HomeMy WebLinkAbout1984-2793 MODIFICATION OF PROPERTY AT 111 NORTH NACHES AVENUE ORDINANCE NO. 279 3 AN ORDINANCE granting a major modification to a Planned Development Zone applicable to property at 111 North Naches Avenue. 4111 WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on July 10, 1984, on the recommendation of the Planning Commission that a major modification be granted to the existing Planned Development Zone applicable to property at 111 North Naches Avenue, Yakima, Washington, and WHEREAS, as a result of its hearing, the City Council hereby makes its following findings and conclusions: FINDINGS: 1. Property at 111 North Naches Avenue is presently zoned Planned Development Zone in contemplation of the construction of a four story residential dwelling with condominium living units. Application has been made for a major modification of the existing plan to allow'the construction of a seven story residential dwelling with fewer condominium living units than originally planned. 2. There is no opposition from neighboring property owners or occupants to the modification. 3. The modification substantially conforms to the General 4111 Plan of the City, and the proposal is in harmony with the surrounding area. 4. The City Planning Commission recommended the approval of the major modification, subject to the conditions set out hereinbelow. CONCLUSIONS: 1. The recommendation of the Planning Commission to. grant the. major modification should be affirmed, and the major modifi- cation request should be granted, subject to the condition set out hereinbelow, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the major modification to the Planned Development Zone applicable to th.e following described property at 111 North Naches Avenue, Yakima, Washington, to wit: Lots 11, 12, 13 and 14 of Block 109 of the Town of III North Yakima as recorded in Volume "A" of Plats, Page 10, records of Yakima County, Washington. be, and the same is hereby, approved and the property is hereby 4 11 1 rezoned as Planned Development Zone to include the major modifi- cation proposed by the development plan and program approved by th.e Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided the major modification is granted subject to the condition that approval be obtained from the City Department of Community & Economic Development of the species of trees to be planted within public right-of-way within the Planned Development area. 4 11 1 Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as pro- vided by law and by the City Charter.
