ORDINANCE NO. 28 •1 3 .
AN ORDINANCE accepting the recommendation of the. Planning
Commission and rezoning property in the vicinity
- lip of 20th Avenue and Prasch. Avenue from R-2, Two-
Family Zone to Planned Development Zone.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 23rd day of October,
1984, on the recommendation of the Planning Commission that
real property situate in the vicinity of 20th Avenue and Prasch
Avenue in the City of Yakima, Washington, the legal description
of which is set out hereinbelow, be rezoned from R-2, Two-Family
Zone to Planned Development Zone, and
WHEREAS, as a result of its hearing, the City Council hereby
410 makes its following findings and conclusions:
FINDINGS:
1. William Trudell has requested a rezone from R-2, Two-
Family Zone to Planned Development Zone for property located at
the Southeast corner of 20th Avenue and Prasch Avenue. The
purpose of this request is to allow construction of a duplex on
a substandard size lot.
2. The subject property is vacant and is currently zoned
R-2, Two-Family Zone. The surrounding zoning and land uses are
as follows:
R-2 Two-Family Land Use
1110 North and East Residential Duplex
South. and West R-2 Two-Family Residential Single-Family
Residential
3. The Optimal Land Use section of the Urban Area Plan
indicates that this proposal is compatible with adjacent land uses.
An Environmental Checklist has been submitted and a declaration of
non-significance issued pursuant to the State Act.
4. The City Planning Commission recommended approval of the
0 rezone.
CONCLUSIONS:
• 1. The recommendation of the Planning Commission to grant
the rezone should be affirmed, and the rezone should be granted,
now, therefore,
BE IT ORDAINED BY THE CITY, OF YAKIMA:

City of Yakima,“Washington, and more particularly described as
follows, to wit:
Parcel "B", Book 80-0125, part of Lot 5, Block 2,
Stone's Addition to North. Yakima, now Yakima, as,
recorded in Volume "C" Page 33., of Yakima ,
County, Washington. ,, ', 4,,--
be rezoned from R-2; Two-Family Zone 'to Planned. Development Zone
be, and the same is hereby,_approved,and said real, property is
hereby rezoned to a Planned Development Zone, ,all in accordance
with, and to conform to, the final development ,plan and program
ID therefore approved by the Yakima Planning,Commission,, a copy of
which is attached hereto and by reference made a, part hereof.
Section 2. The above change ;in zoning shall be included and
depicted on the 'next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with. the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This, ordinance shall beAn full force and effect
thirty days after its passage, approval and publication as provided

BackcIround
Mr. William Trudell has requested a rezone from R -2 f' - Family Residential) to
P.D. (Planned D rel.opannt) for property located at the Southeast corner of 20th
Avenue and Prasch Avenue. The purpose of this request is to allow construction
of a duplex on a substandard size lot. The Planning Oa i_ssion reviewed the
applicant's Preliminary Plan and Program during their meeting on September 4,
1984. In response to the testimony of neighbors expressing concern regarding
traffic in the vicinity of this proposal, the Planning canmission requested that
staff see what might be needed or done. Commission ors otherwise concurred
with staff findirgs and recormnended that the applicant proceed with a Final Plan
and Program, which the applicant has nal.. submitted.
Zoning and Land Use
The subject property is vacant and Ls currently zoned R-2 (Two - Family
Residential). The surrounding moning and land rises are as follows:

1. A report regarding the neighbors' concerns regarding traffic in the vicinity
of 20th and Prasch was presented to the Yam Traffic Safety Advisory
Casa ission on September 19, 1984. Those present at the Sept. 4 Planning
Caiunission meeting were notified of this meek and several of them
explained their concerns. Hank Hein, Supervising Traffic Engineer, reported
that staff will begin worms in the area. Sgt. MUllenhoff, City Police
Officer, offered the Police Department's cooperation in dealing with the
problem. Richard Springer, a neighborhood resident, was appointed to serve
as spokesman for the .area in working with . City staff.
2. The Final Plan and Program appears to satisfactorily respond to Planning
Commission reconmexdations made during their Sept. 4, 1984 meeting.

Larry Lehman presented the staff report and findings, recommending
that the Final Plan and Program of William Trudell for a rezone
from R -2 to Planned Development in the vicinity of So. 20th Avenue
and Prasch Avenue be approved subject to the conditions on the
staff report.
Citizen Comments (For)
No one present wished to speak to this proposal.
Citizen Comments (Against)
Richard Springer, 1118 So. 20th Avenue, stated that he is not
opposed to the project but has some concerns. Mr. Springer stated
that speed detectors and counters had been installed since the last
meeting, but once the Police Department had ceased their special
attention to the traffic problems on So. 20th Avenue, the racing
started again. Mr. Springer said that the proposed project will
create more traffic problems; would like "Stop" or "Yield" signs
installed on So. 20th Avenue. Mr. Springer also said that he is
working with the Traffic Safety Committee as the neighborhood
representative and presented letters in opposition to the project
(E,thibit 0 1 -8) .
Robert Swallow, 1115 So. 20th Avenue, stated that he felt that a
single- family dwelling on this property would be better than a
duplex as proposed.

