AN ORDINANCE relating to traffic control; amending sections 9.15.010,
9.45.010 and 9.46.020; enacting as new sections 9.45.020
Duty on Striking Unattended Vehicle or Other Property --
Penalty, 9.50.015 Obedience to Signs and Markings, and
-
9.50.120 Special Parking Privileges -- Enforcement;
repealing Sections 9.15.020, 9.15.030, 9.15.040,
9.15.050, 9.15.090, 9.48.010, 9.48.020, 9.48.030,
9.48.040, 9.48.050, 9.50.030, 9.50.110, 9.50.250 and
9.50.280, all of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 9.15.010 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"9.15.010 Authority of police and fire department officials.
It shall he the duty of the chief of police and such officers of
the' police department or such officers as are assigned by the chief of
• police to enforce this traffic title."
Section 2. Section 9.45.010 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"9.45.010 Duty in case of damage to attended vehicle or other pro-
perty -- Penalty.
A. The driver of any vehicle involved in an accident resulting
only in damage to a vehicle which is driven or attended by any person or
damage to other property shall immediately stop such vehicle at the
scene of such accident or as close thereto as possible and shall forth-
with return to, and in any event shall remain at, the scene of such
accident until he has fulfilled the requirements; of subsection B of this
section; every such stop shall be made without obstructing traffic more
than is necessary.
B. Unless otherwise provided in subsection D of this section, the
driver of any vehicle involved in an accident resulting in damage to any
vehicle which is driven or attended by any person or damage to other
III property shall give his name, address, and vehicle license number and
shall exhibit his vehicle' driver's license to the driver or occupant of,
or any person attending any such vehicle collided with.
C. Any driver covered by the provisions of subsection A of this
section failing to stop or to comply with any of the requirements of
subsection B of this section under said circumstances shall be guilty of
a gross misdemeanor and, upon conviction, be punished by imprisonment
for not less than thirty days nor more than one year or by a fine of not
less than one hundred dollars nor more than five hundred dollars, or by
both such fine and imprisonment: Provided, that this provision shall
not apply to any person injured or incapacitated by such accident to the
extent of being physically incapable of complying herewith.
III D. If none of the persons specified are in condition to receive
information to which they otherwise would be entitled under subsection C
of this section, and no police officer is present, the driver of any
• vehicle involved in such accident after fulfilling all other require-
ments of subsections A and C of this section insofar as possible on his
part to be performed, shall forthwith report such accident to the near-
est office of the duly authorized police authority and submit thereto
the information specified in subsection C of this section."

Section 3. Section 9.45.020 of the City of Yakima Municipal Code
is hereby enacted as a new section to read as follows:
"9.45.020 Duty on striking unattended vehicle or other property --
Penalty.
The operator of any vehicle which collided with any other vehicle
which is unattended shall immediately stop and shall then and there

either locate and notify the operator or owner of such vehicle of the
name and the address of the operator and owner of the vehicle striking
the unattended vehicle or shall leave in a conspicuous place in the
vehicle struck a written notice, giving the name and address of the
operator and of the owner of the vehicle striking such other vehicle.
The driver of any vehicle involved in an accident resulting only in
damage to property fixed or placed upon or adjacent to any public high-
way shall take reasonable steps to locate and notify the owner or person
in charge of such property of such fact and of the name and address of
the operator and owner of the vehicle striking such property, or shall
leave in a conspicuous place upon the property struck a written notice,
giving the name and address of the operator of the owner of the vehicle
so striking the property, and such person shall further make report of
such accident as in the case of other accidents upon the public highways
of this state. Any person violating the provisions of this section is
guilty of a misdemeanor and may be punished by a fine of not more than •
$500.00, or by imprisonment in the jail facility for the City of Yakima
for not more than 90 days, or both by such fine and imprisonment."
Section 4. Section 9.46.020 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"9.46.020 Deletions and Modifications to the Model Traffic Ordin-
ance.
A. Deletions. The following sections of the Model Traffic
Ordinance are not adopted as part of the City of Yakima Municipal Code:
RCW 46.90.115, 46.90.250, 46.90.255, 46.90.260, 46.90.265, 46.90.275,
46.90.335, 46.90.340, 46.90.375, 46.90.469, 46.90.610, 46.90.620,

Section 5. Section 9.50.015 is hereby enacted as a new section to
read as follows:
"9.50.015 Obedience to signs and markings. Upon those streets
which have been signed or marked for angle parking, parallel parking or
center street parking, no person shall park or stand a vehicle in any
manner other than that indicated by such signs or markings and no person
• shall stand or park any portion of a vehicle outside the confines of
such markings."
Section 6. Section 9.50.120 of the city of Yakima Municipal Code
•
is hereby enacted as a new section to read as follows:
"9.50.120 Special parking privileges -- Enforcement.
A. Any unauthorized use of the special card, decal or special
license plate issued by the department of licensing to persons with
special parking privileges as provided by Chapter 154, Laws of Wash-
ington, 1984, is a traffic infraction.
• B. It is a traffic infraction with a monetary penalty of not less
than fifteen and not more than fifty dollars for any person to park a
• vehicle in a parking, place provided on private property without charge
or on public property reserved for physically disabled persons without a
special license plate, card or decal issued by the department of licen-
sing to persons with special parking privileges as provided by Chapter
154, Laws of Washington, 1984. If a person is charged with a violation
of this subsection such person shall not be determined to have committed
an infraction if the person produces in court or before court appearance
• the special license plate, card, or decal required under this section or
demonstrates that such person was entitled to such special license •
plate, card or decal."

Section 7. Sections 9.15.020, 9.15.030, 9.15.040, 9.15.050,
9.15.090, 9.48.010, 9.48.020, 9.48.030, 9.48.040, 9.48.050, 9.50.030,
9.50.110 and 9.50.250 and 9.50.280 all of the City of Yakima Municipal

Code are hereby repealed.

Section 8. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and by the City Charter.
