AN ORDINANCE accepting the recommendation of the Planning
Commission and rezoning property in the 900
Block of South Naches Avenue from R-3, Multiple-
Family Zone to M-1, Light Industrial Zone.

WHEREAS, pursuant to due and legal notice, the City
Council of the City of Yakima held a hearing on the 10th day
of July, 1984, on the recommendation of the Planning Commission
that real property situate in the 900 block of South Naches
Avenue in the City of Yakima, Washington, the legal description
of which is set out hereinbelow, be rezoned from R-3, Multiple-
Family Zone to M-1, Light Industrial Zone, and
41111 WHEREAS, as a result of its, hearing, the City Council
hereby makes its following finding and conclusions:
FINDINGS:
1. On May 1, 1984, the Planning Commission recommended
approval of Associated Grocer's request for a rezone from R-3,
Multiple-Family Zone to M-1, Light Industrial Zone for seven
lots located in the 900 and 1000 block of South Naches Avenue.
The Yakima City Council subsequently granted the rezone request
on June 5, 1984. In response to public testimony, the Planning
Commission also took action on May 1, 1984, initiating a rezone
to M-1 for the remaining nine lots on the west side of South
41111 Naches Avenue between Pacific Avenue and LaSalle Street. The
purpose of the Commission's action was to consider, in public
hearing, the transition of the remaining residential properties
to industrial use The Planning Commission recommended the
rezone of the northerly four lots, legally described below, which
were the subject of the Council hearing, and concerning which
these findings and conclusions are made.
2. Three of the four lots which are the subject of this
41/11 proceeding are occupied by single family dwellings. The fourth
lot is vacant. Land use and zoning on adjacent properties is
as follows:

3. The Optimal Land Use Element of the Plan states that
industrial and residential uses '. are not compatible and should

not be permitted to locate adjacent to each, other. South Naches

Avenue is classified as a Local Access Street by the TransportatiOn
Element. 1111
4. The Yakima City Planning Commission recommended that the
lots be rezoned to M-1, Light Industrial Zone.
CONCLUSIONS:
•
1. The existing mix of industrial and residential uses in
this general geographical area is incompatible and does not
conform with the intent of the Yakima Urban Area Plan.
2. The trend in this area has been growth of industrial
uses east to Naches Avenue. The:Associated Grocer's rezone •
continues this trend.. Rezoning of the four lots under consideration
to M-1; Light Industrial Zone, would tend toward completing the
transition and establish South Naches Avenue as a buffer, thereby
enhancing land use compatibility and thereby bringing this area
into conformance with the City's general plan.
3. The recommendation of the Planning Comission to rezone
the property under consideration should be affirmed, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The redowffieridation of the Planning Comudssion of
the City of Yakima that the following described real property
situate in the '900 Block of South Naches Avenue in the City of
Yakima, Washington, and more particularly described as follows,
to wit:
Lots 5 through 8 of Block D of South Park Addition to
North Yakima, W.T., now Yakima, Washington, as recorded
in VoluMe B of Plats, Page 2, records of Yakima County,
• Washington; along with a 30 foot wide strip of land
lying directly north of said Lot 8 and between the east
and west lines of said Lot '8 extended.
be rezoned from R-3, Multiple-Family Zone to M-1, Light Industrial
Zone be, and the same is hereby, approved and said real property
is hereby rezoned to M•1, Light Industrial Zone.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended use district map prepared

by and for the City.

• Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
• ordinance.
1111 Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as pro-
vided by law and by the City Charter.