After discussion, it was MOVED by Tenney, seconded by Snodgrass
that the request by William Trudell for a rezone from R -2 to
Planned Development in the vicinity of So. 20th Avenue and Prasch
Avenue be approved subject to the conditions stated on the staff
report. Lotion carried, all members present voting aye by voice
vote. Tarry Wright asked Mr. Tenney if he could make an objective
review of his matter as he had made a statement at the Preliminary
Hearing that he had once been a tenant of Mr. Trudell's. Mr.

Tenney stated that he felt that he could make an objective review
of this matter.

Williams Trudell, 1612 W. Prasch, said his plans for off - street
parking for his project will alleviate the parking problems on
Prasch Avenue.
Citizen Comments (Against)
Richard Springer, 1118 So. 20th Avenue, stated that the City has
not responded to the neighbors complaints to the traffic control
needed on So. 20th Avenue; not opposed to the project, but
concerned that Prasch Avenue is a busy, narrow street.
Joe Bench, 1509 Valley West, owner of 1913 W. Prasch, stated that
traffic on Prasth should be limited to only one side of the street;
opposed to the project as new residents would create more people
and cars in the area.
Robert Swallow, 1115 So. 20th Avenue, stated: there is not proper
drainage, curbs or gutters on 20th Avenue now; traffic control is
needed; additional multi- family dwellings should not be constructed
on that street; the weeds at the corner of 20th Avenue and Prasch
is obstructing traffic and is dangerous.
Ben Hill, 1908 W. Prasch Avenue, said that he is not against the
project, but requested eliminating parking on one side of Prasch
Avenue before the project is approved.

The documents submitted to the City Council in this packet con-
sist of the same documents submitted by the staff to the Planning
Commission in preparation for the hearing. At the Planning
Commission hearing, exhibits were introduced by various parties.
Those exhibits are not included in this packet. Those exhibits
are on file in the office of the Department of Community and
Economic Development, and are available for inspection prior to
the hearing. Those exhibits will be available in the Council
meeting room at the time of the hearing for introduction as ex-
hibits in the City Council hearing if any party desires to intro-

Meet inn began at 7:05 oar. See attached list of members, staff,
and guests present. Members absent and excused were Georoe
Ingaisbe and Mark Eontrager.
20TH AVE. AND PRASCH .
- Denny Cavell stated that in the last 6 to 7 months, there has
been a growing concern regarding traffic flow as to speed, the
narrowness of the roadways, and requests to minimize parking
problems, as pointed out during two recent Planning Commission
Meetings. .
Several citizens were present and shared the fallowing problems
that they would like to see rectified:
Speeders on = 20th Ave. - south of Nob Hill; especially during '
the hours of-6 pm to 12 Pm. - t
?1st Ave. south of Nob Hill, especially during
the hours of 3:30 pat to 7pm.

Hein reported that Staff - will begin working on the area and will
be working through Richard Springer, who will function+ as a •
spokesman for the area. .
Mul lenhoff replied to comments made as to response by the police.
He stated that he had not received any complaints in his office
from this area. He handed out business cards and stated that the
police would begin working the area, but must be aware of "
problems before a response can be made.

v N !TES OF OCTOBER 17, 1984 MEETING

Rich F1athers, Keith Farnam, Bill Orr, Tore Gasseline, and George
ingalsbe. Staff present: Hank Hein, Shelley Harlington, and
Officer Mike Kryger. Visitors present: Ken Kohagen, Wendell
Smith, Ed Cater, and Ken Bischoff (Washington Traffic Safety
Education Association 'President). Member Mark Bontraper was
absent and excused.
Mintues of September 19, 1984, meeting were approved as typed.
PRASCH AREA Officer Mike Kryger reported that patrol cars had
been in the area during the times requested by residents at the
last meetino. The officer reported that he had no vehicles
speeding through the area. A patrol car was recently sent back
to the area at night, and again no speeders.
Shelley Harlington reported that she had difficulty in getting
1 r accurate Volume Speed Recorder readings due to children in the
y area piayanc with the equipment.
The area is still under investigation as to the right -of -way
assignment and signing. Weather permitting, the V.S.R.'s will be
placed again.
Officer Kryger shared that Mr. Springer had telephoned him and
reported that as soon as City Staff left, the speeding returned
to the area. Officer Kryger informed Mr. Springer that the •
' Prasch Avenue Parking Prohibition petition needs resident /owner
signatures that abut the roadway.
