Multiple- Family Zone to M-1, Light Industrial Zone. 411111k NIP WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 5th day of June, 1984, on the recommendation of the Planning Commission that real property situate in the 900 Block of South Naches Avenue • in the City of Yakima, Washington, the legal •description of which is set out hereinbelow, be rezoned from R-3, Multiple- Family Zone to M-1, Light Industrial Zone, and WHEREAS, as a result of its hearing, the City Council ill hereby makes its following findings and conclusions: FINDINGS: 1. Associated Grocers has requested the rezone from R-3, Multiple-Family Zone to M-1, Light Industrial Zone of the real property described hereinblow consisting of seven lots situate in the 900 Block of South Naches Avenue. The property which is the subject of the rezone is east of and adjacent to the existing 1 facility of Associated Grocers. The purpose of the request is , to permit expansion of truck parking space for Associated Grocers. 2. The southerly five lots of the rezone site are presently used by Associated Grocers for truck parking. This truck parking constitutes a non-conforming use in the R-3, Multiple-Family zone. 41 110 A single family, dwelling occupies one of the northerly two lots with the other lot being vacant. 3. South Naches Avenue, which borders the rezone site on the east, is classified as a Local Access Street by the Transpor- tation Element. 4. Land use and zoning on adjacent properties is as follows: (21 Sin Land Use . . NORTH R- Single-family residential SOUTH • R-3 Single-family residential III EAST R-3 Mixed residential, church WEST M-1 Associated Grocers 5. The Optimal Land Use Element of the Plan states that industrial and residential uses are not compatible and should not II be permitted to locate adjacent to each other. The existing mix 0 of industrial and residential uses is incompatible and does not conform to the intent of the Yakima Urban Area Plan. The intent of the Plan, in this case, would be met by granting the rezone so as to enhance the degree of compatibility in the area. Also, 41/ compatibility between the uses would be enhanced through separa- tion by a street or alley. The trend has been growth of industrial uses east of Naches Avenue and at this time only six residences remain in the two blocks from Pacific Avenue to LaSalle Street. Due to this trend, Naches Avenue is a logical boundary between industrial and residential uses. 6. The City Planning Commission recommended approval of the rezone. 40 CONCtUSIQNS: 1. To grant the request would bring the zoning pattern of the area into conformance. with the intent of the Yakima Urba/ Area Comprehensive Plan. 2. The H recommendation of the Planning Commission to grant the rezone should be affirmed, and the rezone should be granted, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section A. The recommendation of the Planning Commission of the City Of Yakima that the following described real property situate in the 900 Block of South Naches Avenue in the City of Yakima, Washington, and more particularly described as follows, 411 to wit: Lots 1, 2, 3, and 4, of Block "D", and Lots 6, 7, and 8, of Block "G", South Park Addition to the City of North Yakima, now Yakima, Washington, as recorded in Volume "B" of Plats, page 2; EXCEPT that portion of said Lot 6 as follows: Beginning at the Southwest corner of Lot 6, Block "G" of said South Park Addition: Thence northerly along the west line. of Lot 6, a distance of 25 feet; thence easterly and parallel to the south line of Lot 6, a distance of 30 feet; thence southerly and parallel to the west line of Lot 6, a distance of 5 feet; thence easterly and parallel to the south line of Lot 6, a distance. of 95 feet to .the east line of Lot 6; thence southerly along the east line to the southeast corner of Lot 6; thence westerly along the south line of said Lot 6 to the point of beginning. AND that portion of vacated alley accruing by reason of vacation ordinance of the City of Yakima, recorded under Auditor's File No. 2271933. -2- AND that portion of vacated Rainier Street accruing by reason of vacation ordinance of the City of Yakima, recorded under Auditor's File No. 2277338. AND that portion of alleyway adjacent thereto. be rezoned from R-3, Multiple-Family Zone to M-1, Light Industrial 44110 Zone be, and that same is hereby, approved and said real property is hereby rezoned to M-1, Light Industrial Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared I , by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. 41111 Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
