AN ORDINANCE accepting th.e recommendation of the Planning
Commission and rezoning property at 1016 South
6th Avenue from R-2, Two-Family Zone and B-3,
• General Business Zone to B-1, Modified Business
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 23rd day of October,
1984, on the recommendation of the Planning Commission that real
property situate at 1016 South 6th Avenue in th.e City of Yakima,
Washington, the legal description of which is set out hereinbelow,
be rezoned from R-2, Two-Family Zone and B-3, General Business
Zone to B-1, Modified Business Zone, and
• 4111 WHEREAS, as a result of its hearing, the City Council hereby
makes its following findings and conclusions:
FINDINGS:
1. Benjamin F. Chadwick submitted a request to rezone property
located at 1016 South. 6th Avenue, Yakima, Washington, to B-1,
Modified Business Zone. That property consists of two lots. The
northerly lot is currently zoned R-2, Two-Family Zone and the
southerly lot is currently zoned B-3, General Business Zone. The
southerly lot is presently occupied by an office building for a
real estate and insurance business.
2. Zoning and land use on adjacent properties is as follows:

lot
3. An environmental checklist was submitted and a declaration
of non-significance issued pursuant to the State Act. The Optimal
Land Use Element of the Urban Area Plan states that Professional
4111 Office (B-1) development may be compatible with low and/or moderate
• density residential uses with appropriate site considerations. The
site is served from Nob Hill Boulevard (Major Arterial) by 6th
Avenue (local access street).
4. The City Planning Commission recommended approval of
the request for rezone.
CONCLUSIONS: 41.
Alle
1. Although nearby residential uses are predominately
single family, the small lots and occasional duplex have the
result of projecting figures characteristic of moderate density
levels (6-8 residential units per acre). The Urban Area Plan
indicates that Professional Office (B-1) development may be
compatible with low or moderate density residential uses with
appropriate site considerations. The current zoning of the
southerly lot (B-3: General Business) is not considered com-
patible with either low or moderate density residential develop-
ment by the Urban Area Plan. 4111
2. The recommendation of the Planning Commission to grant
the rezone should be affirmed, and the rezone should be granted,
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situate at 1016 South 6th Avenue in the City of Yakima, Washington,
and more particularly described as follow, to wit:
Lots 7 and 8, Block 2 of Lenox Homesites according to the
plat thereof recorded in Volume "H", Page 20, records of
Yakima County, Washington.

be rezoned from R-2, Two-Family Zone and B-3, General Business Zone
to B-1, Modified Business Zone be, and the same is hereby, approved
and said real property is hereby rezoned to B-1, Modified Business
Zone..
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.

Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this 411
ordinance.

Section 4. This ordinance shall be in full force and
effect thirty days after its passage, approval and publication
4 as provided by law and by the City Charter.
