HomeMy WebLinkAbout1984-2783 CREATING A “WORKERS’ COMPENSATION FUND” . % ORDINANCE NO. 2783 AN ORDINANCE relating to, funds and accounts; creating a "Workers' Compensation Fund", declaring the purpose thereof, III specifying the source of funds thereto and providing for expenditures therefrom; enacting Chapter 3.102, "Workers' Compensation Fund" and various sections thereof as a new Chapter and new sections of the City of Yakima Municipal Code; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: WHEREAS, the City Council desires to adopt a self-insured workers' compensation plan for City employees pursuant to R.C.W. Chapter 51.14 as a means of reducing the amount of City funds previously spent for industrial insurance premiums under the plan administered by the State, and • WHEREAS, arrangements have been or will be made whereby July 1, 1984, is the effective date for implementation of the City's self-insured plan, and the fund created by this ordinance must be established by that effective date in order to properly complete the implementation of that program, otherwise applicable State regulations would prevent the program from becoming effective until October 1, 1984, to the detriment of the City of Yakima and its citizens, and WHEREAS, in view of the foregoing, the City Council does hereby find and declare an emergency to exist so as to authorize 411/ this ordinance to become immediately effective, as contemplated by Article VI, Section 2, of the Yakima City Charter, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Chapter 3.102, "Workers' Compensation Fund", and Sections 3.102.010, 3.102.020 and 3.102.030 thereof, are hereby enacted as a new Chapter and new Sections of the City of Yakima Municipal Code to read as follows: 111 "CHAPTER 3.102 III Workers' Compensation Fund 3.102.010 Fund Created -- Purposes. There is hereby created a fund to be known as the "Workers' Compensation Fund". Money in the fund shall be expended only to pay costs incurred by the City as a self-insured employer pursuant to R.C.W. Chapter 51.14, including the following purposes: 1. To pay the. City's pro rata share of the State fund deficit as determined by the Director of the Department of Labor and Industries, 2. To pay any liabilities of the City for compensation 1110 incurred as a self-insurer, 3. To pay any premiums or other costs for reinsurance and surety bonds as may be authorized or required by appli- able State laws, and 4. To pay any other costs and expenses incurred in the operation and maintenance of the City's self-insurance program, including fees for administrative services performed by independent contractors as may be authorized from time to time by resolution of the City Council. 3.102.020 Source of Funds. From time to time, the City Council shall budget, appropriate or otherwise authorize the transfer of money from any available source into such fund. 3.102.030 Expenditures. Expenditures from the fund shall be made only for the purposes mentioned in Section 1110 3.102.010 of this Chapter. No expenditure shall be made from such fund unless the City Council shall prove such expenditure by enacting an ordinance appropriating money within the fund for the purpose for which the expenditure is to be made, or by including an appropriation for that pur- pose in the budget." Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publica- as provided by law and by the City Charter.
