HomeMy WebLinkAbout1984-2821 REZONE PROPERTY ON SOUTH 10TH AVENUE ORDINANCE NO, 2 1 AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property on South. 10th Avenue from R-3, Multiple-Family Zone to Planned Development Zone. 4110 WHEREAS, pursuant to due and legal notice, on September 4, 1984 and November 13,. 1984, the Yakima City Council held hearings on the recommendation of the Planning Commission that real property located at 102 to 116 South 10th Avenue in the City of Yakima be rezoned from .R-3, Multiple-Family to Planned Development Zone to accommodate the expansion of St. Elizabeth's Medical Center, and WHEREAS, as a result of its hearings, the City Council hereby makes its following findings and conclusions: 1110 FINDINGS: ' 1. .S.t. Elizabeth's Medical Center submitted a final plan and program, consisting of a narrative. and a drawing constituting Exhibit P7 to rezone property at 102:to 116 South 10th Avenue in • the City o Yakima, Washington, froM R-3, Multiple-Family Zone to Planned Development Zone. The purpose of the request is to allow construction of a three story medical office building with ancillary parking. The applicant also has requested a partial vacation of South 10th Avenue between West Chestnut and West:Walnut Streets, the partial vacation to consist of: narrowing the right-of-way, but not the travelled portion, of that street. 4110 2. The proposal is in substantial conformance with the Yakima Urban Area Plan, and is in keeping'with the to encourage medical facility growth in this vicinity. 3. Inasmuch as: the entire site will be developed at one time, there should be minimal compatibility conflicts with surrounding properties. All existing and proposed parking has been evaluated, and the project designed to accommodate displaced parking as well 41/0 as to provide additional parking for the existing medical center complex. 4. The City Planning Commission recommended approval of the request subject to certain conditions specified below. CONCLUSIONS: 1. The recommendation of the Planning Ccamission to grant the rezone should be affirmed, and the rezone should be granted subject to the conditions specified below, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: The recommendation of the Planning Commission of the City of Yakima that the following described real property at 102 to 116 South. 10th Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: The east 1/2 of Block 392, Capitol Addition of North Yakima, now Yakima, as recorded in Volume "A" of Plats, Page 29, records of Yakima County, Washington. be rezoned from R-3, Multiple-Family Zone to Planned Development Zone be, and the same is hereby, approved and said real property is hereby rezoned to a Planned Development Zone, all in accordance 4111 with andto conform to the final development plan and program there- fore consisting of the narrative approved by the Yakima Planning Commission and a drawing constituting Exhibit P7 at the City Council hearing, copies of which are attached hereto and by reference made a part hereof; provided, the rezone granted by this ordinance is subject to the following conditions: 1. The exact location of the curb cut at Walnut and 10th Avenue is subject to the prior approval of the City Department of Community & Economic Development. 2. Completed plans for drainage, lights and signs are subject 1 11 0 to approval by the City staff before a building permit is issued. 3. All utilities are to be placed underground. 4. Applicant shall repair and repave the alley between South 10th Avenue and South llth. Avenue, from Walnut Street to Chestnut Street, according to specifications and guidelines which are subject to the approval of the Yakima City Engineer. Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. -2- Section 4. Haddi Planning Supervisor, 575 -6162 SUMMARY EXPLANATION: The City Council, upon holding public hearing and having discussion on the rezone and street vacation requests, referred the matter back to the Planning Commission for further report. At the October 2, 1984 Planning Commission meeting, members of the Commission were polled as to whether they wanted to reconsider the Medical Center's proposed planned development. It was the consensus of the Commission that there were no substantive changes to the original request and voted to return the matter to the City Council with no further report. Four conditions of approval still remain applicable of the five originally recommended. They are 1) That 115k South 11th Avenue be removed from the Planned Development request. 2) That complete drainage, lighting and signing plans be approved by staff before a building permit is issued. 3) That all utilities be placed underground. 4) That the applicant work with the City Engineering Division to establish guidelines to repair and repave the alley between South 10th Avenue and South 11th Avenue, Walnut to Chestnut Streets. It was then asked if the Commission wished to reconsider the vacation of South 10th Avenue. It was explained the Medical Center had revised their request to ask that only the right -of -way from the western curb line to their property line be vacated. South 10th Avenue would remain open for public travel. A right -of -way use permit would be sought for the skybridge. It was the consensus of the Commission to return this matter to the City Council with a recommendation of approval of the revised right -of -way vacation request. The revised right -of -way vacation consists of 8,600 square feet with an estimated value of $15,050 (8600 x $3.50 /2). It was the general consensus of the Planning Commission that there were no substantive changes to the original request and to return the matter to the City Council with no further report. Larry Wright asked the Planning Commission if they wished to recons i it the vacation of So. 10th Avenue and explained that St. Elizabeth Medical Center was requesting the right of -way vacation on So. 10th Avenue be modified to include only that property from behind the existing curb line to the property line. It was the general consensus of the Planning Commission to return this matter to the City Council with recommendation of approval of the new request.
