AN ORDINANCE granting a major modification to a Planned Development .
Zone applicable to property at the northwest corner
-11V of 16th Avenue and Summitview Avenue.
4110 WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on September 25, 1984, on
the recommendation of the Planning Commission that a major modifi-
cation be granted to the existing Planned Development zone appli-
cable to property at the northwest corner of the intersection of
16th Avenue and Summitview Avenue, Yakima, Washington, and
WHEREAS, as a result of its hearing, the City Council hereby
makes its followings findings and conclusions:
FINDINGS:
4111 1. Property at the northwest corner of the intersection of
16th Avenue and Summitview Avenue is presently zoned as a Planned
Development. A business called Fiddlesticks is operated on the
premises.
2. Richard and Kathy Myers, dba Fiddlesticks, and Tom and
Diane. Berndt have submitted a final plan and program for a major
modification to the Fiddlesticks Planned Development located at
16th Avenue and Summitview Avenue. The requested major modifica-
tion consists of adding the property at 208 North 16th Avenue to
the Fiddlesticks Planned Development. The existing residence on
the property is proposed to be converted to a children's bookstore
and would share Fiddlesticks new 16th Avenue access. Ten off-street

parking spaces are proposed on the back of the site.
3. Existing land use and zoning on adjacent properties is as
follows:

WEST R-1 Single family residential
4. Fiddlesticks, including the proposed addition, is con-

sistent with the Plan description of Auto Oriented Commercial. The
Optimal Land Use Element of the Plan indicates that Auto Oriented
Commercial development is conditionally compatible with the moderate

density residential development to the north and west and
directly compatible with other commercial uses in the vicinity.
North 16th Avenue and Summitview are both. classified as Major
Arterial Streets. Summitview is a designated truck route. Jb
5. North 16th. Avenue has insufficient right- for 4111
future improvements. Consistent with the rest of the Fiddlesticks,
project, four (4) feet of right-of-way should be dedicated from
this lot. Applicants agreed to dedicate this necessary right-of-

way for street purposes.
6. The City Planning Commission approved the major modifica-
tion, subject to review and approval by the 'City Council of the
following items:
(a) Drainage plan (with engineering analysis)
(b) Landscaping plan 4110
(c) Sign plan
(d) Details of proposed site screening fence
(e) Indication of all proposed structural changes, if any,
which: the Council considered by means of Exhibits 1 and 2 (two
drawings) submitted at the City Council hearing, and which the
City Council found satisfactory; provided, that no sign plans were
submitted, and the applicant agreed to obtain the approval of th.e
Department of Community & Economic Development before erecting
signs on the premises.
CONCLUSIONS:

1. The proposed major modification is compatible with adja-
cent land uses and is in conformance with the policies and objectives
of the Yakima Urban Area Comprehensive Plan.
2. The recommendation of the Planning Commission to grant the
major modification should be granted, subject to the conditions'aet
out hereinbelow, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of 41410
the City of Yakima that the major modification to the Planned Develop-
ment zone applicable to the following described property at the
northwest corner of the intersection of 16th Avenue and Summitview
Avenue, Yakima, Washington, to wit:

Parcel B: the east 70 feet of the south 140 feet of

be, and the same is hereby, approved and the property is hereby
rezoned as Planned Development zone to include the major modifi-
, cations proposed by the development plan and program approved by
the Yakima Planning Commission, a copy of which is attached hereto
and by reference made a part hereof; provided, the major modifica-
tion is granted subject to the condition that the modifications
include the provisions for drainage, landscaping, site screening
and structural changes as depicted on Exhibits 1 and 2 submitted
at the City Council hearing, and that no signs shall be erected
on the premises until the plans therefore have been submitted to
and approved by the City of Yakima Department of Community &
Economic Development; and provided, further, that the strip 4 feet
in width for right-of-way purposes along 16th Avenue shall be
dedicated for street purposes.
Section 2. The above change in zoning shall be included and
4111 depicted on the next regularly amended use district map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section, 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
